The City Manager advised Workforce Planning and Development was the result of City Council's desire
to have additional information relative "succession planning" (aging of the City's workforce) and make sure
the City has developed a skillful workforce to maintain the goals and objectives of the City.
Fagan Stackhouse, Director of Human Resources, quoted Roger Wilkins:
"The best hope of solving all problems lies in harnessing the diversity,
the energy and the creativity of all people ".

The W orkP AD was developed in-house. Mr. Stackhouse extended appreciation to Gwen Cowart, Director
of COMIT and her staff. Communications and Information Technology (COM IT) partnered with Human
Resources to develop the system. During the first phase, this WorkPAD received a national award. This
system is currently tied into the BeachNet and is the engine that facilitates data collection, retrieval and
analysis. WorkPAD provides data on projected retirements: job titles and descriptions, knowledge, skills
and competencies, demographics and gaps in worliforce knowledge, skills and competencies. The Virginia
Retirement System in Richmond has been linked to the WorkPAD and information can be provided on a
periodic basis.

Mr. Stackhouse advised Human Resources is partnering with Tidewater Community College. Approximately
twenty (20) of his staff will be trained on effective, coaching and counseling. Pilot efforts entail the Fire
Department, Museums and Human Resources. Human Resources will have completed their Strategic and
Worliforce Plan by June. The staffwill be aware of the gaps and skills shortages. Other departments are
now being engaged to work with this department.

Mr. Stackhouse quoted Jim Collins - "Good to Great".
"People are not your most important asset!"
"The right people are? "
Mr. Stackhouse advised his colleagues have called and advised they are hiring our personnel from our City.
Councilman Diezel believes this is a plus and indicated the City was doing an excellent job.
Mr. Stackhouse advised a committee has been working on knowledge management to capture the knowledge
of certain key personnel. Timing will be critical as with retirement the City will/oose this component. The
City needs to chronicle this employee and formulate his assets into competencies, knowledge, skills and
abilities to replicate with the new employee. Mr. Stackhouse advised job rotation is encouraged. Once the
skill of the individual is assessed, this will enrich the organization and provide a better support base. The
Worliforce Planning and Development will be an ongoing effort by the various departments.
Approximately $250,000, was expended relative WordPAD, principally involving additional support staff
to assist Communication and Information Technology. Other costs, the realignment of personnel, to perform
the work, would be in-house.
Council Lady McClanan requested information relative the members of the Committee, the number ofhours
expended on meetings as well as information relative productivity of the meetings.
Mr. Stackhouse advised the twenty (20) member committee has completed its mission. The development of
a successful exit process is also beingformulated. The questionnaire will be centralized. Mr. Stackhouse will
provide the exact number of retirees in 2003.
Mr. Stackhouse advised the Mayor, the Plan must fully justify the numbers of employees required. If
technology can do the work, perhaps expansion in many areas might not be necessary.

The City Manager, advised re self evaluation, following the Budget process last May, City Council
expressed a desire to perform the budget review in a different manner. Councilman Diezel circulated an
alternative.
Catheryn Whitesell, Director of Management Services, advised the purpose of Budget Workshops:
To provide an opportunity to discuss policy and programs contained in the
Proposed Operating Budget and Capital Improvement Program.
What Determines Number of Workshops Needed
Amount and variety of information to be covered.

Council Lady Wilson inquired relative meeting on May Fourth, as this is Election Day. The City Manager
advised City Council usually does not meet on Councilmanic Election days. Virginia Beach City Schools
chooses the day which best works for their schedule. Concern was also expressed relative Spring Break

Mayor Oberndorf complimented the e-streaming of the City Council Sessions on www.vbrzov.com.Mr. David
Sullivan, Chief Information D.fficer, advised all City Council Budget Workshops are e-streamed.
Council Lady Eure suggested an advanced outline of the Department Director's presentation in order for
City Council to inquire relative certain items. Councilman Diezel advised concern relative Mental Health
and Social Services. Councilman Schmidt advised if the Departments are limited to a certain time, the City
Council should be limited in their questioning.
Council Lady McClanan did not wish to make any dramatic changes.
The Mayor advised, generally in the past, the Mayor and Vice Mayor, before the Reconciliation Workshop,
have historically forwarded a letter to the City Council inquiring whether these ordinances were the
proposed direction of City Council. Last year, another agenda was introduced.
Vice Mayor Jones suggested four (4) Workshops comprised of three hours rather than two would be
preferable. An outline provided from each Department Director is an excellent idea.
Councilman Diezel advised occasionally, with the City Manager's permission, he will go to the Department
Directors with his individual questions. During the budget process, he will provide City Council with the
responses.
Councilman Reeve advised on March 30, 2004, the proposed FY 2004-05 Resource Management Plan will
be online. Compact discs will be available that night.

Executive Committee has requested the item be WITHDRA WN at this time. This will allow the newly elected
Executive Committee to further study the issue.

(CZO) re signs in the B-3A Pembroke Central Business District.
Associate City Attorney Kay Wilson distributed a Revised Ordinance and advised the following line was
deleted:
"..and (ii) the Planning Director and Zoning Administrator concur.. "
As the maximum of one and eight-tenths (1.8) square feet of sign area allowed for each foot of building
footage, was reduced to one and two-tenths (1.2) square feet of signed area, the staff did not believe the
approval was necessary.
Council Lady McClanan will vote NAY on this item.

(b) Section F-403.1 is hereby amended to read as

1 7 conducted in accordance wi th the laws and regulations set
18 forth by the department of environmental quality (air
19 division), the department of forestry, and sections 12-3
20 through 12-5 of this chapter.

Application of Sudhakar J. Lavingia for the discontinuance, closure
and abandonment of a portion of Stumpy Lake Lane beginning at a
point 103.08 feet west of Harris Creek Court and running in a westerly
direction a distance of 137.46feet. DISTRICT 1- CENTERVILLE
The following conditions shall be required:
1. The City Attorney's Office will make the final determination
regarding ownership of the underlying fee. The purchase price
to he paid to the City shall be determined according to the
"Policy Regarding Purchase of City's Interest in Streets
Pursuant to Street Closures, " approved by City Council. Copies
of the policy are available in the Planning Department. In
addition, consideration may be given to crediting the purchase
price to the City's share of cost based on the Cost
Participation Agreement for the improvements to Stumpy
Lake Lane.
2. The applicant is required to resubdivide the property and vacate
internal lot lines to incorporate the closed area into the
adjoining parcels. The plat must be submitted and approved for
recordation prior to final street closure approval.
3. The applicant is required to verifY that no private utilities exist
within the right-ofway proposed for closure. Preliminary
comments from the utility companies indicate that there are no
private utilities within the right-of-way proposed for closure. If
private utilities do exist, easements satisfactory to the utility
company, must be provided.
4. Closure of the right-of-way shall be contingent upon compliance
with the above stated conditions within 365 days of approval by
City Council (January 12, 2005). If the conditions noted above
are not accomplished and the final plat is not approved within
one year of the City Council vote to close the right-ofway, this
approval shall be considered null and void.

2. If all conditions are met on or before January 12, 2005, the date of final
closure is the date the street closure ordinance is recorded by the City Attorney.
3. In the event the City of Virginia Beach has any interest in the underlying
fee, the City Manager or his designee is authorized to execute whatever documents, if any, that
may be requested to convey such interest, provided said documents are approved by the City
Attorney's Office.
SECTION IV
A certified copy of this Ordinance shall be filed in the Clerk's Office of the
Circuit Court of the City of Virginia Beach, Virginia, and indexed in the name of the CITY OF
VIRGINIA BEACH as "Grantor" and SUDHAKER J. LAVINGIA and GEETA S. LAVINGIA

THIS AGREEMENT, made this 25th day of May, 2003, by and between
SUDHAKAR J. LAVINGIA and GEETA S. LAVINGIA, husband and wife, Grantors,
parties of the first part; and THE CITY OF VIRGINIA BEACH, a municipal
corporation of the Commonwealth of Virginia, GRANTEE, party of the second part.
WITNESSETH:
WHEREAS, the parties of the first part are the owners of two (2) parcels of
property located in the Centerville District of the City of Virginia Beach, containing
approximately 9.769 acres which are more particularly described as Parcels 1 and 2
in Exhibit "A" attached hereto and incorporated herein by this reference (the
"Property"); and
WHEREAS, the parties of the first part have initiated a conditional
amendment to the Zoning Map of the City of Virginia Beach, Virginia, by petition
addressed to the GRANTEE so as to change the Zoning Classification of the Property
from R-IO Residential District to R-5D Residential District; and
WHEREAS, the Grantee's policy is to provide only for the orderly development
of land for various purposes through zoning and other land development legislation;
and

WHEREAS, the Grantors acknowledge that th~ competing and sometimes
incompatible uses conflict and that in order to permit differing uses on and in the
area of the Property and at the same time to recognize the effects of change, and the
need for various types of uses, certain reasonable conditions governing the use of the
Property for the protection of the community that are not generally applicable to land
similarly zoned are needed to cope with the situation to which the Grantor's rezoning
application gives rise; and
WHEREAS, the Grantors have voluntarily proffered, in writing, in advance of
and prior to the public hearing before the Grantee, as a part of the proposed
amendment to the Zoning Map, in addition to the regulations provided for the R-5D
Zoning District by the existing overall Zoning Ordinance, the following reasonable
conditions related to the physical development, operation, and use of the Property to
be adopted as a part of said amendment to the Zoning Map relative and applicable to
the Property, which has a reasonable relation to the rezoning and the need for which
is generated by the rezoning.
NOW, THEREFORE, the Grantors, for themselves, their successors, personal
representatives, assigns, grantee, and other successors in title or interest, voluntarily
and without any requirement by or exaction from the Grantee or its governing body
and without any element of compulsion or quid pro QUO for zoning, rezoning, site
plan, building permit, or subdivision approval, hereby make the following declaration
of conditions and restrictions which shall restrict and govern the physical
development, operation, and use of the Property and hereby covenants and agrees
that this declaration shall constitute covenants running with the Property, which
shall be binding upon the Property and upon all parties and persons claiming under
or through the Grantors, their successors, personal representatives, assigns,
grantee, and other successors in interest or title:
1. When the Property is developed, it shall be developed as no more than
thirty-six (36) single family residential building lots substantially in conformance
with the Exhibit entitled "LAND USE PLAN FOR SUDHAKAR J. LAVINGIA," dated

2. All residential dwellings constructed on the Property shall have a
minimum of 2200 square feet of enclosed living area.
3. When the Property is subdivided, the Grantors agree to participate with
the Grantee in the cost of constructing that section of Stumpy Lake Lane east of the
Property to its intersection with Archdale Drive, including the intersection with
Archdale Drive.
4. Further conditions may be required by the Grantee during detailed Site
Plan review and administration of applicable City Codes by all cognizant City
agencies and departments to meet all applicable City Code requirements.
The above conditions, having been proffered by the Grantors and allowed and
accepted by the Grantee as part of the amendment to the Zoning Ordinance, shall
continue in full force and effect until a subsequent amendment changes the zoning
of the Property and specifically repeals such conditions. Such conditions shall
continue despite a subsequent amendment to the Zoning Ordinance even if the
subsequent amendment is part of a comprehensive implementation of a new or
substantially revised Zoning Ordinance until specifically repealed. The conditions,
however, may be repealed, amended, or varied by written instrument recorded in the
Clerk's Office of the Circuit Court of the City of Virginia Beach, Virginia, and
executed by the record owner of the Property at the time of recordation of such
instrumen t, provided that said instrument is consented to by the Gran tee in writing
as evidenced by a certified copy of an ordinance or a resolution adopted by the
governing body of the Grantee, after a public hearing before the Grantee which was
advertised pursuant to the provisions of Section 15.2-2204 of the Code of Virginia,
1950, as amended. Said ordinance or resolution shall be recorded along with said
instrument as conclusive evidence of such consent, and if not so recorded, said
instrument shall be void.
The Grantors covenant and agree that:
(1) The Zoning Administrator of the City of Virginia Beach, Virginia, shall
be vested with all necessary authority, on behalf of the go-verning body of the City of

abatement, damages, or other appropriate action, suit, or proceeding;
(2) The failure to meet all conditions and restrictions shall constitute cause
to deny the issuance of any of the required building or occupancy permits as may be
appropriate;
(3) If aggrieved by any decision of the Zoning Administrator, made
pursuant to these provisions, the Grantors shall petition the governing body for the
review thereof prior to instituting proceedings in court; and
(4) The Zoning Map may show by an appropriate symbol on the map the
existence of conditions attaching to the zoning of the Property, and the ordinances
and the conditions may be made readily available and accessible for public
inspection in the office of the Zoning Administrator and in the Planning Department,
and they shall be recorded in the Clerk's Office of the Circuit Court of the City of
Virginia Beach, Virginia, and indexed in the name of the Grantors and the Grantee.

Bruce B. Mills v. City of Virginia Beach - Inverse condemnation.
The suit, which was filed in January 2003 and alleges the "inverse condemnation" of four
contiguous platted lots seaward of the primary dune at Chesapeake Beach, was tried Monday,
December 1, 2003. In the suit the landowner, Mills, contends the refusal to allow development of
the lots in accordance with the City's Coastal Primary Sand Dune Ordinance is a "regulatory taking"
by the City, entitling him to compensation for the property. Mills paid $1460 for the four lots in
1975, and now claims they are worth $450,000.
After Mills presented his evidence, the court granted our motion to strike the evidence and
dismissed the case. The court specifically concluded that Mills had not shown that there was a
"taking" of the property.
City of Virginia Beach v. BGJ, LLC Challenge to municipal authority.
In September 2002 BOJ, LLC, the owner of 2.8 acres originally platted in 1977 as a
"recreation area" in The Lakes subdivision, posted the property with "No Trespassing" signs. When
the subdivision was created, the property was reserved for open space/recreational purposes as
required by the City's Subdivision Ordinance. BOJ, LLC acquired the property following a sale by
the Commonwealth after the homeowner's association dissolved. Residents of the neighborhood,
who have for many years, used this property for recreation, reported the posting of the property to the
City. In response, we filed suit in October 2002 to enforce the City Code and enjoin BOJ from
restricting or limiting access to the property for recreational use.
The court granted our motion for a preliminary injunction in October 2002, and ordered the
owner to make the property available for recreational use by the residents pending trial on the merits
of a permanent injunction.
On December 16, 2003, after a day of evidence, the court granted the City a permanent
injunction, and ordered that the property only be used as recreational open space. Also, the owner's
counterclaim against the City for trespass was dismissed.
Virginia Beach General District Court
Rebecca Misenas v. Detective Kriegger - Negligence.
In October 2003, a Warrant in Debt was filed for $6,000 for clothing claimed to have been
left in a stolen car and not returned after the car was recovered. The clothes, in four garbage bags,
were donated to charity before any claim was made. At trial on December 10, 2003, the court
dismissed the suit.
