Mayor Oberndorf advised her delay in amvmg was the result of a Washington Post reporter
questioning her concerning the exoneration of the Witch of Pungo (Grace Sherwood). The Mayor
advised she had no personal knowledge of this woman. Mayor Oberndoif referenced the article in The
Virginian-Pilot, this morning, July 11, 2006, entitled "Spell as "witch" proclaimed over". This story also
appeared on the CNN News.

PARKS AND RECREATION - Customer Service Survey/Focus Group Results

Cindy Curtis, Director of Parks and Recreation advised the Strategic Planning process commenced
December 2004. Parks and Recreation is conducting a comprehensive evaluation of its system, service
offerings, recreation programming and facility development needs to support the development of a
strategic plan. The strategic plan will identifY a long term vision and strategies to guide the Department
for the next ten (10) years. The majority of the work has been undertaken by Parks and Recreation staff
with assistance from the community and other stakeholders. The results of this survey will be used to
assist in setting goals and determining the priorities of the community, and reevaluating the delivery
systems. Facilities and programs that the community assigned high priorities to are not guaranteed to be
funded or implemented immediately. Ms. Curtis introduced Pete Hangen, Project Manager - Strategic
Planning Process.
Mr. Hangen advised the Strategic Plan is intended to be an open and public comment process. The four
(4) components of the process were detailed: key leadership interviews with City Council and Senior City
Staff, focus groups with Parks and Recreation staff, four (4) public forums at various locations
throughout the City and a Citizen Survey. In November of 2005, surveys were mailed to a random sample
of 2,500 households in the City of Virginia Beach. Approximately three (3) days after the surveys were
mailed, each household that received a survey also received an electronic voice message encouraging
them to complete the survey. The return rate was twenty-one (21%) percent. In addition to requesting
suggestions re programs and facilities, the Department also captured the demographics of the
respondents (age, gender, race, income, years residing in Virginia Beach, planning area and zip code).
The demographics of the survey responders statistically match the demographics of the City of Virginia
Beach.

Of the 72% of respondents that have visited City parks during the past year, 88% rated the physical
condition of all the parks they have visited as either excellent (26%) or good (62%). An additional 11%
of respondents rated the parks as fair, and only 1% rated them as poor. However, a "Best in Class"
organization would have a 50% participation rate in programs. 34% of respondents have participated in
City recreation programs during the past year.

Council Lady McClanan inquired if the citizen's survey included a statement the City would support
activities through taxes. Mr. Hangen advised the actual question No. 14 was: "Whichfour (4) of the items
contained in the list would you be most willing to fund with tax dollars?"
Ms. Curtis advised this community, because of what they have supported through their taxes, rated some
things to be more subsidized than other communities, typically Recreation Centers. This community
appreciates their contribution to the longer term operation of the Recreation Centers. In most
communities, Recreation Centers are expected to cover their expenses by revenue generated internally
versus tax support. Children's recreational programs are definitely a driver in this community, both in
the Before and After School, Camp, Learn to Swim, and Athletic Programs. Parks and Recreation
believes there is a need to increase activities for Seniors. The "Baby Boomers" are much more active
than previous senior populations.
Mayor Oberndorf inquired re bicyclists. One citizen, member of the Bikeways and Trails Advisory
Committee, contributed approximately $36,000 a year for a major bicycle tournament to benefit Cancer.
He has requested the City examine afacility which could be utilizedfor this purpose.

Ms. Curtis advised bikeways and trails are the Number One concern of the City. Currently, there is a
project in the Capital Improvement Program to build a one mile criterion at the Sportsplex for the elite
speed riders. The Bikeways and Trails Advisory Committee is involved in multiple plans to drive forward
improvements for City Council's consideration. These include development of the Back Bay "Stumpy
Greenway", development of 30 and 50-mile loops in Pungo, improved connectivity on current trail
systems. There are 134 miles of developed trails, some of which are off road, but not well connected.
Council Lady Henley referenced the Pungo Loop. This is not trails, but just on the road. Ms. Curtis
advised this has been deemed to have the safest traveling roads without shoulders. Long term, a plan has
been developed which would necessitate $20-MILLION to provide the additional shoulders, which is a
best case scenario. Council Lady Henley advised there are many blind curves in this area. It is not a
matter, if someone gets hurt, but when. Ms. Curtis advised this is a dual responsibility and bicyclists at
this level must remind themselves of their accountability and responsibility to share the road.
In response to Council Lady Wilson, Ms. Curtis advised Parks and Recreation is working with Public
Works on any new road during its design stage and negotiating with them. The Bikeways and Trails
Advisory Committee reviews all new transportation plans for roadways. Parks and Recreation has
agreed with Public Works that wherever possible, there will be a ten (lO)-foot wide asphalt path on both
sides of the road to allow for off road biking.
Council Lady McClanan does not believe there should be a road in this City that is not built with some
means of providing for bicycles.
Councilman DeSteph advised he is an avid bicyclist and recommended a separate brief be developed by
Parks and Recreation for City Council concerning the plan.
Councilman Villanueva advised this Summer his company and two (2) of his sister companies are renting
a school facility. There are approximately eighty (80) schools with gymnasiums and this would make an
excellent revenue stream for wellness programs. Ms. Curtis advised Parks and Recreation utilizes sixty-
three (63) school sites offering camp programs; however, in the evening and weekends schools are
available.
Ms. Curtis advised the ownership group of the Mariners has approached the City regarding interest of
the 60 to 80 acres next to the Sportsplex, which has not been developed. A study is currently being
developed in terms of the financial efficacy of a public-private partnership for a long term lease of that
property to develop additional athletic facilities that would support soccer, as a business and soccer for
the community, as well as other multi-purpose use fields. A Briefing will be scheduled during a September
City Council Session relative this activity.

week. Delegate Welch, a number of School Board Members, as well as members of the Restaurant
Association and Minority Business Council attended. The purpose of the Task Force is not to roll back
the Meals Tax or interfere with the tax revenues. The session was very productive.

The City Manager introduced Captain Dennis E. Free, Commanding Officer of the Second Precinct and
Deputy Chief Gregory G. Mullen, Police Operations Division, who were in attendance to respond to City
Council concerns regarding the Midnight Closing of the Municipal Parking Lots during the July Fourth
weekend.
Deputy Chief Mullen advised crowds and their management have always been a concern at the
Oceanfront in the City's continued effort to develop and keep the Oceanfront a family friendly resort.
This is an evolving challenge and requires constant attention.
Regulatory Oceanfront initiatives encompass: noise enforcement, cuifew violations, cruising ordinance,
residential parking, towing enforcement and common nuisance.

Increasing Calls for Service (Percentage) 2005 vs. 2006 and Calls for Service by District.. Said
information is hereby made a part of the record. Between 10:00 P.M. and 2:00 P.M. is the busiest time
for the Officers at the Oceanfront concerning a yearly comparison, the Second Precinct calls for service
have increased 7%, while the other Precincts have only increased 3% and 4%.Calls for service in the
Oceanfront always spike.
Deputy Chief Mullen displayed data concerning "Fight Calls"
The Beachfront contributes about 16% of the calls for service over fights.
Department of Justice (DOJ) studies indicated that large number of ABC venues
contribute to high numbers of fights

At the present time, during the Summer, ninety-four (94) Police Officers are utilized.
Mike Eason. Resort Programs Administrator, Convention and Visitors Bureau, advised events which sell
alcohol, such as the American Music Festival cannot go past 11 :00 P.M.. A "last call" is usually
issued around 10:30 P.M. There is also a limit on the number of events serving alcohol. A Committee,
comprised ofrepresentatives of the Restaurant, Hotel/Motel Association, review these events. At the
present time, there were only thirty-seven (37) alcohol events.

The predominate age of the offenders (comprising approximately 60% of all encounters) at the
Oceanfront are between eighteen (18) and twenty-five (25) years.
Deputy Chief Mullen advised a comparison of other municipalities re parking was reviewed. Arlington
County and Alexandria have a Resort Parking Permit system; however, their problems are 180%
opposite from Virginia Beach (their parking problems arise during the day, not evening). Ocean City has
one large parking lot with a substantial transportation system. moving up and down their main corridor.
Their main corridor is a main street, and the majority of their bars and restaurants are facing the ocean.
Myrtle Beach does not have any particular parking restrictions. All of their parking is on-street (meters).
Norfolk has 18,000 parking spaces, but has various times lots are required to be closed (depending on
location, times and events occurring).
Virginia Beach has the largest number of bars per capita than any other jurisdiction in the
Commonwealth. In 2004, there were 19,900 ABC establishments in Virginia, with over 800 in Virginia
Beach.

At last count, there were 76 establishments authorized to distribute
alcoholic beverages at the Oceanfront.

Deputy Chief Mullen outlined the Bar Mitigation strategies.
Recommendations
Develop standards for new construction that considers crime prevention
aspects
Require CPTED principles be considered in all new development in the
Resort
Provide a Crime Prevention Specialist a seat at the table on RAC as an
advisor for future issues
Continue lighting upgrades at the Resort
Ensure land use policies and zoning changes support vision of the Resort
Seek legislative changes to ABC enforcement and administration
Approve a conditional use permit for bars and nightclubs in the Resort
area
Develop a strategic plan for the Resort and use the plan as a filter for
future decisions and approvals.
Councilman DeSteph suggested the formation of a Task Force.
Deputy Chief Mullen suggested Master Police Office Jeff Eaton as the Crime Prevention Specialist
representative of the Resort Advisory Commission (Planning, Design and Review Subcommittee)
The Closing of the Municipal Parking Lots shall be discussed during the City Council Retreat of August
11 and 12, 2006. Representatives of the Resort Advisory Commission might also be invited to attend.

Ordinance to require certain disclosures regarding recreational areas to
prospective purchasers of property in the Princess Anneffransition
Area
Council Lady Henley wished the Ordinance be reviewed by City Council and scheduled for a future City
Council Session.
Council Lady Henley expressed concern relative approved Transition area applications. Council Lady
Henley wished to make certain the areas open to the public are open to the public in the manner
presented by the applicants. The system of trails has been the primary usage in stating advantage to the
public. As the system of trails map is developed within the City, these trails available to the public (as a
part of each of the approved Transition area developments) are also included. Location and connectivity
are important aspects.
"Prior to the acceptance of a real estate purchase contract, the owner
of any residential real property described in subsection (a) shall
furnish to a prospective purchaser, either in the real estate purchase
contract, in an addendum thereto, or in a separate document, a
disclosure that:
"Open space and other recreational areas in the subdivision are open
to, and available for use by, members of the general public without
regard to ownership of property within the subdivision; and, the
property owner's association or equivalent entity is responsible for
maintaining liability insurance against losses occurring to persons
using the open space or other recreational areas within the
subdivision. "
Council Lady Henley advised the only application, she has determined to provide any type of disclosure
was "Victoria Park". One of the conditions indicated the open space areas shall be public and
appropriately noted on each plat. It is very important that the purchasers of property in the Transition
area developments understand at the time of purchase, these areas are going to be open and utilized by
the public, even though owned and maintained by the Homeowners' Association. Council Lady Henley
wished this to apply to all sales of the properties, not just the initial sale.
Council Lady Wilson requested the City Attorney review the issue and determine the type of
documentation in place (i.e. Homeowners or Condo Associations disclosures)

and local officials and over one hundred (100) business leaders were in attendance. Councilman
DeSteph extended appreciation to Economic Development and all involved for this momentous event

22 article.

AN ORDINANCE GRANTING A FRANCHISE
AGREEMENT FOR AN OPEN AIR CAFE IN
THE RESORT AREA TO ATLANTIC
BISTRO, LLC t/a RIBLEY'S

WHEREAS, by resolution adopted November 15, 1985, City
6 Council authorized the City Manager to promulgate Open Air Cafe
7 Regulations, which have been amended from time to time, for the
8 operation of open air cafes on public property; and
9
WHEREAS, the City has developed a franchise agreement for
10 the regulation of open air cafes, which the above-listed grantee
11 will be required to execute as a condition of the grant; and
12 WHEREAS, the City Council has traditionally granted initial
13 franchises for one-year terms; and
14
WHEREAS, if an open air cafe is successfully operated
15 during the initial one-year term, the franchisee is given the
16 option of entering into a five-year franchise agreement; and
17
WHEREAS, Atlantic Bistro, LLC t/a Ribley's is seeking a
18 one-year franchise agreement; and
19
WHEREAS, the Virginia Beach Convention and Visitors Bureau
20 has reviewed the application and determined that the proposed
21 cafe will have no detrimental effect on the public health,
22 safety, welfare, or interest, and will enhance the festive
23 atmosphere of the Resort Area.

WHEREAS, the Convention and Visitors Bureau recommends that

Atlantic Bistro,
LLC,
t/a Ribley's be granted a one-year
28 franchise agreement.

AN ORDINANCE TO DESIGNATE ST.
GREGORY THE GREAT CATHOLIC CHURCH AS
BEING EXEMPT FROM LOCAL REAL AND
PERSONAL PROPERTY TAXATION

WHEREAS, in accordance with ~ 58.1-3651 of the Code of
7 Virginia, the Council of the City of Virginia Beach has advertised
8 and conducted a public hearing on the issue of granting an
9 exemption from local property taxes to St. Gregory the Great
10 Catholic Church.
11 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
12 VIRGINIA BEACH, VIRGINIA:
13
1.
That the Council of the City of Virginia Beach, Virginia,
14 hereby designates St. Gregory the Great Catholic Church as a
15 charitable organization within the context of 5 6(a) (6) of Article
16 X of the Constitution of Virginia.

2 .
That real and personal property owned by St. Gregory the
18 Great Catholic Church located wi thin the City of Virginia Beach
19 that is used exclusively for charitable purposes on a nonprofit
20 basis is hereby exempt from local property taxation.

3.
This exemption is contingent on the following:
22
(a)
continued use of the property by St. Gregory the
23
Great Catholic Church for exclusively charitable
24
purposes;
25
(b)
that each July 1, St. Gregory the Great Catholic
26
Church shall file with the Commissioner of the
27
Revenue a copy of its most recent federal income
28
tax return, or, if no such return is required, it
29
shall certify its continuing tax exempt status to
30
the Commissioner of the Revenue; and
31
(c) That every three years, beginning on July 1, 2009,
32
St. Gregory the Great Catholic Church shall file
33
with the Commissioner of the Revenue an application
34
for continuation of the exemption.
35
That the effective date of this exemption shall be July
4.
36 1, 2006.
37 Adoption requires an affirmative vote of three-fourths of the
38 members of the Ci ty Council.

WHEREAS, in the opinion of the Council of the City of Virginia
10 Beach, Virginia, a public necessity exists for the construction of
11 this important roadway project to reduce traffic congestion and
12 improve transportation within the City and for other related public
13 purposes for the preservation of the safety, health, peace, good
14 order, comfort, convenience, and for the welfare of the people in

Ordinance to A UTHORIZE a temporary encroachment into City
property to LITCHFIELD MANOR PHASE 2 HOMEOWNER'S
ASSOCIATION, INC. to maintain a flag pole, electrical conduit, brick
wall with neighborhood identification sign and lighting at Litchfield Way
and Holland Road
The following conditions shall be required:
1. The Temporary Encroachment shall be constructed and maintained in accordance with the laws of
the Commonwealth of Virginia and the City of Virginia Beach, and in accordance with the City's
specifications and approval.
2. The Temporary Encroachment herein authorized terminates upon notice by the City to the applicant,
and that within thirty (30) days after the notice is given, the Temporary Encroachment must be
removed from the Encroachment Area by the applicant; and that the applicant will bear all costs and
expenses of such removal.
3. The applicant shall indemnifY and hold harmless the City, its agents and employees, from and against
all claims, damages, losses and expenses including reasonable attorney's fees in case it shall be
necessary to file or defend an action arising out of the location or existence of the Temporary
Encroachment.
4. Nothing herein contained shall be construed to enlarge the permission and authority to permit the
maintenance or construction of any encroachment other than that specified herein and to the limited
extent specified herein, nor to permit the maintenance and construction of any encroachment by
anyone other than the applicant.
5. The applicant agrees to maintain the Temporary Encroachment so as not to become unsightly or a
hazard.
6. The applicant must submit and have approved a traffic control plan before commencing work in the
Encroachment Area.
7. The applicant agrees that no open cut of the public roadway will be allowed except under extreme
circumstances. Requests for exceptions must be submitted to the Highway Operations Division,
Department of Public Works, for final approval.
8. The applicant must obtain a permit from the Office of Development Services Center/Planning
Department prior to commencing any construction within the Encroachment Area.
9. Prior to issuance of a right-of way permit, the applicant must post a bond or other security, in
accordance with their engineer's cost estimate to the Office of Planning Department.

10. The applicant must obtain and keep in force all-risk property insurance and general liability or such
insurance as is deemed necessary by the City, and all insurance policies must name the City as
additional named insured or loss payee, as applicable. The applicant also agrees to carry
comprehensive general liability insurance in an amount not less than $500,000.00 combined single
limits of such insurance policy or policies. The applicant will provide endorsements providing at least
thirty (30) days written notice to the City prior to the cancellation or termination of, or material
change to, any of the insurance policies. The applicant assumes all responsibilities and liabilities,
vested or contingent, with relation to the Temporary Encroachment.
11. The City, upon revocation of such authority and permission so granted, may remove the Temporary
Encroachment and charge the cost thereof to the applicant, and collect the cost in any manner
provided by law for the collection of local or state taxes; may require the applicant to remove the
Temporary Encroachment; and pending such removal, the City may charge the applicant for the use
of the Encroachment Area, the equivalent of what would be the real property tax upon the land so
occupied if it were owned by the applicant; and if such removal shall not be made within the time
ordered hereinabove by this Agreement, the City may impose a penalty in the sum of One Hundred
Dollars ($100.00) per day for each and every day that the Temporary Encroachment is allowed to
continue thereafter, and may collect such compensation and penalties in any manner provided by law
for the collection of local or state taxes.

permission to use the Encroachment Area for the purpose of maintaining the Temporary
Encroachment.

approved a traffic control plan before commencing work in the Encroachment Area.
It is further expressly understood and agreed that the Grantee agrees that no open cut of
the public roadway will be allowed except under extreme circumstances. Requests for exceptions
must be submitted to the Highway Operations Division, Department of Public Works, for final
approval.
It is further expressly understood and agreed that the Grantee must obtain a permit
from the Office of Development Services Center/Planning Department prior to commencing any
construction within the Encroachment Area.
It is further expressly understood and agreed that prior to issuance of a right of way
permit, the Grantee must post a bond or other security, in accordance with their engineer's cost
estimate, with the Office of Development Services Center/Planning Department.
It is further expressly understood and agreed that the Grantee must obtain and keep in
force all-risk property insurance and general liability or such insurance as is deemed necessary by
the City, and all insurance policies must name the City as additional named insured or loss payee, as
applicable. The Grantee also agrees to carry comprehensive general liability insurance in an amount
not less than $500,000.00, combined single limits of such insurance policy or policies. The Grantee
will provide endorsements providing at least thirty (30) days written notice to the City prior to the
cancellation or termination of, or material change to, any of the insurance policies. The Grantee
assumes all responsibilities and liabilities, vested or contingent, with relation to the Temporary
Encroachment.
It is further expressly understood and agreed that the City, upon revocation of such
authority and permission so granted, may remove the Temporary Encroachment and charge the cost

thereof to the Grantee, and collect the cost in any manner provided by law for the collection ()flocal
or state taxes; may require the Grantee to remove the Temporary Encroachment; and pending such
removal, the City may charge the Grantee for the use of the Encroachment Area, the equivalent of
what would be the real property tax upon the land so occupied if it were owned by the Grantee; and
if such removal shall not be made within the time ordered hereinabove by this Agreement, the City
may impose a penalty in the sum of One Hundred Dollars ($100.00) per day for each and every day
that the Temporary Encroachment is allowed to continue thereafter, and may collect such
compensation and penalties in any manner provided by law for the collection oflocal or state taxes.

1. The skateboard ramp shall be located and constructed in substantial compliance with the

3. To reduce the level of sound emanating from the ramp when in use, the following shall be utilized
in the construction of the ramp: (a) the underside of the plywood beneath the skating surface

shall be installed between the plywood and the skating surface of the ramp.
4. A chain shall be secured across the ramp when the ramp is not in use such that the ramp cannot

6. The applicant shall enforce the rules submitted with the application regarding use of the ramp.
The Zoning Administrator shall annually evaluate whether the rules have been enforced and the
conditions above have been adhered to. If the evaluation reveals that the rules and conditions are
being met, the use permit shall be renewed for an additional year, with an annual evaluation
thereafter. If the evaluation reveals that the rules and conditions are not being met, the Zoning
Administrator shall refer the use permit to the City Council for revocation.

Attorney Stephen D. Lentz, Esquire, Lentz, Stepanovich and Bergethon, Attorneys and Counselors at
Law, Phone: 498-7035, represented the applicant and also Trusteefor the Church. Attorney Lentz
advised WA VE Church is seeking approval for a comprehensive Master Plan of a Church that has
been in continuous uninterrupted service to Virginia Beach since 1954. The congregation experienced
an increase in membership from several hundred to several thousand, primarily due to a change from a
traditional format to a contemporary expression offaith. On Easter Sunday, WAVE Church rented the
Convention Center and over 6,000 attended the services. In 1995, the Church purchased this property.
The Church is requesting approval of a phased master plan, beginning with construction of Phase I a
small multi purpose building which will occur approximately 2009, eventually dedicated as the Youth
Center. There will be a school presence during the week. The future phases to develop over the next
decade will depend upon continued growth of the corridor and attendance. A vacant field will be
transformed into a beautiful neighborhood park. The plan will encompass 61% open space. Expansive
and mature landscaping will be placed on the property to include an agreement to install a 3 to 4-foot
high 25-foot undulating and meandering berm. The applicant will dedicate 30-feet along Seaboard
Road for the widening of the road. Deceleration and acceleration lanes to be included.

Princess Anne Raod between General Booth and the Municipal Center is already congested and is
destined to remain a two-lane rural road. Seaboard is a two-lane widening road between these two
areas. The amount of traffic has increased 42% over the last four (4) years.

azr.
7. The applicant shall install a twenty-five (25)-foot landscaped buffer along all property lines.

the City of Virginia Beach, Virginia, by petition addressed to the Grantee so as to change the
Zoning Classification of a 0.387 acre portion of the Property as described in Exhibit "B",
from A-12 Apartment District to Conditional RT -3 Resort Tourist District; and
WHEREAS, the Grantee's policy is to provide only for the orderly development of
land for various purposes through zoning and other land development legislation; and
WHEREAS, the Grantor acknowledges that competing and sometimes incompatible
uses conflict and that in order to permit differing uses on and in the area of the Property and
at the same time to recognize the effects of change, and the need for various types of uses,
certain reasonable conditions governing the use of the Property for the protection of the
community that are not generally applicable to land similarly zoned are needed to cope with
the situation to which the Grantor's rezoning application gives rise; and

WHEREAS, the Grantor has voluntarily proffered, in writing, in advance of and prior
to the public hearing before the Grantee, as a part of the proposed amendment to the
Zoning Map, in addition to the regulations provided for the RT-3 Zoning District by the
existing overall Zoning Ordinance, the following reasonable conditions related to the
physical development, operation, and use of a portion of the Property being recorded to be
adopted as a part of said amendment to the Zoning Map relative and applicable to the
Property, which has a reasonable relation to the rezoning and the need for which is
generated by the rezoning.
NOW, THEREFORE, the Grantor, for itself, its successors, personal representatives,
assigns, grantee, and other successors in title or interest, voluntarily and without any
requirement by or exaction from the Grantee or its governing body and without any element
of compulsion or quid pro quo for zoning, rezoning, site plan, building permit, or
subdivision approval, hereby make the following declaration of conditions and restrictions
which shall restrict and govern the physical development, operation, and use of the portion
of the Property being rezoned and hereby covenants and agrees that this declaration shall
constitute covenants running with the Property, which shall be binding upon the Property
and upon all parties and persons claiming under or through the Grantor, its successors,
personal representatives, assigns, grantee, and other successors in interest or title:
1. If that portion of the Property depicted and designated as "PROPOSED RT 3,
0.387 AC." on that "REZONING SITE PLAN" dated February 1, 2006, prepared by Pinnacle
Group Engineering, Inc., which has been exhibited to the Virginia Beach City Council and is
on file with the Virginia Beach Department of Planning is ever redeveloped for a multi-
family residential use, the density shall be restricted to a maximum calculation of twelve
(12) units per acre.
2. The minimum setback from Pinewood Road for any structure on the portion
ofthe Property zoned RT-3 shall be fifteen feet (15').
The above condit~ons, having been proffered by the Grantor and allowed and
accepted by the Grantee as part of the amendment to the Zoning Ordinance, shall continue
in full force and effect until a subsequent amendment changes the zoning of the Property
and specifically repeals such conditions. Such conditions shall continue despite a
subsequent amendment to the Zoning Ordinance even if the subsequent amendment is part
of a comprehensive implementation of a new or substantially revised Zoning Ordinance
until specifically repealed. The conditions, however, may be repealed, amended, or varied

by written instrument recorded in the Clerk's Office of the Circuit Court of the City of
Virginia Beach, Virginia, and executed by the record owner of the Property at the time of
recordation of such instrument, provided that said instrument is consented to by the
Grantee in writing as evidenced by a certified copy of an ordinance or a resolution adopted
by the governing body of the Grantee, after a public hearing before the Grantee which was
advertised pursuant to the provisions of Section 15.2-2204 of the Code of Virginia, 1950, as
amended. Said ordinance or resolution shall be recorded along with said instrument as
conclusive evidence of such consent, and if not so recorded, said instrument shall be void.
The Grantor covenants and agrees that:
(1) The Zoning Administrator of the City of Virginia Beach, Virginia, shall be
vested with all necessary authority, on behalf of the governing body of the City of Virginia
Beach, Virginia, to administer and enforce the foregoing conditions and restrictions,
including the authority (a) to order, in writing, that any noncompliance with such
conditions be remedied; and (b) to bring legal action or suit to insure compliance with such
conditions, including mandatory or prohibitory injunction, abatement, damages, or other
appropriate action, suit, or proceeding;
(2) The failure to meet all conditions and restrictions shall constitute cause to
deny the issuance of any of the required building or occupancy permits as may be
appropriate;
(3) If aggrieved by any decision of the Zoning Administrator, made pursuant to
these provisions, the Grantor shall petition the governing body for the review thereof prior
to instituting proceedings in court; and
(4) The Zoning Map may show by an appropriate symbol on the map the
existence of conditions attaching to the zoning of the Property, and the ordinances and the
conditions may be made readily available and accessible for public inspection in the office of
the Zoning Administrator and in the Planning Department, and they shall be recorded in
the Clerk's Office of the Circuit Court of the City of Virginia Beach, Virginia, and indexed in
the name of the Grantor and the Grantee.

INCREASING CIVIL PENALTIES FOR CERTAIN
VIOLATIONS OF THE CITY ZONING ORDINANCE

WHEREAS, the public necessity, convenience, general welfare
12 and good zoning practice so require;
13 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VIRGINIA
14 BEACH, VIRGINIA:

That Section 104 of the City Zoning Ordinance is hereby
16 amended and reordained, to read as follows:
17 ARTICLE 1. GENERAL PROVISIONS.
18 Sec. 104. Violations and penalties.
19 ~ Except uo oet forth in Section 217 of thio ordinunce as
20 provided in subsection (b), any person who violates any of the
21 provisions of this ordinance shall, upon conviction thereof, be
22 guilty of a misdemeanor punishable by a fine of not less than ten
23 dollars ($10.00) nor more than one thousand dollars ($1,000.00). If
24 the violation is uncorrected at the time of the conviction, the
25 court shall order the violator to abate or remedy the violation in
26 compliance with this ordinance, within a time period established by
27 the court. Failure to remove or abate a violation within the
28 specified time period shall constitute a separate misdemeanor
29 offense punishable by a fine of not less than ten dollars ($10.00)
30 nor more than one thousand dollars ($1,000.00) and any such failure
31 during any succeeding ten-day period shall constitute a separate
32 misdemeanor offense for each ten-day period punishable by a fine of
33 not less than one hundred dollars ($100.00) nor more than one
34 thousand five hundred dollars ($1,500.00).
35 (b) Any person who violates any provision of Part B of
36 Article 2 hereof or section 203(d) or 205 shall be assessed a civil
37 penalty in the amount of two hundred dollars ($200.00) for the
38 initial summons and not more than five hundred dollars ($500.00)
39 for each additional summons. The assessment of a civil penalty
40 shall not preclude the institution of a civil action by the zoning
41 administrator pursuant to section 103(a) of this ordinance, but no
42 such violation shall, unless it results in injury to any person, be
43 prosecuted as a criminal misdemeanor.
44 ~ The zoning administrator or his or her designee may issue
45 a civil summons as provided by law for a violation. Any person
46 summoned or issued a ticket for a violation may make an appearance
47 in person or in writing by mail to the city treasurer prior to the
48 date fixed for trial in court. Any person so appearing may enter a
49 waiver of trial, admit liability, and pay the civil penalty
50 established for the offense charged. Such persons shall be informed
51 of their right to stand trial and that a signature to an admission
52 of liability will have the same force and effect as a judgment of
53 court. If a person charged with a scheduled violation does not
54 elect to enter a waiver of trial and admit liability, the violation

55 shall be tried in the general district court in the same manner and
56 with the same right of appeal as provided by law. In any trial for
57 a violation, it shall be the burden of the zoning administrator or
58 his or her designee to show the liability of the violator by a
59 preponderance of the evidence. An admission of liability or finding
60 of liability shall not be a criminal conviction for any purpose.

(d) Each day during which the violation is found to have
62 existed shall constitute a separate offense. However, specified
63 violations arising from the same operative set of facts shall not
64 be charged more frequently than once in any ten-day period, and a
65 series of specified violations arising from the same operative set
66 of facts shall not result in civil penalties which exceed a total
67 of five thousand dollars ($5,000.00).

~ This section shall not apply to (i) activities related to
69 land development; (ii) violations of sections 215 and 216 of this
70 ordinance; (iii) violations relating to the posting of signs on
71 public property or public rights-of-way; or (iv) violations

Ivy Daniels, 2901 Bald Eagle Bend, Phone: 368-2010, spoke relative vandalism on behalf of children and
their parents in the Holland Pines West neighborhood. Mr. Daniels requested mediation. The City
Manager has been conferring with Mr. Daniels to develop solutions. Councilman Dyer suggested Mr.
and Mrs. Daniels attend the Police Precinct meeting with the Citizens Advisory Group, and
representatives of the City at Kellam High School. Normally this meeting is on the first Tuesday of the
month; however, due to July lh, the CAC is meeting tonight..
Leona Shuler, 2448 Rose Hall Drive,.Phone: 481-5371, President of Trantwood Lake Corporation,
provided an update concerning the Lake Trant Dredging project. Mrs. Shuler provided an analysis
of the proposed corrective action plan submitted by the City to the Department of Environmental
quality This plan falls far short of the expectations of the residents of Lake Trant. Said information
is hereby made a part of the record.
Herb Jones, 2313 Sandpiper, Phone: 721-1103, submitted petitions containing over 750 signatures to
each member of City Council requesting Reconsideration of the Ordinance upon application of LBH,
LLC (Sherwood Lakes) for a Conditional Change of Zoning (Approved: June 13, 2006). The vote was
8-3. Council Lady Henley advised as she is filling the seat (Princess Anne District) of the
former Council Member who voted on the prevailing side, could she address the reconsideration. The
City Attorney advised this was discussed within his office but determined the vote could not go with the
"seat n.
Joe Ferrara, 209 Cheltenham Drive, Phone: 498-0650, resident of the APZ1, and requested the Open
Mike Policy be re-examined and this Dialogue be televised on Channel 48.
