OF PRI~CESS AI~ COUNTY
Your Petitioners, Croatan Beac~ Corporation, a Virginia Corporation,
and Richard J. Davis and Jean M. Davis, respectfully petition the Board of
Supervisors oi~ Princess Anne County to abandon the street ~ud alley hereafter
set forth according to the statutes made and provided in such cases and more
particularly as provided by Title 33, Section 76.13, through Title 33, Section
76.24, of the Code of Virginia.
In support of said petition, your Petitioners respectfully show unto
the Board oi' Supervisors of Princess :~n~e County the following:
(1) That the Croatan Beach Corporation is a Virginia Corporation
organized for the sale and transfer of real estate and more specifically for
the development known as Croatan Beach in Princess Anne County, Virginia, in
which purpose Richard J. Davis and Jean M. Davis are also participating.
(2) That the said Corporation and said P. ichard J. Davis and Jean M.
Davis, husband and wife, are the owners of all the land in Blocks 29 and 21,
and that the said Corporation is the sole o~n~er of all the land in Block 26,
shown on the Plat oi' Croatan Beach duly recorded in the Clerk's Oi'fice of the
CircUit Court of Princess .Anne County, July, 1949, in Ma~D Book 24, at Page 37,
and also being the same property as shown on the Plat of Resubdivision of Part
of Crop. tan Beach, Princess Anne County, Virginia, dated June, 1954, and duly
recorded in the aforesaid Clerk's Office, September 10, 1954, in Map Book 37,
at Page ll.
A. That the street desired abandoned, vacated and closed is that
portion of Holly Avenue not heretofore closed as shown on the above referred
to plat, described ~s follows: All that certain portion of Holly Avenue beinf
fifty (50) feet in width and beginning at the intersection of Chautauqua Avenue
(Atlantic Avenue) and running from said Eastern side of Chautauqua Avenue in az
Easterly direction to the waters of the Atlantic Oce~u, as shown on said plat,
it being that portion of Holly Avenue running between Blocks 26 and 29, as
shown on said plats.
B. That the alley and/or passageway desired abandoned, vacated
closed is all that certain alley or passageway bisecting and running through
~lock 21 from its intersection with Carolina Avenue to its intersection with Elm
as shown on the above referred to plats.
(3) Your Petitioners further state that the abandoning and vacating
Df the above referred to streets, alley and/or p~ssageway is necessitated by the
change in the physical condition and waterline surrounding the Croatan Beach
area, of which your Petitioners own over 90 per cent, and is necessary for a
proper and adequate development of the area for the best interest o£ your
~etitioners and the County of Princess Aune and the future owners of said
; that the interest of no party concerned will be injured or damaged by
the closing of the said street, alley and/or passageways, but that all interest~
will be promoted thereby.
(4) Your Petitioners, as provided by statute, attach hereto a copy
of the Plat of Croatan Beach which is duly recorded in ~4ap Book 24, at Page 37,
~d a copy of the Plat of Resubdivision of Part of Croata~ Beach, duly recorde~
in the above referred to Clerk's Office, in Nap Book 3?,at Page ll, and that
portion of Holly Avenue and the alley or passageway desired closed are marked
in red on said plats, and said plats are attached hereto and filed herewith.
WHEBE~0EE, Petitioners pray that in accordance with the statutes in
such cases made and provided, that the proper notice be given and that the Boa
of Supervisors of Princess Anne County will find that no public necessity exis
for the continuance or establishment of the above referred to street and alley
or passageway, and that the welfare of the public will best be served by the
abandoning, vacating aud closing of the above referred to street ~ud alley or
pas~agewa~~, and that it ~ill at the proper time az~t~r all requirements of the
sts. tutes have been complied with, enter an order ab~doning, vacatin~ and
closing the above referred to street aud alley, upon the payment of all cost '
the Petitioners herei:~, and your Petitio~ers pray th:'~t they n~y have any and
such further relief as they may be entitled.

Dear Sir:
The property owners of Page Avenue, Lynnhaven District hereby
petition the Princess Anne County Board of Supervisors for street
lights to be installed on Page Avenue.
For the past five (5) years this street's population has in-
creased from three (3) families to twenty-six (26), with several
new buildings under construction ( eight (8) to .~ exact).
Ninety-five (95) percent of these residents own their propert~ y
and are voters in this county.
During our conversation with you on July 8, 1952, we were told
that the funds of Community Impr?~em~?en~?ere ~e.x~austed;. the~r~fore,
we are enclosing our check for /6f~ ~ ~_ col,ars, smgneG oy
Earl L. Aydelotte, made payable to Bo~r~ of Supervisors Princess
Anne County, Virginia, to defray the cost of operation for the first
year, with the agreement that the.county assume the expense there-
after.

JUNE 23, 1952.
At a regular meeting of the Board of County Supervisors of Princess
Anne County, Virginia, held on Monday, the 23rd day of June, 1952, in the
Clerk's Office of Princess .Anne Count~~, Princess Anne, Virginia, all mem-
bers of the Board being present in person, the following resolution was
unanimously adopted.: ~:'
THAT ~N~REAS, pursuant to an order entered by the Circuit Cour~ of
Princess Anne 0ounty, Virginia, on May 30, 1952, entitled, 'Bond issue
of $75,000.00 for installation of pipe lines and fire plugs in the East
Ocean View Sanitary District, Princess Anne 0ounty, Virginia", directing
the Board of County Supervisor~ of Princess Anne Oounty to proceed at
the next meeting to carry out the wishes of the v~ters as expressed at
an election held on the 22nd day of Ap.~il, 1952, '~n the said East Ocean
View S~_nitary Bistrict of Princess Anne County, Virginia, and
WHE.~EAS, pursuant to Section 21-127 of the 19~ ~ode of Virginia,
this board shall determine what amount of bonds shall be issued for the
purposes defined in the order calling the election in the .East Ocean View
Sanitary District, Princess Anne Csunty, Virginia.
THgREFORE, BE IT R'~SOLVED, that the Board of County Supervisors of
Princess Anne County, Virginia, hereby authorizes the sale of bonds aggre.
gating $75,000.00 and maturing without option of prior redemption in ac-

The approving opinion of Messrs. ~o~d, Xing and Dawson, will ~e fur-

District of Princess Anne Cou~ty, Virginia, a~d the Board of County Super-

net revenue derived from the operation of the wa~sr system of said District

We have received a copy of letter dated August 6, 1952 from
~r. U. S. ~iller, i~mnager, of eav~ew Beach to Captain ~Yoore, Chief of
Police of Princess ~nne County; copy of which was sent to you and other
residents who have been annoyed by the public nuisance they are creating
by h~roadcasti~g ~usic through loudspeakers from eavxew Beach.

We previously wrote to Captain ~m~oore, Sheriff~lbon, and ~r.
John Dey who advised he would forward the letter to ~r. Deary regarding
this situation, and have received replies from Chief ~oore and Sheriff
~albon stating they would correct this situation. However, there has
been no change.
As you know we have been residents of Princess Anne County since
1942 and have lived at the present address all this time which is l0 years
or 3 years before Seaview Beach was ever in operation. However, it makes
no difference how long we have been here because every resident and tax-
parer is entitled to freedom from public nuisances that disturb the peace.
What authority does ~..~r. ~iller, ~anager of Seaview Beach have to dictate
to ~he per~anent residents who are property owners and taxpayers that they
have to suffer because Seaview Beach is only in operation for 3 months
during the year and therefore is entitled to make all the noise they want
to with no consideration for the residents; and because it is an ~usement
park has a right to disturb the peace and interfere with the well being
of the residents. I want you to know that my mother is 77 years old and
the continual noises have affected her health to such an extent that she
is partially deaf fr~ it, and we are all ~ade nervous because of it.
i wish you would c o~e over some Sunday afternoon and listen to this nuisance.
You will recall ~eeting our faultily during the last election when
we voted for the organization and were assured by you all that this situation
would be corrected. We cannot understand why there is no ordinance in
Princess Anne which makes it illegal for loudspeakers to disturb the peace.
We are approxi~ately 3 blocks away from Seaview so you can imagine how bad
it is ~en it can be heard way down to Lesner's Bridge. We just read in
a recent paper ~ere the Board of Supervisors passed an ordinance pro-
hibiting outboard n~otorboats from operating without ~ufflers and cannot
understand why there is no ordinance to stop a disturbance of this kind
which is about ~he worst nuisance that could exist. We are shocked that
the Board of Supervisors of Princess Anne does not ~ass an anti-noise law
to protect the residents from these unnecessary annoyances.

I understand that l,.~r. ~iller, i'~nager of Seaview is not even
a resident of Princess t-~nne but he seems to have more power' than the
Princess ~nne authorities. He defies us all and it does no ~ood to
tell him to turn ~ohe loudspeakers off because after a short time they
are back blasting again. The only way to stop this nuisance is to
make a law wit~ stone teeth in it and let him know who has the authority
in }~rincess ~nne. i want you to know that we are not blaming the
colored people - ~.i~e blame ~r. iuiller and his employers who have leased
the enter%ainment and amusement facilities from the colored, ov~ers of
Seaview ~each - ~r. l~iller and his as~ociates are solely responsible and
should be made to respect the rights of the residents. ~r. l~il].er is
trying to make us believe that Ocean View, the Surf Club, etc., are
allowed to dis%urb the peace too when we all know that they are
governed by anti-noise laws which protect the residents of those vicinities.
Even the Government is trying to help the people of i~orfoik Oecause of
.~he noise ~ade by the airplanes, and these are most necessary to the
defense of our counvry (see clipping attached).
The reason that i,~r. i,,iller of ~eaview Leach keeps the loud-
speakers going is to advertise the place and attract attention - They
sell beer at Oeaview Leach and we understand if beer is sold the place
is supposed to be kept quiet.
The only way to put a stop to this nuisance is to [,,ass an anti-
noise ordinance, it does no good to tell 5eaview Beach to turn down the
loudspeakers. ,~e have tried this many ti~es and they turn them right up
again. We want a law that will do away with loudspeakers entirely -
for once and for all time. ~e have suffered long enough and ask that
you have vhe Board of Superw. sors pass this anti-noise law at their
next meeting so we wont be troubled any more.

Gentlemen:
It has been brought to my attention that consideration is
being given to opening a public road across our tracks and right of
way at Sheltonr Va. ~ near where a new school is under construction
by your Board. At present this is a private crossing serving the
Shelton farm. Attached are a number of prints of my drawing H-8484-A
showing the Railway's 50 ft. right of way involved. Through this
crossing are three (3) railroad tracks~ the middle track being o~ned
and maintained by the United States Navy.
The Norfolk Southern Railway Company ~ 11 not offer any
objections to opening this as a public crossing~ provided either the
County or the State bear the expense of building the crossing across
the entire right of way and relieve the Railway Company of having to
install or furnish crossing protection such as watchman or signals
at any time in the future. After the crossing is installed and becomes
a public crossing~ then the Railway Company and the United States Navy
~ill maintain the crossing from end of tie to end of tie~ depending
upon ownership of the track involved~ in accordance with State Law.,~, · ~

by the Board of Supervisors of Princess Anne County
on Monday, August 2~, 19~3 in reference to our plac-
ing a placement man in the southern part of Princess
Anne County, near Pungo Labor C~mp~ as soon as possible.
The funds for the operation of this agency have been
drastically cut for this fiscal year and necessitates
our laying off a number of people. However, we shall
make arrangements to take care of the situation there
and ~rlll do so just as soon as possible, which I think
will be v~thin the next week.

It is agreed between the parties hereto that the poles, wires, attachments, equipment and accessories erected

use of the property occupied by the Company, or for the privilege of constructing, maintaining and operating
said poles and lines; that the Company, its agents and employees shall at all times have full and free ingress to
and egress from and over the said property of the Owner, in order to construct and efficiently maintain said
lines and appurtenances, with the right to inspect, rebuild, repair, improve, re-locate along the route above
described, remove, make extensions or additions thereto, and make such changes, alterations and substitutions
in said lines, wires, poles, attachments, equipment and accessories, as the Company may from time to time
deem advisable, or expedient, including the right to increase or decrease the number of wires; with the fur-
ther right to trim, cut and keep clear all trees, limbs and undergrowth and other obstructions along said lines
or adjacent thereto that may in any way endanger or interfere with the proper and efficient operation of the
same; together with all the rights and privileges reasonably necessary or convenient for the full enjoyment
or use, for any of the aforesaid purposes, of the right of way hereby granted.
The Owner covenants that it has the right to convey the said easement; that the Company shall have
quiet and peaceable possession, use and enjoyment of the said easement, and that the Owner will execute
such further assurances of the said easement as may be requisite.

shall have no parking on either side, or that the road shall
be widened to the extent that parking will no longer present a
traffic hazard. This petition is presented for the following
reasons:
At one time signs were posted prohibiting parking on
the eastern side of this road. These were promptly
knocked down.
Many children are living in the Eastern Park Housing
Project. They dart in s~d out betv,~een parked cars.
Drivers do not ~¥~ t a clear view of the road with cars
parked and are in constant fear of injuring these
children.
There is only room for one lane of traffic when cars
are parked on one sider and they are parked almost
solidly in the early morning and in the evening.
Passing an oncoming vehicle is most difficult.
New houses are now in the process of being constructed
on the eastern side of this road. They are laid out so
near the road that future widening is going to be an
impossibility ~less some action is taken immediately.
We beseech your prompt attention to this matter.
