VIRGINIA BEACH CITY COUNCIL
WHEREAS: The Virginia Beach City Council convened into CLOSED SESSION,
pursuant to the affirmative vote recorded here and in accordance with the provisions of The
Virginia Freedom of Information Act; and,
WHEREAS: Section 2.2-3712 of the Code of Virginia requires a certification by the
governing body that such Closed Session was conducted in conformity with Virginia Law.
N OW, THEREFORE, BE IT RESOLVED:
That the Virginia Beach City Council
hereby certifies that, to the best of each member's knowledge, (a) only public business matters
lawfully exempted from Open Meeting requirements by Virginia Law were discussed in Closed
Session to which this certification resolution applies; and, (b) only such public business matters
as were identified in the motion convening this Closed Session were heard, discussed or
considered by Virginia Beach City Council.

WHEREAS: Doris Gladys Hindlin passed from this life on October 12, 2004 at
the age of Seventy-four. She was a woman of tenacity, a loving mother, volunteer and possessed
great intellect, wisdom and understanding;
WHEREAS: Doris was retired from the Virginia Employment Commission of
Norfolk and Chesapeake. She was a member of Temple Israel and its Sisterhood as well as the
Rabbi's Study Group, Brandeis Women's Book Club, and was past President of Haddassa;
WHEREAS: Doris thrived as a volunteer, spending countless hours working at
Strawbridge Elementary School, as a member of the Friends of the Virginia Beach Juvenile and
Domestic Relations Court and as Assistant Coordinator for the Virginia Beach Volunteer
Resource Office;
WHEREAS: One of her pet projects was the Children's Corner, an area for
children and their parents to wait for their turn to appear in court. Doris wrote the protocol for
the room and helped raise the funds to furnish it; and
WHEREAS: The Friends plan to name the Children's Corner "The Doris
Hindlin Memorial Children's Corner" in her honor.
NOw, THEREFORE, BE IT RESOLVED: That the Virginia Beach City
Council hereby recognizes the outstanding contributions of Doris Gladys Hindlin during her
selfless life.

TAXI CAB SURCHARGE INCREASE
PUBLIC HEARING
ON A PROPOSED ORDINANCE AUTHORIZING A TEMPORARY
TWENTY-FIVE CENT
GASOLINE SURCHARGE ON EACH TAXI TRIP
At its Formal Session on November 2nd, 2004, at 6:00 PM,
the Virginia Beach City Council will hold a PUBLIC HEARING in
the Council Chamber on the second floor of City Hall on a proposed
ordinance authorizing taxi cab companies to collect a temporary twenty-
five cent gasoline surcharge for each taxi cab trip. This surcharge is
proposed due to increased gasoline prices and will be charged in addition
to the rates authorized by City Code § 36-172. The proposed ordinance
authorizes the surcharge for six months, at which time the City Council
will consider whether to make the surcharge permanent or to authorize
other increases in taxi cab charges.
Interested residents of the City of Virginia Beach may appear at the
above-mentioned time and place to present their views.

ITEM: Project Programming Resolution for the inclusion of the Lesner Bridge
Replacement project into the Virginia Department of Transportation Urban Roadway
Program
MEETING DATE: November 2,2004
. Background: In order for a project to be included in the Virginia Department of
Transportation's (VDOT) Urban Roadway Program, a Project Programming Resolution must be
adopted by City Council. It is the intent of this action to include Lesner Bridge Replacement
project into the Urban Roadway Program to establish State funding for the Project. This project
would be managed by the City of Virginia Beach in accordance with procedures set forth with
the First Cities Initiative enacted in July 2004.
. Considerations: The Lesner Bridge is nearing the end of its useful life and based on
recent bridge inspection reports, needs to be replaced to avoid imposing weight limits which
would adversely affect the quality of life for the residents and merchants along the Shore Drive
Corridor. The City has established a project in the currently approved Capital Improvement
Program (CIP) to perform a location and design study for a replacement bridge (Lesner Bridge
Replacement Study CIP 2-168). The Lesner Bridge Replacement Study will determine the
location and aesthetic features required to construct a signature bridge over the Lynnhaven
Inlet. The need to replace the bridge was also identified in the Shore Drive Transportation
Study, adopted by City Council in June 2002.
. Public Information: Two public meetings were held during the development of the
Shore Drive Transportation Study. At these meetings, citizens were able to ask questions of
City staff and provide comments related to the study. The study was subsequently endorsed by
the Shore Drive Advisory Committee and adopted by City Council in June 2002.
. Alternatives: Do not approve the programming resolution for these projects and delay
the replacement of the Lesner Bridge.
. Recommendations: Approve the project programming resolution and establish this
project in the State Urban Roadway Program.

roadway in the City of Virginia Beach.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE

CITY OF VIRGINIA BEACH, VIRGINIA:

That the City Council of Virginia Beach, Virginia

requests the Virginia Department of Transportation ("VDOT") to
14
establish a project for the replacement of the Lesner Bridge,
15
located on Shore Drive between Vista Circle and East Stratford
16
Road.

2. That the City Council of Virginia Beach hereby
18
agrees to pay its share of the total costs for preliminary
19
engineering, right-of-way, and construction of this project in
accordance with Virginia Code § 33.1-44.
3.
That if the City of Virginia Beach subsequently
elects to cancel this project, the City of Virginia Beach hereby
agrees to reimburse the VDOT for the net amount of the costs
expended by VDOT through the date VDOT is notified of such
cancellation.

Background: The Public Works Specifications and Standards Manual was
adopted by City Council on June 14, 1994 with the provision that all amendments
shall be forwarded to City Council for adoption.

Considerations: Amendment #8 includes a compilation of proposed revisions to
various chapters of the Public Works Specifications and Standards Manual. A
summary of these revisions is attached, which indicate that most of these are
general types of updates to typical sections, specification revisions, etc. The
amendment has been compiled and reviewed by city staff and reviewed and
approved by the Tidewater Builders Association (TBA).

Alternatives: Not adopt the revisions to the Public Works Specifications and
Standards Manual.

Recommendations: Public Works recommends adoption of Amendment #8.

CHAPTER 3
1. Deleted Tables referencing Geometric Standards and MTP Right of Way widths and
made reference to the drawings in the Appendices.
2. Added a requirement for commercial entrances relative to the first internal aisleway or
parking space, to accommodate site traffic.
CHAPTER 6
1. Added requirement for CG-12 handicap ramps to meet the new ADA standard with
truncated domes.

Approve Phase One of the Virginia Beach 19th Street
Corridor Design and Improvements and authorize and
direct the City Manager to undertake necessary and
appropriate measures to implement the same

. Background: The City Council has adopted two oceanfront resort area planning
policy documents that relate to this agenda item. They are the June 28, 1994
Oceanfront Resort Area Concept Plan and the January 27, 2004 Creating an Old
Beach District Center. Together, these resources establish strategic goals and
provide planning and development concepts designed to achieve a high quality
resort destination. In addition, two of the Top Priority Actions cited by City
Council for FY 2004 and 2005 include developing action plans to create a first
class beach resort and creating a more specific 19th Street Corridor plan to help
implement many of the planning concepts cited in the original Old Beach District
Center document.
. Considerations: The $203 Million Virginia Beach Convention Center should be
completed in early 2007. As a complement to this important facility, the city has
identified the general location for improvements to 19th Street and related public
park and streetscape systems between the Convention Center and the
Boardwalk. This element is phase 1 of a more comprehensive design and
improvement plan that is scheduled for completion and council consideration
later this year. It will address design and improvement issues affecting the
surrounding 19th Street Corridor area. The intent of this agenda request item is
to obtain Council approval of Phase 1 of the Virginia Beach 19th Street Corridor
Design and Improvements, as shown on the Exhibit A appended hereto, subject
to such future additions, deletions and modifications that the City Council may
direct.
. Public Information: The City's Planning and Public Works Departments have
hosted a number of well-attended outreach sessions to obtain public input and
comment regarding the Old Beach District Center and 19th Street improvements.
Most notable was an open house session attended by approximately 400 people
held at the Pavilion on January 12, 2004. Another public information session on
this topic attracted about 250 people to the Pavilion on October 20, 2004. A
public hearing before City Council was held on October 26, 2004.
. Recommendations: Approval of Phase 1 of the Virginia Beach 19th Street
Corridor Design and Improvements, as shown on the Exhibit A appended hereto,
subject to such future additions, deletions and modifications that the City Council
may direct.
. Attachments: Exhibit A depicting Phase 1 of the 19th Street Corridor Design and
Improvements plan.

action plans to create a first class beach resort and creating a

more specific 19th Street Corridor plan to help implement many of

the planning concepts cited in the original Old Beach District

Study; and

WHEREAS¡ it is anticipated that the new Virginia Beach
24
Convention Center will be completed in early 2007; and
25
WHEREAS¡ as a complement to the new Convention Center¡
26
the
City has
areas
identified the
general
location of
those
27
considered for initial acquisition for public street improvements
28
and public parks along 19th Street¡ said areas being designated as
29
Phase 1 on the Exhibit A appended hereto;

NOW¡ THEREFORE¡ BE IT RESOLVED BY THE COUNCIL OF THE CITY

OF VIRGINIA BEACH, VIRGINIA:

That the City Council hereby approves Phase 1 of the

Virginia Beach 19th Street Corridor Design and Improvements,
as

shown on the Exhibit A appended hereto,
subject to such future

additions, deletions and modifications that the City Council may

direct.

BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF

Background:
Pursuant to § 2-89 of the City Code, the direct appointees of City Council (i.e., the
City Manager, City Attorney, City Clerk, and City Real Estate Assessor) "shall have
their salaries and benefits determined annually by action of city counciL" Section 2-
89 further provides that "[t]he effective date of such salaries and benefits shall be
determined by the counciL"
.
Considerations:
The attached four (4) ordinances increase the salaries and certain benefits of the
City Manager, City Attorney, City Clerk, and City Real Estate Assessor, with the
salary increases taking effect on their respective anniversary dates.

COMPENSATION OF THE CITY MANAGER
WHEREAS, City Council has evaluated the performance of
the City Manager; and
WHEREAS, based upon this evaluation, City Council has
determined that an increase in the City Manager's compensation would
be appropriate.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF VIRGINIA BEACH, VIRGINIA:
1.
That, effective December 1, 2004, the salary of the
City
Manager
is
hereby
increased
from
$179,368
to
$190,000
annually.
2.
That, effective July 1, 2004, the City's contribution
to
the
City
Manager's
deferred
compensation
plan
is
hereby
increased from $14,000 to $16,000 annually.
3.
That the car allowance of the City Manager is hereby
increased from $10,000 to $12,000 annually.
4.
That, effective September 1, 2004, the City will pay
up to $2,684 annually on behalf of the City Manager in premiums
for long term care insurance.

Elbow Road Phase IIA (CIP 2-065) Fund Transfer

. Background: The Elbow Road Phase IIA project was separated from the CIP 2-152
Elbow Road Phase II project to facilitate advance construction of a two lane roadway connection
between Elbow Road and Princess Anne Road. The project will also provide a traffic signal and
turn lane improvements at the intersection of Elbow Road and Salem Road. The project was
advertised for construction bids during the third quarter of FY 2004/2005. During the past year
the construction bid prices for roadway capital projects have increased an average of 28% over
the engineer's estimate. The increase in the construction costs is due to a combination of
increased material costs, and the higher demand for roadway construction contractors in the
Tidewater area. The increase in construction costs has exceeded the funds available for
construction of Elbow Road Phase IIA (CIP 2-065).
. Considerations: An appropriation is necessary to proceed with construction and
complete the Elbow Road Phase IIA project. Funds are available in the crp 2-152 Elbow Road
Extended Phase II project. The attached ordinance will transfer $1,217,000 from the CIP 2-152
Elbow Road Extended Phase II project to the Elbow Road Phase IIA project.
. Public Information: The project was established and included in the Roadway CIP in
FY 2002/2003. During the design phase, a Citizen Information Meeting was held on August 27,
2003 as well as a project information meeting with the New Castle Homeowner's Association.
. Alternatives: If the ordinance is not approved, the project will be delayed until the next
CIP cycle.
. Recommendations: Approve the Ordinance to transfer funds of $1 ,217,000 from the
crp 2-152 Elbow Road Extended Phase II project to the Elbow Road Phase IIA project (Crp 2-
065) to move forward with the construction and completion of the project.
