Currently, the property owners are provided bottled water; however, the Navy is looking for a long-term solution: t Environmental Monitoring • PFAS:Testing of properties utilizing well water in areas around NAS Oceana continues — One business property recently tested slightly above the EPA - Lifetime Heakh Advisory level — Bottled water is being delivered pending decision on long-term ®'r solution — Other well users in the vicinity have again been offered retesting A Drone Awareness Campaign was held during NAS Oceana Air Show to help prevent drone collisions with Naval Aircraft: Other Initiatives • Drone Awareness — Outstanding cooperation between City and Oceana staffs — Safety video will now run at ; F Oceanfrontels — https://youtu./youtu.be/Xuca4p7z2DE • US Army Corps of Engineers study for replacement for x North Landing Bridge i — NAS Oceana staff are ;' $^ participating November 27, 2018 5 CITY MANAGER'S BRIEFINGS NAVAL AIR STATION OCEANA UPDATE (Continued) Through the partnership with the City and the Transition Area/Intrafacility Traffic Area Citizens Advisory Committee, most of the land surrounding NAS Oceana has been purchased to keep the rural area: i Encroachment Management • The City and Oceana staffs continue their close collaboration — Joint Review Process for zoning and development applications — OLUCC and APZ-1/Clear Zone Acquisition&Conformity Program — Encroachment Partnering Program • Encroachment Partnering:The Interfacility Traffic Area(ITA)portion of the program will likely conclude early Summer 2019 upon closing on four properties — Virtually all desired properties in the ITA have been acquired — Encroachment Partnering remains an option in other areas,if such acquisitions meet program goals NAS Oceana is looking at ways to save funding by developing inter-governmental service agreements for ditch clearing, storm drain maintenance and storm debris removal. Additional regulations are expected: Federal Ruling Siting in the Public Right-of-Way September 26,2018-adopted a proposed small cell order Declaratory Ruling and Third Report and Order October 15,2018-published in Federal Register. Will become effective 90 days thereafter unless overturned or stayed January 14,2019-expected effective date Establishes safe harbor for annual fee of$270 per pole,and zoning application fees(Virginia statute already complies, no pre-emption). Here are the companies that have been awarded franchises with the City: Locating Infrastructure Small Cell Franchises Awarded These companies have been awarded a franchise to place their equipment in the ROW(Option#1 and Option#2): • Cellco Partnership d/b/a Verizon Wireless("Verizon") • AT&T Mobility d/b/a New Cingular Wireless PCS("AT&T") • Mobilitie(Infrastructure Provider) • Cox Wireless Access(Infrastructure Provider) • Crown Castle(Infrastructure Provider) These companies have requested a Master License Agreement to attach their equipment to City-owned structures(Option#3): • Cellco Partnership d/b/a Verizon Wireless • AT&T Mobility d/b/a New Cingular PCS a November 27, 2018 9 CITY MANAGER'S BRIEFINGS WIRELESS COMMUNICATIONS FACILITIES MASTER LICENSE AGREEMENT(MLA) (Continued) Here is a "Typical Scenario"where the provider is unable to use an existing pole to place necessary equipment and installs a new pole. The City's goal is to limit the number of new poles installed by using existing poles such as lighting poles and traffic signals: ' Typical scenario: 1. Provider is unable to negotiate Option #1 with the pole owner 2. Provider does not have the option of co- ' locating on an existing City-owned r{ f structure 3. Provider installs its own pole t - ;' Allowing companies to attach to City- 111 owned structures that meet the City's criteria would provide an additional option to providers,with the City's stated goal of lessening the number of poles in ' F - City right-of-way and the aesthetic impact to the streetscape. New pole placed on Rosemont Rd.,near Buckner Blvd. 5 Here is a summary of the Ordinance that will be presented to City Council for consideration on December 4, 2018: Requested Council Action: Approve Master License Agreements with Verizon and AT&T for an initial term of 25 years with a 15 year renewal option, with the following terms and conditions: 1. Attachment to each individual pole will be subject to a formal application process,and reviewed by the appointed department representative prior to approval. 2. Once approved for attachment,each small cell application will then be processed through the City's normal permitting process,and will be granted or denied a right-of-way permit in a non-discriminatory manner. 3. Approval to attach or replace and attach to a City-owned structure is not a guarantee by the City that such project will be issued a right-of-way permit. That determination will be made independently and based on the applicant's detailed site plan,traffic control,and landscape plan,if applicable. Management Fee During first 12 months of construction $15,000 per month During following 12 months of construction $20,000 per month Once the Facility opens $30,000 per month Incentive Fee During first 2 years after opening 6%of gross revenues After 2 years,first$2,500,000 4%of gross revenues Next$1,000,000 above$2,500,000 5%of gross revenues Next$1,000,000 above$3,500,000 6%of gross revenues Above$4,500,000 7%of gross revenues Summary of Terms-PPEA Comprehensive Agreement for the Operation of the Virginia Beach Sports Center Material Terms: • City's CVB Sports Marketing Division books tournaments and sports-related events nine months out from booking date(generally Friday—Sunday) • Within,nine months,the Manager controls the booking calendar,and will work to maximize the use of the Facility during Monday—Thursday through leagues,clubs and other facility use agreements. • As part of a Start-up Budget,the Manager will out-fit facility with furniture,fixtures and athletic equipment and such items will become the property of the facility. • if the Crty terminates the Agreement prior to the completion of the initial 10-year term,the City is required to pay the unamortized cost of the furniture,fixtures and athletic equipment • City will hold and control Operating Reserves and Capital Reserves for the Facility;Manager is responsible for the initial Working Capital • Manager will make quarterly payments to the City based on gross revenues less operating expenses, Management Fee,Incentive Fee,repayment of the Operating Reserves and Repayment of the Start-up Budget. • City to retain control approval of sponsorship and naming rights of the Facility.All funds received from this category,net of direct expenses,will go the Capital Reserve.
