WHEREAS: The Virginia Beach City Council convened into CLOSED SESSION,
pursuant to the affirmative vote recorded here and in accordance with the provisions of The

PUBLIC HEARING
The Virginia Beach City Council, at its Formal Session Tuesday, 7 Sep.
tember 2004, 6:00 PM, will hold a PUBLIC HEARING in the Council
Chamber on the second floor of City Hall, Buildingl, Municipal Center,
regarding the use of Local Law Enforcement Block Grant funds. These
funds will increase the FY 2004-05 Operating Budget by $68,102 and
are available for the purposes of reducing crime and improving public
safety.
Interested residents of the City of Virginia Beach may appear at the
above -mentioned time and place to present their views.

In accordance with the 2004 Local Law Enforcement Block Grant (LLEGB) we have scheduled
a public hearing for September the 7'". The amount of grant funding we will receive ($68,102
with a 10% match for a total of $75,669) has already been determined by the Department of
Justice. However, before awarding the grant, DOJ requires that each locality hold a public
hearing on the funding. The Criminal Justice Board met on July 131" to suggest the following

ITEM: Resolution Referring to the Planning Commission Proposed
Amendments to Section 901 Of The City Zoning Ordinance,
Requiring Conditional Use Permits for Multi -Family Dwellings In The
B-4 Resort Commercial District
MEETING DATE: September T, 2004
■ Background: Current City Zoning Ordinance regulations allow multi -family
dwellings as a principal (i.e., of -right) use in the B-4 Resort Commercial District, except
in the portion of the B-4 Resort Commercial District that is also within the Shore Drive
Corridor Overlay District. Within the Overlay District, which is shown on the City's
zoning map as B-4(SD), multi -family dwellings are a conditional use and therefore
require a conditional use permit. There is much more land within the B-4(SD) District
than in the remainder of the B-4 District.
■ Considerations: The Resolution would refer to the Planning Commission
proposed amendments to Section 901 of the City Zoning Ordinance that would change
the designation of multi -family dwellings in the B-4 Zoning District from a principal use to
a conditional use. If the amendments are adopted, multi -family dwellings would
thereafter be a conditional use in the entire B-4 District.
The Resolution also requires the Planning Commission to make a
recommendation to the City Council at the Planning Commission's special meeting to
be held on September 13, 2004.
■ Public Information: The Resolution will be advertised as a normal agenda item.
If the Resolution is adopted by the City Council, the amendments would be considered
by the Planning Commission and are anticipated to be considered by the City Council
on September 28. The amendments would be advertised in the manner of other
Planning Agenda items. In addition, all owners of property within the B-4 District
outside of the Shore Drive Corridor Overlay District will be notified of both the Planning
Commission's September 13 meeting and the City Council's September 28 meeting by
letter.
■ Recommendations: Adoption of Resolution referring the proposed
amendments to the Planning Commission.
■ Attachments: Proposed amendments to Section 901 of the City Zoning

ITEM: Multi -Jurisdictional Hazard Mitigation Grant
MEETING DATE: September 7, 2004
■ Background:
The City of Virginia Beach has been working with the City of Norfolk, City of
Portsmouth, City of Suffolk, and County of Isle Wight to develop a multi -jurisdictional
hazard mitigation plan. The Federal Emergency Management Agency (FEMA) is
offering federal and state funding through the Hazard Mitigation Grant Program. The
grant requires multi -jurisdictional coordination in order to be eligible for funding.
■ Considerations:
Funds from this grant will be used to hire a consultant to assist cities in hazard
mitigation planning. The grant is structured so that the federal government and the
state will cover a majority of the total project costs, and all localities are responsible for
a soft match that is required. The City will receive $78,151 in federal funds along with
$48,197 in state funds. The local match of $6,500 divided up among the localities can
be paid through in -kind services such as staff time.
■ Public Information:
Public Information will be handled through the normal Council Agenda process.
■ Alternatives:
The City could chose to decline the funds it has already been awarded. However, this
is an opportunity for the City to participate with other local governments to create a
multi -jurisdictional hazard mitigation plan.
■ Recommendations:
Accept $78,151 in federal funds and $48,197 in state funds from the Hazard Mitigation
Grant Program and appropriate to the Fire Department's fiscal year 04-05 operating
budget.

I am pleased to notify you that the Federal Emergency Management Agency has approved the
prol'bct and obligated funds for the project listed below through the Hazard Mitigation Grant Program

As you are aware, the funds indicated are the maximum possible funds to be distributed to the
Commission. Reimbursement of federal and state project funds to the Commission is based on total
eligible project costs. All other costs are the responsibility of the Commission.
In accordance with the requirements for the Hazard Mitigation Grant Program, the,
following conditions apply to the project:
• All contract/ procurement transactions must be carried out in a manner consistent with
financial administrative requirements of Title 44, Code of Federal Regulations (CFR), Part
13.
• Provide the State with a work schedule including the milestones in the HMGP
application for the approved project within 30 days of receipt of this letter. According to
the project's original work schedule, the performance period extends for twenty-two
months. Therefore, the completion date for this project is May 31, 2006. If this
completion date is too short, please notify the Hazard Mitigation Program Manager in
writing as soon as possible.
• All requirements outlined in the attached environmental concurrence letters from State
agencies must be followed.
Award documents enclosed with this letter include the following:
• Grantee-Subgrantee Agreement (Three Covies): An authorized agent of your
Department must sign each agreement before your project can start. Please return all
copies to the Hazard Mitigation Program Manager and one fully executed agreement
will be returned to you. Until the agreement is signed, no funds will be reimbursed.
• Notification to Subgrantees: The notification provides guidance regarding HMGP
regulations on time extensions, inspections, audits, reporting procedures, the appeal
process, cost overruns, etc.
• Subgrantee Ouarterly Report Form: Subgrantees are required to submit progress
reports to the Department of Emergency Management on a quarterly basis until
project closeout. The first quarterly report will be due by September 30, 2004. The
incomplete version of the form is attached. Please make photocopies of this form and
use it each time you submit. The attached Notification to Subgrantees document has
the annual schedule for progress reports submission.
• Request for Reimbursement of Funds Form: Payments to Subgrantees are made on a
reimbursement basis. Reimbursements are for costs to date or expenditures to be
incurred within five (5) days of receipt of funds. Payment will be made by electronic
transfer from the Department of Emergency Management to your Department.
Please use the Request for Reimbursement form to make all reimbursement requests.
• Code 44 of Federal Regulations Parts 201 and 206.

Please read all documents carefully prior to initiating your project. Once again, your
project cannot begin until an authorized agent has signed the Grantee-Subgrantee Agreement.
No reimbursements will be made until the Agreement is signed and received by the
Department of Emergency Management. Please sign each of the three copies of the Grantee-
Subgrantee Agreement and return them to the attention of Ms. Eileen Tarr, Planning
Coordinator. You will be provided with an original agreement, once it is fully executed. The
Federal Categorical Exclusion Document from FEMA will be sent with the executed agreement.
Again, congratulations on approval of this project. We will be offering two workshops
over the next several months to assist you with this process. The first will be regarding the
development of the risk assessment, followed by a second concerning the plan development
process. You will be contacted with the specific details about the workshops in the near future.

In 2002, the City Council adopted an ordinance setting the annual salary of the
City Councilmember representing the Beach district at zero dollars. Funds in the
amount of a Councilmember's salary ($18,000) have been transferred to the
FY'05 Council Donations account to provide a potential source of funding for a
charitable donation by the City Council.
■ Considerations:
The proposed ordinance would donate $18,000 to the Virginia Beach Public
Schools Educations Foundation.

The ordinance requires no special advertising or other public notice.
