The invocation was given by the Reverend W. Thomas Wood, First Baptist Church, Virginia Beach, Virginia. Councilmen present: John A. Baum, Robert H. Callis, Jr., Mayor Robert B. II l ITEM #5791 Public Hearing on the Regional Parks Authority. Mr. Robert Foeller, Executive Director of the Southeastern Virginia Regional Planning District Commission, Number 20, appeared before City Council requesting their support and the participation of the City of Virginia Beach in the constituting of a Regional Parks and Recreational Commission as specified in the Public Recreational Facilities Authoritie~ Act of the Commonwealth of Virginia. '__tl Mrs. S. Kaplan, President of the League of Women Voters of Norfolk- Virginia Beach, filed a statement with the City Clerk indicating the support of her organization in the creation of a Regional Agency. The City Council received their comments and thanked them for their interest. The matter has been taken under study. ITEM #5792 Public Hearing (continued from April 16, 1973, at the request of representatives from the Council of Civic Organizations), on the proposed City Budget for the fiscal year beginning July 1, 1973 and ending June 30, 1974. '1IllI'I<' Mrs. Gene Poole, representing the Budget Committee of the Council of Civic Organizations, addressed City Council regarding the proposed salaries of the City employees, in which she stressed that the rate of increases to persons holding positions with higher salaries is not proportionate to the salaries proposed for persons holding lower grade positions. Mrs. Poole emphasized that larger increases should be granted the lower wage group and less increases to the higher salary brackets. Mrs. Poole also pointed out that some salaries had increased in a short period of employment time as much as 107.5 percent. Mrs. Poole noted that the taxpayers are particularly concerned this year due to increased taxes and rising prices for food and utility services. The report urged City Council to institute economies wherever possible. A copy of the report was filed with the City Clerk. Councilman Ferrell requested that Councilmen be supplied with a copy of the report, and complimented Mrs. Poole on her efforts in reviewing the proposed budget. II I \.' .. Planning Commission Recommendation: , A motion by the Planning Commission was passed for approval of this request subject to the following: 1. Standard site plan requirements to include paved parking with pro- tective curbs (CG-2) at perimeter; standard street improvements shall be constructed along Bonney Road and shall include pavement widening of twenty-one feet from the centerline of existing pavement, curb and gutter, sidewalks and storm drains as l~equired; entrance width shall be restricted to a maximum of forty feet. (Engi neeri ng) . 2. A dedication of right of way 30 feet from the centerline of the exist- ing 30-foot right of v!ay along the 225-foot more or less frontage on Bonney Road (lS-foot dedi cati on) . " III I Requested by the City Manager AN ORDINANCE TO AMEND AND REORDAIN SECTIONS 17-26 17-28, 17-30 AND 17-31 AND TO REPEAL SECTIONS 17-27 AND 17-29 OF THE CODE OF THE CITY OF VIRGINIA BEACH RELATING TO NOTICE FROM THE DIRECTOR OF PUBLIC HEALTH AS TO REMOVAL OF TRASH, WEEDS, ETC., FROM LAND OR PREMISES AND PROCEDURE UPON FAILURE OF RECIPIENT TO COMPLY THEREWITH. '-14 A BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: Sectiort 17-26. Duty of Director of public health to give notice. Upon determination by the director of public health or his agent that there exists upon any land or premises within the city including the area in front of such land or premises extending to the curb line, any trash, garbage, litter and other like substances or that there exists on such premises any grass, weeds or other growth which might endanger the health or safety of other residents of the city, he shall cause notice to be served on the owner or his agent and the occupant of the land or premises to cause such trash, garbage, refuse, litter and other like substances or grass, weeds or other growth which might endanger the health or safety of other residents to be removed or cut and removed from such land or premises within ten days from the date of said notice. Section 17-27. Is hereby repealed. Section 17-28. Manner of service. Notice, as provided for in section 17-26 shall be sent by registered or certified mail. t~i If the owner or his agent or the occupant of the land or premises cannot be found, notice required by section 17-26 may be given by publication for three consecutive days in a daily newspaper of general circulation in the city. Section 17-29. Is hereby repealed. Section 17-30. Procedure upon failure, neglect or refusal of recipient to comply therewith - Generally. Upon the failure, neglect or refusal of any owner, agent, or occupant of the land or premises upon whom notice has been served, as provided in section 17-28, to remove or cut and remove such trash, garbage, litter or other like substances or grass, weeds or other growth which might endanger the health or safety of other residents of the City lying or located on the property in question within the time indicated in the notice, the director of public safety or his agent may have the requisite work done by city forces or by contract. The actual cost of such work shall be charged to the owner of the land or premises, upon whom such notice was served. Section 17-31. Same - Billing and collection of charges. When the director of public safety has accomplished the removal or cutting and removal of trash, garbage, litter or other like substances or grass, weeds or other growth, he shall bill the owner of the land for the cost of such removal or cutting and removing and the cost of publication, if any. If such bill is not paid within thirty days the ~ director of public safety shall transmit such bill to the city treasurer who shall include such amount in the next regular tax bill of the owner of said property. Every charge authorized herein which remains unpaid shall constitute a lien against such property and may be collected as taxes and levies are collected. .-, An emergency exists and this ordinance shall be in full force and effect from the date of passage.
