bridge over RUDEE INLET.

the U.S. Department of Housing and Urban Development for the Rental
Rehabilitation Program.
2. Ordinance upon SECOND READING to accept an amended entitlement grant
from the U. S. Department of Housing and Urban Development and to
appropriate additional funds of $367,000 for the Community
Development Twelfth Program Year.
3. Ordinance upon FIRST READING to appropriate $11,705,613 for Fiscal
Year 1987 for the payment of Purchase Orders brought forward from
Fiscal Year 1986.

The INFORMAL SESSION of the VIRGINIA BEACH CITY COUNCIL was called to order
by Mayor Robert G. Jones in the Conference Room, City Hall Building, on Monday,
October 6, 1986 at 12:30 P.M.

MATTERS BY THE MAYOR
CITY AND STATE MAGAZINE
ITEM # 26117
The Mayor referenced an article cocnerning a survey of the top fifty cities
appearing in the the Magazine "City and State". The City of Virginia Beach was
depicted as the forty-fourth largest city in the Nation. Virginia Beach has the
lowest unemployment rate among the fifty largest cities and ranks ninth in job
growth and twelfth in per-capita income. The City Council oversees the twelfth
largest budget of any City in the Country.
MAYOR'S REPORT

Mayor Jones distributed his third monthly report of "The Work of City Council
for September 1986".
BOND REFERENDUM
ITEM # 26118
The Mayor advised he and the Vice Mayor had been working with volunteers in the
private sector for support of the BOND REFERENDUM.
The Mayor further referenced BUMPER STICKERS promoting the BOND REFERENDUM
which were paid for by Virginia Beach Partners, Inc. The aformentioned
corporation was developed by the Mayor (personally through his law practice).

COUNCIL COMMITTEE
ITEM # 26119
Councilwoman Parker referenced the status of the Council Commitee composed of
Councilwoman Henley, McClanan and herself with a coordinating Committee
composed of three Members of the Planning Commission whenever a significant
change in the Charter is discussed.
The Mayor advised he will confer with Thomas Ammons, Chairman of the Planning
Commission, to appoint three members of the Planning Commission who will meet
with the "lIMP Committee".
BOARD OF ZONING APPEALS
ITEM # 26120
Councilman Balko referenced a Variance of considerable magnitude involving an
application to come before the Board of Zoning Appeals concerning the reduction
in number of parking spaces.
The Mayor advised instead of just an Agenda, Council Members receive copies of
the Minutes of the Board of Zoning Appeals, as well.
Councilman Moss believed City Council might wish to examine same more closely.
Councilwoman McClanan advised the present Board of Zoning Appeals is most
responsive and would be interested in City Council's comments.

BRIEFING
CAPITAL IMPROVEMENT PROJECTS
October 6, 1986
The City Manger distributed a chronological of events cocerning the Air
Conditioning situation in the City Schools.
FY 1984-1985 was the first time AIR CONDITIONING proj ects appeared in the
CAPITAL IMPROVEMENT PRORGRAM of which fourteen (14) schools were identified for
a total amount of $5,107,227. After the defeat of the Bond Referendum, an
Interim Capital Improvement Program was produced and all five of the projects
were removed as unfunded.
In the FY 1985-86 CAPITAL IMRPOVEMENT PROGRAM, twenty-three (23) schools were
identified for a total of $8,113,000.
In the FY 1986-87 CAPITAL IMPROVEMENT PROGRAM, the number of schools was
reduced to nineteen (19) for a total funding of $8,113,000. The Staff's
recommendation to Council was same not be funded in the CIP but funds would be
returned each year following determination of the ending balance. The amount
of funds to be returned this year would be $664,782. This figure would entail
$1,572,000 having been returned to the City and identified for the Salem High
School project.
The City Manager also distributed responses to questions concering the CAPITAL
IMRPOVEMENT PROGRAM reiterated at the September 24, 1986, Council Workshop.
(Said responses are hereby made a part of the record).
City Council inquired as to why renovations to schools would not include air
conditioning.
Councilman Moss inquired as to whether there was an item in the School Board's
OPERATING BUDGET which could be DEFERRED in favor of air conditioning the
schools.
The City Staff will confer with the School Board Administration relative
Council's concerns.

Beverly Lassen, Director with ZONTA.
Patricia Hart is a citizen of Ballarat, Australia and a member of their ZONTA
Club. She has been active in her Club to provide respirators for children,
water wells for the people of Sri Lanka, participated in the "Scented Gardens
for the Disabled" and has been actively participating in providing the
Outreach Program for battered wives and Children as well as assisting in the
food drive for the needy.

was a top winner in
Intenational Conference
Since establishment of the VIRGINIA BEACH CRIME SOLVERS in May, 1982,
approximately $75,000 in rewards have been granted $1.8 MILLION in property
and narcotics has been recovered and over 1,241 individuals have been arrested.
Captain Danny Michaels presented the AWARD PLAQUE to Mayor Robert Jones who, in
turn, presented same to Major McCloud, who represented Police Chief Charles
Wall, who was elected to the International Board of Directors.
Crime Solver Coordinators: Detective's Jim McKinney, Michael Derwent and Jim
Barnes were in attendance also to receive the award.
Captain Michaels also presented the Mayor and each Member of Council with a pin
denoting them as Honorary Crime Solvers.

Robert E. Smartschan, concerned parent of two children in Kingston Elementary
School
Stephen Kurz, represented the various Civic Leagues and self
Karen Washburn, represented parents of Alanton Elementary School children
Rob Jones, President of the Virginia Beach Education Association. (Copy of Rob
Jones remarks are hereby made a part of the record).
Lou Pace, represented the Hunt Club Forest Civic Association, referenced page
12 and page 13 of the CIP concerning the Farmers Market Junior High School
site acquisition at a cost of $1,400,000 for a 30-acre site, as well as page
20 concerning allocation of $535,000 for site acquisition for a 15-acre
elementary school on London Bridge Road. Mr. Pace also spoke in support of the
Recreation (Community) Centers and the Number 1 Priority should be the
installation of water and sewers in the City's Target Areas.
Ronald D. Morrison, Real tor, represented himself and referenced the Baxter
Fly-over and the need for golf courses.
David Winiker, represented the citizens of Larkspur, and spoke concerning the
South Plaza Trail Extension and requested same be assigned a Project Number
and the cost estimate for same be re-examined.
The following presented a petition containing 1,501 names relative the
purchase of the property by the City of Virginia Beach at 24th Street and
Oceanfront and the Post Office property across the street:

The City Manger advised upon review of this year's CAPITAL IMPROVMENT PROGRAM,
there are only 19 Schools identified in need of Air Conditioning. One of the
recommendations made in the ClP was any balance funds returned by the Schools
to the City each year following an amount to be derived from ending balances
that would be placed in the City's escrow fund for bonded debt would be
returned back to the School Board for Air Conditioning. In this fiscal year
approixmately $1.5 MILLION was obtained by the School Board and same was
requested to be utilized for Salem High School, and in addition $664,782 in
funds are to be returned to the School Board for air conditioning in accordance
with this policy.
The City Manager further advised as the CAPITAL IMPROVEMENT PROGRAM was
expanded from five to ten years, the City Council received a great many more
proj ects than it had received in past years and all seemed to have a higher
priority.
The City Staff will confer with the School Board Administration concerning
their priorities relative school projects which could be delayed and these
funds subsequently made available for air conditioning.

Assistant City Attorney Kevin Cosgrove advised of a telephone call on Friday,
October 5, 1986, received from Attorney David A. Miller who represented the
applicant, advising his clients had instructed him not to appear to oppose
DENIAL and were aware the conditions imposed previously had not been
satisfied.
Upon motion by Councilman Balko, seconded by Viuce Mayor Oberndorf, City
Council DENIED an Ordinance for the discontinuance, closure and abandonment of
portions of Jade Street and Cape Henry Drive in the petition of JADE STREET
ASSOCIATES.

Attorney Robert Cromwell represented the applicant and distributed a copy of an
Ordinance ADOPTED by the City Council on November 22, 1971, showing the
property was 50 feet by 95.5 feet. However, after recent appraisals, between
converging lines, the property was depicted as 35 feet on one end and
approximately 32 feet on the other.
OPPOSITION:
Marie W. Wood, adjacent resident, spoke concerning parking problems in this
vicinity and the lot being to small upon which to build.
Mary Jo Griffith, resident of Lauderdale, advised Elsie Judge owned Lots 16,

Displays, advised approximately $250,000 of labor per year is subcontracted
and the principals in Adams Outdoor Advertising own property in Virginia Beach
appraised at approximately $200,000.
The Mayor advised of a letter from Mrs. Lillian Devenny, Board Chariman of
VIRGINIANS OPPOSING DRUNK DRIVING, in support of said Billboard Ordinances and
in appreciation of Adams Outdoor Advertising/Creative Displays program against
Drunk Driving. Adams Outdoor Advertising/Creative Displays donated 100 posters.
Said letter and Mrs. DeVenny's testimony concerning "Lifting the Ban on
Fourteen (14) Hajor Streets in the City of Virginia Beach" is hereby made a
part of the record.
Sumpter Priddy, President of the Virginia Retail Herchants Association

proposed Ordinances be rejected, Billboards be limited to usual visually
congested commercial corridors and prohibiting all bilboards on all other
existing and new streets and highways in Virginia Beach.

Law Center in Charlottesville, Virginia, advised the revision of the Billboard
Ordinances was actually a "policy" change. Mrs. McNett advised it would not be
illegal to specify certain streets in said Ordinances.
Councilwoman McClanan referenced her preference of Recommendation I
concerning AMENDMENTS to the Comprehensive Zoning Ordinance relative Article
1, Section 111 BILLBOARDS - Definitions. Councilwoman McClanan further
referenced Article 2, Section 216 BILLBOARDS - Location and mentioned
paragraph (e) and (f). Councilwoman McClanan requested these sections be
reinserted into the Ordinance and several streets be added to the list in
section (f) as streets designated as having special sign restrictions. (Said
list of streets is hereby made a part of the record). The last part of
Section 2J7 BILLBOARDS - Conditional Use Permits concerning highways, streets
and roadways deemed to warrant close scrutiny could thus be removed.

That Section 111 of the Comprehensive Zoning Ordinance
of the Code of the City of Virginia Beach, Virginia, pertaining
to billboards, is hereby amended to read as follows:
Section 111. Definitions.
A sign, as defined in this zoning code,
Billboards.
including the supporting sign structure, which advertises or
directs the attention of the general public to an establishment,
business or service and which is located on a separate site from
the establishment, business or service which the billboard
advertises. This definition shall not be interpreted so as to
regulate the content of the message on the billboard, unless the
content of the message is legally obscene or otherwise legally
prohibited.
This Ordinance shall become effective on the date of its
adoption.

of any interstate or expressway designated by city council, nor
closer than twenty-five (25) feet of the right-of-way of any
other street.
However, no billboard shall be located within two
hundred (200) feet of any established residential or apartment
zoning district.

WHEREAS, Council in adopting
the 1985-86/1989-90 Capital

Improvement Program (CIP), approved project #2-903 Rudee Inlet Bridge, for
construction in 1989, at an estimated total cost of $6,379,074, and
WHEREAS, this is a joint project between the City of Virginia
Beach and the Virginia Department of Highways and Transportation, with the city's
share of the costs to be $318,954, and
WHEREAS, the site required for the construction of this project
has had a development plan, which meets all city requirements, submitted to the
Planning Department for approval, and
WHEREAS, the city must either approve the development\of this site
and issue the appropriate permits or purchase the property now for the bridge
construction, and
WHEREAS, the City Council, on August 18th instructed staff to
acquire the property required for the location of the bridge from its present
owners, and
WHEREAS, a sale price of $2,450,000 has been negotiated.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA that funds in the amount of $2,450,000.00 be
appropriated to project #2-903 Rudee Inlet Bridge from the Undesignated General
Fund balance for the construction of the second bridge over Rudee Inlet, and
BE IT FURTHER ORDAINED that the City Manager is authorized to
acquire this site from its present owners.
This ordinance shall be effective from the date of its adoption.

same for air conditioning.
Councilman Moss requested consideration by City Council of reallocating the
funds for the School Bus Maintenance Facility and utilizing same for the air
condi tioning of the schools. Councilman Moss wished staff to prepare a
possible recommendation for reprogramming said funds to finance the School Bus
Maintenance Facility in a more cost-effective manner.
Councilman Perry advised perhaps the proposed tennis courts at Independence
Junior could be eliminated and air condition substituted.

Section 5. That additional appropriations and the addition of
capital projects shall not be initiated except with the consent and approval of
the City Council first being obtained.
Section 6. That the restriction with respect to the expenditure
of funds appropriated shall apply only to the totals for each project class
within each funding source included in this ordinance.
All contracts awarded for approval and appropriated capital pro-
jects, exclusive of school projects, must be certified as to the availability of
funds by the Director of Finance prior to the lnitiation of work on the contract.
Section 7. That this ordinance shall be in effect from and after
the date of its adoption.
Section 8. That if any part or parts, section or sections, sen-
tences, clauses, phrases of this ordinance is for any reason declared to be
unconstitutional or invalid, such decision shall not affect the validity of the
remaining portions of this ordinance.

TEXTBOOK RENTAL FUND BUDGET
WHEREAS, the Attorney General of Virginia has opined that School
Board expenditures of funds generated by the rental of textbooks require an
appropriation of the local governing body, and
WHEREAS, the Virginia Beach School Board has a textbook rental
plan whereby rental income is deposited in a textbook rental fund and purchases
of textbooks and other related expenses are paid from this fund, and
WHEREAS, the School Board has submitted a Textbook Rental Fund
budget for FY 1986-87 in order to comply with the Attorney General's opinion, and
WHEREAS, the Textbook Rental budget approve by the School Board
included total revenues of $2,588,040 and total disbursements of $2,588,040 for
fiscal year 1986-87.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA that funds of $2,588,040 be appropriated for a School

expense to the City.
2. The owner agrees to keep and hold the City free and
harmless of any liability as a result of the
encroachment.

AN ORDINANCE TO AUTHORIZE
A TEMPORARY ENCROACHMENT
INTO A PORTION OF THE
RIGHT-OF-WAY OF FERRELL
PARKWAY TO CHARLES C.
HICKMAN, HIS HEIRS,
ASSIGNS AND SUCCESSORS IN
TITLE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
That pursuant to the authority and to the extent
thereof contained in Section 15.1-893, Code of Virginia, 1950, as
amended, Charles C. Hickman, his heirs, assigns and successors in
title are authorized to construct and maintain a temporary
encroachment into the right-of-way of Ferrell Parkway.
That the temporary encroachment herein authorized is
for the purpose of constructing and maintaining a private 2" D.I.
force main to serve the proposed Great Big Greenhouse and that
said encroachment shall be
constructed and
maintained in
accordance with
the City
of Virginia Beach Public Works
Department's specifications as to size, alignment and location,
and further that such temporary encroachment is more particularly
described as follows:
An area of encroachment into a
portion of the City's right-of-way
known as Ferrell Parkway as shown
on that certain plat entitled:
"PHYSICAL SURVEY OF GENERAL BOOTH
BLVD. AT FUTURE FERRILL PKWY. FOR
CITY RIGHT OF WAY ENCROACHMENT
PERMIT, SCALE: 1" = 40' DATE:
6/12/86 REV: 7/15/86" and prepared
by Land Design & Development, Inc.,
a copy of which is on file in the
Virginia Beach Department of Public
Works and to which reference is
made for a more particular
description.
PROVIDED, HOWEVER, that the temporary encroachment
herein authorized shall terminate upon notice by the City of
Virginia Beach to Charles C. Hickman, his heirs, assigns and
successors in title and that within thirty (30) days after such
notice is given, said encroachment shall be removed from the
City's right-of-way of Ferrell Parkway and that Charles C.
Hickman, his heirs, assigns and successors in title shall bear
all costs and expenses of such removal.
AND, PROVIDED FURTHER, that it is expressly understood
and agreed that Charles C. Hickman, his heirs, assigns and
successors in title shall indemnify and hold harmless the City of
Virginia Beach, its agents and employees from and against all
claims, damages,
losses and
expenses including reasonable
attorney's fees in case it shall be necessary to file or defend
an action arising out of the location or existence of such
encroachment.
AND, PROVIDED FURTHER, that this ordinance shall not be
in effect until such time that Charles C. Hickman executes an
agreement with the City of Virginia Beach encompassing the
afore-mentioned provisions.
