The Task Force has structured tts report tnto three (3) categortes (1) recommended changes that can be
tmplemented under extsttng state law, (2) recommended changes to extsttng state law that would be requtred
to expand the current tax rehef program, and, (3) recommended State constttuttonal amendment to permtt
a local optton non-means tested tax freeze for all sentor ctttzens
RECOMMENDED CHANGES THAT CAN BE IMPLEMENTED UNDER EXISTING STATE LA W
ADOPT the current State Maxtmum Income Ltmtt of $52, 000
ADOPT the current State Net Combtned Ftnanctal Worth Ltmtt to the
State Ltmtt of $195,000
Set the Ctty's income level for full real estate tax rehef at fifiy (50%)
percent ($26, 000) of the Ctty's Maximum Income Ltmtt
Implement a phastng of the real estate tax rehef for tncome levels
greater than the Ctty's tncome level for full real estate tax rehef
($26,0000) by estabhshtng four (4) brackets for reducing the
percentage of abatement unttl tt reaches zero (0) at $52,000 of tncome
Allow semor ctttzens the optton of paytng real estate taxes quarterly or
monthly
Ehmmate the current eight (8%)percent tnterest charge on the City's
real estate tax deferral program
Implement the foregoing changes in a phased manner in order to

Force's over-arching objective The Task Force beheves tt ts the City Council's responstbthty to evaluate
and determtne the fiscal tmpltcattons of the recommendattons made tn thts report Whtle fiscal tmpacts were
not controlhng tn the dehberattons of the Task Force, the Task Force was not mdtfferent to fiscal
constderattons and tmpacts tn maktng recommendattons The Ctty staff asststtng the Task Force shared thetr
best estimates of the tax tmphcattons to the City and the tax savtngs that sensor ctttzens may expertence
based on a vartety of recommendattons constdered by the Task Force Data provtded to the Task Force
shows that the recommendations heretn can be tmplemented wtthout reductng current revenues These
recommendattons can be accomphshed through a reduction tn revenue growth of real estate taxes

Arttcle XII "Future Changes ", Sectton 1 A mendtnents) Amendments requtre approval by both the House and
Senate tn consecuttve terms of the General Assembly, after whtch a referendum electron on the proposed
amendment must occur IJ the General Assembly approves the legtslatton tn thts upcoming sesston, an
amendment removtng the ~neans testtng requtrement could not become law unttl January 1, 2007, whtch
means thts change would be effecttve tn the FY 2007-08 Budget

State's cap, however tt ts an esttmate There ts no cost esttmate relattve the dtsabled portton of a non-means
tested freeze for elderly and dtsabled
The Mayor advtsed the Merchant Marmes who served during World War II are also forcefully lobbying for
a complete exemptton
The Task Force recogmzed Senior Ctttzens requtre much less relattve Ctty services

OF ANNUAL LEAVE HOURS ACCRUED DURING THE 2003
CALENDAR YEAR BY SHERIFF'S OFFICE EMPLOYEES AS
A RESULT OF THE MUHAMMAD TRIAL
6 Whereas, City Code § 2-85 provides that I'no employee shall be
7 paid for unused annual leave except upon termination of employment
8 .No employee shall be allowed to carry over more than four
9 hundred (400) hours of accumulated annual leave from one calendar
10 year to the next if the employee works a forty (40) hour workweek
11 ";
12 Whereas, City Code § 2-85 is applicable to the Virginia Beach
13 Sheriff's Office;
14 Whereas, as a result of the John Allen Muhammad trial,
15 employees of the Virginia Beach Sheriff's Office have been required
16 to postpone the taking of annual leave to attend to increased
17 staffing needs;
18 Whereas, the Sheriff has advised City Council that as a result
19 of increased staffing needs due to the John Allen Muhammad trial,
20 that he has cancelled the ability of his employees to take annual
21 leave and as a result they will be unable to reduce the number of
22 annual leave hours accrued in excess of four hundred (400); and
23 Whereas, City Council finds that such result is unintended and
24 unavoidable under the circumstances and desires to make a one time
25 exception to the applicable City ordinance especially in view of
26 the exceptional performance of the Sheriff's Office employees during
27 the John Allen Muhammad trial.
28 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
29 OF VIRGINIA BEACH, VIRGINIA:
30 That the application of Czty Code Section 2-85 shat] hereby be
31 modified to allow the employees of the Virginia Beach Sheriff's
32 Office who have accrued annual leave hours in excess of four
33 hundred (400) hours as of December 31, 2003, as a result of
34 staffing requirements during the John Allen Muhammad trial and the
35 suspension of leave during the trial, to receive payment for those
36 annual leave hours accumulated in excess of four hundred (400) at
37 their regular rate of pay, provided that payments shall be
38 conditioned upon verification in writing by the Sheriff to the City
39 of Virginia Beach Payroll Office of the eligibility of each
40 employee under the circumstances and provisions set forth in this
41 ordinance.

6 WHEREAS, the Democratic Party has called for a presidential primary
7 election to be held on February 10, 2004;
8 WHEREAS, the Code of Virginia, at ~ 24.2-518, requires the
9 locality in which a primary election is conducted to pay the costs of
10 the election; and
11 WHEREAS, the FY 2003-04 Operating Budget of the General
12 Registrar does not contain funding for this special election, but
13 $117,715 is available in the FY 2003-04 General Fund Reserve for
14 Contingencies to provide $117,175 to conduct this primary.
15 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
16 VIRGINIA BEACH, VIRGINIA:
17 That $117,175 is hereby transferred from the General Fund

That, WHEREAS, the Grantee is the owner of that certain lot, tract, or parcel of land
designated and described as "Section A Lot 38 Princess Anne Hills Park" and being further
designated and described as 444 Goodspeed Road, %rg~ma Beach, Virginia 23451; and
WHEREAS, it ~s proposed by the Grantee to construct and maintain an existing
bulkhead, rip-rap and dock, "Temporary Encroachment", ~n the City of %rg~ma Beach;
WHEREAS, ~n constructing and maintaining the Temporary Encroachment, it ~s
necessary that the Grantee encroach into a portion of an ex~sting City waterway known as
Stratton's Creek "The Encroachment Area"; and
WHEREAS, the Grantee has requested that the City permit a Temporary
Encroachment within The Encroachment Area.
NOW, THEREFORE, for and in consideration of the premises and of the benefits
accruing or to accrue to the Grantee and for the further consideration of One Dollar ($1.00), in
hand paid to the City, receipt of which is hereby acknowledged, the City doth grant to the Grantee

Encroachment.
It is expressly understood and agreed that the Temporary Encroachment will be
maintained in accordance with the laws of the Commonwealth of Virginia and the City of Virginia

as follows, to wit:
A Temporary Encroachment into The Encroachment Area as shown on
that certain plat entitled: "Hardscape Layout Plan for Administrative
Approval Wilson Residence Virginia Beach, Virginia WPL Engineers
Surveyors Land Planners Landscape Architects," a copy of which is
attached hereto as Exhibit "A" and to which reference is made for a more
particular description.
It is further expressly understood and agreed that the Temporary Encroachment herein
authorized terminates upon notice by the City to the Grantee, and that within thirty (30) days after the
notice is given, the Temporary Encroachment must be removed from The Encroachment Area by the
Grantee; and that the Grantee will bear all costs and expenses of such removal.
It is further expressly understood and agreed that the Gmnte~ shall indemnify and hold
harmless the City, its agents and employees, from and against all claims, damages, losses and expenses
including reasonable attorney's fees in case it shall be necessary to file or defend an action arising out
of the location or existence of the Temporary Encroachment.
It is further expressly understood and agreed that nothing herein contained shall be
construed to enlarge the permission and authority to permit the maintenance or construction of any
encroachment other than that specified herein and to the limited extem specified herein, norto permit
the maintenance and construction of any encroachment by anyone other than the Grantee.
It is further expressly understood and agreed that the Grantee agrees to maintain the
Temporary Encroachment so as not to become unsightly or a hazard.
It is further expressly understood and agreed that the Grantee must obtain and keep in
force all-risk property insurance and general liability or such insurance as is deemed necessary by the
City, and all insurance policies must name the City as additional named insured or loss payee, as
applicable. The Grantee also agrees to carry comprehensive general liability insurance in an amount not
less than $500,000.00, combined single limits of such insurance policy or policies. The Grantee will
provide endorsements providing at least thirty (30) days written notice to the City prior to the
cancellation or termination of, or material change to, any ofthe insurance policies. The Grantee assumes
all responsibilities and liabilities, vested or contingent, with relation to the Temporary Encroachment.
It is further expressly understood and agreed that the Grantee must submit for review and
approval, a survey of The Encroachment Area, certified by a registered professional engineer or a
licensed land surveyor, and/or "as built" plans of the Temporary Encroachment sealed by a registered
professional engineer, ifrequired by either the City Engineer's Office orthe Engineering Division ofthe
Public Utilities Department.
It is further expressly understood and agreed that the City, upon revocation of such
authority and permission so granted, may remove the Temporary Encroachment and charge the cost
thereof to the Grantee, and collect the cost in any manner provided by law for the collection of local or
state taxes; may require the Grantee to remove the Temporary Encroachment; and pending such
removal, the City may charge the Grantee for the use of The Encroachment Area, the equivalent of what
would be the real property tax upon the land so occupied if it were owned by the Grantee; and if such
removal shall not be made within the time ordered hereinabove by this Agreement, the City may impose
a penalty in the stun of One Hundred Dollars ($100.00) per day for each and every day that the
Temporary Encroachment is allowed to continue thereafter, and may collect such compensation and
penalties in any manner provided by law for the collection of local or state taxes.
IN WITNESS WHEREOF, John W. Wilson, Jr. and Tammy A. Wilson, the said
Grantees have caused this Agreement to be executed by their signatures and seals duly affLxed. Further,
that the City of Virginia Beach has caused this Agreement to be executed in its name and on its behalf
by its City Manager and its seal be hereunto affixed and attested by its City Clerk.

THIS AGREEMENT made this 1st day of October 2003, by and between SHIPPS-
HOLLAND ASSOCIATES, L L.C., a Virglma limited liability company, Applicant, and
hereinafter called Grantor for purposes of ~ndexlng and the CITY OF VIRGINIA BEACH, a
Municipal corporation of the Commonwealth of V~rgmla, hereinafter called Grantee.
RECITALS:
R-1 The Grantor is the record fee simple owner of the property located in the Pnncess
Anne District, City of Virginia Beach and described m Exhibit A attached hereto (the
"Property") and ~ncorporated into this Agreement
R-2 The Applicant ~mtiated an amendment to the zoning map of the City of Vlrglma
Beach, Virginia, by petition of the Applicant addressed to the Grantee, so as to change the
zomng classification of a portxon of the Property from AG-1 Agricultural to I-1 conditional
Industrial D~stnct The proposed amendment is made pursuant to the terms of the zomng
ordinance of the City of Vxrg~ma Beach, Virginia, adopted April 18, 1988, as amended and as m
effect as of the date of th~s Agreement (the "Zomng Ordinance")
R-3. The Grantee's policy is to provide only for the orderly development of land, for
industrial purposes through zoning and other land development legislation
R-4 The Grantor and the Applicant acknowledge that competing and sometimes
incompatible uses conflict, and that in order to permit different uses on and in the area of the
Property and at the same t~me to recognize the effect of the changes, and the need for various
types of uses, ~ncluding those listed above, certain reasonable conditions governing the use of the
Property for the protection of the community that are not generally applicable to land s~m~larly
zoned I-1 cond~tmnal are needed to cope with the situation to which the Applicant's rezomng
application gives rise
R-5 The Grantor and the Applicant have voluntarily offered, in writing, in advance of
and prior to the public hearing before the Grantee, as part of the proposed amendment to the
zomng map with respect to the Property, in addxtlon to the regulatmns provided for in the
existing I-1 zoning distnct by the Zoning Ordinance, the following reasonable conditions related
to the physmal development, operation and use of the Property to be adopted as part of said
amendment to the zomng map relative and apphcable to the Property, which have a reasonable
relation to the rezoning and the need for which ~t ~s generated by the rezomng.
R-6. The conditions outlined in th~s Agreement have been proffered by the Grantor and
the Apphcant and allowed and accepted by the Grantee as part of the amendment to the Zoning

Ordinance and the zoning map. These conditions shall continue In full force and effect until
subsequent amendment changes the zoning of the Property; however, that such conditions shall
continue despite a subsequent amendment if the subsequent amendment is part of the
comprehensive ~mplementation of a new or substantmlly revised zoning ordinance of the
Grantee, unless, notwithstanding the foregoing, the conditions are amended or vaned by written
instrument recorded in the Clerk's Office of the Clrcmt Court of the City of V~rglma Beach,
Virginia and executed by the record owner of the Property at the time of recordation of such
instruments, provided further that sa~d instrument is consented to by the Grantee in writing as
evidenced by a certified copy of the ordinance or resolution adopted by the governing body of
the Grantee, after a public heanng before the Grantee advemsed pursuant to the provisions of
Section 15.2-2004 of the Code of Vtrgtnza, 1950 as amended, which smd ordinance or resolution
shall be recorded along with smd instrument as conclusive ewdence of such consent.

NOW, THEREFORE, the Grantor and the Apphcant, for themselves, their successors,
personal representatives, assagns, grantees and other successors in t~tle and interest, voluntarily
without requirement by or exactmn from the Grantee or ~ts governing body and without any
element of compulsion or qmd pro quo for zomng, rezomng, site plan, building permit or
subdivlsmn approval, hereby make the following declaration of conditions and restrictions which
shall restrict and govern the physmal development, operation and use of the Property and hereby
covenant and agree that this declaratmn shall constitute covenants running w~th the Property,
which shall be binding upon the Property and upon all parties and persons claiming under or
through the Grantor, their successors, personal representatives, assigns, grantees and other
successors in interest or title.
1. The prehminary subdivision plan submitted by the Grantor and the Applicant to
the Department of Planning with this Agreement and entitled '"'Zoning Exhibit" Preliminary
Subchvlsion of Property, Parcel BI-B, Subdivision of Property of Margaret A. Drummond and
James R. and Marguerite Johnson, M.B. 293, P 34, 35, dated September 26, 2003" (the "Plan")
~s incorporated hereto by reference and forms a part of this Agreement and shall be substantially
adhered to in the development of the Property.
2. The following uses shall not be permitted unless a Conditional Use Permit xs
approved by C~ty Council: airports, heliports and helistops; automobile rental establishments;
automotive servme estabhshments; heavy eqmpment sales and servxce, and truck and trailer
rentals.
3. Only one additional new entrance shall be permitted on Shlpps Comer Road for
the Property. The existing entrance used for the existing residence on the Property shall remain
whether or not the residence ~s removed or ~s used for a purpose other than a residence. Future
access to the other portion of the Property (other than residence) shall be through the one shared
entrance. Cross access easements shall be provided.
4 Building facades visible from Shlpps Comer Road shall ~ncorporate architectural
features including, but not limited to, arcades, display windows, entry areas, false windows and
awnings to add visual interest. Variation in roof lines shall be ~ncorporated through overhanging
eaves, parapets, pop outs, entrance features or height vanatmns. Flat roofs and all rooftop
equipment shall be concealed from typical street level view by the use of parapets or other
means. The front elevation of the bmld~ngs constructed on the Property shall be brick, wood,
stone or tinted and textured concrete masonry All exterior surfaces shall have an earth tone
color
5. All freestanding signs shall be monument style or column style signs constructed
of the same primary material as the bmld~ng and shall not exceed a height of eight (8) feet No
neon lighting wslble from Shipps Comer Road shall be permitted on the Property
6. The Grantor and the Apphcant agree to make a right-of-way reservation on
Shipps Comer Road according to the reqmrements of the City of Virginia Beach Master
Transportation Plan Map as Amended and Adapted May 27, 2003
7. Further conditions may be required by the Grantee dunng detmled site plan and/or
subdivision review and admlmstration of applicable C~ty Codes by all cognizant City agenmes
and departments to meet all applicable City Code requirements.
The Grantor and the Applicant covenant and agree that:
a The Zoning Admlmstrat~on of the City of Virginia Beach, Virginia, shall
be vested with all necessary authority on behalf of the govermng body of the City of Virginia
Beach, Virginia, to administer and enforce the foregoing conditions and restrictions, including
the authority (i) to order in writing that any non-compliance with such conditions be remedied
and (ii) to bnng legal action or suit to insure compliance with such conditions including
mandatory or prohibitory injunction, abatement, damages or other appropriate action, suit or
proceedings.
b. Failure to meet all conditions and restrictions shall constitute cause to
deny the issuance of any of the reqmred bmldlng or occupancy permits as may be appropriate.
c. If aggrieved by any dec~sion of the Zoning Administrator made pursuant
to the provisions of the City Code, the Zoning Ordinance, or this Agreement, the Grantor shall
petmon the governing body of Grantee for the review of such demsion prior to instituting
proceedings in court.
d. The Zoning Map shall show by an appropriate symbol on the Map the
existence of condltxons attaching to the zoning of the Property on the map and that the ordinance
and the conditions may be readily available and accessible for pubhc ~nspection in the office of
the Zoning Administrator and ~n the Planning Department and that they shall be recorded in the
Clerk's Office of the C~rcuit Court of the City of Varglma Beach, V~rglma, and indexed in the
name of the Grantor and Grantee

development of the Property.
2 The only permitted use on the Property is to be a car wash unless agreed to by
City Council.
3 The Grantor and the Applicant agree to make a right-of-way reservation on
Holland Road according to the requirements of the City of Virgtma Beach Master Transpiration
Plan Map as Amended and Adapted May 27, 2003
4. Further conditions may be required by the Grantee dunng detailed site plan and/or

WHEREAS, the purpose of the Comprehensive Plan is to
guide and accomplish the coordinated, adjusted and harmonious
development of the City which will, in accordance with present and
probable future needs and resources, best promote the health,
safety, morals, order, convenience, prosperity and general welfare
of the C~ty and mts cmtlzens;
WHEREAS, the Planning Commission, in concert with the
Department of Planning, conducted numerous work sessions and an
extensive outreach program ~n order to determine the needs and
desires of the general public and buszness, environmental,
military, agricultural, cultural and other groups;
WHEREAS, on October 20, 2003, the Plannmng Commission
recommended and certified to the City Council a Comprehensive Plan
amending the previous Comprehensive Plan adopted by the City
Council on November 4, 1997, and thereafter revised on December 14,
1999, January 4, 2000, March 28, 2000, June 27, 2000, July 11,
2000, December 12, 2000, May 22, 2001, June 11, 2002 and May 27,
2003, in accordance with the requirements of Article 3 of Chapter
22 of Title 15.2 of the Code of Virginia;
WHEREAS, the Cmty Council has thoroughly stud~ed the
Comprehensive Plan recommended and certifmed to it by the Planning

Commission, and has actively and affirmatively sought and obtained
the views of the citizens of the City;
WHEREAS, the City Council has held a public hearing on
the proposed Comprehensive Plan, after having given due notice
thereof pursuant to Section 15.2-2204 of the Code of Virginia, as
amended; and
WHEREAS, the Comprehensive Plan presented to the City
Council thzs day, bearing the date of September 29, 2003, and the
revisions thereof dated October 20, 2003, amend the version o£ the
Comprehensive Plan recommended and certifzed by the Planning
Commission;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF VIRGINIA BEACH, VIRGINIA:
That it hereby adopts, as the Comprehensive Plan of the
City of Virginia Beach, that certain document entitled
"Comprehensive Plan, City of Virginia Beach," dated September 29,
2003, as amended by the aforementioned revisions bearing the dates
of October 20, 2003, and December 2, 2003, which Comprehensive Plan
and revisions were presented to the Cmty Council this day.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE Cii~ OF
VIRGINIA BEACH, VIRGINIA:
That it hereby also adopts, as an integral part of the
Comprehensive Plan, the Comprehensive Land Use Plan Map and Master
