WHEREAS: The Virginia Beach City Council convened into CLOSED SESSION,
pursuant to the affirmative vote recorded here and in accordance with the provisions of The
Virginia Freedom of Information Act; and,
WHEREAS: Section 2.2-3712 of the Code of Virginia requires a certification by the

CITY OF VIRGINIA BEACH
The City Council of Virginia Beach. Virginia at its for-
mal session on February 6, 2007, at 6:00 P.M.,
will consider an ordinance to make changes to the
boundary lines and/or polling locations for the Seatack,
Glenwood and Courthouse Precincts.
The ordinance proposes that the Seatack Precinct poll-
ing place be moved from Seatack Community Recre-
ation Center at 141 S. Birdneck Road to Mt. Olive Bap-
tist Church at 310 N. Birdneck Road; the Glenwood
Precinct be divided forming a new Hillcrest Precinct and
placing voters in the new polling location at Victory Bap-
tist Church at 4125 Indian River Road; the Courthouse
Precinct be divided forming a new North Landing Pre-
cinct and placing voters in the new polling location at
Union Mission Ministries, Hope Haven at 3000 North
Landing Road.
After adoption by City Council, these changes will
become effective following approval by the United States
Department of Justice, pursuant to the Voting Rights Act
of 1965, as amended. Descriptions and maps of the
precinct boundaries and polling place changes, as well
as a copy of the aforesaid ordinance, may be inspected
in the Voter Registrar's Office, which is located at 2449
Princess Anne Road, Municipal Center, Building 14, Vir-
ginia Beach, Virginia, 23456.
The Public Hearing will be conducted in the City Coun-
cil Chamber of the Administration Building (Building #1)
at the Municipal Center. If you are physically disabled

ITEM: An Ordinance to Amend and Reordain Section 10-1 of the City
Code by Adding Two Precincts and Moving One Polling
Location
MEETING DATE: February 6, 2007
■ Background: The Virginia Beach Electoral Board voted on November 29, 2006
and January 16, 2007 to create two new precincts and move one polling location. Growth
and development in the City along with DMV voter registration opportunities have
increased the size of the Glenwood and Courthouse Precincts near the precinct limit set
by law and they necessarily need to be split. As a result, Hillcrest and North Landing
Precincts will be created. The necessary location change to the Seatack Precinct was at
the request of the Seatack Recreation Center.
■ Considerations: All of the locations in this list do meet requirements of the
Americans with Disabilities Act. These changes will become effective upon approval by
the U.S. Department of Justice pursuant to the Voting Rights Act of 1965, as amended
beginning with the tentative June 12, 2007 Party Primary Election.
■ Public Information: As required by Section 24.2-306 of the Code of Virginia
notice of this proposed change was published in the newspaper once a week for two
consecutive weeks. All voters in the precinct will receive new voter cards with the name
and address of the new polling location. An advertisement will be placed in the
newspaper prior to the tentative Party Primary Election to be held June 12, 2007
and/or General Election to be held on November 6, 2007.

The Seatack Precinct polling location currently located at Seatack Community
Recreation Center will be moved to Mount Olive Baptist Church located at 310
N. Birdneck Road. This move is at the request of the current polling location.
Map B — Glenwood Precinct
The Glenwood Precinct must be divided due to increased number of registered
voters. An additional polling location at Victory Baptist Church located at 4125
Indian River Road has been secured for the new Hillcrest Precinct and precinct
lines will be adjusted accordingly.

MEETING DATE: February 6, 2007
■ Background:
Michael T. Dunham and Patricia B. Dunham have requested permission to
construct and maintain a retaining wall and two (2) piers in a portion of the City's
right of way known as Lynnhaven Promenade (a paper street), located at the rear
of 2078 Tazewell Road, Virginia Beach, Virginia.
■ Considerations:
City Staff has reviewed the requested encroachments and has recommended
approval of same, subject to certain conditions outlined in the Agreement.
Several adjacent property owners have similar encroachments and permits
approved by the City of Virginia Beach.
■ Public Information:
Advertisement of City Council Agenda
■ Alternatives:
Approve the encroachments as presented, deny the encroachments, or add
conditions as desired by Council.
■ Recommendations:
Approve the request subject to the terms and conditions of the Agreement.

11 WHEREAS, Michael T. Dunham and Patricia B. Dunham desire to
12 construct and maintain a retaining wall and two (2) piers within a
13 portion of the City's right of way known as Lynnhaven Promenade (a
14 paper street).
15 WHEREAS, City Council is authorized pursuant to §§ 15.2-2009
16 and 15.2-2107, Code of Virginia, 1950, as amended, to authorize
17 temporary encroachments upon the City's right of way subject to
18 such terms and conditions as Council may prescribe.

33 in the Agreement between the City of Virginia Beach and Michael T.
34 Dunham and Patricia B. Dunham (the "Agreement"), which is attached
35 hereto and incorporated by reference; and
36 BE IT FURTHER ORDAINED, that the City Manager or his
37 authorized designee is hereby authorized to execute the Agreement;
38 and
39 BE IT FURTHER ORDAINED, that this Ordinance shall not be in
40 effect until such time as Michael T. Dunham and Patricia B. Dunham
41 and the City Manager or his authorized designee execute the

THIS AGREEMENT, made this day of December, 2006, by and between
the CITY OF VIRGINIA BEACH, VIRGINIA, a municipal corporation of the Commonwealth
of Virginia, Grantor, "City", and MICHAEL T. DUNHAM and PATRICIA B. DUNHAM,
and THEIR HEIRS, ASSIGNS AND SUCCESSORS IN TITLE, "Grantee", even though more
than one.
WITNESSETH:
WHEREAS, the Grantee is the owner of that certain lot, tract, or parcel of land
designated and described as "# 2078" as shown on that certain plat entitled, "EXHIBIT `B"
PLAT OF CRAB CREEK CONDOMINIUM" dated January 28, 1987 and said plat is recorded
in the Clerk's Office of the Circuit Court in the City of Virginia Beach, Virginia in Map Book
2633 at Page 0416, and being further designated, known, and described as 2078 Tazewell Road,
Virginia Beach, Virginia 23455;
WHEREAS, it is proposed by the Grantee to construct and maintain a retaining
wall and two (2) piers, the "Temporary Encroachment", in the City of Virginia Beach;
WHEREAS, in constructing and maintaining the Temporary Encroachment, it is
necessary that the Grantee encroach into a portion of an existing City right of way known as
Lynnhaven Promenade (a paper street), the "Encroachment Area"; and
WHEREAS, the Grantee has requested that the City permit the Temporary
Encroachment within the Encroachment Area.
LYNNHAVEN PROMENADE (A PAPER STREET) (CITY RIGHT OF WAY - NO GPIN REQUIRED)

NOW, THEREFORE, for and in consideration of the premises and of the benefits
accruing or to accrue to the Grantee and for the further consideration of One Dollar ($1.00), in
hand paid to the City, receipt of which is hereby acknowledged, the City hereby grants to the
Grantee permission to use the Encroachment Area for the purpose of constructing and
maintaining the Temporary Encroachment.
It is expressly understood and agreed that the Temporary Encroachment will be
constructed and maintained in accordance with the laws of the Commonwealth of Virginia and
the City of Virginia Beach, and in accordance with the City's specifications and approval and is
more particularly described as follows, to wit:
A Temporary Encroachment into the Encroachment Area as shown
on that certain plat entitled: "PROPOSED ENCROACHMENTS
FOR PIERS & RETAINING WALL FOR MIKE DUNHAM," a
copy of which is attached hereto as Exhibit "A" and to which
reference is made for a more particular description.
Providing however, nothing herein shall prohibit the City from immediately
removing, or ordering the Grantee to remove, all or any part of the Temporary Encroachment
from the Encroachment Area in the event of an emergency or public necessity, and Grantee shall
bear all costs and expenses of such removal.
It is further expressly understood and agreed that the Temporary Encroachment
herein authorized terminates upon notice by the City to the Grantee, and that within thirty (30)
days after the notice is given, the Temporary Encroachment must be removed from the
Encroachment Area by the Grantee; and that the Grantee will bear all costs and expenses of such
removal.
It is further expressly understood and agreed that the Grantee shall indemnify and
hold harmless the City, its agents and employees, from and against all claims, damages, losses

and expenses, including reasonable attorney's fees, in case it shall be necessary to file or defend
an action arising out of the construction, location or existence of the Temporary Encroachment.
It is further expressly understood and agreed that nothing herein contained shall
be construed to enlarge the permission and authority to permit the maintenance or construction of
any encroachment other than that specified herein and to the limited extent specified herein, nor
to permit the maintenance and construction of any encroachment by anyone other than the
Grantee.
It is further expressly understood and agreed that the Grantee agrees to maintain
the Temporary Encroachment so as not to become unsightly or a hazard.
It is further expressly understood and agreed that the Grantee must obtain a permit
from the Office of Planning Department prior to commencing any construction within the
Encroachment Area.
It is further expressly understood and agreed that the Grantee must obtain and
keep in force all-risk property insurance and general liability or such insurance as is deemed
necessary by the City, and all insurance policies must name the City as additional named insured
or loss payee, as applicable. The Grantee also agrees to carry comprehensive general liability
insurance in an amount not less than $500,000.00, combined single limits of such insurance
policy or policies. The Grantee will provide endorsements providing at least thirty (30) days
written notice to the City prior to the cancellation or termination of, or material change to, any of
the insurance policies. The Grantee assumes all responsibilities and liabilities, vested or
contingent, with relation to the construction, location, and/or existence of the Temporary
Encroachment.

It is further expressly understood and agreed that the City, upon revocation of
such authority and permission so granted, may remove the Temporary Encroachment and charge
the cost thereof to the Grantee, and collect the cost in any manner provided by law for the
collection of local or state taxes; may require the Grantee to remove the Temporary
Encroachment; and pending such removal, the City may charge the Grantee for the use of the
Encroachment Area, the equivalent of what would be the real property tax upon the land so
occupied if it were owned by the Grantee; and if such removal shall not be made within the time
ordered hereinabove by this Agreement, the City may impose a penalty in the sum of One
Hundred Dollars ($100.00) per day for each and every day that the Temporary Encroachment is
allowed to continue thereafter, and may collect such compensation and penalties in any manner
provided by law for the collection of local or state taxes.
IN WITNESS WHEREOF, Michael T. Dunham and Patricia B. Dunham, the said
Grantee, have caused this Agreement to be executed by their signatures. Further, that the City of
Virginia Beach has caused this Agreement to be executed in its name and on its behalf by its City
Manager and its seal be hereunto affixed and attested by its City Clerk.

a Virginia limited liability company, has requested permission to maintain existing
sidewalks, landing, steps, irrigation, and landscaping encroaching upon City
rights-of-way known as 33`d Street and Ocean Avenue (the Boardwalk) located
adjacent to 3209 Atlantic Avenue.
■ Considerations:
City Staff has reviewed the requested encroachments and has recommended
approval of same, subject to certain conditions outlined in the Agreement.
There are similar encroachments that have been approved along Ocean Avenue
and the streets leading to Ocean Avenue.

It is further expressly understood and agreed that the Temporary Encroachment
herein authorized terminates upon notice by the City to the Grantee, and that within thirty (30)
days after the notice is given, the Temporary Encroachment must be removed from the
Encroachment Area by the Grantee; and that the Grantee will bear all costs and expenses of such
removal.
It is further expressly understood and agreed that the Grantee shall indemnify and
hold harmless the City, its agents and employees, from and against all claims, damages, losses
and expenses, including reasonable attorney's fees, in case it shall be necessary to file or defend
an action arising out of the construction, location or existence of the Temporary Encroachment.
It is further expressly understood and agreed that nothing herein contained shall
be construed to enlarge the permission and authority to permit the maintenance or construction of
any encroachment other than that specified herein and to the limited extent specified herein, nor
to permit the maintenance and construction of any encroachment by anyone other than the
Grantee.
It is further expressly understood and agreed that the Grantee agrees to maintain
the Temporary Encroachment so as not to become unsightly or a hazard.
It is further expressly understood and agreed that prior to issuance of a right of
way/utility easement permit, the Grantee must post a bond or other security, in the amount of two
times their engineer's cost estimate, to the Office of Planning Department to guard against
damage to City property or facilities during construction.
It is further expressly understood and agreed that the Grantee must obtain and
keep in force all-risk property insurance and general liability or such insurance as is deemed
necessary by the City, and all insurance policies must name the City as additional named insured

or loss payee, as applicable. The Grantee also agrees to carry comprehensive general liability
insurance in an amount not less than $500,000.00, combined single limits of such insurance
policy or policies. The Grantee will provide endorsements providing at least thirty (30) days
written notice to the City prior to the cancellation or termination of, or material change to, any of
the insurance policies. The Grantee assumes all responsibilities and liabilities, vested or
contingent, with relation to the construction, location, and/or existence of the Temporary
Encroachment.
It is further expressly understood and agreed that the City, upon revocation of
such authority and permission so granted, may remove the Temporary Encroachment and charge
the cost thereof to the Grantee, and collect the cost in any manner provided by law for the
collection of local or state taxes; may require the Grantee to remove the Temporary
Encroachment; and pending such removal, the City may charge the Grantee for the use of the
Encroachment Area, the equivalent of what would be the real property tax upon the land so
occupied if it were owned by the Grantee; and if such removal shall not be made within the time
ordered hereinabove by this Agreement, the City may impose a penalty in the sum of One
Hundred Dollars ($100.00) per day for each and every day that the Temporary Encroachment is
allowed to continue thereafter, and may collect such compensation and penalties in any manner
provided by law for the collection of local or state taxes.
IN WITNESS WHEREOF, the said La Playa Investment Associates, L.L.C., a
Virginia limited liability company, has caused this agreement to be executed on its behalf by
Thomas J. Lyons, Jr., Managing Member of La Playa Investment Associates, L.L.C., a Virginia

MEETING DATE: February 6, 2007
■ Background: The widening of Birdneck Road, Phase II to four lanes with a bikepath is
a Virginia Department of Transportation (VDOT) highway improvement project. The limits of
construction are from General Booth Boulevard intersection to Norfolk Avenue/Southern
Boulevard intersection, a distance of approximately 2.5 miles.
This project first appeared in the 1989/93 CIP. Funding for design became available in fiscal
year 1991/92. City Council approved a programming resolution on September 3, 1991
requesting that VDOT administer a project for the design and construction of the Birdneck Road
project. On June 4, 1996, City Council approved the "LOCATION AND DESIGN PUBLIC
HEARING APPROVAL RESOLUTION", "AN ORDINANCE TO ESTABLISH THE
BIRDNECK ROAD RIGHT-OF-WAY BETWEEN GENERAL BOOTH BOULEVARD AND
NORFOLK AVENUE/SOUTHERN BOULEVARD AS AN UNDERGROUND UTILITY
COORIDOR" and "AN ORDINANCE TO AUTHORIZE ACQUISITION OF PROPERTY IN
FEE SIMPLE FOR RIGHT-OF-WAY FOR BIRDNECK ROAD, PHASE II (CIP 2-149) AND
THE ACQUISITION OF TEMPORARY AND PERMANENT EASEMENTS, EITHER BY
AGREEMENT OR CONDEMNATION".
■ Considerations: Bids for the construction were opened on November 22, 2006, and the
low bid of $27,940,872.65 submitted by E.V. Williams, is within the VDOT budget for the
construction of this portion of the VDOT project. In order for VDOT to proceed with the
construction, the City must execute a City -State Agreement for the project with VDOT.
The City -State Agreement is the formal mechanism that VDOT uses to obligate project costs,
which include design, acquisition and construction. While the amounts shown in the City -State
Agreement are estimated costs based on currently known costs, the actual cost of the project will
be determined by applying the percentages designated by the City -State Agreement to the final
costs for construction and other project activities.
The City's cost share with VDOT will cover the basic VDOT project requirements (Design,
Right -of -Way, Private Utilities Adjustments, Construction, Landscaping and Streetlights) plus
other partially funded costs as utility betterments, undergrounding utilities, enhanced soundwalls,
and concrete pavers. As presented in the City -State Agreement, the total project cost is

estimated by VDOT to be $47,186,727.82. The amount that the City is responsible for is
estimated to be $3,315,701.10 with the remainder, $43,871,026.72, to be responsibility of
VDOT.
Funding for the City's $3,315,701.10 share is available from three CIP projects: CIP 2-149 will
provide $2,038,144.70 for roadway improvement, CIP 5-008 will provide $164,577.12 for public
utility water main betterments, and CIP 6-069 will provide $1,112,979.28 for public utility sewer
betterments.
■ Public Information: VDOT held a Design Public Hearing on March 6, 1996 at Birdneck
Elementary School and approximately 25 citizens attended. Also on September 8, 1994, VDOT
held a Citizen Information Meeting for this project at Birdneck Elementary School. City staff
also participated in the Public Hearing and the Citizen Information Meeting. Throughout the
right-of-way acquisition that was completed in 2006, City staff was in discussions with the
property owners.
■ Alternatives: Do not accept the construction project and lose $35,797,161.37 of federal
funds, or fund the entire project at 100% City cost.
■ Recommendations: Staff recommends that City Council approve the ordinance to
authorize the City Manager to execute the City -State Agreement of Birdneck Road, Phase II.

1. The DEPARTMENT will construct the Project as.approved.
2. After construction the MUNICIPALITY will maintain the Project, or have it
maintained, in a manner satisfactory to the DEPARTMENT or its authorized
representatives and will make ample provision each year for such maintenance.
3. The MUNICIPALITY, after construction of the Project or any part thereof:, shall not
permit any reduction in the number of or width of traffic lanes, or any additional
median crossovers and enlargement of existing median crossovers, or any alterations to
channelization islands, without the prior written approval of the DEPARTMENT.

4. Right-of-way for the Project was acquired with rights of access restricted to points
designated on the plans. No additional access points will be permitted without prior
written approval of the DEPARTMENT.
5. Parking will be prohibited at all times on both sides of the roadway on this Project and
appropriate NO PARKING signs shall be erected. The signs shall conform to the
standards as shown in the current edition of the Manual on Uniform Traffic Control
Devices.
b. The location, form and character of informational, regulatory and warning signs, curb
and pavement or other markings and traffic signals, installed or placed by the
MUNICIPALITY or any public authority, or other agency, or private entity, shall
conform to the standards as shown in the current edition of the Manual on Uniform
Traffic Control Devices or be subject to the written approval of the DEPARTMENT.
7. The location and installation of utility poles, lighting standards, traffic signal poles or
any other facility installed or placed within the right-of-way by the MUNICIPALITY
or any public authority, or other agency, or private entity, shall conform to the VDOT
Land Use Permit Manual, or be subject to the written approval of the
DEPARTMENT.
8. The MUNICIPALITY shall comply with Title VI of the Civil Rights Act of 1964 and
the Fair Employment Contracting Act, Section 2.2-4200 through 2.2-4201 of the Code
of Virginia (1950), as amended.

regulations and statutes when work is performed on this project by it's employees,
agents, or contractors at Project expense.

Certified Crime Prevention Community Program
MEETING DATE: February 6, 2007
■ Background: On September 12, 2000, City Council approved a resolution
authorizing the City to participate in the Virginia Department of Criminal Justice
Services' ("DCJS") Certified Crime Prevention Community Program ("Program"). The
program encourages localities to develop and implement collaborative community
safety plans. It also provides communities with an ongoing process to reassess and
update their plans to address emerging community safety issues. The City obtained
certification following adoption of the resolution in 2000, but DCJS requires that City
Council authorize the City to re -certify in order to continue participating in the Program.
■ Considerations: Re -certification will reinforce the City's commitment to
providing a safe community and will demonstrate that the City continues to meet
rigorous standards related to community safety.

MEETING DATE: February 6, 2007
■ Background: The Department of Criminal Justice Services has awarded the Virginia
Beach Police Department $33,000 of funding through the Byrne Memorial Justice Grant
Program. This grant will be active from 1/1/2007 through 12/31/2007. The grant requires an
$11,000 match.
The Forensics Services Unit (FSU) will utilize these funds to increase the unit's ability to collect
evidence in less than ideal conditions. This will be accomplished by purchasing an infrared
camera system, a video enhancement system, and photo -quality printers. These improvements
will allow the FSU to examine more cases and to collect a higher quality of evidence.
■ Considerations: These funds will be used to improve the quality of evidence collected
by the Virginia Beach Police Department.
The Police Department will provide an $11,000 match from the department's DEA Seized
Property Special Revenue Fund.
■ Public Information: Public information will be provided through the normal Council
agenda process.
■ Recommendations: It is recommended that Council accept and appropriate the grant
award of $33,000 and transfer $11,000 for the match from the DEA Seized Property Special
Revenue Fund for the purchase of an infrared camera system, video enhancement system, and
photo -quality printers.

■ Background: Virginia Beach has been awarded $25,000 in competitive federal grant
funds to undertake the restoration of riparian buffers adjoining Red Mill Elementary School
within the Back Bay watershed. The purpose of the funds is to establish a riparian vegetated
buffer zone for filtering non -point source runoff and helping improve water quality. The funds
will be used to plant woody vegetation (trees and shrubs), develop and print an educational fact
sheet, install an information kiosk concerning the riparian buffer project, and create an outdoor
classroom learning environment for promoting greater stewardship and environmental
awareness of the Back Bay watershed.
The grant requires a local cash match of $12,100 to support this project and an in-kind match of
$5,000 to be provided by City staff and volunteers from the Back Bay Restoration Foundation
Community Watershed Organization. The matching funds are available within the FY 2006-07
Operating Budget of the Department of Public Works — Storm Water Management Program
Fund.
■ Considerations: The project provides an opportunity for enhancing recommendations
outlined in the City's Comprehensive Plan Natural Resources Plan concerning the Back Bay
watershed. Incorporation of this project into the long-term recommendations for the Back Bay
watershed affords an opportunity to enhance environmental restoration efforts currently being
evaluated by the City in partnership with state, federal and other non-government entities.
■ Public Information: Public information will be provided through the normal Council
agenda process.
■ Recommendations: It is recommended that Council accept and appropriate the grant

MEETING DATE: February 6, 2007
■ Background: (Note: This item was deferred from the January 9, 2007 Council
meeting.) Virginia Beach has been awarded $175,000 in competitive state grant funds to
undertake a series of water quality enhancement projects and a pilot community conservation
partnership with two community watershed organizations in the City. These enhancement
projects are located in the City's Back Bay, Elizabeth River, Little Creek, Lynnhaven River, and
North Landing River watersheds. The projects are intended to reduce excessive nitrogen and
phosphorus concentrations in runoff to these receiving watersheds and reduce fecal coliform
bacterial contamination in these receiving watersheds, thereby helping the City to meet Total
Maximum Daily Load standards, the Chesapeake Bay 2000 Agreement, the Lower James
Tributary Strategy, the SWAMP Special Area Management Plan goals and objectives, various
water quality regulatory programs (such as Chesapeake Bay Preservation Act, Erosion and
Sediment Control, and Stormwater Management), and general water quality initiatives.
These grant funds require a City cash match of $175,000 to support this series of projects.
Matching funds in the amount of $175,000 for the enhancement projects are available in two
capital projects, $73,500 in CIP #7-153, Lynnhaven Watershed Restoration, and $101,500 in
CIP #7-159, Water Quality Participation Projects.
Utilization of these funds as proposed will help enhance water quality and showcase various
protection efforts in many of the City's watersheds and also provide an educational opportunity
for citizens to observe or become involved in the implementation of various demonstration
projects with community watershed organizations in partnership with the City.
■ Considerations: The projects provide an opportunity for enhancing recommendations
outlined in the City's Comprehensive Plan Natural Resources Plan concerning many of the
City's watersheds. These projects also will afford citizens hands-on stewardship opportunities
and assist the City in meeting various federal and state water quality mandates.
