Acting Mayor Jones expressed his appreciation to Admiral Quigley and the entire staff at HRMFFA for all of the hard work. May 19, 2015 -17- WOUNDED WARRIOR PROGRAM ITEM#64853 4:40 P.M. Acting Mayor Jones welcomed Paula Moran, President and CEO— USO of Hampton Roads and Central Virginia. Ms. Moran expressed her appreciation to City Council for their support. She advised the Mission of the USO is to "14ft the spirits of America's troops and their families". Hampton Roads is the largest USO affiliate in the world with eleven (11) Centers from Central Virginia down to Little Creek— Fort Story. "Warrior Week" began last year and is held in conjunction with the Patriotic Festival and was a huge success. This year, "Warrior Week" has been improved and new activities have been added. Ms. Moran showed a brief video regarding the Wounded Warrior Program. Acting Mayor Jones expressed his appreciation to Ms. Moran and the entire staff at USO of Hampton Roads and Central Virginia for all of their hard work. May 19, 2015 -18- CITY COUNICL COMMENTS ITEM#64854 4:57P.M. Councilman Dyer suggested City Council schedule a workshop in the near future to discuss ways to bridge the gap between the City and Citizens. During the Budget process this year, there were far too many personal attacks from Citizens when speaking at the meetings. He would like to see some bold initiatives in promoting civility and mutual respect, as well as, improving the process for more involvement. He noted the Police Department has done a wonderful job in building the bridges and improving the relationship between Officers and Citizens. He is not looking to give anyone the impression that City Council is not going to listen but hopes to build a stronger bond with Citizens. Council Lady Wilson concurs. She stated she does agree some Citizens took their comments a bit far but does not blame them. Rather she blames City Council as there are rules in place but are simply not being enforced. Councilman Wood received numerous phone calls from concerned Citizens advising they were watching the meeting from home and they were disturbed with certain comments and demeanor of some of the speakers. He felt certain Citizens were inappropriate by screaming and making malicous personal attacks against certain City Council Members. He would also like to see the rules enforced. He spoke to certain Legislators from Richmond and was told the behavior would not be allowed in Richmond. Council Lady Kane feels it makes it difficult for the Presiding Officer to "gavel someone down"when the comments are directed at that particular Council Member. Acting Mayor Jones asked if there is a provision that would allow another Member of City Council to call someone down for not following the Rules. City Attorney Stiles advised any Member of City Council can always raise a "Point of Order"to be raised by the Presiding Officer. Councilman Moss concurs completely but cautioned as the School Board lost a case not too many years with the State's Supreme Court for "gaveling down citizens" when they were admonishing and making personal attacks on School Board Members. He requested a copy of the Legal Opinion and suggested the City set the Rules and Guidelines around that Case. He does feel a number of people crossed way over the line. Councilman Uhrin advised he was not as concerned about the comments regarding the Members of City Council as he was about the comments about other citizen's comments. No one deserves to feel intimidated while attending a City Council Meeting. He feels this is a discussion for the upcoming Retreat. May 19, 2015 -19- CITY COUNICL COMMENTS ITEM#64854 (Continued) Acting Mayor Jones requested the City Attorney provide some guidelines and help in creating some specific Rules and Procedures. Council Lady Wilson advised she feels everyone would just like to be clear on the process of how to handle inappropriate comments. Councilman Dyer would rather have a Workshop and discussion the subject prior to the Retreat in August. May 19, 2015 -20- CITY COUNCIL COMMENTS ITEM#64855 Council Lady Henley feels the Environmental Impact Study is awkward to read and there is a lot of information in the Study. Since the best Local Alternative was chosen, it is best to take advantage of the information in the Study. A number of important issues were raised in the Study and should be discussed at an upcoming Workshop. She was impressed with the Social Chapter of the Study and, a number of the comments within that Chapter are directly related to the Comprehensive Plan that is currently being revised. A number of comments stressed the importance of transit and transit corridor; and interestingly, a number of comments were "without the transit the Comprehensive Plan will be ineffective." The corridor is the "commercial spine"and, unfortunately, the City does not know what the "No Build Plan" involves. One of the reasons the Homeless Resource Center site was chosen was for the location being on a major transit line. Applications for the enlargement, 41 extension or relocation of a nonconforming use or structure shall be filed 42 with the planning director. The application shall be accompanied by a fee 43 of five hundred dollars ($500.00) to cover the cost of processing the 44 application. The planning director shall cause the application to be 45 advertised for public hearing before the planning commission. Notice shall 46 be given as provided by Section 15.2-2204 of the Code of Virginia; 47 provided, however, that written notice as prescribed therein shall be given 48 at least fifteen (15) days prior to the hearing. No nonconforming use located in any form-based 64 district may be converted to any other use except as allowed pursuant to 65 the regulations of such district. 66 67 (e) (1) Conversion of a nonconforming use to another use. No nonconforming 68 use shall be converted to another use which does not conform to this 69 ordinance except upon a resolution of the city council authorizing such 70 conversion, based upon its finding that the proposed use is equally 71 appropriate or more appropriate to the district than is the existing 72 nonconforming use. In the resolution authorizing such change, the city 73 council may attach such conditions and safeguards to its approval as it 74 deems necessary to fulfill the purposes of this ordinance. When any 75 nonconforming use is converted to another use, the new use and 76 accompanying conditions of development shall conform to the provisions 77 of this ordinance in each respect that the existing use conforms, and in 78 any instance where the existing use does not conform to those provisions, 79 the new use shall not be more deficient. Live-work units shall be permitted in the following district: 63 64 (1) The OR Oceanfront Resort District, in accordance with Section 5.2 of the 65 Oceanfront Resort District Form-Based Code. 66 67 (c) Performance and development standards. Except as otherwise provided by the 68 regulations of the zoning district in which they are located, live-work units shall be subject to 69 the following requirements: 70 71 (1) Commercial activity performed within a live-work unit shall be limited to 72 those uses permitted by the regulations of the district in which such unit is 73 located. Live-work units shall be subject to the provisions of Article 18 74 (Special Regulations in Air Installations Compatible Use Zones); 75 76 (2) At least one (1) resident of the live-work unit shall be engaged in the 77 commercial activity performed within such unit and, if required by Section 78 18-5 of the City Code or any successor ordinance, shall have a valid 79 business license for such activity or be a bona fide full-time employee of 80 an individual or entity having such a license; 81 82 (3) Living and work spaces in a live-work unit shall not be sold, rented or 83 subleased separately; 2 84 85 (4) A maximum of five (5) employees who are not residents of a live-work unit 86 may occupy the working space within such unit at any one time; 87 88 (5) No more than fifty per cent (50%) and no less than twenty per cent (20%) 89 of the floor area a live-work unit shall consist of work space. For purposes 90 of this section, "work space" shall mean the area within a live-work unit 91 that is used primarily or exclusively for the performance of commercial 92 activity, including any retail sales; 93 94 (6) Work space shall be located exclusively on the lower floor of any live-work 95 unit having two or more levels, including lofts; 96 97 (7) Live-work units shall have a minimum floor area of one thousand (1,000) 98 square feet of floor area and a maximum floor area of three thousand 99 (3,000) square feet; and 100 101 (8) Parking requirements shall be in accordance with the regulations of the 102 district in which a live-work unit is located; provided, however, that in any 103 district in which parking requirements are determined exclusively by a 104 parking study, the parking requirement for live-work units shall be two (2) 105 spaces per unit. 106 107 (d) Building Code standards. Live-work units shall be subject to all applicable 108 regulations of the Virginia Uniform Statewide Building Code (USBC), including the regulations 109 of other building codes incorporated by reference into the USBC. 110 111 COMMENT 112 113 Subsection (a) sets forth the objectives of the ordinance, the general purpose of which is to 114 encourage redevelopment of certain areas of the City, such as the Resort Area, in which mixed-use 115 environments are encouraged and current land use is less than optimal. While not a new concept, live- 116 works have been successful in helping to revitalize commercial and industrial areas of a number of major 117 cities. 118 119 Subsection (b) lists the districts in which live-work units are allowed. While the section,as drafted, 120 allows them only in the OR Oceanfront Resort District, it is contemplated that future ordinances would 121 allow them in portions of certain of the City's Strategic Growth Areas. 122 123 Subsection(c) sets forth the performance and development standards for live-work units. The 124 listed standards are subject to the regulations of the district in which a live-work unit is located, such that 125 any conflicting standards are resolved in favor of the standards of the district. This approach allows a high 3 126 degree of flexibility in tailoring the applicable live-work unit regulations to the objectives of each zoning 127 district in which they are allowed. 128 129 Subsection (d) requires conformity with the Virginia Uniform Statewide Building Code, including 130 the building codes it incorporates by reference,such as the International Building Code.
