Wood Council Members Absent: Robert M Dyer [Entered: 2:10 P.MJ John E. Uhrin [Entered: 1:50 P.MJ December 4, 2007 - 2 - MA YOR 'S COMMENTS ITEM # 57101 1:30 P.M. Concerning the issue of illegal immigration, Mayor Oberndorf requested the City Manager and City Attorney conduct an Administrative Review of all issues, A Briefing relative this issue was tentatively scheduledfor a City Council Work Session, but has been rescheduled to allow for their Review. The City Attorney advised this item was rescheduled in order to collect the various positions from the different departments and formulate same into the format of an Administrative Directive. The City Attorney wished to check with the other cities within the Hampton Roads Region, in order to assure the policies would be similar. The presentation re Illegal Immigration would be more efficiently given when it contains all the relevant statistics, By Consensus, it will be scheduled for a January 2008 City Council Session. The City Manger advised many uncoordinated actions are being taken throughout the region, state and country concerning the subject of Illegal Immigration, He would like to have a more cooperative effort. Council Lady McClanan referenced the newspaper article re the Chesterfield County Sherriff's Department re funds received to pay for certain inmates. The City Attorney advised speaking to the Sherriff's office concerning this item who has utilized this program in the past, There are many issues re immigration and there are many ordinances in various municipalities Councilman Villanueva requested fiscal impacts be attached to the recommendations, in order to be approached from a budgetary standpoint. The City Attorney advised there would be costs with certain initiatives. The present efforts of the departments would be compiled along with any suggested changes. Policy changes would not be recommended, only compiled in an administrative format to afford City Council the opportunity for review, Council Lady Wilson advised this topic was discussed during the City Council Retreat to assure the employees of the City's vendors were all legal citizenry. Council Lady Wilson referenced the label of "Sanctuary City ", The City Attorney advised, as an example, it is already against the law to hire an illegal immigrant. Language within the contracts could be emphasized to reflect the present laws. Mayor Oberndorf advised, under Virginia Law, the City does not have the authority to declare Virginia Beach anything that has not been a due process by the General Assembly. Mayor Oberndorf has never heard anyone declare Virginia Beach as a "Sanctuary City" other than a television personality, which does not make it true. Council Lady Henley requested the City Attorney clarify there are only certain things one can legally require in determining someone 's documentation. The City Attorney advised the Federal Government has refused to act re Illegal Immigration. Presidential Candidates are debating this issue and disagreeing with each other. Every Bill introduced last year re any manner re Illegal Immigration was defeated Generalization, cost and impact are some of the problems which must be considered Mayor Oberndorf expressed appreciation to the City Manager and City Attorney. ITEM # 57101 (Continued) ITEM # 56993 Andrew Friedman, Director, Housing and Neighborhood Preservation, advised, in preparation for the budget, the Department of Housing and Neighborhood Preservation sought input from community stakeholders to identify key issues, needs and concerns. Housing and Neighborhood Preservation engaged an outside facilitator, Kay Carey of Horizons Consulting Services, to conduct focus groups to promote objectivity and eliminate any influence by Housing and Neighborhood Preservation. Mr, Friedman introduced Kay Carey - Horizons Consulting Services, and Jasmine D. Dezone - Communications - Housing and Neighborhood Preservation. . Fourteen (14) focus groups and one one-on-one session were held . Ninety-three (93) participants attended sessions, representing over 30 organizations and individuals affected by issues facing the Department of Housing and Neighborhood Preservation Questions . What does your neighborhood and/or the City need related to preserving housing and neighborhoods between now and 2010? . What do you like about your neighborhood? What should the Department of Housing and Neighborhood Preservation continue to do that contributes to your neighborhood? . What should the Department of Housing and Neighborhood Preservation do/provide to address the things you do not like about your neighborhood? Responses are organized into four (4) categories, The frequency with which each category was identified as a priority was depicted: Programs and Services Education/Communication/Awareness Neighborhood/Community Involvement Partnerships (51%) (19%) (17%) (13%) Programs and Services . Code enforcement is seen as a key to maintaining quality homes . Issues regarding absentee landlords were identified by approximately 30% of the focus groups . The Department of Housing and Neighborhood Preservation and partners should be pro-active in its programs and services Gaps: . Lack of affordable housing opportunities Need for housing preservation Needfor neighborhood enhancement and preservation . . Housing preservation Code Enforcement . Stricter guidelines and earlier intervention with ordinances regarding occupancy, broken- down vehicles, and dilapidated housing . Assign one Department of Housing and Neighborhood Preservation staff member to landlord enforcement issues . Reduce absentee landlords . Provide incentives . Communications and information enhancements - dedicated one full time staff member . Neighborhood Institute continuing - enhanced marketing/communication to increase participation- annual review of content/method . Actively managing code enforcement program to increase effectiveness and impact . Beginning to address housing preservation through budget proposals Mr. Friedman advised, concerning absentee landlords, a change in the law is being sought to make a requirement for registration of buildings and failure to rehabilitate, Mr. Friedman shall advise the specific guidelines concerning standards re parking of inoperable cars in yards of homes and rental apartments. There is a difference when a Condominium Association has control. Vice Mayor Jones referenced the article concerning the boarding up of hones and fines, The City Manager advised a legislative change is being proposed to shorten the amount of time a house may be left abandoned and to increase the fines for non-compliance. This effort is being undertaken regionally. Mr. Friedman advised Housing and Neighborhood Preservation's Budget Request does not include additional Code Enforcement Inspectors. Mayor Oberndorf expressed concern re predatory lending. The citizens need to be educated re the various loans and credits, Last year, the Mayor of Charleston, South Carolina, instituted a program to designate a police officer who would respond to complaints re abandoned cars and deteriorated housing. A retired Judge agreed to assume a part time position to hear these cases and render a decision. Mayor Oberndorf suggested Mr. Friedman discuss this concept with the Department of Housing and Neighborhood Preservation. Mr, Friedman advised there are both Federal and State initiatives to address predatory lending and foreclosure prevention. Mr. Friedman will make sure his Department is fully informed and take advantage of any authority providedfor local governments, A communication strategy has ascended to the "top of the list", December 4, 2007 - 8 - CITY COUNCIL LIAISON REPORTS 2: 28 P.M. ITEM # 57102 Council Members Dyer and Wilson, Liaisons - Blue Ribbon Tax, Fee and Spending Task Force, advised this Committee has been very active with the involvement of a broad spectrum of the City, The Expenditure Task Force portion is providing their final recommendations with the Revenue portion complete. Linwood Branch, Chair, Local Government, is composing a descriptive summary and introduction, which should be completed within two (2) weeks, This will be the City Council's decision, only recommendations are being provided. ITEM # 57103 Council Members Dyer, Wilson and Villanueva are Liaisons to the Joint/School Modernization. Committee. Councilman Villanueva advised they will meet on December 18, 2007 at 10:00 A.M with the Joint City/School Revenue Sharing Committee and other colleagues. Mayor Oberndorf advised she understood the School Board wishes to meet relative these issues, ITEM # 57104 Council Lady Wilson, Liaison - Workforce Housing Advisory Board, advised the preservation portion was discussed at the City Council Retreat. The Board has recently had an organizational meeting. She spoke with Dan Brockwell, a retired Architect, who is very excited concerning this concept. Hopefully the Board can work with some of the educational institutions in the region re an internship program. as well as the students from VOTECH, who are drafting help to work with the Pattern Books and move forward with these concepts. Mayor Oberndorf advised years ago the Hampton University architectural students actually did the first sketches for improvement of the Resort Area. Much of the work currently being considered is very similar to the original studies provided the City Council re medians, greenery and sidewalk connection. ITEM # 57105 Councilman DeSteph - Liaison, Southeastern Public Service Authority (SPSA) advised a Special Board Meeting has been called for Thursday, December 13, 2007, 9:30 A.M., SPSA Regional Board Room, 723 Woodlake Drive, Chesapeake, The purpose of the special meeting is to review, discuss and examine a new financial pro forma and debt repayment model developed by R. W. Beck, Inc. Hopefully, Councilman DeSteph will be provided a copy of the model to submit to City Council. December 4, 2007 - 9 - CITY COUNCIL COMMENTS 2:35 P.M. ITEM # 57106 Councilman Wood distributed: Resolution in SUPPORT of the Virginia Tuition Assistance Grant Program Councilman Wood requested this Resolution be ADDED to the Agenda. Councilman Wood discussed tuition Assistance Grants for local schools for the disabled children with Legislators during the General Assembly meeting with the City Council and Virginia Beach School Board, last evening, December 3,2007, at 6:30 P.M, Sheraton Oceanfront, This tuition grant provides a small stipend to Virginia residents who attend private colleges, Three colleges and universities in the Region benefit from this Virginia Tuition Assistance Grant program (TAG): Regent University, Hampton University and Virginia Wesleyan College. Nine hundred five (905) students form Virginia Beach currently are TAG recipients, ITEM # 57107 Council Lady Wilson referenced Virginia Business Magazine and noted that two (2) attorneys listed as being "legal elite", fall under the City Attorney's purview: Deputy City Attorney Kamala H Lannetti - Schools and Associate City Attorney Jennifer Huelsburg. ITEM # 57108 Council Lady Henley advised last Saturday evening (December 1, 2007), the First Annual Pungo Tree Lighting occurred with a very good turnout from the enthusiastic community. The City assisted with this lighting. ITEM # 57109 Mayor Oberndorf advised she spoke with the Chairman of the School Board re the Veterans Day Memorial Holiday concern. When the School Board set the year's calendar for holidays, the School Board thought this celebration was going to be on Sunday, November 11, 2007. The scheduling of holiday dates by the School Board is made a year in advance, However, the Veterans Committee decided to celebrate on Monday rather than Sunday (the actual holiday). The Virginia Beach School Board did not mean to offend anyone in any walk of life by having a school working day on November 12, 2007. December 4, 2007 - 10 - AGE N DA REV IE W S E S S ION 2:43 P.M. Three (3) years ago, Fulton Financial Corporation ("Fulton Financial '') purchased Resource Bank. On March 31, 2007, Vice Mayor Jones retired from the Board of Directors. Although, he is no longer a Board Member, he owns stock in Fulton Financial, and that stock ownership causes him to have a "personal interest" in Fulton Financial. However, due to the size of Fulton Financial and the volume of transactions it handles in any given year, Fulton Financial, or any of the banks that are owned by Fulton Financial, may have an interest in numerous matters in which Vice Mayor Jones has no personal knowledge. Turner, a father and son team, have been designing and casting wildlife sculptures in bronze. To date they have created more than 300 different limited-edition bronzes and more than 50 large public commissions. Ranging in size from life-size mice and wrens to full-size bears and dolphins, the Turners have a sculpture to fit the smallest niche in a home or to enhance the entrance of a zoo or museum. Whatever the case, the Turners' work is a reflection of their deep appreciation and understanding of nature. Bill and David Turner both grew up and currently reside on the Eastern Shore of Virginia, which is a narrow peninsula sandwiched between the Chesapeake Bay and the Atlantic Ocean. This area is rich in wildlife, both in diversity and density, which continues to inspire the Turners to create works of art in bronze. They created and cast their first bronzes at their family farm, but they quickly outgrew this space. They purchased the property where they are now located on Route 13, near Onley, Virginia, Two wings and nine buildings have been added to their growing facility since 1984. Among these buildings are studios for Bill and David as well as their foundry, gallery, metal shops, wood shop, wax shop, mold room, and storage. The Turner's supervise the entire process of lost-wax bronze casting that they accomplish on site with the assistance of more than 20 skilled artisans. The 4,000+ square feet gallery displays most of the current editions as well as the two dimensional works of local and national wildlife artists. A video tape is available so that one can obtain a better understanding and appreciation of what it takes to design and produce a sculpture using the lost-wax method of bronze casting. Wood Council Members Voting Nay: None Council Members Absent: None December 4, 2007 Requested by Council member Wood A RESOLUTION IN SUPPORT OF THE VIRGINIA TUITION ASSISTANCE GRANT PROGRAM 1 WHEREAS, in 1972, the Virginia General Assembly adopted the Tuition 2 Assistance Grant (liT AG") Act to assist Virginia residents who attend accredited private 3 non-profit colleges and universities in Virginia; and 4 5 WHEREAS, approximately 20,000 Virginia residents currently receive TAGs for 6 use at Virginia's 31 accredited private non-profit colleges and universities; and 7 8 WHEREAS, the TAG program represents less than five percent of the 9 Commonwealth's total budget for higher education; and 10 11 WHEREAS, the State Council of Higher Education for Virginia ("SCHEV") 12 administers the TAG program; and 13 14 WHEREAS, in light of increasing tuition and related expenses for higher 15 education, the SCHEV has recommended an increase in TAG awards from the current 16 amount of $3,200 to $3,500 in FY09 and $3,700 in FY10, all of which are far less than 17 the average $8,100 per-student cost to the state to enroll a Virginia resident in a state- 18 supported public four-year college or university; and 19 20 WHEREAS, the average of almost $5,000 per student in savings realized by the 21 state when TAG recipients attend private colleges or universities instead of public 22 colleges or universities does not include the millions of dollars that otherwise would be 23 spent for buildings and other facilities to accommodate the 20,000 TAG recipients if they 24 instead attended state-supported colleges or universities; and 25 26 WHEREAS, the fact that private colleges and universities absorb a percentage of 27 Virginia college attendees allows state-supported schools greater flexibility in their 28 selection of students, which means they can include more out-of-state students, who 29 generally are charged 160% of in-state tuition rates, which reduces the amount of 30 financial support needed from the state; and 31 32 WHEREAS, three colleges and universities in Virginia Beach benefit from TAG, 33 with Regent University enrolling 2,640 in-state students, Hampton University enrolling 34 2,284 in-state students, and Virginia Wesleyan College enrolling 1,125 in-state 35 students; and 36 37 WHEREAS, 905 students from Virginia Beach currently are TAG recipients. 38 39 NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 40 VIRGINIA BEACH, VIRGINIA: 41 42 That the City Council supports higher education in Virginia by both public and 43 private institutions and urges the Governor and General Assembly to maintain financial 44 support for the TAG program by following SCHEV's recommendations. 45 46 47 BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF VIRGINIA 48 BEACH, VIRGINIA: 49 50 That the City Clerk is hereby directed to transmit a copy of this resolution to the 51 Governor and to each member of the City's local Delegation to the General Assembly. 52 53 Adopted by the City Council of the City of Virginia Beach, Virginia, this 4th 54 day of December , 2007. December 4, 2007 - 41 - OPEN DIALOGUE Non Agenda Items John Erb, 1805 Summerhedge Close, Phone: 416-1380, spoke re his presentation at the First Annual Interagency Autism Committee meeting which was his personal research currently before the Food and Drug Administration and the World Health Organization (a new theory on the cause of Autism). His paper was presented in June to the Virginia Beach School Board. However, the reason for his attendance is that on December 19, 2007, the City of Virginia Beach intends to place him in jail (up to a year). He provides residential services to mentally handicapped adults and does not have a business license to conduct this service. Currently, he has two (2) adults in a residential home. This home is not open to the public, only those receiving specific Medicaidfunds. The City is operating eight (8) similar homes and does not have the requirements of licensing. Mr. Erb believes his paying 'thousand of dollars in license fees is unfair and he would like the City competitors to do the same. Mr, Erb requested he be placed on the City Council Agenda for December 11,2007, to bringforward his documentation. December 4, 2007
