• Freestanding -measured from ground level to highest
point on tower, including rotor blades.
Roof Mounted -measured from base at building or lowest
point of any component to the highest point of system,
including any rotor blades.
Roof mounted may project 8' above roof line. Greater
where specified in a CUP.
• Minimum rotor clearance - z5' above ground level for
horizontal axis turbines and ro' for vertical axis turbines
Other General Regulations
• No signs, except safety and warning signs
• All towers must be monopole unless other allowed by
CUP
• Noise -not exceed 55dB(A)
• Not lighted unless FAA requires
• Locate to minimize shadowing and flickering effects
on adjacent property
• All electrical underground or otherwise hidden
• All must have braking system that engages in

DEFINITIONS, APPLICATION REQUIREMENTS,
LOCATIONAL AND OTHER REQUIREMENTS, AND
ZONING DISTRICTS WHERE PERMITTED

WHEREAS, the public necessity, convenience, general welfare and good zoning
practice so require;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA:
1 g That Sections 111, 202, 301, 401, 501, 601, 701, 801, 901, 1001, 1501, 1511 and
20 1521 of the City Zoning Ordinance, pertaining to wind energy conversion systems, are
21 hereby amended and reordained, and new Sec#ions 209 and 242.5 are hereby added, to
22 read as follows:
23 Sec. 111. Definitions

26 wind char er that converts wind ever into electricit includin the rotors nacelles

38 The section defines wind energy conversion systems and classifies them as either freestanding
39 or roof-mounted.

41 Sec. 202. Height regulations.

43 (a) Whenever height limits for buildings and other structures are established, no
44 portion of any building or other structure shall extend above such height limits, except
45 residential chimneys, communication towers, broadcasting
46 towers, radio or television antennas, spires, flagpoles, water tanks, roof-mounted wind
47 energv conversion svstems or monuments otherwise approved for erection; provided,
48 however, that smokestacks may also extend beyond such limits, if they do not exceed in
49 height the distance to the nearest lot line; and further provided that one tower for
50 purposes of an amateur radio station operation, which may contain multiple antennas,
51 may extend beyond said height limits but shall not exceed ninety (90) feet in height above
52 ground elevation.

54 (b} No artificial structure or tree or other natural growth which on the basis of its
55 height would constitute an obstruction to air navigation pursuant to Part 77 of the Federal
56 Aviation Administration Regulations, 14 C.F.R. §§ 77.21 et seq. shati be allowed in any
57 district. The director of the department of planning shall prepare a map delineating
58 geometric specifications and height limitations for protecting navigable airspace in
59 compliance with Part 77 of the Federal Aviation Administration Regulations, 14 C.F.R. §§
60 77.21 et seq.

64 The amendment allows roof-mounted wind energy conversion systems to exceed the height
65 limits otherwise applicable in the various zoning districts within the City. The proposed Section
66 242.5, which appears immediately below, contains independent limitations on the height of wind
67 energy conversion systems, both roof-mounted and freestanding.

69 The amendment on Line 4S is a technical correction that replaces the term "llne-of--sight
70 relaying devices" with the currently-used term, "communication towers." Tt is not related to the
71 regulation of wind energy conversion systems.

73 Sec. 209 Wind Energy Conversion Systems

75 fa) Purpose. The purpose of this section is to promote the use of renewable
76 energv sources by allowing wind energv conversion svstems in appropriate locations
77 while minim~zing visual safety and environmental impacts and promoting the safe
78 effective and efficient use of such svstems

80 (b) Applicafion requirements

82 (1) Conditional use permit applications In addition to the information

84 a wind energv conversion system shall include the following items•

86 1A) A site plan or plan drawn to scale showing the location
87 height and design of the proposed system including_ any

88 accessory buildinas or other appurtenances, adjacent land
89 uses and any other applicable information reauired by the
90 Planning Director:

92 LB) A certification from a professional enaineer licensed in the
93 Commonwealth of Virain~a that the proposed svstem complies
94 with all applicable reaulations and requirements of the Vir_ is nia
95 Uniform Statewide Building Code and Federal Aviation
96 Administration;

98 ~C} A certification from a professional enaineer licensed in the
gg Commonwealth of Vir inia that the structure u on which the
100 groposed wind energv conversion svstem is to be mounted
101 will have the structural integrity to carry the weight and wind
102 loads of the wind enerav conversion svstem and have minimal
103 vibration impacts on the structure; and

105 (D) Elevation drawings computer-generated photographic
106 simulations or such other documentation as the Plannm~c.

133 use the City Council may approve an application in which the
134 subiect property fails to meet the specified minimum lot area
135 requirements upon a finding that the proposed system is of
136 such size or in such location or that the conditions attached to
137 the conditional use permit are sufficiently restrictive that the
138 deficiency in lot area will not result in any adverse effects
139 upon surrounding properties The Planning Director shag

149 way than a distance equal to one hundred ten per cent
150 (110%) of the height of the tower or the setback specified in
151 the applicable district reaulations whichever is greater or

156 (B) No support structure of a freestanding wind energy conversion

162 (A) Unless otherwise specified in this section or the conditional
163 use permit. wind energv conversion systems shall be subiect
164 to the height reaulations of the zoning district in which they
165 are located: provided. that in no event shall the hei hq t of a~
166 such system exceed that recommended by the manufacturer

168 (B) The height of a freestanding wind energv conversion system
169 shall be measured as the distance from ground level to the
170 highest point on the tower including the vertical length of any
171 extensions such as rotor blades The height of aroof-mounted
172 wind energv conversion system shall be measured as the
173 distance from the point at which the base of the system is
174 attached to the building or the lowest point of any component
175 of the wind energv conversion system, whichever is lower to
176 the highest point on the wind energv conversion system
177 includina the vertical length of any extensions such as rotor
178 blades.
179 (C) Notwithstanding any contrary height limitation specified in the
180 district re ulations roof-mounted wind ener conversion
181 s stems may proiect a maximum of eight (8) feet above the
182 roofline of the structure on which they are located unless a
183 greater height is allowed by the conditional use permit.

COMMENT
Subsection (a) [lines 75-78] states that the purpose of the wind energy system section is to
promote energy conservation by allowing wind energy conversion systems while minimizing the
safety, visual and environmental impacts of such systems.
Subsection (b) sets forth the conditional use permit application requirements [lines 82•-111]
and requirements for site plans and building permit applications [lines 1 i3-116].
Subsection (c) [lines 118-215j sets forth requirements pertaining to lot area, setbacks, height,
structural standards, lighting, signage, noise, shadowing/flickertng, electrical connections and
braking.
Subsection (d) [lines 217-220J requ#res an insgQCtion every two years and submission of the
inspection report to the Planning Director.
Subsection (e) [lines 222-224] requires the removal of the system if it is not used for one year.
Sec. 242.5. Wind energy conversion systems
!n addition to general requirements w[nd energy conversion systems shall be
subject to the nrovis~ons of Section 209

The section provides that wind energy conversion systems allowed as conditional uses shall be
subject to the provisions of Section 209 of the City Zoning Ordinance.
Sec. 301. Use regulations [Preservation District].
(a) Principal and conditiona! uses- The following chart lists those uses permitted within
the P-1 Preservation District. Those uses and structures shall be permitted as either principal
uses indicated by a "P" or as conditional uses indicated by a "C." No uses or structures other than
as specified shall be permitted.
