Mayor Sessoms requested Councilman Uhrin commence the Briefing re Grommet Island Park.
Councilman Uhrin advised the City has made many strides in creating access for the disabled. The access
to the City's Beaches are preferable to any on the East Coast. The Sandler Center has gone well beyond
the legal requirements re disability access. Virginia Beach is also the "home" of the only Dinner Cruise
Ship, located off Laskin Road, which is fully handicap accessible. Councilman Uhrin presented City
Council with an opportunity to do even better in terms of providing a handicapped accessible playground
directly on the sand in Virginia Beach. Bruce Thompson, President - PHR, developed the concept.
Bruce Thompson advised his son, Josh, had been diagnosed with Amyotrophic Lateral Sclerosis (A LS),
now commonly known as "Lou Gehrig's Disease ", inspired a record breaking fundraiser for ALS, the
"JT WALK AND BEA cn PAR TY" on October 19, 2008. The goal for $100,000,' was exceeded with
$1-MILLION raised. There were 7,000 participants. The proceeds were provided to John Hopkins and
shortly thereafter President Obama signed the legislation for "stem cells ". A substantial grant was
received for this research. Also a substantial grant was made to the local ALS Chapter. The first Multi-
Disciplinary Clinic was opened in Newport News where all the ALS patients can be provided medical
care in one place (Speech Pathologist, Neurologist, Social Worker, Occupational Therapist and Dentist).
These facilities were not previously available anywhere in the region. Mr. Thompson referenced The
New York Times article featuring his son on "Fighting for a Last Chance at Life", Sunday, May 17,
2009. This concerned the Family Access to an unproved drug developed in Richmond but not approved
by the Federal Drug Administration (FDA) in the United States. The Italian Minister of Health made this
drug available in Italy. There is legislation that is being considered today which will make experimental
drugs available to terminally ill patients.
Mr. Thompson advised the cost to maintain Josh's health is well over $1I4-MILL/ON a year, of which
much of this amount is not covered by insurance.
Mr. Thompson was requested to fund the building of a playground, which was built right behind the
Hilton to the right of the Neptune statue. Because of conflicts, he had to move the Park to the other side of
the Neptune Statue. However, as a result of the new location, the park is even larger and more improved.
While walking by the Park, his attention was brought to a small boy in a wheel chair looking through the
railings. He contacted Barry Frankenfield, Strategic Growth Area Manager (SGA) , who advised
playground equipment is available for individuals with disabilities. BifZv Almond, Landscape Architect,
advised if Mr. Thompson wished to assume this project he would assist with the design. Working with the
National ALS Association, local organizers of the JT Walk have agreed that 100% of sponsor donations
and 50% offunds raised by the Walk will be used toward the construction of JT's Grommet Island
Beach Park and Playgroundjor "everyone ". The remaining 50% offunds raised by the JT Walk will be
donated to the ALS Association to use for patient services. The location considered is Rudee Inlet.
Representatives of the surfing community were requested to attend a meeting re this location and
concurred with the site. Mr. Thompson di!;played a Bronze Sculpture entitled ("Anticipation "), which
will overlook the Park. This Sculpture was made from a family photograph featuring Josh mentoring his
younger brother in the art of surfing.
A young girl, thirteen years of age, Caroline Pennell, National spokesperson for Multiple Dystrophy, was
chosen as the Chair for the development of JT's Grommet Island Park. Unfortunately, she has a
progressive form of the disease but readily agreed to assist in the design of the Park. She will be on the
Jerry Lewis Telethon Memorial Day weekend and will discuss this proposed Virginia Beach Park.

JT's Grommet Island site consists of roughly 15,000 square feet of a paradise playground located at the
Atlantic Ocean Boardwalk between 1" and 2nd Streets in Virginia Beach. This one-ofa-kind playground
inspired by JT and his for surfing will front directly on the sand overlooking the popular surf spot for the
annual East Coast Surfing Championships. It also boasts the most accessible beach playground in the
region. Amenities, such as Beach Combers, Surf Cams and cutting-edge play structure integrate children
of all ages and of every physical ability level to play and imagine. At the very end of the Boardwalk, an
existing ramp and stairs provide the primary entrance. On the north side of the playground, a secondary
ramp provides additional wheelchair access. Extra wide ramps and features designed for universal
access truly make this a playground that will integrate children of all ability levels. The Tensile Canopy
consists of fabric stretched atop 20-foot poles which provides ample shade. These are easily remuvable
and may be hoisted daily during Summer months. There is accessible surfthemed play. "Beach
Combers" will be allowed accessible interaction with surf and beach activities. While some of the
features are freestanding, others may be integrated with the play system. Features, such as the Padding
Challenge, offer children the benefit of exercise while they test their big surf paddling skills. The
accessible play system's universal design accommodates use by all children. Accessible beach seating
provides a place for friends and family to experience the beach tOflether. Wood polymer decking provides
abundant accessible !;pace for viewing the East Coast Surfing Championships and other Oceanfront
beach events held every year.
The soft play structure consists of a pod of dolphins playfully welcoming visitors into the !;pace and
encourages toddler climbing This play zone is a safe distance from the more rambunctious play. but
close enough to encourage different age groups to integrate. A space along the secondary ramp allows
the opportunity of a municipal beach wheelchair rental program. Additional space under the ramp yields
storage for tensile canopies and beach umbrellas.
50% of the JTWALK and BEACH PARTY proceeds this year will go toward park construction and
100% of !;ponsorship donations will be used to build the park.
The website is jtwalk.org. Grommet is a Hawaiian term which means "little surfer".

Councilman DeSteph distributed the announcement and certificate re the Veterans Day National
Committee selecting the City of Virginia Beach, Virginia, as a Regional Site for the observance of
Veterans Day 2009.
Councilman DeSteph advised Bill Muehleib, National Vice President of the local Pearl Harbor Survivors
Association, Inc. and a member of the Department of Veterans Affairs, Veterans Service Organization,
sponsored Virginia Beach as a candidate for consideration as a National Veterans Day Regional Site.
Mr. Meuhleib gave this request to Councilman DeSteph who has worked on this designation for
approximately a year.
ITEM # 59116
Councilman Villanueva referenced the Black Expo 2009 in Virginia Beach this past week with many
activities involved. 350 African American businesses participated. All the events were very well intended.
Councilman Villanueva welcomed the Black Expo 2009 at the Westin re the African American Business
Awards Breakfast on August 20, 2009. On Saturday, August 22, 2009, the 5th Annual Virginia Black
Expo was held at the Convention Center.

Councilman Diezel advised the issue of International Seasonal Workers was examined afew years ago. A
citizen expressed concern re the treatment and disposition of these workers. Councilman Diezel advised
there are no hostels. Councilman Diezel requested a progress report
Councilman Uhrin advised the Hotel/Motel Association. in conjunction with several organizations at the
Oceanfront, has established a very intensive orientation program, which has assisted with the placement
of jobs, housing and various services i.e. including cell phones. There has been some commercial
development at the Ocearifront designed especially for exchange students.
Mayor Sessoms advised free computer time is provided for communication to the families, and the
students are provided bicycles.

Councilman Uhrin referenced the accomplishments of the MEDAC (Military Economic Development
Advisory Committee). A new military website has been developed through Economic Development to
create links to contractors with potential military and government contracts and the private sector to hire
potential employees who are leaving the Military. Links are being created between future developments in
Burton Station and other governmental and military contractors. Councilman Uhrin believes successes
would be announced in the very near future. MEDAC has been working with the Commanding Officer of
Little Creek to introduce testing for a wind farm.

ITEM # 59119
Councilman Uhrin referenced the New Construction Report for the Quarter Ending June 30, 2009,
provided by the Real Estate Assessor, Jerald Banagan. The current tax base is 15% commercial and 85%
residential. City Council set a goal to change this in terms of the value of new construction. The value of
new construction for the quarter ending June 30,2009, was $138,868,952. Of that amount, $43,190,800
or (31.1%) was commercial and $95,678,152 or 68.9% was residential. The total represents a decrease
of 44. 7% from the same quarter last year. Said report is hereby made a part of the record.
Council Lady Wilson advised in her review of the past four or five years, the percentage of residential to
commercial has really been in line with the City's goal,' however, the problem is that the residential
assessments rose so high that this balance was "knocked" off jar a while. The City has been absorbing a
lot more commercial to achieve the goal.
ITEM # 59120
Councilman Davis referenced the Sportsplex. The new turf was fully installed on Thursday, August 20,
2009. This turf is amazing and the premier turn jar the National Football League (NFL). It is amazing
just to walk on this turf The Sportsplex website shows the detailed laying of this turf The Ribbon
Cutting will be Thursday, August 27,2009, at 1:30 P.M One of the practices was delayed an hour and a
'half due to a big downpour of rain. Ocean Lakes and Princess Anne will have the "football game of the
week", this Friday, August 28,2009.
ITEM # 59121
The City Manger distributed notice re Phase I Laskin Gateway Construction Impact and Public Open
House notice. The PUBLIC OPEN HOUSE will be held on September 3, 2009 from 6:30 A.M to 8:30
P.M at the Virginia Beach Convention Center. Phase I is scheduled to begin September 8. Virginia
Beach Public Utilities will manage construction during this phase. New water and sanitary sewer lines
will be installed to replace aging systems, improve storm water facilities to improve drainage and
minimizeflooding and install electrical duct banks so we can remove overhead power lines over time.
ITEM # 59122
Council Lady Henley referenced e-mails concerning the light rail transit meetings sponsored by
Hampton Roads Transit. The City Manager advised these meetings will introduce the study and provide
citizens the opportunity to submit public comment.

Councilman Diezel advised City Council he, with the assistance of the City Attorney, had prepared a
DRAFT Ordinance re electronic billboards.
Councilman Diezel, the City Manager and City Attorney met with Adams Advertising to review the Draft
Ordinance and share their thoughts.
After that meeting, Deidra Fernandes - Virginian-Pilot Reporter, sent a FOIA request for the Ordinance.
Councilman Diezel apologized that the Ordinance was made public ahead of their perusal.
City Council discussed areas where the landscaping around billboards is in need of maintenance and that
some billboards in disrepair need to be replaced.

PLEDGE OF ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA
Mayor Sessoms DISCLOSED as an officer of TowneBank (which has a corporate office located at 297
Constitution Drive in Virginia Beach), he is directly and indirectly involved in many of TowneBank's
transactions. However, due to the size of TowneBank and the volume of transactions it handles,
TowneBank has an interest in numerous matters in which he is not personally involved and of which he
does not have personal knowledge. In that regard, he is always concerned about the appearance of
impropriety that might arise if he unknowingly participates in a matter before City Council in which
TowneBank has an interest. Mayor Sessoms also has similar concerns with respect to Prudential Towne
Realty, which is an affiliate of TowneBank. In order to ensure his compliance with both the letter and
!;pirit of the State and Local Government Conflict of Interests Act (the "Act'), it is his practice to
thoroughly review each City Council agenda to identify any matters in which he might have an actual or
potential conflict. If, during his review of an agenda, he identifies a matter in which he has a "personal
interest ", as defined by the Act, he will either abstain .from voting, or file the appropriate disclosure letter
with the City Clerk to be included in the official records of City Council. Mayor Sessoms' letter of
March 24, 2009, is hereby made a part of the record.
Vice Mayor Jones DISCLOSED, for many years, he served on the Board of Directors of Resource Bank.
Three (3) years ago, Fulton Financial Corporation ("Fulton Financial") purchased Resource Bank. On
March 31, 2007, Vice Mayor Jones retired .from the Board of Directors. Although, he is no longer a
Board Member. he owns stock in Fulton Financial, and that stock ownership causes him to have a
"personal interest" in Fulton Financial. However, due to the size of Fulton Financial and the volume of
transactions it handles in any given year, Fulton Financial, or any of the banks that are owned by Fulton
Financial, may have an interest in numerous matters in which Vice Mayor Jones has no personal
knowledge. In order to ensure his compliance with both the letter and the spirit of the State and Local
Government Conflict of Interests Act, it is his practice to thoroughly review the agenda for each meeting
of City Council for the purpose of identifying any matters in which he might have an actual or potential
conflict. If, during his review, he identifies any matters, Vice Mayor Jones will prepare and file the
appropriate disclosure letter to be recorded in the official records of City Council. Vice Mayor Jones
regularly makes this disclosure. Vice Mayor Jones' letter of April 10, 2007, is hereby made a part of the
record.

transactions. However, due to the size of Goodman and Company and the volume of transactions it
handles in any given year, Goodman and Company has an interest in numerous matters in which her
husband is not personally involved and of which she does not have personal knowledge. In order to
ensure her compliance with both the letter and the spirit of the State and Local Government Coriflict of
Interests Act, it is her practice to thoroughly review the agenda for each meeting of City Council for the
purpose of identifying any matters in which she might have an actual or potential conflict. lj, during her
review she identifies any matters, she will prepare and file the appropriate disclosure letter to be
recorded in the official records of City Council. Council Lady Wilson regularly makes this disclosure.

who advised there are many wonderful volunteers who produce the Neptune Festival. The citizens enjoy
the best community festival anywhere in the Commonwealth of Virginia. Ms. Creech introduced Matthew
Breitenberg, 2009 Festival Chair and owner of Straightpath Management, Inc. He is the "best of the
best. "
Chairman Breitenberg advised the Neptune Festival is entering the Thirty-sixth year of serving Virginia
Beach. The leadership of Virginia Beach Events, Unlimited, is comprised of men and women who are
actively engaged in supporting our community in many areas, including business, civic. cultural and
educational arenas. The Neptune Festival is recognized as one of the top festivals in the Country and the
largest special event in the Commonwealth of Virginia. Each year the Festival produces a significant
economic return to the City as well as a great time for citizens and visitors. There is truly something for
everyone ranging from activities appealing to children, Senior Citizens and all ages in between.
Chairman Breitenberg appreciates the support of the City Council and thanked them again for partnering
in this great community celebration. He expressed appreciation to the over 1,000 volunteers who assist in
producing the Festival. The Court is dedicated and proud to be part of Virginia Beach's largest and best
loved celebration.

He is proud to be associated with Chairman Breitenberg, Chief Executive Officer Nancy Creech, his
Tritons and Princesses and, most especially, the Mayor and City Council. About five (5) years ago, he
was involved with the development of the King Neptune Statue at 31'/ Street Park. The organization is
comprised of a group of individuals who have dedicated their lives to this City. The Neptune Festival
commenced thirty-six (36) years ago as a means of extending the Resort Season by providing a
celebration to its citizens. The Neptune Festival has evolved into an organization that is now involved
with virtually every major charitable organization in the City.
Mayor Sessoms expressed appreciation to the members of the Neptune Festival. The Mayor and City
Council are extremely proud of them.

WESTERN BA YSIDE SUMMER CAMPS.
Mayor Sessoms introduced Barbara A. Brinson, Youth Opportunities Coordinator, who recognized some
very exceptional individuals, the parents and youth participants of the Western Bayside Summer Camps
and the Freedom School (a literacy based Summer Camp operated by Parks and Recreation in
collaboration with the Children's Defense Fund) The City Council the Summer Camps from a Request
For Funding (RFP)in the Western Bayside area. Ms. Brinson advised: "They are all here to thank City
Council in their own very special way ". In the three (3) Western Bayside Summer Camp programs, over
one hundred fifty (150) elementary and middle school Western Bayside Youth had educational and
recreational opportunities, which they may not have otherwise had. One Program was administered by
Reaching our Communities in partnership with Heritage United Methodist Church and the other by
Enoch Baptist Church providing the space. Heritage United Methodist Church was represented by Board
Members Larry Zotzmann and Bill MaGaw (Reaching our Communities). Dr. Michael Daniels. Pastor,
represented Enoch Baptist Church. Harry Young oversees all "out of school" programs. Parents have a
vital role in assisting their children. Ms. Brinson requested all the parents of the Western Bayside
Community stand.

appreciation:

more important.
Vice Mayor Jones advised Western Bayside Summer Camps has been a tremendous success and is an
excellent example of what a new Western Bayside Recreation Center can accomplish for children in this
area.

Attorney R. J. Nutter, 222 Central Park Avenue, Phone: 687-7500, represented Hi-Sea, LLC, and spoke re the Joint
Term Sheet. Bruce Thompson is a partner in Hi-Sea, LLC. This property has been owned in excess of twenty (20)
years, with the most recent acquisition ten (lO) years ago. The owners began acquiring property in the 1950 'so The
property coming before the City Council for redevelopment is a by-right activity. Mr. Thompson did not enter into
the transaction until 2007. This property is consistent with the Comprehensive Plan changes and the Capital
Improvement Program.
Billy Almond, 209 - 70'h Street, Phone: 422-9522, resident of the North End, represented the Resort Advisory
Commission, and the RAC Planning, Design and Review Subcommittee. Beach Centre, and the remaining six (6)
development blocks of the Laskin Gateway area, are vital to the convention and tourism business.
David Jester, 200 63rd Street, Phone: 422-0175, President - North Virginia Beach Civic League. Mr. Jester advised
Barry Frankenfield and his staff presented information a few weeks ago which was attended by a number of Civic
Leagues. The members were impressed with the presentation and he has not had any negative feedback.
Lawrence W Kliewer, 205 77th Street, Phone: 431-0033, member of the Resort Advisory Commission, Planning
and Design Review Committee, brought attention to the quality of this development of Hi-Sea, LLC and Gold Key
PHR.
The following issued concerns re traffic:
Ted Davis, 137 Pinewood Road, Phone: 282-9404, Treasurer - Linkhorn Park Civic League and Member of the
Citizens Action Committee re trqffic, advised concerns re traffic. Mr. Davis has attendedfive (5) meetings held by
City staff. Of those five (5) meetings, there was not one of them that was not contentious.
Joseph Pruecher, 126 Pinewood Road, Phone; 425-2031, resident of Linkhorn Park, supports the modernization of
the Beach and improvements to Laskin Road. Mr. Prueher believes some of the traffic issues must be resolved. The
information available to the residents re the Laskin Road plan and the effect on Hol~v and Pinewood Roads
indicates a large impact on the trafficflow in Linkhorn Park, Bay Colony and the North End of the Beach. The
proposed redirection of the traffic seems to ignore some issues, such as the periodic flooding of Pinewood Road
and the emergency vehicle ingress and egress.
Greg Battaglia, 1016 Abingdon, Phone: 713-5899, representative of Bay Colony Community League,
complimented the City re the initiative to improve the Laskin Road/3]'"1 Street Corridor. In the process of
developing this area, the residents wish to make sure their concerns are heard, especially re the flow and access to
andjrom their neighborhoods (safety and emergency vehicle access).
Priscilla Parcells, 617 Linkhorn Drive, Phone: 425-5715, former President - Linkhorn Park Civic League and
resident of over 35 years. Many of the residents of Bay Colony, Cavalier and Linkhorn Parks believe the City
Council is more concerned with the transient tourists than the residents. Because of poorly planned traffic patterns
and traffic light sequencing, it has become increasingly difficult to move around and through the Beach District.
Tom Coghill, 1125 York Lane, Phone: 422-3425, spoke in OPPOSITION. He believes the $30-MILLION would
be of better elsewhere to provide safe routes to schools and the Recreation Center in Bayside.

7 WHEREAS, the City of Virginia Beach (the "City") is the owner of
8 that certain parcel of land located at 224 Roselynn Lane (GPIN 2417-05-3393)
9 (the "Property"), more particularly described on Exhibit "A" attached hereto and
10 made a part hereof;

12 WHEREAS, the City acquired the Property pursuant to the APZ-1
13 Acquisition Program;

15 WHEREAS, the City funded the acquisition of the Property through
16 a partnership with the Commonwealth of Virginia (the "Commonwealth"), with
17 each party contributing fifty percent (50%) of the funds;
18
19 WHEREAS, the Property is in the midst of other residences and at
20 the time of acquisition was improved with a residential dwelling;
21
22 WHEREAS, City Council has elected to allow the renovation of the
23 single-family home in order to maintain the integrity of the neighborhood; and
24
25 WHEREAS, a Request for Proposal ("RFP") was advertised for the
26 potential sale of the Property;
27
28 WHEREAS, Don Danylyk ("Danylyk") responded to the RFP with an
29 offer to purchase the Property;
30
31 WHEREAS, the APZ-1 Disposition Committee has recommended
32 that City Council declare the Property to be in excess of the City's needs and sell
33 the Property to Danylyk.;

35 WHEREAS, Danylyk will renovate the existing single-family home
36 on the Property to prescribed standards acceptable to the City, including
37 elevated noise attenuation standards, and will thereafter occupy the Property;
38
39 WHEREAS, Danylyk will purchase the Property in accordance with
40 the Summary of Terms attached hereto as Exhibit "B" and made a part hereof;

42 WHEREAS, the City Council is of the opinion that the Property is in
43 excess of the needs of the City of Virginia Beach.

45 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF

7 WHEREAS, the City of Virginia Beach (the "City") is the owner of that certain
8 parcel of land located at 1461 Bartow Place (GPIN 2417-05-9136) (the "Property"),
9 more particularly described on Exhibit "A" attached hereto and made a part hereof;
10
11 WHEREAS, the City acquired the Property pursuant to the APZ-1
12 Acquisition Program;
13
14 WHEREAS, the City funded the acquisition of the Property through a
15 partnership with the Commonwealth of Virginia (the "Commonwealth"), with each party
16 contributing fifty percent (50%) of the funds;
17
18 WHEREAS, the Property is in the midst of other residences and at the
19 time of acquisition was improved with a residential dwelling;
20
21 WHEREAS, City Council has elected to allow the renovation of the single-
22 family home in order to maintain the integrity of the neighborhood; and
23
24 WHEREAS, a Request for Proposal ("RFP") was advertised for the
2 5 potential sale of the Property;

2 7 WHEREAS, Scot and Allison Willwerth responded to the RFP with an offer
28 to purchase the Property;
29
30 WHEREAS, the APZ-1 Disposition Committee has recommended that City
31 Council declare the Property to be in excess of the City's needs and sell the Property to
32 Mr. and Mrs. Willwerth;
33
34 WHEREAS, Mr. and Mrs. Willwerth will renovate the single-family home
35 on the Property to prescribed standards acceptable to the City, including elevated noise
36 attenuation standards, and will thereafter occupy the Property;
37
38 WHEREAS, Mr. and Mrs. Willwerth will purchase the Property in
39 accordance with the Summary of Terms attached hereto as Exhibit "B" and made a part
4 0 hereof;

4 2 WHEREAS, the City Council is of the opinion that the property is in excess
4 3 of the needs of the City of Virginia Beach.

45 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCil OF THE CITY

48 That the Property located at 1461 Bartow Place (GPIN 2417-05-9136) is hereby
49 declared to be in excess of the needs of the City of Virginia Beach and that the City

50 Manager is hereby authorized to execute any documents necessary to convey the
51 Property to Scot and Allison Willwerth, in substantial conformity with the Summary of
52 Terms attached hereto as Exhibit B and such other terms, conditions or modifications
53 as are deemed necessary and sufficient by the City Manager and in a form deemed
54 satisfactory by the City Attorney.

56 Further, that the revenue from the sale of the Property in the amount of
57 $70,000 shall be received and appropriated as follows:
58 1. $35,000 shall be appropriated to CIP #9-060, Oceana and Interfacility
59 Traffic Area Conformity and Acquisition, for the purpose of the City Manager refunding
60 the Commonwealth's portion in accordance with the partnership agreement;
61 2. $35,000 shall be appropriated to CIP #3-368, Various Site Acquisitions.

8 "School Site"), it was determined that the School Site is owned by the City of Virginia
9 Beach;

11 WHEREAS, Virginia Code 922.1-125 requires that title to all school property be
12 vested in the School Board absent an agreement between the School Board and the
13 City to the contrary; and

15 WHEREAS, it is appropriate that title to the School Site be transferred from the
16 City to the School Board.

18 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF

AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
EXECUTE A lEASE FOR lESS THAN FIVE YEARS WITH JOHN
DOE FOR CITY OWNED PROPERTY lOCATED AT 2089 INDIAN
RIVER ROAD
WHEREAS, the City of Virginia Beach ("the City") is the owner of that
certain residential dwelling (the "Premises") located at 2089 Indian River Road
and shown on Exhibit A;
WHEREAS, John Doe (the "Tenant") has agreed to pay the City $825.00
monthly for the use of the Premises;
WHEREAS, the Police Department prefers to lease the property to a
police officer, and the Tenant is a police officer. For security reasons, the Police
Chief has requested that the name of the Tenant not be publicly released.
WHEREAS, the Tenant would like to enter into a formal lease
arrangement with the City for the Premises; and
WHEREAS, the Premises will be used as a residence, and for no other
purpose.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF VIRGINIA BEACH, VIRGINIA:
That the City Manager is hereby authorized to execute a lease for a term

19 That Section 111 of the City Zoning Ordinance is hereby amended and
20 reordained, and a new Section 217, pertaining to electronic display signs, is hereby
21 added, to read as follows:

23 Sec. 111. Definitions.
24 For the purpose of this ordinance, words used in the present tense shall include
25 the future; words used in the singular number include the plural and the plural the
26 singular; the use of any gender shall be applicable to all genders; the word "shall" is
27 mandatory; the word "may" is permissive; the word "land" includes only the area
28 described as being above mean sea level; and the word "person" includes an individual,
29 a partnership, association, or corporation.

31 In addition, the following terms shall be defined as herein indicated:

33 Sian. electronic disp/av. A sian containina liaht emittina diodes (LEOs), fiber
34 optics. liaht bulbs. plasma displav screens or other illumination devices. or a series of
35 vertical or horizontal slats or cvlinders that are capable of beina rotated at intervals. that

framework or integrated into landscaping or other solid structural features other than
support poles, and the base of which is at least seventy-five (75) percent of the total
width of the sign. Monument sians have the followina additional characteristics:

COMMENT
The amendments in Lines 33-39 define the term "electronic display sign." Specifically
excluded from the definition are ordinary time/temperature signs that do not alternate cycles more
frequently than every five seconds. The remaining amendments to the section refine the definition
ofthe term "monument sign."

Business Districts and in coniunction with schools or other public uses in any zonina
district: provided. however. that no such sians shall be allowed in any Historic and
Cultural District. and provided further. that electronic display sians in public parks or in

Use District shall reauire the approval of the City Council.
(b) Electronic display sians shall conform to the provisions of this section and
to all applicable aeneral sian reaulations set forth in Part B of Article 2.

COMMENT
The amendments allow electronic display signs only in conjunction with schools and other
public uses in all zoning districts and in the B-IA though B-4C Business Districts (i.e., all Business
Districts except the B-1 Neighborhood Business District and B-4K Historic Kempsville Area Mixed
Use District), and not within any Historic and Cultural District. Inasmuch as all freestanding signs
in the B-3A and B-4C Districts require the approval of the City Council under existing CZO

132 The amendments also provide that electronic display signs must, in addition to the

136 In addition, there are a number of requirements specific to electronic display signs that
137 address the special characteristics of such signs. These requirements pertain to size, height,

7 WHEREAS, the Green Jobs Alliance (uGJA") is a national nonprofit partnership
8 created in response to the Green Jobs Act (included as Title X of Public Law 110-140,
9 Energy Independence and Security Act of 2007) and in anticipation of the passage of
10 the American Recovery and Reinvestment Act (UARRA"); and
11
12 WHEREAS, the GJA By-Laws and Articles of Incorporation are in alignment with
13 the Green Jobs Act; and
14
15 WHEREAS, the GJA has been designated a State Energy Training Partner by
16 the Commonwealth of Virginia; and
17
18 WHEREAS, the GJA is an organization formed by renewable energy industries
19 and labor organizations, that includes a coalition of higher educational institutions,
20 career and technical training schools, community service organizations, environmental
21 groups, workforce investment boards, green construction companies, sustainable small
22 businesses, and veteran's groups, who have partnered to provide education, green
23 workforce training, job placement, and career development; and
24
25 WHEREAS, the mission of the GJA is to coordinate the resourcing, training, and
26 associated support for the development of an evolving energy efficiency and renewable
27 energy industries workforce with a goal of economic independence for individual
28 workers, including unemployed and underemployed workers, veterans, at-risk youth,
29 workers affected by national environmental and energy policy, individuals in need of
30 updated training related to energy efficiency and renewable energy, and former
31 incarcerated, adjudicated, non-violent offenders, and those who seek a pathway out of
32 poverty; and
33
34 WHEREAS, the ARRA authorizes $500 million in competitive grants for green
35 workforce training, and
36
37 WHEREAS, the Department of Labor has split this funding into five separate
38 grant competitions for strategic partnerships and other entities to prepare workers for
39 careers in energy efficiency and renewable energy industries; and
40
41 WHEREAS, the GJA is applying for an Energy Partnership Grant.

3 WHEREAS, the City Council of the City of Virginia Beach desires to make
4 reasonable accommodations for the various users of the City's public roads, including
5 motor vehicles, pedestrians and bicyclists; and
6
7 WHEREAS, in 2004, City Council amended the Master Transportation Plan
8 component of the Comprehensive Plan to incorporate a Bikeways and Trails Plan;
9
10 WHEREAS, the Bikeways and Trails Plan calls for a comprehensive system of
11 bikeways and trails, including multi-modal accommodations, but it does not specifically
12 address on-road bicycle lanes;
13
14 WHEREAS, on-road bicycle accommodations include Bike Lanes, Wide Curb
15 Lanes, certain shoulder improvements, and certain signage and road markings for
16 shared-lane use, as well as other physical improvements and traffic control devices as
17 established in professional guidelines and standards issued by the American
18 Association of State Highway and Transportation Officials ("AASHTO"), the Virginia
19 Department of Transportation ("VDOT"), the Federal Highway Administration ("FHWA")
20 Manual for Uniform Traffic Control Devices ("MUTCD"), and other recognized
21 authorities;
22
23 WHEREAS, on-road bicycle accommodations, in particular bike lanes, are
24 preferred by many long-distance, sport, and higher speed cyclists, and dedicated
25 bicycle facilities better protect the safety of both bicyclists and motorists; and
26
27 WHEREAS, on-road bicycle accommodations not only could be incorporated into
28 certain roadway projects in addition to multi-modal accommodations and sidewalks, but,
29 in some instances, also could be included as part of roadway projects for which multi-
30 modal accommodations are not feasible.

32 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
33 VIRGINIA BEACH, VIRGINIA:

35 That the City Manager or designee shall conduct a review of the Bikeways and
36 Trails Plan component of the Comprehensive Plan, in consultation with the Bikeways
37 and Trails Advisory Committee, with an emphasis on identifying existing and proposed

THIS AGREEMENT, made as of the 26th day of March, 2009, by and between the
CORPORATION OF THE PRESIDING BISHOP OF THE CHURCH OF JESUS CHRIST OF
LATTER-DAY SAINTS, a Utah corporation Sole, Grantor, and the CITY OF VIRGINIA
BEACH, a municipal corporation of the Commonwealth of Virginia, Grantee.
WITNESSETH:
WHEREAS, the Grantor is the owner of that certain parcel of property located in the
Independence District of the City of Virginia Beach, Virginia, containing approximately 3.8948
acres and described in Exhibit "A" attached hereto and incorporated herein by this reference,
said property hereinafter referred to as the "Property"; and
WHEREAS, the Grantor has initiated a conditional amendment to the Zoning Map of the
City of Virginia Beach, by petition addressed to the Grantee so as to change the Zoning
Classification of the Property from 1-2 Industrial District to Conditional 0-1 Office District; and
WHEREAS, the Grantee's policy is to provide only for the orderly development ofland
for various purposes through zoning and other land development legislation; and
WHEREAS, the Grantor acknowledges that the competing and sometimes incompatible
uses conflict and that in order to permit differing uses on and in the area of the Property and at
the same time to recognize the effects of change, and the need for various types of uses, certain
reasonable conditions governing the use of the Property for the protection of the community that
are not generally applicable to land similarly zoned are needed to cope with the situation to
which the Grantor's rezoning application gives rise; and

WHEREAS, the Grantor has voluntarily proffered, in writing, in advance of and prior to
the public hearing before the Grantee, as a part of the proposed amendment to the Zoning Map
with respect to the Property, the following reasonable conditions related to the physical
redevelopment, operation, and use of the Property to be adopted, as a part of said amendment to
the Zoning Map relative and applicable to the Property, which has a reasonable relation to the
rezoning and the need for which is generated by the rezoning.
NOW, THEREFORE, the Grantor, it's successors, personal representatives, assigns,
grantees, and other successors in title or interest, voluntarily and without any requirement by or
exaction from the Grantee or its governing body and without any element of compulsion or quid
pro quo for zoning, rezoning, site plan, building permit, or subdivision approval, hereby makes
the following declaration of conditions and restrictions which shall restrict and govern the
physical development, operation, and use of the Property and hereby covenants and agrees that
this declaration shall constitute covenants running with the Property, which shall be binding
upon the Property and upon all parties and persons claiming under or through the Grantor, it's
successors, personal representatives, assigns, grantees, and other successors in interest or title:
1. When the Property is redeveloped, it shall be redeveloped substantially as shown
on the exhibit entitled "'Existing Site Conditions & Demolition Plan", dated 11/18/08, prepared
by Dills Ainscough Duff Architects, which has been exhibited to the Virginia Beach City
Council and is on file with the Virginia Beach Department of Planning (hereinafter referred to as
the "Site Plan").
2. When the building depicted on the Site Plan is developed, its exterior appearance
shall be substantially similar in architectural features, details and building materials on the
exhibits entitled "Exterior Elevations," and "Heritage 98 Traditional," prepared by Dills
Ainscough Duff Architects, which have been exhibited to the Virginia Beach City Council and
are on file with the Virginia Beach Department of Planning.
3. When the Property is re-developed, the interior property lines of Parcels A, B, and
C shall be vacated, as shown on the Site Plan.
4. Further conditions may be required by the Grantee during detailed Site Plan
and/or Subdivision review and administration of applicable City Codes by all cognizant City
agencies and departments to meet all applicable City Code requirements.

All references hereinabove to the 1-2 and 0-1 Districts and to the requirements and
regulations applicable thereto refer to the Comprehensive Zoning Ordinance and Subdivision
Ordinance of the City of Virginia Beach, Virginia, in force as of the date of approval of this
agreement by City Council, which are by this reference incorporated herein.
The above conditions, having been proffered by the Grantor and allowed and accepted by
the Grantee as part of the amendment to the Zoning Ordinance, shall continue in full force and
effect until a subsequent amendment changes the zoning of the Property and specifically repeals
such conditions. Such conditions shall continue despite a subsequent amendment to the Zoning
Ordinance even if the subsequent amendment is part of a comprehensive implementation of a
new or substantially revised Zoning Ordinance until specifically repealed. The conditions,
however, may be repealed, amended, or varied by written instrument recorded in the Clerk's
Office of the Circuit Court of the City of Virginia Beach, Virginia, and executed by the record
owner of the Property at the time of recordation of such instrument, provided that said instrument
is consented to by the Grantee in writing as evidenced by a certified copy of an ordinance or a
resolution adopted by the governing body of the Grantee, after a public hearing before the
Grantee which was advertised pursuant to the provisions of Section 15.2-2204 of the Code of
Virginia, 1950, as amended. Said ordinance or resolution shall be recorded along with said
instrument as conclusive evidence of such consent, and if not so recorded, said instrument shall
be void.
The Grantor covenants and agrees that:
(1) The Zoning administrator of the City of Virginia Beach, Virginia, shall be vested
with all necessary authority, on behalf of the governing body of the City of Virginia Beach,
Virginia, to administer and enforce the foregoing conditions and restrictions, including the
authority (a) to order, in writing, that any noncompliance with such conditions be remedied, and
(b) to bring legal action or suit to insure compliance with such conditions, including mandatory
or prohibitory injunction, abatement, damages, or other appropriate action, suit, or proceeding;
(2) The failure to meet all conditions and restrictions shall constitute cause to deny
the issuance of any of the required building or occupancy permits as may be appropriate;
(3) If aggrieved by any decision of the Zoning Administrator, made pursuant to these
provisions, the Grantor shall petition the governing body for the review thereof prior to
instituting proceedings in court; and

(4) The Zoning Map may show by an appropriate symbol on the map the existence of
conditions attaching to the zoning of the Property, and the ordinances and the conditions may be
made readily available and accessible for public inspection in the office of the Zoning
Administrator and in the Planning Department, and they shall be recorded in the Clerk's Office
of the Circuit Court of the City of Virginia Beach, Virginia, and indexed in the names of the
Grantor and the Grantee.

DISTRiCT 7 - PRiNCESS ANNE
The following conditions shall be required
1. The conditions of the Conditional Use Permit approved by City Council on January 13, 1998, shall
remain in effect with the exception of Condition 1 which shall be replaced with the following:
The communication tower shall be constructed in substantial coriformance with the plan entitled,
"NR-5437, Princess Anne, Sheet Number C-3, "prepared by All Pro Consulting Group, dated
03/17/09 ", which has been exhibited to City Council and is on file with the Department of Planning
2. In the event interference with any City emergency communications facilities results from the use of
this tower and antennas, the user(s) shall take all measures reasonably necessary to correct and
eliminate the interference. If the interference cannot be eliminated within a reasonable time, the user
shall immediately cease operation to the extent necessary to stop the interference.
3. As required by Section 232(i)(4) of the City Zoning Ordinance (CZO), should the antennas cease to
be used for a period of more than one (1) year, the applicant shall remove the tower, antennas and
related equipment from the property.
4. No signs indicating the location of this facility are permitted.
This Ordinance shall be effective in accordance with Section 107 (f) of the Zoning Ordinance.

DISTRICT 5 - LYNNHAVEN
The following conditions shall be required:
1. There shall be no more than 219 multi-family dwelling units within the
proposed building.
2. The exterior of the building shall substantially adhere to the submitted
renderings and elevations titled "The Town Center Block 9", prepared by
BH&A Architects, LLC. Said renderings have been exhibited to the Virginia
Beach City Council and are on file with the City of Virginia Beach Planning
Department.
3. All mechanical equipment, including generators, shall be screenedjrom the
public right-of-ways. The screening shall include solid walls that
complement the structure.
This Ordinance shall be effective in accordance with Section 107 (j) of the Zoning Ordinance.

DISTRICT 2 - KEMPSVILLE
The following conditions shall be required:
1. The skateboard ramp shall be relocated to meet required setback for accessory structures as set
forth in the City of Virginia's Zoning Ordinance (CZO) and retrofitted in compliance with the
cross section detail entitled, "Britt Ramp, "
2. Use of the ramp shall be limited to the hours between 10:00 A.M and dusk.
3. To reduce the level of sound emanatingfrom the ramp when in use, the following shall be utilized
in retrofitting the construction of the ramp: (a) the underside of the plywood beneath the skating
surface shall be insulated,' (2) the sides of the ramp shall be enclosed with wood; and, (3) roofing
paper shall be installed between the plywood and the skating surface of the ramp.
4, A chain shall be secured across the ramp when the ramp is not in use such that the ramp cannot
be used.
5. At least one adult shall be outside the house and present when the ramp is in use.
6. The Zoning Administrator shall annually evaluate whether the rules have been enforced and the
conditions above have been adhered to. If the evaluation reveals that the rules and conditions are
being met, the use permit shall be renewedfor an additional year, with an annual evaluation
thereafter. If the evaluation reveals that the rules and conditions are not being met, the Zoning
Administrator shall refer the use permit to the City Council for revocation.
