WHEREAS: The Virginia Beach City Council convened into CLOSED SESSION,
pursuant to the affirmative vote recorded here and in accordance with the provisions of The
Virginia Freedom of Information Act; and,
WHEREAS: Section 2.2-3712 of the Code of Virginia requires a certification by the
governing body that such Closed Session was conducted in conformity with Virginia Law.

Public Notice
Notice is hereby given that the Virginia Beach
City Council will hold a Public Hearing concerning the
grant of a franchise to Verizon Virginia, Inc. to con-
struct or operate a cable system in the. City of Vir-
ginia Beach. The Public Hearing will be held in
Council Chamber, City Hall Building, Municipal Cen-
ter, Virginia Beach. Virginia, on March 6, 2007 at
6:00 p.m. All interested persons are invited to
attend. A copy of the proposed franchise is on file
and available for inspection during normal business
hours in the office of the City Clerk.

An Ordinance Authorizing the Reimbursement of an Employee for Legal
Fees and Expenses Incurred in the Successful Defense of a Misdemeanor
Charge Arising Out of the Discharge of Official Duties
MEETING DATE: March 6, 2007
. Background: A Virginia Beach public library supervisor was charged with a
misdemeanor by a former subordinate employee. The charge arose out of the
supervisor's discharge of her official duties. At her trial on November 27, 2006,
the Virginia Beach General District Court found her not guilty of the charge.
. Considerations: Section 15.2-1521 of the Code of Virginia authorizes local
governing bodies to reimburse the legal fees and expenses incurred by any
employee of the locality on any criminal charge arising out of any act committed
in the discharge of the employee's official duties if at trial the employee is found
not guilty.
The City Attorney's Office has reviewed the circumstances of the case and
determined that the supervisor's legal fees and expenses of $1668.50 are
reasonable.
. Recommendation: Approval of ordinance.

AN ORDINANCE AUTHORIZING THE
REIMBURSEMENT OF AN EMPLOYEE'S LEGAL
FEES AND EXPENSES INCURRED IN~-THE
SUCCESSFUL DEFENSE OF A MISDEMEANOR
CHARGE ARISING FROM THE DISCHARGE OF
OFFICIAL DUTIES
WHEREAS, a Virginia Beach employee was charged with a
9 misdemeanor for actions arising out of the performance of her
10 official duties;
11 WHEREAS, at a trial held in the Virginia Beach General
12 District Court on November 27, 2006, she was found not guilty of
13 the charge;
14
WHEREAS, in the defense of said charge, the employee
15 incurred legal fees and expenses in the amount of $1,668.50 and has
16 requested the City to reimburse her for such fees and expenses;
17
WHEREAS, Section 15.2-1521 of the Code of Virginia
18 provides that "( i) f any officer of employee of any locality is
19 investigated, arrested or indicted or otherwise prosecuted on any
20 criminal charge arising out of any act committed in the discharge
21 of his official duties, and no charges are brought, the charge is
22 subsequently dismissed, or upon trial he is found not guilty, the
23 governing body of the locality may reimburse the officer of
24 employee for reasonable legal fees and expenses incurred by him in
25 defense of such investigation or charge, the reimbursement to be
26 paid from the treasury of the locality"; and
27 WHEREAS, the Department Director and the City Attorney's
28 Office have reviewed the circumstances of this case, assessed the
29 itemized bill submitted by the employee's legal counsel, and
30 determined that the legal fees and expenses are {easonable.
31 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
32 OF VIRGINIA BEACH, VIRGINIA:
33 That the Director of the Public Library Department is
34 hereby authorized to expend funds in the amount of $1,668.50 from
35 the FY 2006-07 Operating Budget of the Public Library Department
36 for the purpose of reimbursing the employee for legal fees and
37 expenses incurred by her in defense of a misdemeanor charge brought
38 against her arising out of the performance of her official duties.

An Ordinance to Establish CIP Project # 4-076, "Playgrounds on the Beach," Accept
and Appropriate $30,000 from the Virginia Beach Hotel and Motel Association, and
Transfer $70,000 from the Tourism Growth Investment Fund Reserve for
Contingencies to CIP Project # 4-076 to Construct Two Playgrounds on the Beach

. Background: The Virginia Beach Hotel/Motel Association has proposed a partnership
with the City to construct two playgrounds on the beach to enhance efforts to provide additional
family-oriented activities in the Resort Area.
. Considerations: The total cost to construct the two playgrounds is $100,000 ($50,000
per playground). This initiative will be funded by transferring $70,000 from the Tourist Growth
Investment Fund Reserve for Contingencies and accepting and appropriating a $30,000
contribution from the Virginia Beach Hotel and Motel Association. The proposal has been
reviewed by City Staff, and maintenance requirements of approximately $2500 per playground
annually will be handled within existing appropriations.
Department of Parks and Recreation staff has completed a preliminary design of both
playgrounds and will coordinate the bid and installation processes for the two playgrounds. The
two playgrounds will be constructed approximately 25' from the boardwalk for safety,
convenience, and shade and will accommodate boys and girls ages two to twelve. The play
area of each playground will be approximately 40' x 50' and will be constructed with state-of-the-
art playground components with surfaces that are non-skid, non burn, and UV protected.
Regular inspection and maintenance of the playgrounds will be coordinated by Department of
Parks and Recreation staff and Department of Public Works staff. The locations of the
playgrounds are to be in the vicinity of 10th Street and 315t Street. The exact locations will be
determined based on comments from adjacent property owners and city staff.
The proposal has been endorsed by the Resort Area Advisory Commission Design
Subcommittee, the Resort Area Advisory Commission, and the Virginia Beach Hotel and Motel
Association.
. Public Information: Public information will be handled through the normal Council
agenda process.
. Recommendations: Establish CIP Project # 4-076, "Playgrounds on the Beach,"
accept and appropriate $30,000 from the Virginia Beach Hotel and Motel Association, and
transfer $70,000 from the Tourism Growth Investment Fund Reserve for Contingencies to
construct two playgrounds on the beach.

ITEM: An Ordinance to Appropriate $894,281 from Fund Balance in the Tourism Advertising
Program Special Revenue Fund to the FY 2006-07 Operating Budget of the Convention
and Visitors Bureau for Advertising and Marketing Related Activities

. Background: In July 1996, the City Council of Virginia Beach established the Tourism
Advertising Program ("TAP") Special Revenue Fund and dedicated to the fund one cent of the
transient lodging tax, one-half cent of the restaurant meal tax and a flat tax of one dollar for
each night of lodging in the City. These revenues support the City's advertising and marketing
program and related activities, including the operation of the Visitor Center, to promote and
increase tourist visitation to the City.
. Considerations: Each year, the unappropriated fund balance of the TAP Fund has
been appropriated to the operating budget of the Convention and Visitors Bureau for tourism
advertising and promotion. At the close of FY 2005-06, the TAP Fund had an unappropriated
fund balance of $894,281, which is the net result of (1) budgeted revenues vs. realized
revenues, (2) appropriation balances, and (3) accumulated interest. The Convention and
Visitors Bureau is seeking appropriation of these funds to achieve the following:
. $290,843 to expand the City's advertising and promotional efforts, including new convention
center marketing, sports marketing, regional cooperative advertising campaigns with the
State, and new market opportunities.
. $300,000 as a contingency to ensure quality advertising and marketing capacity in the event
of a natural disaster or serious economic condition impacting the City's tourism industry. The
Convention and Visitors Bureau, together with the City's Advertising Advisory Committee,
annually dedicates a portion of the fund balance as a contingency in an appropriate amount
based on current trends and economic outlook in the tourism industry.
. $303,438 for capital improvements at the Visitor Information Center (which was constructed
in 1989), including site improvements, improved technology, and expansion studies.
. Public Information: Public Information will be handled through the normal Council
agenda process.
. Recommendations: Appropriate $894,281 from fund balance in the TAP Fund to allow
expansion of the City's tourist advertising and marketing program, establish reserves for
emergency and/or economic issues that may arise in the tourism industry, and provide for
annual capital funding for the Visitor Information Center.
