The Economic Development Incentive Program ("EDIP") is a major factor in the City's ability to
compete in the economic market. During FY2017, the Authority approved thirteen (13) EDIP Grants
totaling$1.4-Million; however, these grants leveraged more than $40-Million in new Capital Investment
and created or retained nearly 700 jobs:

Last year, Telefonica, Microsoft and Facebook announced their intent to bring the two fastest data
communication cables in the world to Virginia Beach. The activity since then has been phenomenal, to

The City transferred 155 acres in support of VABEACHBIO. The Authority is excited about the
Governor's decision to locate a new 120-bed Veteran's Care Center in the City. The City continues to
partner with Tidewater Community College for the BioScience Accelerator, which continues to produce
results. The City hosted the Virginia BIO Bi-Annual Conference, bringing 250 of the Commonwealth's
top Bio businesses to the City:

homeless persons

what is possible to achieve: Make homelessness rare, brief,and

BACKGROUND
• The "Community of One" plan represents the vision of the entire Virginia
Beach community
• It is the collective work of city, state and Federal agencies, nonprofit
service providers,faith-based organizations and involved individuals
• The plan is intended to serve the needs of all who experience
homelessness including families, individuals,youth, veterans, and people
transitioning from institutional living.
• The plan was written by staff of the Department of Housing and
Neighborhood Preservation:

Councilman Moss advised the Deferred Compensation Board met last week to discuss the possibility of
moving the fiduciary responsibility of the 957 Retirement Plan to VRS. In addition to the returns being
competitive, the costs are significantly lower with VRS. In fact, it will give employees more choices at
lower costs. Councilman Moss complimented the leadership of Patti Phillips and feels employees receive
a tremendous benefit with all of her expertise, time and work she dedicates to the Retirement Plan.
Councilman Moss advised the Board is planning to provide a presentation to City Council regarding this
issue in December and then the legislation will be placed on the Agenda for City Council consideration.

November and then by City Council in December.

Council Lady Henley referenced the letter that was included in City Council's packet to the Army Corps
of Engineers regarding the Sandbridge Beach Replenishment Project moving forward even though there
is no Federal 'Dollars available and will he funded by the SSD.
Councilman Moss asked if the lack of Federal Funds is due to where it falls in the Budget Cycle or is it a
change of philosophy in the Administration not to fund these types of projects.
City Manager Hansen advised the Office of Management Budget has never been a huge supporter of the
commitments made regarding shore replenishment and now there is just no funding available.
Council Lady Henley advised this project was started in the '90's and was to be funded 65%federal and
35%local. The City implemented the SSD, with the cooperation of Sandbridge residents, and has made
such a difference in Sandbridge with all of the projects that have been funded by the SSD.

Mayor Sessoms DISCLOSED he is retired from Towne Bank (which has a corporate office located at
297 Constitution Drive in Virginia Beach), and no longer has any involvement in Towne Bank's
transactions. However, due to the size of TowneBank and the volume of transactions it handles, Towne
Bank has an interest in numerous matters in which he is not personally involved and of which he does not
have personal knowledge. In that regard, he is always concerned about the appearance of impropriety
that might arise if he unknowingly participates in a matter before City Council in which TowneBank has

Susan Grube, Chair- Music Director Search Committee, advised she is here in Mr. Brown's stead and it
is her honor to introduce Daniel Booth, Conductor—Symphonicity. Mrs. Grube advised the search for a
new Conductor was a two-year search process, with more than 75 applicants from all over the world
applying; however, it was clear that Daniel Booth, was the clear choice to lead Symphonicty. Most
recently, he was the Conductor and Public Relations Strategist for the United States Air Force Band and
Orchestra.
Maestro Booth expressed his appreciation to the City Council for allowing him the opportunity to appear
tonight. He also thanked the Arts and Humanities Commission for all they do in this great City and he is
truly excited about this new venture and chapter in his life.

WHEREAS: Bishop Rudolph B.Lewis is the Senior Pastor of New Light Full Gospel Baptist Church. Bishop
Lewis was born September 23, 1942,in Loris,South Carolina,the ninth child of William S.and Ruth B.Lewis. His
future in the ministry was inevitable in that six of his parent's ten children became Ministers. He graduated from
Finklea High School and attended Howard University. It was there he received his call to serve the Lord. In May
1995, he received an Honorary Doctorate of Divinity Degree and in March 2000 an Honorary Doctorate of Law
Degree from Richmond Seminary and College;

WHEREAS: Bishop Lewis married the former Maurine Delores Arnold. They are blessed with four children:
April Lewis Gray, Pastor Rudolph B. Lewis, Jr., Pastor Estrelda Yvette Lewis, Vicki Nichole Lewis, four
grandchildren: Chela Epps (Darreo), Michael Gray, Jr. , Cameka Gray, Jermane Beckett, Jr. and eight great
grandchildren.
WHEREAS: For two years, Doctor Lewis served as the National Youth President of the First United Churches of
Jesus Christ before becoming the Pastor of the First United Church of Jesus Christ in Portsmouth where he served
fourteen years. At the same time, he also served as the President of the Interdenominational Minister's Forum, a
member of the Tidewater Ministerial Conference of Norfolk and a member of the Special Day Finance Committee of
Virginia Seminary and College in Lynchburg;
WHEREAS: In 1979, Doctor Lewis became the Pastor of New Light Baptist Church. His purpose was to lead
and guide God's people by teaching and discipleship. His leadership direction was set by example for this church
became "A Church of Expanding Ministries"by developing ministries dedicated to outreach that sought to propel
people toward Jesus Christ and the uplifting of His Kingdom. As a visionary, Doctor Lewis led the New Light
Baptist Church family and the surrounding community to be blessed through ever increasing ministries;
WHEREAS: In 1994, Pastor Lewis and New Light Baptist Church became affiliated with the Full Gospel
Baptist Church Fellowship International. In November 1998, the Full Gospel Baptist Church Fellowship
ordained him Bishop. He was then appointed Bishop over the Full Gospel Baptist Church Fellowship Covenant
Partners Ministry. Bishop Lewis'first book, "Godly Principles and Grace", was released in May 1996. His
personal ministry, "This is the Day" was his first ministry crusade and was held in Johannesburg, Africa, in
February 2006. He has preached in Israel as well as in thirteen African countries,at the Lott Carey Convention
and the National Baptist Convention.
NOW, THEREFORE, BE IT RESOLVED: That the Virginia Beach City Council pause in its deliberations to
acknowledge Bishop Rudolph B. Lewis'dedication, awesome leadership and untiring service to the world, this
community and to the parishioners of his Church and wishes Bishop Lewis a very HAPPY BIRTHDAY on
September Twenty-third, Two Thousand Seventeen. The Mayor and Members of City Council hereby ordain that
this Resolution shall be recorded in the proceedings of this Formal Session of City Council on the Nineteenth day of

8 WHEREAS, the requirement for bid, payment, and performance bonds
9 (collectively, "bonding") for City nontransportation-related construction contracts
10 exceeding $100,000 is provided by state law;

12 WHEREAS, in the 2011, the General Assembly authorized waiver of bond
13 requirements for nontransportation-related construction projects between $100,000 and
14 $500,000 ("bond waiver projects"), but the bidders for such projects were required to be
15 prequalified;
16
17 WHEREAS, the City Council, in an effort to remove potential barriers to
18 participation in City contracting, included an item in its Legislative Agenda to remove the
19 prequalification requirement for bond waiver projects;
20
21 WHEREAS, in the 2017 General Assembly Session, Delegate Ron Villanueva
22 proposed House Bill 2017 to remove the prequalification requirement for
23 nontransportation-related construction contracts that would otherwise require bonding;
24
25 WHEREAS, the General Assembly adopted a revised bill and the Governor signed
26 it into law, which, will allow the City to waive the bonding requirements up to 10 contracts
27 per year for nontransportation-related construction contracts valued between $100,000
28 and $300,000;

30 WHEREAS, the Virginia Beach Minority Business Council supports the removal of
31 prequalification for bond waiver projects.

33 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
34 VIRGINIA BEACH, VIRGINIA:

36 That the City Council finds the removal of barriers in City contracting increases
37 competition, which is a benefit to the residents of the City, and as the removal of a barrier,
38 the Council finds that removing prequalification for nontransportation-related construction
39 contracts between $100,000 and $300,000 is in the best interests of the City.

A RESOLUTION SUPPORTING THE ENVIRONMENTAL
ASSESSMENT FOR THE TRANSITIONING OF THE
REMAINING F/A-18 AIRCRAFT TO NAVAL AIR STATION
OCEANA
1 WHEREAS, Naval Air Station Oceana ("NAS Oceana") has been an important part
2 of the community and the economy of Virginia Beach and Hampton Roads since the mid-
3 19405;
4
5 WHEREAS, NAS Oceana has been the site of Navy Strike Aircraft since that time;
6
7 WHEREAS, the majority of aircraft based at NAS Oceana transitioned to F/A-
8 18E/F Super Hornet more than a decade ago;
9
10 WHEREAS, these F/A-18E/F aircraft Super Hornets have been operating over the
11 Oceana Naval Air Station and Fentress Naval Auxiliary Landing Field for many years;
12
13 WHEREAS, the Navy wishes to transition the remainder of the legacy F/A-18A/C/D
14 Hornet aircraft to the new F/A-18E/F Super Hornet Aircraft;
15
16 WHEREAS, the Navy began the development of an Environmental Impact
17 Statement (EIS) for this action, and the initial analysis showed no significant
18 environmental impacts;
19
20 WHEREAS, this is mainly because the flight training is nearly identical to the
21 existing Hornet aircraft, and the noise impacts are virtually the same;
22
23 WHEREAS, the Navy has redesigned the EIS as an Environmental Assessment
24 (EA); and
25
26 WHEREAS, the Navy is requesting public comments on the Environmental
27 Assessment.

29 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
30 VIRGINIA BEACH, VIRGINIA:

32 1. That the City Council supports the completion of the Environmental
33 Assessment for the transitioning of the remainder F/A-18A/C/D Hornet aircraft to F/A-

36 2. That the City Council has concluded that this transition supports both the
37 national defense and the longevity of NAS Oceana.

Re: Abstention Pursuant to Conflict of Interests Act § 2.2-3115(F)
Dear Mrs. Fraser:
In my fourteen years of service to the public on City Council, I have rarely
abstained. It is my position that state law sets the lowest standard of acceptable conflicts
of interests. Unlike the Commonwealth of Virginia's much lower standard of conflict of
interests, the Federal standard is one of avoiding even the appearance of a conflict.
Tonight's agenda includes a resolution supporting the environmental assessment
for the transitioning of the remaining F/A-18 aircraft to Naval Air Station Oceana. The
Navy has requested public comment on the environmental assessment, and the resolution
is the mechanism whereby City Council could convey its comments to the Navy.
The United States Department of Defense is the executive branch department of the
federal government that is charged with coordinating and supervising all agencies and
functions of the government concerned directly with national security and the United States
Armed Forces, including the Navy. As an employee of the Department of Defense, I have
concluded that my participation in City Council's discussion and vote on this resolution
would result in the appearance of a conflict of interest under the "appearance of a conflict

11 WHEREAS, the Property is located adjacent to existing Pump Station 414 that
12 needs to be replaced;

14 WHEREAS, the Terrys have agreed to convey the Property to the City for$277,500,
15 subject to Council approval and in accordance with the Summary of Terms attached hereto
16 as Exhibit B and incorporated herein; and

18 WHEREAS, funding for the acquisition is available in Pump Station Modifications
19 Phase V, CIP 6-041.105.

Ordinance upon application of PRINCESS ANNE ESTATE TRUST&
VIRGINIA BEACH FINANCIAL CENTER, INC for Closure of a
portion of Lord Dunmore Drive, at Princess Anne Road and relocated

The following conditions shall be required:
1. The City Attorney's Office will make the final determination regarding ownership of
the underlying fee. The purchase price to be paid to the City shall be determined as
specified in the July 27, 2010, Sale Agreement[the 'Agreement] between the City of
Virginia Beach and the applicant. A copy of the Agreement has been made part of the
file for this street closure application, which is available at the Planning Department.
2. The applicant shall submit a Subdivision Plat that incorporates the closed area into
the adjoining parcels (referenced by the Agreement as the 'Trotman Residue'[West
of the closure area] and the 'VBFC Remainder'[East of the closure area]). The plat
shall include a public easement for a boat launch, including access to two parking
spaces, and a public ingress/egress easement, as specified in the Agreement. This
plat must be submitted and approved for recordation prior to final street closure
approval.
3. The applicant shall verb that no private utilities exist within the right-of-way
proposed for closure. Initial review indicates that there appears to be private utilities
within the right-of way proposed for closure. If it is determined that private utilities
do exist, easements satisfactory to the utility company must be provided.
4. Easements for public water and sewer lines located within the closed area,
satisfactory to the Virginia Beach Department of Public Utilities, must be provided
on the plat referenced in Condition No. 2.
5. Closure of the right-of-way shall be contingent upon compliance with the above
stated conditions within 365 days of approval by City Council.If the conditions noted
above are not accomplished and the final plat is not approved within one year of the
City Council vole to close the right-of-way, this approval shall be considered null
and void.
This Ordinance shall be effective in accordance with Section 1076) of the Zoning Ordinance.

8 WHEREAS, Princess Anne Estate Trust, a Virginia business trust, and Virginia
9 Beach Financial Center, Inc., a Virginia corporation (collectively, the "Applicant") applied
10 to the Council of the City of Virginia Beach, Virginia, to have the hereinafter described
11 portions of unimproved right-of-way discontinued, closed, and vacated; and
12
13 WHEREAS, it is the judgment of the Council that said portions of unimproved
14 right-of-way be discontinued, closed, and vacated, subject to certain conditions having
15 been met on or before one (1) year from City Council's adoption of this Ordinance.

17 NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Virginia

34 BEACH, VIRGINIA", dated February 7, 2017, prepared by
35 Stephen I. Boone & Associates, P.C., a copy of which is
36 attached hereto as Exhibit A.

38 SECTION II

40 The following conditions must be met on or before one (1) year from City
41 Council's adoption of this ordinance:

43 1. The City Attorney's Office will make the final determination regarding ownership
44 of the underlying fee. The purchase price to be paid to the City will be set

48 resolution of concerns raised by the Applicant related to impacts from the
49 Princess Anne Road/Kempsville Road Intersection Improvements Project.

51 2. The Applicant shall resubdivide the property and vacate internal lot lines to
52 incorporate the portion of closed right-of-way into the adjoining parcels. The
53 resubdivision plat must be submitted and approved for recordation prior to final
54 street closure approval. The resubdivision plat shall show an easement area for
55 a public boat launch and two parking spaces, as well as an easement for
56 ingress/egress thereto.

58 3. The Applicant shall verify that no private utilities exist within the right-of-way
59 proposed for closure. Preliminary comments from the utility companies indicate
60 that there are private utilities within the right-of-way proposed for closure. If
61 private utilities do exist, easements satisfactory to the utility company must be

78 3. In the event the City of Virginia Beach has any interest in the underlying
79 fee, the City Manager or his designee is authorized to execute whatever documents, if
80 any, that may be requested to convey such interest, provided said documents are
81 approved by the City Attorney's Office.

85 A certified copy of this Ordinance shall be filed in the Clerk's Office of the Circuit
86 Court of the City of Virginia Beach, Virginia, and indexed in the name of the CITY OF

88 business trust, and VIRGINIA BEACH FINANCIAL CENTER, INC., a Virginia
89 corporation, as "Grantees".

I. The applicant shall obtain and maintain a Federal Firearms License through the
Bureau afAlcohol, Tobacco, Firearm and Explosives, as required by law.
2. The Home Occupation shall not create noise, dust, vibration, smell, smoke, glare,
electrical interference,fire hazard or any other hazard or nuisance to any greater or
more frequent extent than would normally be expected in the neighborhood under
normal circumstances wherein no home occupation exists.
3. There shall be no sign identifying the business on the exterior of any building on the

4. There shall be no more than five (5) hand-to-hand transactions per month from the
dwelling.
5. Delivery of firearms to the property shall be received on the applicant's property

6. Not more than twenty (20) percent of the floor area of the dwelling unit and
accessory structures shall be used in the conduct of activity with the home
occupation.
7. Any firearm or firearm parts kept on the property shall he stored in a locked, secured
vault or similar container. The applicant shall contact the Police Department's
Crime Prevention Office to arrange for a meeting at the property for the purpose of
conducting a security assessment. A report shall be written by the Police
Department, a copy provided to the applicant, the Planning Department, and a copy
retained by the Police Department.
8. All small arms ammunition, primers, smokeless propellants and black powder
propellants stored or awaiting transfer at the residence shall comply with Section
3306 of the Virginia Statewide Fire Prevention Code and NFPA 495.
9. There shall be no more than one (I) employee, other than the home owner, on the
property associated with this home-based business

11 WHEREAS, the public necessity, convenience, general welfare and good zoning
12 practice so require;

14 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VIRGINIA
15 BEACH, VIRGINIA:

17 That Section 201 of the City Zoning Ordinance is hereby amended and
18 reordained to read as follows:

20 Sec. 201. - Yards.

24 (e) Requirements for fences and walls. Except as may be provided by the regulations
25 of the Oceanfront Resort District Form-Based Code, the following requirements
26 shall apply to fences and walls:
27
28 (1) Fences and walls shall not exceed a height of eight (8) feet. Walls and fences
29 may project into or enclose any part of any yard; provided, however, that any
30

32 projects into or encloses a required front yard shall not exceed a height of four
33 (4) feet, and that any fence or wall which proiects into or encloses a side yard
34 adiacent to a street shall not exceed four (4) feet in height when located within
35 ten (10) feet of the right-of-way except in the case of a through lot when a
36 required front yard setback is clearly and physically the rear of the dwelling, an
37 eight-foot fence will be allowed, no No fence or wall
38 may be erected closer than five (5) feet to any right-of-way line, and where it is
39 sleser-than ten (10) feet or closer to any right-of-way line,

41 between it and the right-of-way line.

43 (1a)Fences constructed of materials generally recognized on an industry-wide basis
44 as maintenance-free, such as vinyl and aluminum, may be located on a right-of-
45 way line, provided that (i) Category I landscaping shall be installed immediately
46 inside the entire length of any such fence; (ii) the height of any such fence shall

47 not exceed the limits set forth in subsection (e)(1) above; and (iii) any such
48 fence shall be no greater than fifty (50) percent opaque.

50 (1b) Fences or walls six feet or less in height, located on corner lots, may be
51 erected in the required side yard setback, provided that no such fence or wall
52 shall be closer than ten (10) feet to any right-of-way line. In addition, fences

54 in the required side yard setback, substantially parallel to the right-of-way line
55 located adjacent to the side yard, in line with the closest corner of any
56 nonconforming dwelling. The closest corner of the nonconforming dwelling shall
57 not include fireplaces, bay windows or similar amenities. No such fence or wall
58 may be erected closer than five (5) feet to any right-of-way line, and where it is
59 sleser--than ten (10) feet or closer to any right-of-way line, Category I
60 landscaping shall be installed between it and the right-of-way line and-the
61 fcncc.

63 (1c)Adjacent to a city, state or federal road project sound-wall directly adjacent to
64 and substantially parallel to a right-of-way, fences or walls located within thirty
65 (30) feet of the right-of-way adjacent to the sound-wall may be placed up to the
66 right-of-way line directly behind the sound-wall provided that (i) such fences or
67 walls shall not exceed eight (8) feet in height, (ii) such fences or walls shall not
68 be installed within the right-of-way unless all necessary permits and approvals
69 are obtained from the Department of Public Works, and (iii) no such fence or
70 wall exceeding four (4) feet in height shall be permitted within the front yard
71 setback in front of the wall closest to the dwelling.

75 (6)No nonconforming fence or wall located within thirty (30) feet of, and
76 substantially parallel to, any public right-of-way shall be enlarged, extended,
77 relocated, or reconstructed nor shall more than fifty (50) percent of any

55 signs up to two hundred (200) square feet in addition to other allowed
56 signage. Such signs shall be mounted on or above the top one-quarter (Y) of
57 the building, but not above the roofline of such building, and only one (1) sign
58 per building facade shall be allowed. Two (2) additional signs, not exceeding
59 twenty (20) square feet each, may be allowed at each street level entrance.

61 (d) Commercial buildings of more than ten (10) stories in height may have two
62 (2) signs up to three hundred (300) square feet each in addition to other
63 allowed signaqe. Such signs shall be mounted on or above the top one-
64 quarter (Y) of the building, but not above the roofline of such building, and
65 only one (1) sign per building facade shall be allowed. Two (2) additional
66 signs, not exceeding twenty (20) square feet each, may be allowed at each
67 street level entrance.

69 (e) Establishments with a lot frontage of between one hundred (100) linear feet and
70 two hundred (200) linear feet shall be permitted one (1) freestanding sign, which
71 shall not exceed thirty two (32) square feet in area per face. Establishments with
72 a lot frontage greater than two hundred (200) linear feet shall be permitted one
73 (1) freestanding sign, which shall not exceed seventy five (75) square feet in area

98 (e)fh) To facilitate occupancy in new industrial parks, a temporary sign may-be-erected
99 shall be permitted at each principal entrance. In an industrial park containing a
100 minimum of ten (10) acres of land area, one (1) sash sign no greater in area than
101 one hundred fifty(150) square feet may be erected at each principal entrance. In
102 a new industrial park containing a minimum of thirty (30) acres of land, one (1)
103 gush sign no greater in area than two hundred (200) square feet may be erected
104 at each principal entrance. Such signs shall be removed when seventy (70)
105 percent of the property is occupied or leased, or after a period of twenty-four (24)
106 months from the date a certificate of occupancy is issued, whichever comes first.
