ITEM: An Ordinance to Amend the Motor Vehicle and Traffic Code by Adding Section
21-222 to Authonze the Use of Photo-Monitonng Systems to Enforce Traffic Light
Signals
MEETING DATE: September 2, 2008
. Background: The 2007 General Assembly re-established the authority for
localities to use photo-monitonng systems to enforce traffic light signals. The City
previously operated such a system, but discontinued its use when the General
Assembly withdrew its authority In 2005.
. Considerations: This ordinance authonzes the establishment of a photo-
monitonng system to enforce traffic light signals pursuant to Code of Virginia S 15.2-
968. It establishes a monetary penalty of $50 for such Violations and provides
Information regarding the procedures to contest a summons Issued for such a Violation.
The City Manager will be authonzed to Implement the program within the following
parameters:
· The system may not be operated In more than one Intersection for every
10,000 residents at anyone time.
· For each Identified vehicle, there must be at least one recorded Image before
the vehicle illegally enters the Intersection, and one after it illegally enters the
Intersection.
· A summons for a Violation may be executed by mailing a copy to the owner,
lessee, or renter of the vehicle. The mailing will Include, In addition to the
summons, a notice of the summoned person's ability to rebut the presumption
that he was the operator of the vehicle at the time of the alleged Violation
through the filing of an affidavit.
· Information collected by a photo-monitonng system must be limited
exclUSively to Information that IS necessary for traffic light enforcement. A
pnvate entity acting on behalf of the City may not obtain records regarding the
registered owners of vehicles that fail to comply with traffic light signals. All
photographs, microphotographs, electronrc Images, or other personal
Information collected by the photo-monitonng system must be used
exclUSively for enforCing traffic Violations and may not (i) be open to the
public; (ii) be sold or used for sales, solicitation, or marketing purposes; (iii) be

disclosed to any other entity except as may be necessary for the enforcement
of a traffic light violation or to a vehicle owner or operator as part of a
challenge to the violation; or (iv) be used In a court unless the proceeding
relates to a traffic light violation or it IS requested upon a court order
Information collected pertaining to a violation must be purged and not
retained more than 60 days after the collection of the $50 penalty If the City
does not execute a summons for a violation of thiS section within 10 bUSiness
days, all Information collected pertaining to that suspected violation must be
purged within two bUSiness days. The City must annually certify compliance
with the state law authonzlng the program and make all records pertaining to
such system available for Inspection and audit by the Commonwealth
Transportation Commissioner or the Commissioner of the Department of
Motor Vehicles. Any person who discloses personal Information obtained
from thiS program In violation of state law IS subject to a civil penalty of
$1,000.
. The City will enter Into an agreement with a pnvate contractor to be
compensated for proViding the photo-monitonng system or eqUipment, and all
related support services, to Include consulting, operations and administration.
However, only a City police officer may swear to or affirm the certificate
reqUired as proof of a violation. The City may not base the contractor's
compensation on the number of violations or monetary penalties Imposed.
. When selecting potential Intersections for the photo-monitonng system, the
City must consider factors such as (i) the aCCident rate for the Intersection; (ii)
the rate of red light violations occurnng at the Intersection (number of
violations per number of vehicles); (iii) the difficulty expenenced by law-
enforcement officers In patrol cars or on foot In apprehending violators; and
(iv) the ability of law-enforcement officers to apprehend violators safely within
a reasonable distance from the violation. The City may consider the nsk to
pedestnans as a factor The City must submit a list of proposed Intersections
to the Virginia Department of Transportation for approval.
. Before Implementation of photo-monitonng at an Intersection, the City will
complete an englneenng safety analysIs that addresses signal timing and
other location-specific safety features. The length of the yellow phase must
be established based on the recommended methodology of the Institute of
Transportation Engineers. All photo-monitonng systems must provide a
minimum .5-second grace penod between the time the signal turns red and
the time the first violation IS recorded. If recommended by the englneenng
safety analysIs, the City will make reasonable location-specific safety
Improvements, Including signs and pavement markings.
. The City must evaluate the system on a monthly baSIS to ensure all cameras
and traffic signals are functioning properly Evaluation results must be made
available to the public.

. The City must place conspIcuous signs within 500 feet of the Intersection
approach at which a traffic light signal violation monitoring system IS used.
· Prior to or cOincident with the Implementation or expansion of the photo-
monitoring system program, a public awareness program must be conducted.
. Public Information: Public Information will be handled through the normal
Council agenda process.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA.
That Section 21-222 of the Code of the City of Virginia Beach, Virginia, IS hereby
added and ordained to read as follows:
Sec. 21-222 Traffic Sianal Enforcement Proaram
(a) Establishment. There IS hereby established a traffic slanal enforcement
proaram pursuant to and In accordance with Code of Viralnla ~ 15.2-968,1 The
proaram shall Include the Installation and operation of traffic liaht slanal violation
monitonna systems In a number UP to the maximum number permitted by state law No
traffic liaht slanal violation monitonna system shall be operated for enforcement
purposes at an Intersection until all prerequisites for such operation have been fulfilled.
(b) Implementation. The City Manaaer shall (i) have the authority to Implement
the prOVISions of this Section. (iD promulaate the rules and reaulations necessary to
administer the traffic slanal enforcement proaram In compliance with all reqUirements of
Code of Viralnla ~ 15.2-968.1 and this Section. and (Hi) be responsible for the
compliance of all aspects of the traffic slanal enforcement proaram with applicable state
law
(c) Pnvate contractor The City may enter Into an aareement with a pnvate
entity for the Installation and operation of traffic liaht slanal violation monitonna systems
and related services as permitted by and subject to the restnctions Imposed by Code of
VirQlnla & 15.2-968.1 (I).
(d) Penalties.
(1) For failure to comply with traffic liaht slQnal. The operator of a vehicle
shall be liable for a monetary penalty of Fifty Dollars ($50.00) if such vehicle IS found. as
eVidenced by Information obtained from a traffic liaht slQnal violation monitonnQ system.

(2) For disclosure of personal Information. Any person who discloses

COMMENT
This amendment authorizes the re-establishment of the City's photo-monitoring system
program to enforce traffic light signals as provided in Code of Virginia Section 15.2-968.1,
establishes a monetary penalty of $50 for such violations, and provides information regarding the
procedures to contest a summons issued for such a violation.

ITEM: An Ordinance to Amend the City Code by Adding Section 27-5.1 Pertaining to
Burglar Alarm Permits
MEETING DATE: September 2, 2008
. Background: On May 13, 2008, City Council approved an ordinance allowing
the City to Impose a service charge when police respond to the same location for
multiple false alarm calls from third-party alarm compames. ThiS fee IS the first step In
an attempt to reduce the police responses to false alarms. The second step In the
program IS to require persons who rely on a third-party alarm company that notify the
Police Department In the event of an alarm activation to obtain a permit from the City
. Considerations: Requlnng persons who rely on such a service from third-party
alarm compames to obtain a permit from the City will provide the Police Department
with the Information necessary to manage and reduce the number of false alarms
responded to each year
. Public Information: City Council was bnefed on thiS program on July 8, 2008.
Public Information will be provided through the normal City Council agenda process.
. Recommendations: Adopt Ordinance.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA.
That Section 27-5.1 of the Code of the City of Virginia Beach, Virginia. IS hereby
added and ordained to read as follows:
Sec. 27-5.1. Permits reauired for alarm systems usina third-party alarm
companies to notify police.
lID Permit required: No person shall use an alarm system that relies on a thlrd-
party alarm company to notify the Police Department In the event the alarm IS activated
without first obtalnlno a permit to operate such a system from the Police Department. A
ten-dollar ($10.00) fee shall be charoed for such a permit.
fQl Application: The permit application shall be submitted by the alarm user on a
form obtained from the Police Department. For the purpose of thiS section. the "alarm
user" IS any person who IS In phYSical possession of any premises where an Installed
alarm system IS monitored bY a third-party alarm company
19 Transfer of premises possession: Alarm permits are not transferable. Alarm
permits Issued by the Police Department shall eXPire when the alarm user. as Identified
on the alarm permit application. vacates possession of said premises. Any person In
possession of said premises after the eXPiration of the alarm permit shall be required to
obtain a new alarm permit.
@ Reportino updated Information: Whenever any Information provided to the
Police Department on the alarm permit application chanoes. the alarm user shall
provide the updated Information to the Police Department within 30 days.
~ Multiple alarm systems or users: In the event an alarm user has one or more
alarm systems protectino two or more separate structures that have either different
addresses or tenants. a separate permit shall be required for each structure and/or
tenant.
ill Notice:
1 All third-party alarm companies that notify the Police Department In the
event of an alarm activation on behalf of clients/subscribers located In the City.
shall provide notice of the reqUirements of thiS section to all such
clients/subscribers located In the City

2. After police provide a response to a third-party alarm company's call for
service to a location where a person or persons In possession of such property
has not obtained the required alarm permit. the Police Department will prOVide no
further responses requested by a third-party alarm company's call for service
until the required permit IS obtained.

1 The prOVISions of subsections (a) throuQh (e) shall take effect Immediately
2. The prOVISion of subsection (f) shall take effect on January 1. 2009
COMMENT:
This ordinance will require persons who rely on third-party alarm companies that notify
the Police Department in the event of an alarm activation to obtain a permit from the City.

ORDINANCES PERTAINING TO THE COMPENSATION OF THE CITY
MANAGER, CITY ATTORNEY, CITY CLERK, AND CITY REAL ESTATE
ASSESSOR
MEETING DATE: September 2, 2008
. Background: City Charter 9 3.05 provides that City Council shall determine the
compensation of the City Manager, City Attorney, City Clerk, City Real Estate Assessor,
and City Auditor, all of whom are directly appointed by City Council.
. Considerations: In accordance with the budget adopted by City Council on May
13, 2008, City employees other than sworn positions In public safety departments
received a 2.5% general Increase on July 1, 2008. City employees In sworn positions In
public safety departments received a 1 % general Increase (unlike other employees,
sworn positions In public safety departments received an enhanced 1.85% retirement
multiplier). The Department of Management Services has calculated the average
Increase for all City employees to be 2.24%. Accordingly, the attached ordinances
provide that the City Manager, City Attorney, City Clerk and City Real Estate Assessor
will receive a 2.24% Increase In their compensation. Appointees who received car
allowances and/or contributions to their deferred compensation accounts will receive the
same allowances and contributions as they did dunng the pnor fiscal year Pursuant to
the terms of the City Manager's contract, the City also will continue to pay up to $2,684
annually on his behalf In premiums for long term care Insurance. Finally, because City
Council established the compensation of the City Auditor In late April of thiS year, no
changes are being made to his compensation at thiS time.

and
WHEREAS, based upon thiS evaluation, City Council has determined that an
Increase In the City Attorney's compensation would be appropriate.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA.
1 That effective July 1, 2008, the salary of the City Attorney IS hereby
Increased by 2.24% to $208,151.23.
2. That the City's contribution to the City Attorney's deferred compensation
plan shall remain at $20,500 annually

An Ordinance Granting Theme Restaurants, Inc., t/a II Giardino Ristorante
Two Temporary Franchise Agreements for an Open Air Cafe In the Resort
Area
MEETING DATE: September 2,2008
. Background: By resolution adopted November 15, 1985, City Council
authonzed the City Manager to promulgate Open Air Cafe Regulations, which have
been amended from time to time, for the operation of open air cafes on public property
("Regulations"). The City has developed a franchise agreement for the regulation of
open air cafes, which the grantees are required to execute as a condition of the grant.
The City Council has traditionally granted Initial franchises for one-year terms. If an
open air cafe IS successfully operated dunng the Initial one-year term, the franchisee
may return to Council upon the expiration of the one-year term and request a five-year
franchise agreement.
On April 30, 2004, Theme Restaurants, Inc., t/a II Giardino Ristorante ("II
Giardino"), was granted two franchise agreements for (1) an Atlantic Avenue side walk
open air cafe and (2) an Atlantic Avenue side street open air cafe, located at 910
Atlantic Avenue (collectively, "franchise agreements"). The franchise agreements
expired In 2005 and were not renewed by the City because the cafe did not comply with
the Regulations. The cafe was constructed as a permanent structure with a solid roof,
side walls, floonng, and heating and air conditioning. The Regulations require that open
air cafes be constructed with canvas roofs, removable side walls, and non-permanent
floonng. Although II Giardino does not have current franchise agreements, II Giardino
has continued to operate its open air cafe In the City nght-of-way from 2005 through the
present. II Giardino has, however, paid to the City the required franchise fees for the
penod dunng which it has operated without franchise agreements.
. Considerations: In an effort to bnng II Giardino Into compliance with the
Regulations while keeping the cafe open to customers, this ordinance proposes to grant
II Giardino two short-term franchise agreements until December 31, 2008. The
franchise agreements provide that by December 31, 2008, II Giardino will remove its
eXisting cafe structure and that any new structure constructed by II Giardino will fully
comply with the Regulations. If the cafe IS not In compliance with the Regulations by
December 31, 2008, the City will (1) remove the nonconforming structure and have the
nght to obtain reimbursement for the costs associated with such removal from II
Giardino; (2) retain all compliance and enforcement nghts set forth In the franchise
agreements; and (3) refuse to award II Giardino any franchise agreements In the future
until the cafe structure complies with the Regulations. Like all bUSinesses that are
granted cafe franchises, II Giardino will be required to execute a bond or letter of credit
In favor of the City In the amount of ten thousand dollars ($10,000).

INTERSTATE 264 AS AN ECONOMIC REDEVELOPMENT AREA
MEETING DATE: September 2, 2008
. Background: The developer of Convergence Center, Olympia Development
Corporation ("Developer"), IS planning a fourth phase of development and has
applied for a grant under the Economic Development Investment Program
("EDIP"). On August 19, 2008, the City of Virgmla Beach Development Authority
(the "Authority") approved an award under Part B of the EDIP to the Developer
conditioned on Council's deSignation of area In which the Convergence center IS
located as an Economic Redevelopment Area. The area IS a former greyfield
site formerly used as a trash transfer station and animal control storage yard. To
date, redevelopment of the site has occurred with the construction of three Class
"A" office buildings.
. Considerations: DeSignation of an area between Bonney Road and Interstate
264, compnslng the Convergence Center Office Park, as an Economic
Redevelopment Area would allow the Authority to grant the Developer's
application for EDIP funds under Part B of the EDIP The Developer IS planning
an 89,000 square foot Class "A" five-story office building with structured parking.
The pnvate mvestment for this expansion IS estimated at $22,300,000. The EDIP
award would allow greater Infrastructure and parkmg Improvements than would
otherwise be constructed.

. Background:
Richard V Hampton and Kristen C Hampton, Trustees, have requested
permisSion to construct and maintain a bulkhead, an 8' X 8' timber pier, and an
8' X 40' floating dock In a portion of the City's property known as Harbor Canal,
located at the rear of 2336 Spindrift Road, Virginia Beach, Virginia.
The 15' riparian buffer to help address water quality protection In conjunction with
Temporary Encroachments has not been Incorporated In thiS Encroachment
Agreement. On October 20, 2007, Mr and Mrs. Hampton's home was totaled In
a fire and the rebuild of the residence will go before the CBPA Board for
approval. At that time, per the Department of Planning / Environmental
Management Center, the reqUired riparian buffer will be Incorporated Into the
new Site Plan for the reSidence.
. Considerations:
City Staff has reViewed the requested encroachments and has recommended
approval of same, subject to certain conditions outlined In the Agreement.
There are Similar encroachments In Harbor Canal, which IS where the Hampton's
have requested to encroach.

Approve the encroachments as presented, deny the encroachments, or add
conditions as desired by Council.

WHEREAS, it is proposed by the Grantee to construct and maintain a
bulkhead, an 8' X 8' timber pier, and an 8' X 40' floating dock, collectively, the
"Temporary Encroachment", in the City of Virginia Beach;
WHEREAS, In constructing and maintaining the Temporary
Encroachment, it IS necessary that the Grantee encroach into a portion of an existing

City property known as Harbor Canal, located at the rear of 2336 Spindrift Road,
Virginia Beach, Virginia, the "Encroachment Area"; and
WHEREAS, the Grantee has requested that the City permit the Temporary
Encroachment within the Encroachment Area.
NOW, THEREFORE, for and in co nsideration of the premises and of the
benefits accruing or to accrue to the Grantee and for the further consideration of One
Dollar ($1.00), in hand paid to the City, receipt of which is hereby acknowledged, the
City hereby grants to the Grantee permission to use the Encroachment Area for the
purpose of constructing and maintaining the Temporary Encroachment.
It is expressly understood and agreed that the Temporary Encroachment
will be constructed and maintained in accordance with the laws of the Commonwealth of
Virginia and the City of Virginia Beach, and in accordance with the City's specifications
and approval and is more particularly described as follows, to wit:
A Temporary Encroachment into the Encroachment Area as
shown on that certain plat entitled: "ENCROACHMENT OF
LOT 229 SUBDIVISION OF BAY ISLAND L YNNHA VEN
BOROUGH - VIRGINIA BEACH, VIRGINIA FOR RICHARD
V. HAMPTON," a copy of which is attached hereto as Exhibit
"A" and to which reference is made for a more particular

Providing however, nothing herein shall prohibit the City from immediately
removing, or ordenng the Grantee to remove, all or any part of the Temporary

Encroachment from the Encroachment Area In the event of an emergency or public
necessity, and Grantee shall bear all costs and expenses of such removal.
It IS further expressly understood and agreed that the Temporary
Encroachment herein authonzed terrmnates upon notice by the City to the Grantee, and
that within thirty (30) days after the notice IS given, the Temporary Encroachment must
be removed from the Encroachment Area by the Grantee; and that the Grantee will bear
all costs and expenses of such removal.
It is further expressly understood and agreed that the Grantee shall
indemnify, hold harmless, and defend the City, its agents and employees, from and
against all claims, damages, losses and expenses, including reasonable attorney's fees,
In case it shall be necessary to file or defend an action arrslng out of the construction,
location or existence of the Temporary Encroachment.
It is further expressly understood and agreed that nothing herein
contained shall be construed to enlarge the permission and authority to permit the
maintenance or construction of any encroachment other than that specified herein and
to the limited extent specified herein, nor to permit the maintenance and construction of
any encroachment by anyone other than the Grantee.
It IS further expressly understood and agreed that the Grantee agrees to
maintain the Temporary Encroachment so as not to become unsightly or a hazard.
It IS further expressly understood and agreed that the Grantee must obtain
a permit from the Department of Planmng prror to commencing any construction with the
Encroachment Area (the "Permit").
It IS further expressly understood and agreed that the Grantee must obtain
and keep In force ail-risk property Insurance and general liability or such Insurance as IS

deemed necessary by the City, and all insurance policies must name the City as
additional named insured or loss payee, as applicable. The Grantee also agrees to
carry comprehensive general liability Insurance In an amount not less than $500,000.00,
combined SIngle limits of such insurance policy or policIes. The Grantee will proVide
endorsements providing at least thirty (30) days written notice to the City prior to the
cancellation or termination of, or matenal change to, any of the insurance policIes. The
Grantee assumes all responsibilities and liabilities, vested or contingent, with relation to
the construction, location, and/or eXistence of the Temporary Encroachment.
It IS further expressly understood and agreed that the Temporary
Encroachment must conform to the mInimum setbacks requirements, as established by
the City.
It IS further expressly understood and agreed that the City, upon
revocation of such authority and permIssion so granted, may remove the Temporary
Encroachment and charge the cost thereof to the Grantee, and collect the cost In any
manner proVided by law for the collection of local or state taxes; may requIre the
Grantee to remove the Temporary Encroachment; and pending such removal, the City
may charge the Grantee for the use of the Encroachment Area, the equivalent of what
would be the real property tax upon the land so occupied if it were owned by the
Grantee; and if such removal shall not be made within the time ordered hereinabove by
thIs Agreement, the City may Impose a penalty In the sum of One Hundred Dollars
($100.00) per day for each and every day that the Temporary Encroachment is allowed
to continue thereafter, and may collect such compensation and penalties in any manner
proVided by law for the collection of local or state taxes.

the Fire Department for Tactical Rescue Equipment for the Tidewater Regional
Technical Rescue Team
MEETING DATE: September 2, 2008
. Background: The City was notified that the Virginia Department of Emergency
Management would be providing pass through funding for localities for Heavy and
Tactical Rescue equipment, practical exercises and training. The Virginia Beach Fire
Department IS the lead agency for the Tidewater Regional Technical Rescue Team.
The Fire Department has Identified equipment that will enhance the Technical Rescue
Team's logistical needs and Improve the team's ability to deliver and function In a
vanety of technical rescue environments. The funds will be used to purchase
equipment designed for high anglelvertical rescue, heavy lifting and moving, confined
space operations, patient packaging, and vehicle extncation.
. Considerations: This grant IS awarded by the Virginia Department of
Emergency Management through funding onglnating from the Department of Homeland
Security's National Preparedness Directorate, FY 2007 State Homeland Security Grant.
The funds will be apportioned to the Fire Department's operating budget. No local
match IS reqUired.
. Public Information: Public Information will be handled through the normal
Council agenda process.

ITEM: An Ordinance to Accept Grant Funding from the Virginia Department of Criminal
Justice Services to Establish a CriSIS Intervention Team
MEETING DATE: September 2,2008
. Background: The Virginia Department of Criminal Justice Services has
awarded the City of Virginia Beach federal pass-through funding from the Byrne
Memorial Justice Grant Program. ThiS grant will be active through June 30, 2009 The
grant provides $98,093 of federal funding and requires a local cash match of $32,697
These funds will be used to Implement a CriSIS Intervention Team (CIT) In the City of
Virginia Beach. The CIT will train first responders to effectively deal with situations
involVing people experiencing a mental health CriSIS, and will link offenders with
appropriate treatment and resources In the community ThiS program will proVide
community support, Infrastructure, and training to deal with psychiatriC diagnOSIs,
SUICide Intervention, substance abuse Issues, de-escalation techniques, the role of the
family In the care of a person with mental illness, legal training In mental health and
substance abuse Issues, and local resources for those In a mental health CriSIS. ThiS
funding will be used to purchase a notebook computer, an LCD projector, training
manuals, conduct training, contractual labor to assist with project coordination, and a
consultant to work with the committee.
. Considerations: The Police Department, the Department of Human Services,
and the Sheriff's Department will share the reqUired match equally The Police match of
$10,899 will come from the DEA Seized Property Special Revenue Fund, the
Department of Human Services will proVide $10,889 from their operating budget, and
the Sheriff's Department will take the $10,889 match from the Inmate Services Fund.
