July 2, 1973
The regular meeting of the Council of the City of Virginia Beach,
Virginia was held in the Council Chambers in the Administration
Building in the Borough of Princess Anne, on Monday, July 2, 1973,
at 2:00 p.m.
The invocation was given by Chaplain Gerald K. Hilton, Fort Story,
Virginia Beach, Virginia.

BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
WHEREAS, lots 40 and 41 of Block 117 of the Subdivision of
Lakewood was acquired by the City of Virginia Beach and in the
opinion of City Council is now excess of the needs of the City;
and
WHEREAS, these pa~cels have now been appraised and advertised
for bids; and
WHEREAS, it is now considered suitable to dispose of these
parcels;
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA:
That the City Manager is hereby authorized to convey to the
successful bidder Lots 40 and 41 of Block 117 of the subdivision of
Lakewood. The said parcels are to be sold as a whole and not as
separate parcels.

date of adoption.

FOR MORE THAN FIVE DAYS

'That Sections 2-4~.2 and 2-43.4 of the Code of the City of
Virginia Beach is hereby amended and reordained as follows:
Section 2-43.2 Same - Powers and duties.
The personnel board shall have the power and shall be required
to hear appeals from any action pertaining to classification,
reclassification and allocation of positions and prom any
disciplinary action susoending for more than five workin~
days, reducing in rank or ~ay or removing any officer
or employee in the classified service, as provided in
Section 2-43.4, and to report in writing its findings
and' recommendations on such appeal to the city manager.

The classified service shall comprise all positions not
specifically included by Section 2-43.3 in the unclassifi~
service. All original appointments shall be for a proba-
tionary period, the conditions of which shall be governed
by the rules established by the city manager. Members
of the classified service shall be subject to such
disciplinary action including removal as may be ordered
or approved by the officer having the power of appoint-
ment to the position held by the person to be disciplined.
Prior to the conclusion of the probationary period of any
'employee, his service may be terminated by such officer
if in the opinion of such officer the emo1oyee does not
possess the qualifications required by the position to
which he was appointed. Upon the conclusion of the
probationary period no member of the classified service
shall be suspended for more than five working days,
reduced in rank or payor removed, except after notice
in writing of the grounds of the proposed disciplinary
action and an opportunity to be heard thereon by the
.personne1 board. If within five working days following
the service of such notice an employee shall in writing
addressed to the secretary of the personnel board re-
quest a hearing, the secretary shall fix a time and place
for such hearing to be held not less than five working
days nor more than ten working days after the receipt
of such requests and notify the employee thereof. The
findings of the personnel board either sustaining,
reversing or modifying the disciplinary action appealed
from shall be advisory to the city manager.
An emergency exists and this ordinance shall be effective from
date of passage.

That Ordinance Number 425 be amended and reordained to read as
follows:
A. A "family table top commercial recreation center" within the
meaning and application of this ordinance is defined as any establish-
ment where footsba1l, table tennis, shuffleboard or any like game of
recreation or amusement is displayed for public patronage, where the
insertion of a coin, slug or token or the payment of a fee is required
and where three or more tables for such activity are used. There is
excepted from the ~egulations contained herein those establishments
duly licensed and regulated by the Virginia Alcoholic Beverage Control
Board.

B. No person shall operate a family table top commercial recre-
ation center without first obtaining a permit from the City Manager
or his authorized delegate. Application for such permit shall be
accompanied by a fee of $20.00 which shall not be refundable and shall
contain the following information:
1. Name and address of the applicant, age, social
security number, race, sex, date and place of birth
and where pertinent the relationship of the applicant
to any company, corporation or other entity which has
any interest in the ownership or management of the
center.
2. Prior criminal convictions, excluding traffic
offenses, of the applicant, if any.
3. Prospective location of the center.
4. Maximum number of patrons center will accommodate.
5. A list of all employees who are expected to
serve in a managerial capacity, in the center.

6. A certification by the applicant that all
requirements of this ordinance, as herein set
forth, have been complied with.
C. Upon receipt of an application for a permit, the City
Manager shall immediately cause an investigation to be made concerning
the qualifications of the applicant and whether the proposed center is

in compliance with this ordinance. The City Manager shall grant or
deny such permit and shall notify the applicant of his action within
thirty days of the filing of the application. If the City Manager
denies such permit, he shall state in writing his reasons for such
action. The following factors shall constitute grounds for denial of

a permit for operation of a center:
1. A finding by the City Manager that the
applicant has falsified his application in a
material manner.
2. A finding by the City Manager that the
applicant or any of his designated managerial
employees has a criminal record which reveals
any convictions for violations of any drug control
laws or any other pattern of criminal misconduct
involving moral turpitude.
3. A finding by the City Manager that the
applicant consistently fails to cooperate with
law enforcement personnel in the exercise of
their official duties.
4. A finding by the City Manager that the
application is not properly completed as required
herein.

5. A finding by the City Manager that the
proposed center fails to comply with the provi-
sions of this ordinance.

No other factors shall be sufficient grounds for denial of an
application for a permit.
D. The City Manager may revoke or suspend for a period of
thirty days the permit for the operation of a family table top commer-
cia1 recreation center if he finds:
1. That the premises have been declared a
common nuisance by a court of competent juris-
diction.
2~ That the permittee has consistently failed
to operate the center in an orderly manner.

3. That the permittee has failed to take prompt
and vigorous action to prevent violations of
criminal statutes occurring on the premises which
are known or should have been known to the
permittee.
4. That circumstances exist which would have
justified a denial of such permit at the time
of its issuance.

5. That the permittee has failed to comply with the
provisions of this ordinance.

A permittee shall be entitled to a hearing before the City
Manager before such permit is revoked or suspended. The City Manager
shall give the permittee thirty days notice of his intention to
revoke or suspend such permit along wit~ his grounds for revocation
or suspension by certified mail, return receipt requested. The hearing
shall be held not more than twenty days after giving of the notice.
E. No permit issued under this ordinance shall be assignable in
any manner whatsoever. When the permittee shall cease to operate the
center for a period of sixty days, the permit shall be void.
F. No center shall be operated except in compliance with the
following operating requirements provided that requirements 6 and 7
shall not be required of any center operating lawfully prior to the
effective date of this ordinance.

1. The center shall be illuminated throughout
its interior at a level of forty foot candles.
2. The center shall provide separate rest room
facilities for both sexes.
3. No minor, under the age of sixteen years,
shall be allowed to patronize the center's game
tables and no minor, under the age of eighteen
years, shall be allowed to remain in the center
between the hours of 12:01 a.m. and 5:00 a.m.
unless accompained by their parent or guardian.
4. The center shall at all times be under
management and control by a person at least
eighteen years of age who shall be on the pre-
mises of the center at all times during the
hours of operation.
5. The center shall have no partitioned or
closed off areas other than those for toilet
facilities, office space and storerooms.

6. The center shall be located on the ground
level floor of the building in which it is .
situated; it shall also have a window or windows
with a total of not less than one hundred square
feet of glass which shall not be covered or
otherwise obstructed during hours of business.
7. The center shall provide permanently
maintained off-street parking for personnel
and patrons at the rate of one and one-half
parking spaces for each game table or machine
displayed whether in use or not.

G. This ordinance shall be effective sixty (60) days from the
date of its passage.

~ City Council approved an appropriation of $22,500 to the Department of
Community Services' Legal and Expert Services Account to fund a proposed
hydraulic study of Long Creek and Lynnhaven waters.
ITEM #6080
Councilman Callis made a motion, seconded by Councilman Gardner, to
approve the Revenue Sharing proposed by the City Manager for the first
six months of 1973, in the amount of $2,009,000. (Two million and nine
thousand dollars), and funds for the fiscal year 1974, ,in the amount of
$4,024,000. (Four million and twenty-four thousand dollars).

Vice Mayor Ervin offered an amendment to the main motion, seconded by
Councilman Baum with approval of the sum of $425,000 for Old Donation
Parkway, which was included in the main motion, but qualified that no
further funding for this road be included in future studies until such
time there is a comprehensive location study made by the State Highway
Department and presented to the people of this City for a public hearing,

Councilman Rhodes indicated that he could agree with Vice Mayor Ervin's '
motion if certain other roads in the City were included for public
hearing prior to funding, he specifically noted, in addition to Old
Donation Parkway, except that portion between First Colonial Road and
Great Neck Road, Churchill Drive, and Lord Dunmore Road.

It was indicated by Mr. W. W. Fleming, Director of Community Services,
that such a motion could endanger federal and state funds already
ear-marked for construction of other roads in the City. Mr. Fleming
also noted that Churchill Drive and Lord Dunmore Road were approved
as part of the site plans of the subdivisions and were constructed by
the developer at his own expense.

Councilman Baum requested the application of Sea Bay Corporation be
reconsidered as the original site plan did not correspond with the
topo map, and as the developer did not adhere to Council's specification:~.
Council authorized the City Attorney to notify the applicant and to .
give him the required ten days notice to appear back before City Council I
and further authorized a stop work order be placed on the site.

Councilman Holland requested that at the Informal session on July 9,
1973, a report be given of the meeting with Colonel Love of the
Hampton Roads Sanitation District Commission regarding the proposed
$210.00 assessment on pe~sons presently now connected to ~eptic tanks.
It was Councilman Hollands understanding that the subject $210.00
assessment could be levied on new construction. Councilman Holland
requested that the money that would come from the southern tidewater
,- area go to the plants that are in this area. He requested that
discussion of this item also be placed on the informal agenda of
City Council on July 9, 1973.

Mayor Cromwell requested the City Manager put in written form the
fact that the off-duty police officers are to receive payment when
appearing in court.
ITEM #6086
Councilman Holland requested guidance from Council concerning a
vote that will be coming up in the Southeastern Virginia Planning
District Commission regarding the effect of air craft noise on
land use. The SVPDC, at their last meeting, asked Council to go
along and concur with their policy on land use in noise areas siftce
they do have the prerogative to give their recommendations of VA
and FHA funding of fifty units or greater. This would affect Virginia
Beach in the greatest amount. Councilman Holland further requested
the City Manager's office to have a recommendation on the Informal
agenda for July 9, 1973.

with the Planning staff on the Comprehensive Zoning Ordinance and Land
