That the City Manager is hereby authorized to sign the term-sheet describing the "Implementation of the Tidewater Community College's Strategic Plan" in substantially the form as presented to the City Council. 3. That $500,000 of fund balance from the General Fund is hereby appropriated to CIP #3-262, Tidewater Community College Expansion, for the acquisition of a parcel of property bordering Buckner Boulevard and Rosemont Road labeled as parcel E on the document titled "Map showing Tidewater Community College" and dated "June 2001," a copy of which has been presented to the City Council. 4. That the City Council hereby expresses its support for Tidewater Community College's efforts to obtain necessary funding from the General Assembly to continue the development of educational facilities in the Princess Anne Commons area. Adopted by the Council of the City of Virginia Beach, Virginia on the 11th day of December CA-8333 Ordin kNONCODE \TCCExpans ion. ord. wpd November 29, 2001 R1 g ment Services , 2001. Approved as to Legal Sufficiency uepartment &~f Law~ ~/ TERM-SHEET IMPLEMENTATION OF TIDEWATER COMMUNITY COLLEGE'S STRATEGIC PLAN Representatives of the City of Virginia Beach ("City") and Tidewater Community College CTCC") have been discussing a possible partnership for implementation of TCC's Strategic Plan for the Virginia Beach Campus This Term-Sheet is intended to reflect the shared understanding of both parties and their respective commitments and to update the 1996 Memorandum of Understanding between the City and TCC. The Term-Sheet is not intended to be a legally binding agreement, and all commitments outlined are subject to City Council and the Commonwealth of Virginia's ("Commonwealth") future appropriation. The policy implications associated with this Term-Sheet are outlined in the attached Policy Report that was presented to City Council on November 27, 2001. o City will provide for site improvements associated with a major initiative for the strategic plan of TCC as outlined in the attached Policy Report. . TCC agrees to provide, in a timely fashion and in a format suggested by the City, its annual request for capital funding. . The appropriation process of the Commonwealth involves the appropriation of funds for both maintenance and operation of the Virginia Beach Campus, and for construction of its buildings. It is understood and agreed by TCC that the City shall be bound and obligated hereunder only to the extent that funds shall be appropriated and budgeted for particular projects pursuant to Article VII, Section 10 of the Constitution of Virginia and subject to appropriation by City Council. . The appropriation process of the Commonwealth is summarized in the biennial budget bill. The biennial budget bill typically provides, in pertinent part: "Expenditure for land acquisition, site preparation beyond five feet from a building, and the construction of additional outdoor lighting, sidewalks, outdoor athletic and recreational facilities, and parking lots in the Community College system shall be made only from appropriated Trust & Agency Funds, including local government allocations and appropriations, or the proceeds of indebtedness authorized by the General Assembly.." . Both parties agree to coordinate lobbying efforts with the General Assembly delegation and the new Governor for inclusion in the State's capital program. o The City may provide funding for site acquisition and site preparation beyond five feet from the campus buildings provided that there are sufficient funds appropriated by the Commonwealth for the campus buildings for the purposes requested. 7. Because local funds may, consistent with the biennial budget bill, be appropriated . . 10. 11. 12. 13. 14. and allocated to the Trust and Agency Funds to be spent at TCC, both parties agree that the State Board for Community Colleges, as provided in Chapter 16 of Title 23 of the Code of Virginia, is the appropriate body to contract for the design and construction of site improvements five feet from the campus buildings. TCC will be solely responsible for all legal and risk management issues associated with the design, construction and operation of these facilities. TCC will be responsible for ensuring that the design, construction, and inspection of site improvements shall be performed in accordance with state procurement code and state and local regulations. TCC agrees to provide appropriate documentation to the City verifying that City- provided funds were expended for the intended purpose. This documentation may include, but shall not be limited to, copies of bids, contracts, and final payments. In furtherance of the City's plan for the Princess Anne Commons and TCC's strategic and master plans, the City also agrees to use its best efforts to purchase properties or obtain an option for the properties labeled as Parcel A, Parcel B, Parcel C, Parcel E, Parcel F and Parcel G as outlined on a map entitled Tidewater Community College (Appendix D map prepared by the City's Center for GIS). Due to imminent development potential, the City will use ~ts best efforts to purchase Parcel E during FY 2001-2002 With the adoption of this Policy Report/Term-Sheet, City Council will be forwarded an Agenda Request/Ordinance appropriating funds for this purpose. The City will use its best efforts to purchase Parcels F and G during FY 2002-2003, and Parcels A, B, and C during FY 2003-2004. Once the City acquires title to any one of the parcels enumerated above, the C~ty will effect a transfer of title to the State Board for Community Colleges. If funds are not appropriated by the General Assembly within six years from the date title was transferred to the State Board for Community Colleges by the City, the t~tle may, at the City's option, revert back to the City. If any parcel of property is planned to be used for non-educational purposes, the arrangements for transfer of its t~tle shall be determined collaboratively between the City and TCC w~th a mutually agreed shanng of the subsequent revenue stream, ~f any Both parities agree that this Term-Sheet may be revised by mutual agreement, in writing, as circumstances may dictate. 15. Both the City and TCC agree to meet and confer as necessary in furtherance of the objectives expressed in this Term-Sheet. Signed this day of ,2001. City of Virginia Beach Tidewater Community College By: By: James K. Spore City Manager Deborah M. DiCroce President Considerations: The City's commitment for implementation of TCC's strategic plan falls ~nto two broad categories: site improvement and land acquisition. Th~s commitment is the creation of CIP proJect # 3-262 Tidewater Community College Expansion and the appropriabon of $500,000 from the Fund Balance of the General Fund for land acquisition of the parcel of property bordenng Buckner Boulevard and Rosemont Road as delineated in the attached Term-sheet (parcel "E") and map. The TCC six-year capital plan currently represents a 6 to 1 ratio ~n State investment compared to City investment at the Virginia Beach campus (the final ratio depends on final land costs). All funding commitments are subject to City Councd appropriation. Public Information: A public hearing discussing the City's participation in the project was held on December 4, 2001. Alternatives: The only alternative is to not participate with TCC in this project. Without the City's participabon, the State will not appropriate funding for the buildings, site ~mprovements and s~te acquis~bon This alternative would not be consistent with City Council's strategy initiative of Quality Education and Lifelong Learning and the creation of an Academic Village in this area The C~ty has an unique opportunity to create an educational center for our citizens and provide training that would greatly enhance the City's long-term economic vitality. Recommendations: It is recommended that: 1) ClP project #3-262 Tidewater Community College Expansion be created. 2) The City is authorized to enter into a Term-Sheet with TCC for the implementation of the TCC strategic plan. 3) That $500,000 be appropriated from Fund Balance ofthe General Fund for the acquisition of property as delineated in the attached Term-sheet and map. 4) The City Council support the efforts of TCC to obtain necessary funding from the General Assembly to begin the realization of our joint vision. TQ: The Virginia Beach City Council DATE: October/Novelnber 2001 As a resident and registered voter in the City of Virginia Beach, I hereby support building a new performing arts theater in the Central Business District for the following reasons' The Central Business District is located at the geographical center of the developed portion of the City of Virginia Beach, which is convenient to the community as a whole. The Central Business District of Virginia Beach is a non-flyover zone by jets out of the Oceana Naval Air Station. This should reduce the cost of providing special acoustical treatment to the theater. There is a symbiotic relationship between the Performing Arts Center and the mixed-used community of retail, restaurants, entertainment venues, and businesses. This relationship will enhance the theater experience for citizens, as they can dine, attend the theater, and enjoy a full and complete night of entertainment n a brightly lit, vibrant pedestrian area. An alternative location might only provide patrons with the option to drive into a parking lot, attend the event, and then return straight to the parking lot. The site is available immediately to start construction, which will permit the opening of the theater in a timely fashion, coordinated with the removal of the existing Pavilion Theater.
