ITEM: An Ordinance to Amend Sections 35-136 and 35-138 of the City Code
Pertaining to Meals Taxes
MEETING DATE: August 1, 2017
• Background: The City assesses and collects meals taxes subject to restrictions
set forth in the Virginia Code. The Commissioner of the Revenue has consistently
applied the meals taxes to non-factory-sealed sandwiches and pastries sold by grocery
stores and convenience stores because these food items are ready for immediate
consumption. A recent entry to the local grocery market has taken exception to the
Commissioner's approach to the application of the meals tax for the aforementioned
items. It is the position of the Commissioner that principles of equity require treating all
providers of non-factory-sealed sandwiches and pastries in the same manner as long as
the food is ready for immediate consumption.
• Considerations: The attached ordinance amends the City Code to make clear
that the meals tax applies to non-factory-sealed sandwiches and pastries sold by a
grocery store, supermarket, or convenience store. For pastries, the application of meals
tax is subject to the caveat that purchases of quantities above two of the pastry would
be subject to the bulk sale exemption from meals taxes provided by City Code § 35-
138(b)(2).
There is one technical edit to incorporate exemptions provided by § 58.1-3840 of the
Code of Virginia. In recent years, the General Assembly has amended this statute to
expand classes to transactions not subject to the local meals tax, so the incorporation
by reference avoids the need to mirror the local code each time the statute is amended.

10 That Sections 35-136 and 35-138 are hereby amended to the Code of the City of
11 Virginia Beach, Virginia to read as follows:

13 Sec. 35-136. - Definitions.
14
15 Except where the context clearly indicates a different meaning, the following
16 words and phrases, when used in this article, shall, for the purpose of this article, have
17 the meanings ascribed to them in this section:
18
19 Cater means the furnishing of food, beverages, or both on the premises of
20 another, for compensation.
21
22 City treasurer means the treasurer of the city and any of his duly authorized
23 deputies, assistants or other employees.
24
25 Commissioner of the revenue means the commissioner of the revenue of the
26 city and any of his duly authorized deputies, assistants or other employees.
27
28 Food means all food, beverages or both, including alcoholic beverages,
29 purchased in or from a food establishment, whether prepared in such food
30 establishment or not, and whether consumed on the premises or not, and without
31 regard to the manner, time, or place of service.

33 Food establishment means any place in or from which food or food products are
34 prepared, packaged, sold or distributed in the city, including, but not limited to, any
35 restaurant, dining room, grill, coffee shop, cafeteria, café, snack bar, lunch counter,
36 movie theater, delicatessen, confectionery, bakery, eating house, eatery, drugstore,
37 ice cream or yogurt shop, lunch wagon or truck, pushcart or other mobile facility from
38 which food is sold, public or private club, resort, bar, brewery, winery, distiller, lounge,
39 or other similar establishment, public or private. The term "food establishment" shall
40 include private property outside of and contiguous to a building or structure operated
41 as a food establishment at which food is sold for immediate consumption. A grocery
42 store or similar establishment may be included in the definition of "food establishment"
43 subject to the application of section 35-138(c).

45 Meal means any prepared food or beverages, ready for immediate
46 consumption, offered or held out for sale by a food establishment. All such food or
47 beverages, unless otherwise specifically exempted or excluded herein shall be
48 included, whether intended to be consumed on the seller's premises or elsewhere,
49 whether designated as breakfast, lunch, snack, dinner, supper or by some other
50 name, and without regard to the manner, time or place of service.

52 Person means:
53
54 (a) Where the food establishment is a corporation, the president or managing
55 agent of such corporation.
56
57 (b) Where the food establishment is an unincorporated partnership or
58 association, the general partner, partners, or managing agent of such
59 unincorporated partnership or association.

61 (c) Where the food establishment is a sole proprietorship, the owner or
62 managing agent of such sole proprietorship.

66 Sec. 35-138. - Exemptions; limits on application.

68 (a) The tax imposed under this article shall not be levied on candy, gum, nuts, and
69 other items of essentially the same nature served for on- or off-premises consumption.

71 (b) The tax imposed under this article shall not be levied on the following items when
72 served exclusively for off-premises consumption:

74 (1) Donuts, crackers, chips, cookies, and other factory-prepackaged items of
75 essentially the same nature. Such items that are not factory-prepackaged are
76 subiect to the tax imposed under this article provided the items are not sold in
77 quantities that are exempted by subsection (b)(2).

79 (2) Food sold in bulk. For the purposes of this article, a bulk sale shall mean the
80 sale of any item that would exceed the normal, customary, and usual portion
81 sold for on-premises consumption (e.g., a whole cake or a gallon of ice cream);
82 a bulk sale shall not include any food or beverage that is catered or delivered
83 by a food establishment for off-premises consumption.

85 (3) Alcoholic and non-alcoholic beverages sold in factory-sealed containers.

87 (4) Any food or food product purchased with food coupons issued by the United
88 States Department of Agriculture under the Food Stamp Program or drafts
89 issued through the Virginia Special Supplemental Food Program for Women,
90 Infants, and Children.

92 (5) Any food or food product purchased for home consumption, as defined in
93 the federal Food Stamp Act of 1977, 7 U.S.C. § 2012, as amended, except hot
94 food or hot food products ready for immediate consumption. The following
95 items, whether or not purchased for immediate consumption, are excluded from
96 the federal Food Stamp Act definition and are thus subject to the tax imposed
97 under this article: sandwiches, salad bar items sold from a salad bar,
98 prepackaged single-serving salads consisting primarily of an assortment of
99 vegetables, and nonfactory-sealed beverages. This subsection shall not affect
100 provisions set forth in subparagraphs (d)(3), (4) and (5) herein below.

102 (c) A grocery store, supermarket, or convenience store shall be subiect to the tax
103 imposed under this article for prepackaged sandwiches and wraps, salad bar items
104 sold from a salad bar, prepackaged single-serving salads consisting primarily of an
105 assortment of vegetables, non-factory-sealed beverages, pizza slices, and non-
106 factory-prepackaged items included in subsection (b)(1) not bo tioct

110 (d) The tax imposed under this article shall not be levied on the following purchases of
111 food and beverages:

113 (1) Food and beverages furnished by restaurants (or other food establishments)
114 to employees as part of their compensation when no charge is made to the
115 employee.

117 (2) Food and beverages sold by a day care center, public or private elementary
118 or secondary school, or any college or university to its students or employees.

120 (3) Food and beverages purchased for use or consumption by, and which are
121 paid for directly by, the commonwealth, any political subdivision of the
122 commonwealth, or the United States.

124 (4) Food and beverages furnished by a hospital, medical clinic, convalescent
125 home, nursing home, home for the aged, infirm or handicapped, or other
126 extended care facility to patients or residents thereof.

128 (5) Food and beverages furnished by a nonprofit charitable organization to
129 elderly, infirm, handicapped, or needy persons in their homes or at central
130 locations.

132 (6) Food and beverages sold on an occasional basis, not exceeding three (3)
133 times per calendar year, by a nonprofit educational, charitable, or benevolent
134 organization, church, or religious body as a fund-raising activity, the gross
135 proceeds of which are to be used by such organization exclusively for non-profit
136 educational, charitable, benevolent, or religious purposes.

ITEM: A Resolution to Re-Name the City Building Located at 4160 Virginia Beach Blvd
from the "Adult Learning Center" to "Virginia Beach EMS"
MEETING DATE: August 1, 2017
• Background: The City acquired the building located at 4160 Virginia Beach
Boulevard on February 7, 2017 through a voluntary sale from Virginia Beach City Public
Schools, which had declared the building surplus. Originally built in 1984, the building is
currently being renovated by the City and outfitted to house the administrative and
training needs for the Department of Emergency Medical Services (EMS). EMS is
planning to move into the building in October 2017. Discussions with EMS resulted in
recommending this building be renamed to "Virginia Beach EMS".
• Considerations: The renovation of the property, which will last approximately
nine months, will create a new office and training space for EMS. Also included in this
space will be a backup area to be used by Emergency Communications and Citizen
Services in the event they cannot operate from Building 30. Discussions with EMS
resulted in the recommended designation of "Virginia Beach EMS". Pursuant to City
Administrative Directive 3.19, "City Facility Naming Directive", the City Manager shall
present to City Council for approval and subject to Council amendment, the proposed
name of the subject facility, which should reflect the geographic area where the facility
is located, the name of the department(s) occupying the facility, the purpose of the
facility or something of historical significance related to the facility, or any combination
thereof.

ITEM: An Ordinance to Appropriate $595,077 to the Clerk of the Circuit Court for
Technology Needs
MEETING DATE: August 1, 2017
• Background: The Code of Virginia (§ 17.1-279) establishes a $5 Technology
Trust Fund Fee imposed on instruments recorded in the deed book. Four dollars of
every $5 fee accumulates in a Technology Trust Fund to implement automation plans to
modernize land records and update other office automation and information technology
equipment. The remaining $1 reverts to the Compensation Board to fund studies to
develop individual land-records automation plans for individual circuit court offices. The
Clerk's Office is requesting an appropriation of $595,077 from the current fund balance
of this fund, which will support Granicus (land records system), CCMS (case
management software), CIS (case imaging software), and VDS (video docketing
software).
• Considerations: This appropriation will not require any additional funding from
the City.

ITEM: An Ordinance to Accept and Appropriate Funds from the Tenth Annual Virginia
Beach Business Appreciation Charity Golf Classic and Networking Reception
and to Authorize Three Donations
MEETING DATE: August 1, 2017
• Background: On June 5, 2017, the Virginia Beach Development Authority
(VBDA) and the Department of Economic Development (DED) hosted the tenth annual
Virginia Beach Business Appreciation Charity Golf Classic and Networking Reception at
Virginia Beach National Golf Club. The Golf and Reception event normally coincides
with the Commonwealth of Virginia's Business Appreciation Month, which is typically
celebrated annually during May. Business Appreciation Month recognizes the
invaluable contributions that Virginia Beach businesses make to support our excellent
economy and high quality of life.
The invitation list for the Golf and Reception included over 800 Virginia Beach business
and industry executives, real estate agents, developers, brokers, architects, engineers,
and consultants (joined by members of the VBDA and DED). This charitable fundraising
event donates a portion of the private sector proceeds to three local organizations
encompassing job skills for special needs adults, instruction for children, and community
awareness. This year the three organizations are: the Global Studies Academy at
Tallwood High School; the Entrepreneurship and Business Academy at Kempsville High
School; and the Virginia Beach GrowSmart Foundation. This event generated $16,500
in monies to be allocated equally for the benefit of the above referenced programs.
• Considerations: Approval of the attached ordinance will allow the City to accept
a check from the VBDA, appropriate it in the FY 2017-18 Operating Budget of the
Department of Economic Development, and then donate the funding received to the
organizations listed above for use within the City of Virginia Beach.

ITEM: An Ordinance to Accept and Appropriate Grant Funds to the Department of
Emergency Medical Services and to Authorize a Transfer for a Local Match
MEETING DATE: August 1, 2017
• Background: The General Assembly established the Four-for-Life program for the
purpose of providing financial assistance to volunteer rescue squads and municipal EMS
agencies. As required by Virginia Code 46.2-694, the Four-for-Life collects four additional
dollars on each state automobile license purchased annually. Twenty-five percent of these
funds collected are available to EMS agencies through the Rescue Squad Assistance
Fund (RSAF) Grant Program for training programs, equipment and supplies intended to
enhance rescue/medical capabilities.
The Virginia Department of Health, Office of Emergency Medical Services has awarded
the City's Department of Emergency Medical Services (EMS) a RSAF grant of $51,428.27
to purchase:
- Two ISim ALSi sim training kits (total cost $16,400);
- Two Resusci Baby QCPR manikins with SimPads (total cost $5,378); and
- One SimMan ALS manikin (total cost $29,650.27).
The addition of these items will increase the capabilities for EMS to offer related trainings
to volunteer, career, and Fire Department patient care providers. A 50% local City match
is required at $25,715.
• Considerations: Four-for-Life funding that a locality receives through the annual
Return to Localities portion of the fund may not be used for the matching portion of the
RSAF grant. The funding for the local grant match portion of these items ($25,715) is
available in the General Fund Reserve for Contingencies. After this request, the total in
the General Fund Reserve for Contingencies will be $720,090.

ITEM: An Ordinance to Accept and Appropriate Funds for a Regional Opioid Recovery
Project
MEETING DATE: August 1, 2017
• Background: The Commonwealth of Virginia is experiencing an opioid epidemic,
and in November 2016, Governor Terry McAuliffe declared the opioid addiction crisis a
public health emergency. According to an April 2017 article in the Washington Post,
1,420 Virginians died from opioid overdoses in calendar year 2016, double the number
of fatalities from automobile accidents. In Virginia Beach, there were 263 overdoses and
54 deaths in 2016.
As part of a FY 2018 federal Substance Abuse and Mental Health Administration grant
to the Commonwealth of Virginia, the Virginia Department of Behavioral Health and
Developmental Services has made a regional award of $267,894 in federal pass-
through funds for a collaborative project between the Norfolk Community Services
Board, the Portsmouth Behavioral Healthcare, and the City's Department of Human
Services. This demonstration project will provide emergency room access to Peer
Recovery Specialists for people experiencing opioid addiction crisis and will provide a
warm line access to Peer Recovery Specialists for people to connect peer-to-peer
before a crisis occurs.
The Norfolk Community Services Board will serve as the fiscal agent for the project and
Virginia Beach will bill, and be reimbursed by, Norfolk. It is anticipated the City will
engage two contracted manpower Peer Specialists. The Virginia Beach budget for the
project is $64,696.
• Considerations: This is one-time federal pass-through funding of $64,696 to
provide peer support to individuals in various stages of recovery from Opioid addiction.
This demonstration project will not require additional General Fund support.

• Background: The Commonwealth of Virginia is experiencing an opioid epidemic,

to the Commonwealth of Virginia, the Virginia Department of Behavioral Health and
Developmental Services has awarded $942,586 in federal pass-through funds to the
City's Department of Human Services to identify 207 individuals struggling with opioid
addiction who are not currently receiving treatment for their addiction and bring them
into treatment. Funding covers breaking down barriers to accessing treatment, such as
housing, transportation and daycare assistance, as well as the cost of daily Suboxone
or methadone treatments, and where necessary, residential recovery treatment.
Assistance payments are limited in duration, and after four months of medical treatment,
individuals will be required to contribute to the cost of their medication. The program is
designed to assist individuals with opioid addiction getting started in treatment so that
they can sustain recovery on their own. Contracted manpower staff will be engaged to
run this program and include an Administrative Technician, a Care Coordinator, and a
Case Manager. This program will also be heavily marketed with public safety, hospitals,
online, and in public spaces with the collaboration of the City's Communication Offices.
• Considerations: This is one-time federal pass-through funding of $942,586 to
assist individuals with opioid addiction to begin medically assisted treatment and
remove barriers to their sustained recovery. This program will not require additional
General Fund support and is intended to close to new applicants in April 2018, and
completely expend all funds from the Commonwealth by June 30, 2018.

Technical Rescue Team
MEETING DATE: August 1, 2017
• Background: The City was notified that the Virginia Department of Emergency
Management would be providing federal pass-through funding for localities for heavy
tactical rescue team equipment, training, and exercise. The Virginia Beach Fire
Department is the lead agency for the Tidewater Regional Technical Rescue Team,
which is one of seven regional state and urban search and rescue teams. The funding
will allow the Virginia Beach Fire Department Heavy Tactical Rescue Team to purchase
technical search equipment, which will increase its response capability.
• Considerations: This grant is awarded by the Virginia Department of
Emergency Management with funding originating from the U. S. Department of
Homeland Security's National Preparedness Directorate. There is no local match
required for this program and the program's period ends on June 30, 2018.
