Mayor Oberndorf introduced the Fist Lady of Virginia, Anne Holton, wife of Governor Kaine. The need
for change in Virginia re Foster Care was initiated by First Lady Anne Holton, and her "For Keeps
Initiative". The FOR KEEPS INITIATIVE focuses on the need for communities to help foster care
children who are growing out of the system. Her work has been recognized with the "Families for Life
Award" in May 2008. Anne Holton graduated from Princeton University, Magna Cum Laude, with a
Degree in Economics. She graduated from Harvard Law School Cum Laude, assuming her law degree in
1983. Since then she has worked as an Attorney with Legal Aide for ten (10 years, then served as a
Juvenile Domestic Relations Judge in Richmondfrom 1998 until her husband's election as Governor in
2005. Attending with First Lady Holton was her Chief of Staff, Mike Evans and Ray Ratke, Deputy
Commission Mental Health/Mental Retardation//Substance Abuse and Special Advisor for Children's
Services. Dr. Terry Jenkins, President, will provide information re the "Together We Can" Foundation.
Anne Holton advised approximately one-half of the children in Foster Care are teenagers. She worked
with her State Director of Social Services focusing on this issue of older children to be more successful in
connecting with permanentfamilies.
Anne Holton referenced children age of twelve (12), and older achieve permanency nationally at 72%,
and in Virginia at 44%
National Research:
Foster Youth Who Age Out
. One in four will be incarcerated within the first two years after leaving the system
. Over one-fifth will become homeless at some time
. About 60% will have a high school diploma at age 19 - compared to about 90% of non-foster
youth

Mrs. Holton referenced the Chart entitled "Older children Placed in Congregate Care". Virginia is
substantially over utilizing Congregate Care (Group Homes and Residential Treatment facilities). This is
one of the most expensive forms of "care". These facilities often cost $60,000 to $70,000 a year for
essential treatment facilities. Foster Care families only receive approximately $440 a month.

KEY FINDINGS
. In 2006, 45% of CSA expenditures were used to support congregate placements * *
. In January 2007, 24% of Foster Care children were in Congregate Care (national average =
18%, better jurisdictions place less than 10%)
. 52% of teen (12 and up) initial placements were in Congregate Care, a 24% increase from 2000
. In 2003, 44% of teens achieved permanence, a 28% gap from the national average of 72. %
. After 7 years, 24% of young children entering Care in 2000 had not achieved permanence. These
children potentially will "age in" to teens who have an even greater chance of not achieving
permanence
. The use of regular Foster Care for teens has decreasedfrom 41% in 2000 to 23% in 2006, while
usage of formal kin placements has declined to almost nothing
. Significant gap between current Foster Care payment rate and the rate recommended in a new
study (i.e. current teen rate = $546; recommended teen rate = $760)

Key Criteria:

The localities invited to participate, because of their large overall populations, also had significant
numbers of youth in out-of-home care
2) Were geographically diverse across the State:
Localities invited represent each of the 5 Districts served by the Department Of Social Services- Central,
Northern, Eastern, Piedmont and Western. Also, that localities were able to represent some diversity
across urban and rural areas across the state

Secretary of Health and Human Resources, Marilyn Tavenner,
has charged the CORE to focus on the following Critical Reform Areas:
. Adopt a state-wide philosophy that supports family-focused, child-centered, community-
based care with a focus on permanence for all children
. Establish a state-level practice model focused on family-centered care and permanence
that is reinforced by a uniform training program for resource families as well as local
staff in DSS and CSA (integrated with DMHRSAS practice model)
. Create and implement a statewide strategy to increase availability and utilization of
relative care and non-relative foster and adoptive placements to ensure that children
can be placed in the most family-like setting that meets their needs
. Create a robust performance monitoring/quality assurance system to identify and
measure outcomes, monitor quality of practice, and improve accountability

As initial measures of the success of the transformation, the Initiative will be
focused on the following goals:
. Decreasing the number of youth in Congregate Care
. Increasing the number of youth who exit Foster Care to permanency
. Decreasing the amount of time it takes those youth to exit the Foster Care system to permanency
. Increasing the number of youth enteringfamily-based care
. Increasing the number of youth entering kinship care placements
. Decreasing the length of time youth spend in Congregate Care
The Work of CORE towards Transformation is a Parallel State and Local Process
CORE Data Highlights
. Since October of 2007, CORE agencies have reduced congregate placements by 103 children,
while statewide (exclusive of CORE) that number has risen by 69.
. Stated as a percentage, in October 2007, 26% of CORE children were in congregate care with
the statewide number (exclusive of CORE) at 21.9%. As of the end of July, 23.7% of children
from CORE localities were in congregate care. Statewide this percentage is 23.3%.
. Overall, the total congregate care population of CORE agencies has seen a perant change of -
12% while the statewide number (exclusive of CORE) has increased by 6.3%.
. Fairfax County - October of 2007 had 113 youth in Congregate Care, July of 2008 had 88 (a
22% decrease).
. Prince William - October of 2007 had 80 youth in Congregate Care, July of 2008 had 60 (a 25%
decrease).
. Richmond City - October of 2007 had 223 youth in Congregate Care, July of 2008 had 193 (a
13% decrease).

Dr. Jenkins extended appreciation to Attorneys R. J Nutter, and Mark Slaughter of Troutman and
Saunders, providing legal services pro bono for the incorporation of the Foundation. "Together We
Can" is also chartered as a non-profit organization in Virginia and they are currently persuing tax
exempt status with Internal Revenue Service. Since 2000, Virginia has led the nation with the highest
percentage of Foster Care youth who "age" out of the system without permanent family support. The
"Together We Can" Foundation was created to address the needs of at-risk individuals. The initial
projects will focus on Foster Youth. The Foundation will work with the community, businesses, clergy,
civic leaders, human services agencies and other foundations to improve the lives and the futures of
Foster Youth.

Dr. Jenkins cited the Foundation's Five-Year Goals:
Increase the number of Foster Care children who complete higher education and/or
vocational training opportunities by working with institutions of higher learning,
vocational schools and scholarship programs
Support the development of employment opportunities for young people aging out of
Foster Care by creating partnerships with area businesses and advocatingfor changes in
Medicaid regulations that are disincentive to employment
Partner with area providers to develop independent living programs for youth aging out
of Foster Care, including supervised living programs.
The response from the community has been very positive.
Relative attainingfunds at the State level to meet the initiatives, Deputy Commissioner Ray Ratke advised
utilizingfunds available through the Comprehensive Services Act in a better way.
Dr. Jenkins advised the Foundation wishes to focus on the children fourteen (14) years and older, One
hundred fifteen (115) children fall within this age group. The total Foster Care population is
approximately two hundred seventy (270) Mr. Jellig, Cheryl Williams and Dr. Jenkins met with Deborah
M mCroce, President of Tidewater Community College, who was supportive of their efforts, On
Thursday, September 11, 2008, the Foundation will be meeting with Dr. Bullock, Provost - TCC Virginia
Beach Campus, on Thursday to determine how the services of this Campus can be utilized for the Foster
children. The Foundation wishes to also create an Advisory Board composed of Foster Care youth.
Mayor Oberndorf extended appreciation to First Lady Anne Holton, Ray Ratke, Dr. Terry Jenkins, the
members of the Foundation, and Virginia J. Diezel, for her design of the Logo "Together We Can"
inscribed on their pamphlet,
Mrs. Holton complimented Virginia Beachfor their decrease in Foster Care children from 370 to 270 in
less than a year.

Mayor Oberndorf requested Deputy City Manager Steve Herbert introduce the newest member of the City
staff.•
Deputy City Manager Steve Herbert introduced Retired Commander Sali Gear, Navy Reserve, joining the
City as the Military Liaison. After a long search process, she emerged as the top candidate. Gear spent
twenty-three (23) years in the service, sixteen (16) of them on active duty while serving in three (3) air
squadrons as well as the Naval Special Warfare Command and the Joint Forces Command. She was
carrier qualified in the A-4 Skyhawk. She owns a company that trains officials from federal agencies and
the Navy to board moving ships. She also runs a farm in Virginia Beach for rescue racehorses. Her
husband is a Navy SEAL. As recently as 2003, she was recalled to active duty, working in the Joint
Forces Command. Sali is the mother of three (3) boys, who are part of the community. Virginia Beach,
for the last fifteen (1 S) years, has been her home and she looks forward to working with the City.

Council Lady McClanan advised the City held a Hearing last week re the Buckner Farms Road
Extension. She has heard from two (2) community representatives. David Hansen is working with these
representatives re their concerns. Some of these concerns involve crime moving down Holland Road..
Council Lady McClanan believes these concerns will be discussed tonight, September 9, 2008, at Kellam
High School during the First Precinct Advisory Commission meeting.

Councilman Uhrin referenced a section of the Traff c Code, making it illegal to have a' for sale "sign on
your car if parked on a public street or highway. The intent of this ordinance is clearly to prevent the
City from becoming a: "used car lot ".
Councilman Uhrin distributed a DRAFT of an AMENDED Ordinance:
Ordinance to AMEND §21-303 of the City Code, Motor Vehicle and Traffic Code
pertaining to the parking of vehicles displaying for sale signs.
The following section shall be AMENDED.
Section 21-303. General parking prohibitions; penalties for violation.
(b) No person shall park a vehicle, except when necessary to avoid conflict with other
traffic or in compliance with the directions of a Police Officer or traff c-control device, in
any of the following places:

Mayor Oberndorf referenced the new Emergency facility (311) the City Council had the foresight to
approve as well as finance and build. Mayor Oberndorf advised her husband, Roger, who volunteers at
the State Level as Chairman of the State Aviation Board in preparation for any disaster statewide visited
this facility. He has visited national and other state facilities and has never seen any other comparable to
this state of the art center. This equates to a "gold star" for the staff and City Council for their
foresight, The Emergency Center was formerly in the basement of the Police Department. The Center
has a television screen. where one could see the 13,000 homes without electricity. There was constant
contact with the providers of the City.

Council Lady Henley referenced the Historic Preservation Town Meeting to be held on Wednesday,
September 24, 2008, 7:00 to 9:00 P.M, Kellam High School. The meeting will be organized so as to
obtain effective public comment on the issue. The information received will be recorded, documented and
evaluated for use by staff and the Commission in the development of recommendations for preservation
policies and the City's role and assistance for preservation.
Mayor Oberndorf advised Candidate Forums are scheduled almost every single night. Detailed
questionnaires are being forwarded to the Candidates, She will check her schedule and advise Council
Lady Henley
Council Lady Wilson also referenced the Wine Tasting Fund Raiser at the historic Francis Land House
sponsored by the Friends of the Francis Land House. Saturday, September 13, 2008. 5:00 P.M - 7:00
P.M Tickets are $30.00 each.
Mayor Oberndorf advised the High Holy Days also occur and this is definitely our time to be with the
family and Synagogue.
Council Lady Henley advised the Comprehensive Plan Forums are also scheduled and scattered
throughout the City from September 15, 2008, to October 27. 2008.

Mayor Oberndorf extended congratulations directly to Councilman Villanueva and his wife Cathy on the
birth of the ir precious daughter, Kate Jolie Caragan Villanueva, 7 pounds 9 ounces.

Councilman Diezel complimented the City Manager and staff for responding to the concerns of Willis
Harold, 4821 Dolton Drive concerning the "Cornerstone" development surrounding his property. (See

Mr. Harold has gone from living in a very quite residence with trees surrounding his presence to
construction 3600 (three hundred sixty degrees) surrounding his residence. Councilman Diezel and staff
will continue to monitor the problems.

The purpose of the Public Utilities Supervisory Control and Data Acquisition (SCADA) System is to
replace the City's outdated system operated by the Department of Public Utilities at the Dam Neck
Operations Facility and Lake Gaston Pumping station. The SCADA system monitors and controls the
water and sanitary sewer infrastructure for the entire City and monitors the raw water feed from the Lake
Gaston pumping station,
The system vendor (Edison Automation) and ComIT are making changes to the new system and setting up
new features based on feedback and testing by Public Utilities. Support and reliability have been
enhanced through Public Utilities' and ComIT's collaborative efforts
The InSITE Human Resources/Payroll System's purpose is to consolidate multiple aging Human
Resources and Payroll systems into one centralized, integrated system, streamlining business processes,
improving reporting and data access capabilities and meeting the demands of the City's changing
workforce. The Payroll System is still on-line for the January 1, 2009, launching.

Ordinance CONFIRMING the Declaration of a Local Emergency Due to the Imminent
Threat of Disaster posed by Tropical Storm Hanna.
Virginia Code ~ 44-146.21. authorizes the local Director of Emergency Services to declare the existence
of a local emergency. As Tropical Storm "Hanna" approached the City, the City Manager, as the
Director of Emergency Management, issued a Declaration of Local Emergency in light of the imminent
threat of danger that this tropical storm posed. Virginia Code ~ 44-146.21. requires the City Council
confirm the Declaration of Local Emergency within fourteen (14) days of that declaration.
The City Manager requested this Ordinance be ADDED to the Agenda,
Mayor Oberndorf referenced a telephone call from a citizen concerned about a tree being brought down
by the storm on Gum Bridge Road.
Council Lady Henley advised the City Arborist contacted her approximately three (3) weeks prior
concerning this tree close to Charity United Methodist Church. This tree could not be further pruned or
cabled: and. therefore. was looked upon as a potential hazard. The tree was very old. The City was also
very prompt in removing the debris of the other tree which went down on Indian River Road.

Imminent Threat of Disaster Posed by Tropical Storm Hanna
MEETING DATE: September 9,2008
. Background: Virginia Code ~ 44-146.21 authorizes the local director of
emergency services to declare the existence of a local emergency. As Tropical Storm
Hanna approached the City, the City Manager, as the Director of Emergency
Management, issued a declaration of local emergency in light of the imminent threat of
danger that this tropical storm posed. The local declaration of emergency was issued at
noon on September 5, 2008 and concluded at 3:00 p.m. on September 6, 2008.
Governor Kaine also issued a State of Emergency on September 4, 2008. The
Governor's declaration authorized state agencies to take all reasonable actions
necessary to protect the health and safety of Virginians from the potentially damaging
effects of Tropical Storm Hanna. The City Manager's declaration authorized City
agencies to take similar steps to adequately and appropriately respond on the local
level.
. Considerations: Section 44-146.21 requires that the City Council confirm the
declaration of local emergency within 14 days.
. Public Information: This ordinance will be advertised in the same manner as
other Council agenda items.

11 WHEREAS, in conformity with the Commonwealth of Virginia Emergency
12 Services and Disaster Law of 2000 (Virginia Code S 44-146.13 et seq.), City Council, by
13 adoption of SS 2-411 through 2-413 of the City Code, created the Office of Emergency
14 Management and appointed the City Manager as the Director of Emergency

1. The skateboard ramp shall be located and constructed in substantial compliance with the

2, Use of the ramp shall be limited to the hours between 10:00 AM and dusk.
3. To reduce the level of sound emanating from the ramp when in use, the following shall be utilized
in the construction of the ramp: (a) the underside of the plywood beneath the skating surface
shall be insulated; (b) the sides and ends of the ramp shall be enclosed with wood; (c) roofing
paper shall be installed between the plywood and the skating surface of the ramp.
4. A chain shall be secured across the ramp when the ramp is not in use such that the ramp cannot
be used.
5, At least one adult shall be outside the house and present when the ramp is in use.
6, The applicant shall enforce the rules submitted with the application regarding use of the ramp.
The Zoning Administrator shall annually evaluate whether the rules have been enforced and
verify adherence to the conditions above. If the evaluation reveals that the rules and conditions
are being met, the use permit shall be renewed for an additional year with an annual evaluation
thereafter. If the evaluation reveals that the rules and conditions are not being met, the Zoning
Administrator shall refer the use permit to City Council for revocation.
This Ordinance shall be effective in accordance with Section 107 (f) of the Zoning Ordinance,

5. No signs indicating the location of this facility are allowed.
6. Unless a waiver is obtainedfrom the Department of Communications and Information
Technology (COMIT), a radio frequency emissions study (RF Study), conducted by a qualified
Engineer licensed to practice in the Commonwealth of Virginia, showing that the intended user(s)
will not interfere with any City of Virginia Beach emergency communications facilities, shall be
provided prior to site plan approval for the tower and all subsequent users.
7. In the event interference with any City emergency communications facilities arises from the users
of this tower, the user(s) shall take all measures reasonably necessary to correct and eliminate
the interference. If the interference cannot be eliminated within a reasonable time, the user shall
immediately cease operation to the extent necessary to stop the interference.
8, Should the antennas cease to be usedfor a period of more than one (1) year, the applicant shall
remove the antennas, tower and related equipment from the property.
This Ordinance shall be effective in accordance with Section 107 (f) of the Zoning Ordinance.

RESTRICTIONS AND CONDITIONS
THIS FIRST AMENDMENT TO AGREEMENT REGARDING PROFFERED
COVENANTS, RESTRICTIONS AND CONDITIONS made this 23rd day of May, 2008, by and
between SHIPPS-HOLLAND ASSOCIATES, L.L.C., a Virgmla limited liability company,
"Grantor" and R. J McGINNIS (the "Applicant"), both Grantors for purposes of mdexmg and
the CITY OF VIRGINIA BEACH, a Muruclpal corporatlOn of the Commonwealth of Virgmla,
heremafter called "Grantee"
RECITALS:
R-1 The Grantor IS the record fee simple owner of the property located m the Prmcess
Anne DistrIct, City of Virglma Beach and described m Exhibit A attached hereto (the
"Property") and incorporated mto thiS Agreement
R-2. The Applicant has Imtiated a modification to a conditlOna1 amendment to the
zomng map of the City of Virgmla Beach, Virgmia, by petitlOn of the Applicant addressed to the
Grantee, so as to modify conditlOns to the zomng classlficatlOn of the Property. Specifically, the
Applicant has requested the Grantee permit thiS modification of the prevlOus1y proffers,
covenants, restnctions and conditlOns as contamed in that certam Agreement dated October 1,
2003 and recorded IIi the Clerk's Office of the Circwt Court of the City of Virgmla Beach,
Virgmia as Instrument #2004010700003184 (the "2003 Proffers") to reflect amendments
applicable to the land use plan of the property. The proposed modification IS made pursuant to
the terms of the zomng ordinance of the City of Virgima Beach, Virglma, adopted April 18,
1988, as amended and as m effect as of the date of this Agreement (the "Zomng Ordinance").
R-3 The Grantee's policy IS to provide only for the orderly development ofland, for
commerCial purposes through zomng and other land development legislation.
R-4 The Grantor and the Applicant acknowledge that competmg and sometimes
mcompatible uses conflict and that m order to permit different uses on and m the area of the
Property and at the same time to recognize the effect of the changes, and the need for VarIOUS
types of uses, mcluding those listed above, certain reasonable conditlOns governmg the use of the
Property for the protectlOn of the commumty that are not generally applicable to land Similarly
zoned B-2 conditional are needed to cope With the situatlOn which the Applicant's rezomng
applicatlOn gives rIse to.
R-5 The Grantor and the Applicant have voluntarily offered, m writmg, m advance of
and prIor to the public hearmg before the Grantee, as part of the proposed amendment to the

to the physIcal development, operation and use of the Property to be adopted as part of saId
amendment to the zoning map relatIve and applicable to the Property, winch have a reasonable
relatIOn to the rezonmg and the need for WhICh It IS generated by the rezomng.
R-6. The conditIOns outlined m tins Agreement have been proffered by the Grantor and
the Applicant and allowed and accepted by the Grantee as part of the amendment to the Zomng
Ordinance and the zOnIng map. These conditions shall contmue m full force and effect until
subsequent amendment changes the zoning of the Property; however, that such conditIOns shall
contmue despIte a subsequent amendment If the subsequent amendment IS part of the
comprehensIve ImplementatIOn of a new or substantially revIsed zomng ordinance of the
Grantee, unless, notwithstanding the foregomg, the conditions are amended or varied by wntten
mstrument recorded In the Clerk's Office of the Circuit Court of the City of VirgInIa Beach,
V irgInIa and executed by the record owner of the Property at the tune of recordation of such
Instruments; provIded further that saId instrument is consented to by the Grantee In wntIng as
eVIdenced by a certIfied copy of the ordinance or resolutIOn adopted by the govermng body of
the Grantee, after a public hearIng before the Grantee advertIsed pursuant to the provIsIons of the
Code of VirgInIa, SectIOn 15.2-2204, WhICh saId ordinance or resolution shall be recorded along
wIth saId mstrument as conclusIve eVIdence of such consent.
WITNESSETH:
NOW, THEREFORE, the Grantor and the Applicant, for themselves, theIr successors,
personal representatIves, assIgns, grantees and other successors In title and Interest, voluntarily
Without reqUIrement by or exactIOn from the Grantee or ItS govermng body and Without any
element of compulsIOn or qUId pro quo for zomng, rezoning, site plan, building permit or
subdiVIsion approval, hereby make the follOWing declaratIOn of conditions and restnctIons WhICh
shall restnct and govern the physIcal development, operation and use of the Property and hereby
covenant and agree that thIS declaratIOn shall constItute covenants runnIng WIth the Property,
whIch shall be bmding upon the Property and upon all partIes and persons ClaImIng under or
through the Grantors, theIr successors, personal representatives, assIgns, grantees and other
successors In mterest or title.
1 The prelimmary sIte plan submItted by the Grantors and the Applicant to the
Department of PlannIng With this Agreement and entItled "OfficelRetail Building Parcel B I-B4"
dated May 1, 2008 (the "Plan") IS mcorporated herein by reference and forms a part of thIS
Agreement and shall be substantially adhered to in the development of the Property
2. The only permItted use on the Property IS to be an office and retail building unless
agreed to by City Council.
3 The covenants, restrIctIOns and conditIOns set forth herem replace and supersede
the 2003 Proffers With the exception of Section 3 of the 2003 Proffers, WhICh remams m full
force and effect.

4 Further conditIOns may be reqUired by the Grantee dunng detailed sIte plan and/or
subdivlSlon reVIew and admInIstratIon of applicable City Codes by all cognIzant City agenCIes
and departments to meet all applicable City Code requirements.
The Grantor and the Applicant covenant and agree that:
a. The Zoning AdmInistration of the City of VirgInIa Beach, VirgInIa, shall
be vested WIth all necessary authonty on behalf of the governing body of the City of VirgInIa
Beach, VirgInia, to admInIster and enforce the foregoIng conditIOns and restnctions, Including
the authonty 0) to order In wntIng that any non-compliance WIth such conditions be remedied
and (ii) to brIng legal actIOn or SUIt to Insure compliance with such conditions Including
mandatory or prohibItory inJunction, abatement, damages or other appropriate actIon, SUIt or
proceedings.
b. Failure to meet all conditIOns and restnctions shall constitute cause to
deny the Issuance of any of the requIred building or occupancy permIts as may be appropnate.
c. If aggneved by any decIsIon of the ZOnIng AdmInIstrator made pursuant
to the provlSlons of the City Code, the ZOnIng Ordinance, or thIS Agreement, the Grantor shall
petItIon the governIng body of Grantee for the reVIew of such declSlon pnor to institutIng
proceedings in court.
d. The ZOnIng Map shall show by an appropnate symbol on the Map the
eXIstence of conditIOns attachIng to the ZOnIng of the Property on the map and that the ordinance
and the conditIOns may be readily available and accessible for public InSpectIOn In the office of
the ZonIng AdmInIstrator and In the Planmng Department and that they shall be recorded In the
Clerk's Office of the CirCUIt Court of the City of VirgInIa Beach, VirginIa, and Indexed In the
name of the Grantor and Grantee.

WHEREAS, the public necessity, convenience, general welfare and good zoning
practice so require;

For the purpose of this ordinance, words used in the present tense shall include
the future; words used in the singular number include the plural and the plural the
singular; the use of any gender shall be applicable to all genders; the word "shall" is
mandatory; the word "may" is permissive; the word "land" includes only the area
described as being above mean sea level; and the word "person" includes an individual,
a partnership, association, or corporation.
In addition, the following terms shall be defined as herein indicated:

34 Automobile museum. A museum at which vintaqe or classic automobiles
35 manufactured prior to 1971. exotic or limited-production automobiles, or automobiles
36 havinq a special cultural or historical siqnificance and qenerallv reqarded as collector's

38 the qeneral public as an ancillary activity.

Sec. 223.1. Automobile museums.
In addition to qeneral requirements. automobile museums shall be subiect to the
followinq provisions:
(a) No automobiles. except for vintaqe or classic automobiles manufactured
prior to 1971. exotic or limited-production automobiles. or automobiles havinq a special
cultural or historical siqnificance and qenerallv reqarded as collector's items shall be
exhibited. displaved. offered for sale or stored on the property.
(b) All automobiles that are exhibited. displaved or offered for sale shall be of
exhibition Qualitv and appearance;
(c) No automobiles shall be exhibited. displaved or stored except within a
fullv-enclosed buildinq; provided. that a maximum of three (3) automobiles may be
parked outside of a buildinq for UP to seventy-two (72) hours for purposes of preparinq
such automobiles to be displaved as a museum exhibit or delivered to a purchaser. and
provided further. that if allowed bv the conditional use permit. special shows of
automobiles meetinq the requirements of subsections (a) and (b) may be held outdoors
for periods of a maximum of five (5) days and no more freQuentlv than once every thirty
(30) days.
(d) No automobile shall be offered for sale unless it has been displaved as a
museum exhibit or at a special show for at least three (3) days.
(e) No repairs or other work on automobiles. except for refurbishinq and
restorinq of automobiles meetinq the requirements of subsection (a). detailinq in
preparation for exhibition. and final preparation and assemblv for delivery to a person
purchasinq an automobile. shall be permitted. All such work shall be performed
indoors. except as allowed in subsection (c).
(f) The City Council may attach such other and further reasonable conditions
of the conditional use permit as it may deem necessary to ensure that the sale of
automobiles is conducted in such manner as to be ancillary to the use of the property as
a museum.
Sec. 901. Use regulations [Business Districts].
(a) Principal and conditional uses. The following chart lists those uses
permitted within the B-1 through B-4K Business Districts. Those uses and structures in
the respective business districts shall be permitted as either principal uses indicated by
a "P" or as conditional uses indicated by a "C." Uses and structures indicated by an "X"
shall be prohibited in the respective districts. No uses or structures other than as
specified shall be permitted.
