City Council had a minute of silent prayer due to the sudden
death of Mr. John Banks, a City employee with the Health Department
and a former First Citizen of Virginia Beach.
The invocation was given by the Reverend Cecil Carroll, Tabernacle
Methodist Church, Virginia Beach, Virginia.
Councilmen present: John A. Baum, Robert H. Callis, Jr., Robert B.
Cromwell, Jr., Vìce Mayor George R. Ferrell, Charles W. Gardner,

City Council adopted the following resolution regarding the Tenth
Anniversary of Virginia Wesleyan College:
RESOLUTION ON THE TENTH ANNIVERSARY
OF
VIRGINIA HESLEYAN COLLEGE
WHEREAS, Hay 10, 1976 marks the tenth anniversary of
Virginia Hesleyan College, founding and locating.in an area
embraced by the Cities of Virginia Beach and Norfolk, Virginia;
and
WHEREAS, Virginia Hesleyan College has provided a means
whereby the youth of t!1C'. area may obtain an education on the
collegiate level in additoLor. to the educational sources formerly
available in the area, and has presented opportunities for study
in nevl fields or educati.Œ\; and
WHEREAS, Virginia \.Jes lf~Yém College has by the development
of a planned program enriched both the esthetic and cultural
environment of the local clìrmnunities, and has provided cncourage-
ment to those T)(~rsons ambitious to improve the quality and extent
of their education; and in ~>O doing have elevated the desirability
of this area as a place :fo!.' future residential development and
industrial-commercial gnYv¡th,
NOW, THEREFORE, BE IT RESOLVED BY THE City Councils of the
Cities of Virginia Beach and Norfolk, Virginia, that their
respective City Clerks enter this Resolution of Appreciation to
Virginia Wesleyan College in the Minutes of the respective City
Councils and provide an original signed by the Mayors and Council-
men of each City to the Honorable Jerry G. Bray, Jr., Chairman of
the Board of Trustees of Virginia Wesleyan College, for presenta-
tion to the College at the conclusion of the tenth academic
session on May 15, 1976.

RESOLUTION OF APPRECIATION
\-1l-lEREAS, ROLAND H. ì>JT~ST, Deputy Clerk of the Circuit Court
of Vi~ginia Beach, formerly Princess Anne County Circuit Court,
has been called to the service of His Maker after long and
honorable service to the public in his capacity as Deputy Circuit
Court Clerk, and in his voluntary service as a member of the
Princess Anne County, em_Hothouse Station of the Volunteer Fire
Department; and
WHEREAS, ROLAND H. \"JEST did aid and assist the Courthouse
Volunteer Fire Department
not only with his active \.<70rk in the
Fire Department, but also by his faithful dedication to the
financial interests of the Department by servicing and maintain-
ing the vending machines Hhich supplies the Fire Department with
much of its financial support.
ROLAND H. HEST was an exemplary
citizen and public employ?'e,
NOW, THEREFORE, the City Council of the City of Virginia
Beach does herein offer U¡j,ô Resolution of Appreciation in his
honor on this Second day of May, 1976, and does direct the City
Clerk to enter said Resollltion in the minutes of the meeting of

Branch of the Princess klne County Volunteer Fire Department,
having rendered meritorious service to his fe11mvman in his
long tenure as a member of the Princess Anne County Volunteer
Fire Departmen t, and in ot:h¿:~:r humanitarian labors to his fe11ow-
man, has noy¡ been called to His Haker; and

the minds of his fellow citizens, properly reflect the dedication

WHEREAS, the City Manager has heretofore submitted to the Council an
Annual Budget for the City for the fiscal year beginning July 1,1976, and
ending June 30, 1977, and it is necessary to appropriate sufficient funds
to cover said budget.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
Section 1.
That the amounts named aggregating ONE HUNDRED FIFTY NINE
MILLION, FOUR lflJNDRED FORTY THREE THOUSAND, ONE HUNDRED THIRTY DOLLARS
($159,443,130) consìsting of THUn'"Y SIX HILLION, EIGHT HUNDRED FORTY FOUR
THOUSAND, SEVEN Hù~DRED TWELVE Den.LARS ($36,844,712) in interfund tran~fers
and ONE mINDRED TWENTY TWO MILLION, FIVE HUNDRED NINETY EIGHT THOUSAND,
FOUR HUNDRED EIGIITEEN DOLLARS ($122,598,418) for operations or so much thereof
as may be necessary as set f(nth in nie Annual Budget for the fiscal year
1976-77, submitted by the City Hanager on the date of March 30, 1976 are

Section 2.
Subject to the provisions of Chapter 2, Article III,
of the Virginia Beach City Code, the salaries and wages set forth in
detail in said Annual Budget, are hereby authorized and fixed as the
maxi~m compensation to be paid for services rendered.
t,~.
The total of positions, shall be the maximum number of positions
authorized for the various departments, bureaus and divisions of the
City during said fiscal year, and the number thereof shall not be
increased during said fiscal year unless authorized by the Council.
The City Manager 'may from time to time increase or decrease the
number of positions in the labor class provided the aggregate amount
expended for such services shall not exceed the respective appropriations
made therefor.
The City Manager is authorized to make such rearrange-
ments of positions within bureaus named herein, as may best meet the
u!~~ .~~ interests of the City.
Section 3.
All collections of delinquent City taxes shall be
credited to the General Fund of the City by the Treasurer.
Section 4.
All collections of local taxes levied shall be credited
to the General Fund of the City.
Transfers shall be made from the General
Fund to the respective specially designated funds for which a levy is
made in the respective amounts levied for each'such specially designated
fund.
Section 5.
All tax abatements and tax supplements dated subsequent
to December 5,1976, for the 1976 tax year shall accrue to the General
Fund of the City.

Section 9.
Allowances out of any of the appropriations made
in this Ordinance by any or all of the City departments, bureaus
or agencies, to àny~f their officers and employees for expenses
on account of the use by such officers and employees of their
personal auto~obiles in the discharge of their official duties
shall not exceed twelv~ cents (l2~) per mile of actual travel.
Section 10.
All traveling expense accounts shall be submitted
on forms and according to regulations prescribed or approved by the
Director of Finance.
Each account shall show the dates expenses
were incurred or paid; number of miles traveled; method of travel;
hotel expenses, meals, incidental expenses such as telegrams,

telephone calls, etc.
The Director of Finance is specifically
directed to withhold the issuance of checks in payment of expense
accounts submitted for "lump-sum" amounts, except in the case of
Council Members and employees of the School Board.

That if any part or parts, section or sections,
sentences, clause or phrase of this Ordinance is for any reason
declared to be unconstitutional or invalid, such decision shall

Pursuant to' the authority of the Charter of the City of Virginia
Beach (Ch. 147), Acts of Assembly of 1962, as amended), and the Public Finance
Act, as amended, there are hereby authorized to be issued Sixteen Million
Dollars ($16,000,000) Public Improvement Bonds of the City of Virginia Beach
to provide funds, together with other funds that may be available, for the
following purposes:

That a certain street located in Lynnhaven Borough,
City of Virginia Beach, as hereinafter described, is hereby closed,
vacated and discontinued as a public street of "the City of Virginia
Beach, said street not being needed for public use and travel:
All that 525 feet, more or less, of what was
formerly First Colonial Road and lying south
of First Colonial High School the width of
that portion of said First Colonial Road sought
to be closed being 100 feet, more or less,
running westwardly from the formerly eastern
boundary of First Colonial Road, as shown
marked in red on Plat of Baldwin and Gregg,
Engineers, Surveyors and Planners, dated
May 1, 1973; and said portion of road proposed
to be closed lies in Lynnhaven Borough of
the City of Virginia Beach. .

A letter was presented by the City Manager listing the bids submitted
by various contractors for the construction of public restrooms and a
mall at 17th Street and Atlantic Avenue. The bids are as follows:

A detailed drawing and sketch was submitted to Council indicating
several amenities included by thc architect to give a higher
aesthetic appearance to the basic restroom purpose of the mall.
Amongst these were some asphalt planters which it was indicated
would cost $l2,000 to $l4,OOO. A discussion by the Council in-
dicated approval of the mall concept. In addition, it was in-
4icated that the design improved the appearance of the beach
area and certainly enhanced the value of the surrounding property.
It was noted that the monetary value of the real property is an
item to be considered should such land require condemnation for
similar malls in another area.
Before voting, Councilman McCoy noted that while he did not object
to the construction of the "relief stations" he felt that in approving
the bid City Council was setting a precedent in that several more will
be required in the future, and the cost per unit was too high.

On May 26, 1971, the City entered into an agreement with Hampton
Roads Sanitation District for the construction of interceptor
force mains in the Courthouse area and other south central areas
of the Ci ty..
HRSD agreed to construct the lines, which have cost $3,525,l86.22,
provided the City would pay 7 1/2% interest, quarterly, not to exceed
$300,000. The terms of the agreement state that HRSD will credit to ,
the City 70% of all revenues collected for ~ewage treatment services
to properties connected to these facilities. The payments by the
District to the City are to terminate after a period of five years,
0 l' when the sum of $ 30 0,000 has been credi ted, ,whi chever occurs
first.
Through December 31, 1975, the City has been billed $l29,456.79 in
interest charges, with an additional $80,000 anticipated for the
period through June 30, 1976, or a total of $209,500. As this money
has not yet been appropriated, City Council voted to approve an
appropriation in the amount of $209,500, from line fees, for the
purpose of making these payments to Hampton Roads Sanitation District.
