RESOLUTION
WHEREAS: The American Payroll Association and its more than 21,000 members have
launched a nationwide public awareness campaign that pays tribute to the more than 156-Million
people who work in the United States and the payroll professionals who support the American
system by paying wages,reporting worker earnings and withholding federal employment taxes;
WHEREAS: Payroll professionals in Virginia Beach play a key role in maintaining the
economic health of Virginia Beach,carrying out such diverse tasks as paying into the
unemployment insurance system,providing information for child support enforcement, carrying
out tax withholding,reporting and depositing;
WHEREAS: Payroll departments collectively spend more than$15-Billion annually complying
with myriad federal and state wage and tax laws;
WHEREAS: Payroll professionals play an increasingly important role ensuring the economic
security of American families by helping to identify noncustodial parents and making sure they
comply with their child support mandates;
WHEREAS: Payroll professionals have become increasingly proactive in educating both the
business community and the public at large about the payroll tax withholding systems;
WHEREAS: Payroll professionals meet regularly with federal and state tax officials to discuss
both improving compliance with government procedures and how compliance can be achieved at
less cost to both government and businesses;and,
WHEREAS: The week in which Labor Day falls,September 7-11,2015,has been proclaimed
National Payroll Week,and we hereby give additional support to the efforts of the people who
work in Virginia Beach and of the entire payroll profession.
NOW,THEREFORE,BE IT RESOLVED:That the Virginia Beach City Council pause in its
deliberations to recognize these employees for their professionalism and dedication to make
Virginia Beach "the greatest city in the world".
BE IT FURTHER RESOLVED: That September 7-11,2015,be designated as
PAYROLL WEEK
in Virginia Beach, Virginia.

AGENDA ITEM
ITEM: Resolution urging the Attorney General to vigorously oppose Virginia Uranium's
lawsuit seeking to invalidate the Commonwealth's longstanding moratorium on
uranium mining in Virginia.
MEETING DATE: September 01, 2015
• Background: The Commonwealth of Virginia has maintained a statutory
moratorium on uranium mining in Virginia since the early 1980's. After unsuccessful
attempts to convince the General Assembly to eliminate the moratorium, Virginia
Uranium recently filed suit in federal court challenging the legality of the moratorium and
asking the court to order the agencies responsible for regulating mining to accept and
process Virginia Uranium's applications. Uranium mining is opposed by a multitude of
Virginia and North Carolina jurisdictions and organizations, including the Roanoke River
Basin Association, the Hampton Roads Planning District Commission, and the cities of
Virginia Beach, Norfolk, and Chesapeake.
• Considerations: While Virginia Uranium has asked the court to order the
agencies responsible for issuing the permits necessary for mining uranium under the
same rules as currently apply to the mining of other materials, the National Academy of
Sciences (NAS) has concluded that Virginia has no experience with uranium mining,
and that there are gaps in legal and regulatory coverage for uranium mining and steep
hurdles to be overcome before mining could be established in Virginia within a
regulatory framework that is protective of health, safety, and the environment. Based
upon the findings of the NAS and other information provided by local governments,
state agencies, environmental agencies, and the general public, the General Assembly
wisely declined to overturn the legally enacted moratorium.
• Public Information: Public information will be provided through the normal
Council agenda process.
• Recommendations: It is recommended that City Council adopt a resolution
urging the Attorney General to vigorously oppose Virginia Uranium's lawsuit seeking to
invalidate the Commonwealth's longstanding moratorium on uranium mining in Virginia.

8 WHEREAS, the Virginia General Assembly enacted a Moratorium on Uranium
9 Mining in the early 1980's; and
10
11 WHEREAS, this Moratorium was established based on scientifically
12 demonstrated environmental concerns relating to Uranium Mining; and
13
14 WHEREAS, Virginia Uranium, Inc. and its affiliated companies own mineral
15 rights to a potentially large uranium deposit in the Roanoke River Basin; and
16
17 WHEREAS, Virginia Uranium has repeatedly attempted through the General
18 Assembly to have the Moratorium lifted; and
19
20 WHEREAS, The General Assembly has maintained the Moratorium on Uranium
21 Mining; and
22
23 WHEREAS, Uranium Mining was opposed by multiple jurisdictions and
24 organizations, such as the Roanoke River Basin Association, Hampton Roads Planning
25 District Commission, and the cities of Virginia Beach, Norfolk, and Chesapeake, among
26 many others, several of which obtain their drinking water from Lake Gaston, which is in
27 the Roanoke River Basin and downstream from the Virginia Uranium site; and
28
29 WHEREAS, Virginia Uranium recently filed suit in Federal Court to challenge the
30 legality of the Moratorium; and
31
32 WHEREAS, Virginia Uranium claims that the moratorium on mining was enacted
33 solely because of concerns arising from the disposal of uranium mining by-products and
34 that regulation of the disposal of uranium mining by-products has been pre-empted by
35 Federal law and that, therefore, the moratorium on uranium mining is invalid; and
36
37 WHEREAS, Virginia Uranium requests the court to order the applications for the
38 licenses and permits needed to commence mining operations to be accepted and
39 processed in the same manner as they would if those permits and licenses pertained to
40 any other mineral that may be legally mined; and
41
42 WHEREAS, Virginia Uranium's assertions are inimical to sound public policy
43 and contrary to settled principles of law, inasmuch as the several states, including
44 Virginia, clearly retain the authority to regulate uranium mining within their respective
45 borders;

46 NOW, THEREFORE, BE IT RESOLVED BY THE VIRGINIA BEACH CITY
47 COUNCIL:

49 That for the foregoing reasons, on behalf of the Citizens of Virginia Beach, it is
50 respectfully requested that the Attorney General, on behalf of the Governor and other
51 officials of the Commonwealth who have been named as defendants, vigorously oppose
52 Virginia Uranium's lawsuit seeking to invalidate the Commonwealth's longstanding
53 moratorium on uranium mining in Virginia.

ITEM: An Ordinance declaring the property located at 1449 Bartow Place (GPIN 2417-
15-2124) to be in excess of the City's needs and authorizing the City Manager to
sell the property to Michael R. St. Jean and Barbara J. St. Jean.
MEETING DATE: September 1, 2015
• Background:
As part of the APZ-1 Use and Acquisition Plan, the City of Virginia Beach
acquired 1449 Bartow Place (the "Property") on February 27, 2008 for $200,000.
The Property consists of 9,917 sq. ft. of land, and was improved with a single-
family home, which has been demolished.
Michael R. St. Jean and Barbara J. St. Jean (collectively, the "Buyer"), own the
adjacent property at 1453 Bartow Place. The Buyer proposes to purchase the
Property for $9,917 ($1/SF) and resubdivide it with their adjacent property to
create one residential lot.
• Considerations:
The Property will be sold with a plat and deed restriction that prevents any new
dwelling units from being constructed. The APZ-1 Disposition Committee
reviewed the Property and determined that it should be sold to the adjoining
property owner. The sale would enhance the neighborhood and reduce density.
The Buyer's offer of $1 per square foot is consistent with previous City properties
sold as excess in the APZ-1 area that were not building sites.
If the City retains the Property, the City must pay to maintain the lot, an estimated
annual cost of$630.
• Public Information:
Advertisement for public hearing as required by Section 15.2-1800 Code of
Virginia and advertisement of City Council Agenda.
• Alternatives:
Retain ownership of the Property.
• Recommendations:
Approve the request and authorize the City Manager to execute all necessary
documents to convey the Property subject to the terms and conditions in the

attached Summary of Terms and such other terms, conditions or modifications as
may be acceptable to the City Manager and in a form deemed satisfactory to the
City Attorney.
• Revenue restrictions:
The City funded the acquisition of the Property through the partnership with the
Commonwealth of Virginia. The proceeds from the sale of the Property in the
amount of$9,917 will be received. Fifty percent (50%) of the proceeds will be
appropriated to CIP #9-059, Oceana and Interfacility Traffic Area Conformity and
Acquisition, and fifty percent (50%) will be deposited for future payment by the
City Manager to refund the Commonwealth's portion in accordance with the grant
agreement. A manual encumbrance will be established to ensure that the
$4,958.50 retained by the City will be available for BRAC program acquisitions in
future years per the agreement with the Commonwealth.

"Parent-subsidiary relationship" means "a relationship that exists when one corporation directly or
indirectly owns shares possessing more than 50 percent of the voting power of another corporation."
See State and Local Government Conflict of Interests Act, Va. Code § 2.2-3101.
2 "Affiliated business entity relationship" means "a relationship, other than
parent-subsidiary
relationship, that exists when (i) one business entity has a controlling ownership interest in the other
business entity, (ii) a controlling owner in one entity is also a controlling owner in the other entity, or
(iii) there is shared management or control between the business entities. Factors that should be
considered in determining the existence of an affiliated business entity relationship include that the
same person or substantially the same person own or manage the two entities; there are common or

9 WHEREAS, the City of Virginia Beach (the "City") is the owner of that
10 certain 9,917 sq. ft. parcel of land located at 1449 Bartow Place (the "Property") more
11 particularly described on Exhibit "A" attached hereto and made a part hereof;

13 WHEREAS, the City acquired the Property pursuant to the APZ-1
14 Acquisition Program;
15
16 WHEREAS, the City funded the acquisition of the Property through a
17 partnership with the Commonwealth of Virginia (the "Commonwealth"), with each party
18 contributing fifty percent (50%) of the funds;
19
20 WHEREAS, the Property is in the midst of other residences and at the
21 time of acquisition was improved with one single-family dwelling unit;
22
23 WHEREAS, Michael R. St. Jean and Barbara J. St. Jean (collectively, the
24 "Buyer") own adjacent property at 1453 Bartow Place and have requested to purchase
25 the Property in order to utilize it in a manner compatible with the APZ-1 Ordinance;
26
27 WHEREAS, the Buyer desires to purchase the Property in accordance with
28 the Summary of Terms attached hereto as Exhibit "B" and made a part hereof;
29
30 WHEREAS, the APZ-1 Disposition Committee has recommended that City
31 Council declare the Property to be in excess of the City's needs and sell the Property to
32 the Buyer; and
33
34 WHEREAS, the City Council is of the opinion that the Property is in
35 excess of the needs of the City of Virginia Beach.

37 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
38 OF VIRGINIA BEACH, VIRGINIA:

40 That the Property located at 1449 Bartow Place is hereby declared to be
41 in excess of the needs of the City of Virginia Beach and that the City Manager is
42 hereby authorized to execute any documents necessary to convey the Property to
43 Michael R. St. Jean and Barbara J. St. Jean in accordance with the Summary of
44 Terms attached hereto as Exhibit "B" and such other terms, conditions or
45 modifications as may be acceptable to the City Manager and in a form deemed
46 satisfactory by the City Attorney.

48 Further, that revenue from the sale of the Property in the amount of
49 $9,917.00 shall be received, and fifty (50) percent of this amount shall be appropriated

50 to CIP #9-059, Oceana and ITA Conformity and Acquisition II, and fifty (50) percent
51 shall be deposited for future payment by the City Manager to refund the
52 Commonwealth's portion in accordance with the grant agreement. A manual
53 encumbrance will be established to ensure that the $4,958.50 retained by the City will
54 be available for BRAC program acquisitions in future years per the agreement with the
55 Commonwealth.

MEETING DATE: September 1, 2015
• Background: The McDonald's Corporation ("McDonald's") has held a ground
lease to the 25,140 sq. ft. property located at 300 21st Street and the 7,000 sq. ft.
adjacent lot located at 305 20th Street (the "Premises") since 1974 and 1976,
respectively. The City of Virginia Beach acquired the Premises from two separate
owners in 2008, subject to existing ground leases with McDonald's (the
"Leases"). The Leases expire in 2016, and McDonald's would like to combine
the Leases and extend the term for up to 4 additional years (the "Lease
Extension"). The City receives rental income of approximately $51,000 per year
for the Leases, which will escalate each year of the Lease Extension.
• Considerations: The initial term of the Lease Extension is two (2) years and
seven (7) months, with one renewal option for a term of one (1) year. The
McDonald's building will remain the property of McDonald's. At the end of the
Lease Extension (if not further extended by Council), McDonald's has the option
of removing the building, or allowing it to remain, at which time it will become City
property. For more specific terms, see the attached Summary of Terms.

ITEM: An Ordinance to Accept and Appropriate State Funds from the Virginia
Department of Behavioral Health and Developmental Services to the
Department of Human Services
MEETING DATE: September 1, 2015
• Background: The Department of Human Services (DHS) has been awarded
additional State funding from the Virginia Department of Behavioral Health and
Developmental Services (DBHDS) as part of the annual DBHDS Performance Contract
to be used in the following two areas:
1. PATH (Projects for Assistance in Transition from Homelessness) Program to
create Peer Services for persons with substance use disorders (SUD), who are
experiencing homelessness or are a great risk for experiencing homelessness.
These funds may be used to hire a full time peer staff or to contract with a peer
run organization. The peer staff will do outreach within Virginia Beach to help
identify persons with SUD's whom the PATH program has been unable to serve
due to its eligibility requirements. Funds can be paid on behalf of the consumers
for transportation and for services to obtain safe temporary or permanent
housing. This can be assistance with deposits for housing, utilities, rental
assistance for a specific period of time and needed furnishings or supplies. Also
funded will be expenses related to detoxification, medications, food, clothing, and
personal items needed to stabilize an individual, social activities with others in
recovery to help individuals experience and learn healthy social skills, and fees
for skill development to help persons meet their goals for obtaining and taking
care of housing, living independently, reaching employment, vocational and
educational goals.-
2. Substance abuse related rehabilitation services to be provided by the Mental
Health Substance Abuse Recovery Center including reimbursement of
reinvestment discharge planning services, additional contract positions to provide
these services, and client needs including rent, medications, and transportation.
• Considerations: The estimated cost of the Peer Services program is $70,130 to
be funded 100% by State funds. To provide this service, DHS will contract with a peer-
run organization or use contract positions rather than request the addition of a full-time
employee. The State will require semi-annual reports to address numbers served,
demographic information, types of peer supports and other services received. Financial
reports will also be required quarterly. The current funding will continue through June
2016. Although there is no guarantee, the State feels there is a good possibility that the
funds will continue for this purpose after June, 2016.
The additional State funding for substance abuse recovery rehabilitation services is
$141,281, and will be received in quarterly payments. Additional City funding for a local
match is not required. DBHDS will be required to provide quarterly reports to include
numbers served, demographic information, and service hours. Financial reports will
also be required quarterly. This funding will continue through June 2016.

• Background: Since FY 1995-96 the City received a Community Corrections and
Pretrial Grant authorized by the Comprehensive Community Corrections Act (section 9.1-
173 Code of Virginia) and Pretrial Services Act (section 19.2-152.2 Code of Virginia) from
the Virginia Department of Criminal Justice Services (DCJS) for the Virginia Beach
Community Corrections and Pretrial Program (collectively, the "Programs"). The Community
Corrections program provides sentencing alternatives to incarceration for persons convicted
of certain misdemeanors or non-violent felonies for which sentences would be 12 months or
less in a local or regional jail including: community service; home incarceration with or
without electronic monitoring; electronic monitoring; and substance abuse screening,
assessment, testing and treatment. The Pretrial Program provides information and
investigative services to judicial officers (judges and magistrates) to help them decide
whether persons charged with certain offenses and awaiting trial need to be held in jail or
can be released to their communities subject to supervision. The number of cases has
grown from 1,211 in FY 2013, to 1,349 in FY 2014 and 1,404 in FY 2014-15.
• Considerations: This is the second year of a biennial grant for the Programs
covering FY15 & FY16. The amount of state funding has increased $12,153 above the
FY16 budgeted amount to $1,140,013. The program collects some fees for service
($43,632 annually), which has not changed. The FY16 Budget provides $531,712 in
General Fund support for the Programs.
There is no grant match requirement. The City provides General Fund support
for the
Programs because of the service needs of the community. The attached ordinance reduces
the General Fund support by the amount of increased state funding and moves the funds to
the Reserve for Contingencies. If the service levels require additional funding later in the
fiscal year, the Programs would look back to the General Fund for additional resources at
that time. The General Fund Reserve for Contingencies has a balance of $1,220,964 as of
August 18, 2015.
