Oberndorf called to order the SPECIAL FORMAL and CLOSED SESSIONS of the VIRGINIA BEACH CITY COUNCIL in the City Council Conference Room, City Hall Building, on Tuesday, November 19, 2002, at 1:00 P.M. Council Members Present: Margaret L. Eure, Vice Mayor Louis R. Jones, Richard A. Maddox, Reba S. McClanan, Mayor Meyera E. Oberndorf Jim Reeve, Rosemary Wilson, and James L. ITEM # 50433 The Mayor read the CALL TO SPECIAL FORMAL SESSION: "HONORABLE MEMBERS OF CITY COUNCIL In accordance with the City Charter, Section 3.06, the Virginia Beach City Code, and by the authority vested in me as Mayor of the City of Virginia Beach, I hereby call a SPECIAL SESSION of the VIRGINIA BEACH CITY COUNCIL at 1:00 P.M. on Tuesday, November 19, 2002, in the City Council Conference Room, City Hall Building, 2401 Courthouse Drive. The purpose of this Special Formal and Closed Session is to review applications of citizens in Kempsville District 2, who have expressed interest to fill this representative seat on Virginia Beach City Council. The previously scheduled Workshop re 19~n Street Corridor and Convention Center Design will convene at 3:00 P.M. Sincerely, Meyera E. Oberndorf Mayor" November 19, 2002 -3- MA YOR~S COMMENTS ITEM # 50434 Mayor Oberndorf requested a process be chosen relative the selection of the candidates for the Kempsville District 2 representative seat. Mayor Oberndorf expressed appreciation to the City Clerk and her staff for their dedication in the preparation of the detailed notebook encompassing the credentials and completed questionnaires of all proposed candidates. The Mayor advised Councilman Villanueva had suggested the proposed candidates and supporters of particular candidates be allowed to speak in favor of their candidates. BY CONSENSUS, during the Closed Session, the City Council chose eight (8) of the twenty-five potential candidates as the most qualified Kempsville citizens to be interviewed at 1:00 P.M., Tuesday, December 17, 2002. The Kempsviile District Representative will be selected and announced at this Special Session of City Council on that date. November 19, 2002 -4- ITEM # 50435 Mayor Meyera E. Villanueva November 19, 2002 -5- Item IlL ITEM # 50436 Mayor Oberndorf entertained a motion to permit City Council to conduct its CLOSED SESSION, pursuant to Section 2.1-344(A), Code of Virginia, as amended, for the following purpose: PERSONNEL MATTERS: Discussion, consideration or interviews of prospective candidates for employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees pursuant to Section 2.2-3711 (A) (1). To Wit: Appointment: City Councilmember - Kempsville District Upon motion by Vice Mayor Jones, seconded by Councilman Wood, City Council voted to proceed into CLOSED SESSION. Villanueva November 19, 2002 Bem IV -7- CERTIFICATION OF CLOSED SESSION ITEM # 50438 Upon motion by Councilman Reeve, seconded by Councilman Schmidt, City Council CERTIFIED THE CLOSED SESSION TO BE IN ACCORDANCE WITH THE MOTION TO RECESS. Only public business matters lawfully exempted from Open Meeting requirements by Virginia law were discussed in Closed Session to which this certification resolution applies; AND, Only such public business matters as were identified in the motion convening the Closed Session were heard, discussed or considered by Virginia Beach City Council. Villanueva November 19, 2002 RESOLUTION CERTIFICATION OF CLOSED SESSION VIRGINIA BEACH CITY COUNCIL WHEREAS: The Virginia Beach City Council convened into CLOSED SESSION, pursuant to the affirmative vote recorded in ITEM # 50438, page 7, and in accordance with the provisions of The Virginia Freedom of Information Act; and, WHEREAS: Section 2.2-3 711 (A) of the Code of Virginia requires a certification by the governing body that such Closed Session was conducted in conformity with Virginia law. NOW, TI-~REFORE, BE IT RESOLVED: That the Virginia Beach City Council hereby certifies that, to the best of each member's knowledge, (a) only public business matters lawfully exempted from Open Meeting requirements by Virginia law were discussed in Closed Session to which this certification resolution applies; and, (b) only such public business matters as were identified in the motion convening this Closed Session were heard, discussed or considered by Virginia Beach City Council.
