Mayor Dyer welcomed Charles J. Bodnar, Civil Engineer—Public Works Stormwater Management
Center. Mr. Bodnar expressed his appreciation to City Council for their continued support and
distributed a copy of the presentation which is attached hereto and made a part of the record. Mr.
Bodnar provided an update on the Sea Level Rise and Recurrent Flood Study which included; City-wide
Structural Alternatives, Individual Site/Parcel-level Strategies (NNBF), Public Engagement, Next Steps,
and Policy Document.
Mayor Dyer expressed his appreciation to Mr. Bodnar for the presentation.

Mayor Dyer opened the discussion and requested Vice Mayor Wood read the Reconciliation Letter, which
is attached hereto and made a part of the record.
Council Member Wilson advised she predicts there will be a lot of discussion concerning the use of
reversion funds for full-day Kindergarten and explained reversion funds can be used for as they were in
2003,for teacher salaries.
Council Member Moss advised the school board is over budgeting salaries and believes there are
recurring revenues within the reversion fund. Council Member Moss supports the school board using
reversion funds to fund full-day Kindergarten. Council Member Moss requested a cross-reference and a
sequence of events concerning employee salaries.
Council Member Henley advised item five (5) in the Reconciliation Letter is extremely important
concerning tide water and requested specific details on the funding and the scope of the second study.
She expressed concern that the 15 year Stormwater Management Plan does not address wind tide
flooding solutions.
Council Member Henley advised there is a citizen who consistently requests re-instituting a boat tax to
cover the costs of dredging and recommended City Council consider that tax next year.
Council Member Abbott requested clarification on the pay compression component and what is being
proposed be included in the Friday package.
Council Member Wooten advised she would like to see the funding proposed for consulting and
monitoring the disparity study implementation used in part for the staff as she believes it would have
more of an impact. Council Member Wooten also requested funding to be put towards CIP#3047-
Landfill closure in Centerville, to help with the smell as citizens have been complaining.
Council Member Moss advised the amusement tax could be used to fund public safety instead of using
recurring revenue.
Council Member Rouse requested to have funding set aside to help preserve the historical value in the
Seatack Community with historical markers and the expansion of the park.
Mayor Dyer expressed his appreciation for the discussion and all of the input from City Council and the
public. There will be more discussion moving forward.

Subject: FY 2019-20 Operating Budget and CIP Reconciliation
Dear Mayor and City Council Members:
After several months of briefings with extensive discussion and listening to the public input at
the various public meetings, town halls, public hearings and on social media, it is recommended
that the Operating Budget and CIP be adopted with the following adjustments:
New Initiatives
1. Add $4,511,823 for implementation of a Public Safety Pay System expansion. To address
public safety pay disparities within the Sheriff's Office and further expand a workforce
development plan in the Fire Department, EMS, Police Department and Sheriff's Office, an
accelerated program toward promotions for sworn non-supervisory positions is to be
implemented: a program providing a salary increase of 5% in year 3, salary increase of 10%
in year 6 and a salary increase of 5% in year 9. The pay disparity for Sheriff Deputies is to
be implemented over a four year period.
2. Add $30,000 to the Department of Finance to continue the implementation of findings and
recommendations resulting from a disparity study completed by the City.
3. Increase funding to both Juvenile & Domestic Relations District Court and the General
District Courts by a total of$120,414. A City supplement of 5%is provided to those making
less than $34,000, a 3% salary supplement is provided to those making between $34,001
and $40,000, and a 1% salary supplement is provided to those making more than $40,000.
These supplements should be calculated after the State provides a 3% increase for each
employee.
4. Increase funding to CIP Project #2-126 "Laskin Road Phase I-A (VDOT)" in the FY 2020
Capital Improvement Program by $6,000,000. This is a VDOT managed project and due to
a recent bid bust, additional funding is necessary to progress to a construction contract. This
project increase will be supported by an increased use of previously authorized but
unallocated charter bonds in the amount of$5,700,000 and by $300,000 from the recently
completed CIP # 2-168 Lesner Bridge Replacement project. In order for this project to go
forward, the CTBNDOT must add $12 million and the project team must value engineer $8
million in savings.
5. Direct the City Manager to conduct two studies. The first pertains to studying Back Bay and
the potential relief cut to the ocean or other strategies which would mitigate the effects of
wind driven tidal flooding in the southern region of the City. The second study is to
establish a site acquisition policy and action plan of potential future uses of those properties
related to flood mitigation.
6. Accelerate Full Day Kindergarten in all remaining Schools not under construction—see
attached summary.
7. Move funding for Historic Homes and contributions to both Atlantic Wildfowl Heritage
Museum and Virginia Beach Surf&Rescue Museum (Old Coast Guard Station) to the
newly established Department of Cultural Affairs. Increase funding to Cultural Affairs for
Historic Homes by$90,000 for programming and an additional FTE to be funded on
January 1, 2020. This results in renaming the Department of Aquariums, Historic Houses
and Museums to the Department of the Virginia Aquarium and establishing the Office of
Cultural Affairs as a department.
8. Increase funding to Sister Cities by$7,000 to support another partnership in Virginia Beach
high schools. (Cox High School)
Additional Revenues or Offsetting Reductions
9. The final General Assembly budget lowered the required Standard of Quality (SOQ) local
match from the proposed Governor's budget. The SOQ match is a variable used within the
existing City/School Revenue Sharing Formula. As a result of this change, the City's
obligation to Schools is reduced by$421,977.
10. Increase State revenue by $1,198,815 for reimbursement of Constitutional Officers and their
employees based on the State Compensation Board's recent budget announcement. This
exceeds the amount estimated in the City Manager's Proposed Budget.
11. Increase "State Aid to Localities with Police Departments" (599 funding) by $456,536. The
City has revised its projection for this revenue based on the State's adopted FY 2020 budget.
The Code of Virginia provides financial assistance to localities with police departments that
meet or exceed certain criteria through the "599" program.
12. Increase Interest Income in the General Fund by $900,000. This is a result of revised
projections due to additional months of realized revenue which were not available at the
time of the initial revenue estimates.
13. Eliminate the General Fund dedicated reserve for Neighborhood Dredging Special Service
Districts (SSDs) by $340,000. When a neighborhood obtains 80% signatures in favor of a
SSD for dredging, the General Fund loans the newly established SSD initial funding with
the SSD to repay the loan over 16 years. If a SSD is established in FY 2020, the funding
will be established in the FY 2021 budget.
14. Reduce the General Fund pay-as-you-go transfer to the CIP in FY 2020 by $1,441,909.
Reductions in year 1 of the CIP will include reducing CIP # 3-153 Various Site Acquisitions
III by $361,476 and CIP # 8-402 Replacement for Rudee Inlet Dredge by $1,080,433. In
order to fully fund CIP # 8-402 Replacement for Rudee Inlet Dredge, $1,080,433 is added to
year 2 of the CIP with an equal increase in General Fund pay-as-you-go financing.
Capturing City Council Actions and Housekeeping Items
15. Increase positions within Human Services FY 2020 budget to reflect City Council action
taken on March 19, 2019. An additional full-time Licensed Practical Nurse (LPN) and .75
part-time FTE Administrative Technician is added to Human Services FY 2020 Operating
Budget. To support these positions, Human Services FY 2020 Appropriations are increased
by$98,620 with State revenue being increased accordingly.
16. Convert 1.3 part-time FTEs in the Police Department to fund one full-time veterinary
technician (a total net change of -0.3 FTEs). On April 2, 2019, City Council adopted an
ordinance to make this change in the department's FY 2019 Operating Budget; however,
due to the timing of that ordinance in relation to the drafting of the City Manager's Proposed
Budget, the Proposed Budget reflects the part-time 1.3 FTEs. This adjustment will be cost
neutral in the FY 2020 Operating Budget.
17. Add $77,889 and authorize an additional FTE within the Health Department's FY 2020
Operating Budget to support the Healthy Families program. State revenue estimates to
support this position are increased by$77,889.
18. Modify the Schools' FY 2020 Operating Budget and Capital Improvement Program to
reflect adopted adjustments by the School Board on April 9th 2019. These changes include;
reduction of state funding in the amount of $883,108 (across all school funds) due to the
loss of state revenue, a reduction of local funding through the revenue sharing formula of
$421,977, reduction of budgeted debt service $2,043,114 due to a Fall bond issuance instead
of a Spring bond issuance, increase of$244,224 in a required local grant match (across all
school funds) for a Virginia Preschool Initiative Plus grant, and an increase to Schools' pay-
as-you-go transfer to the CIP by $721,541 for project # 1-179 Renovation and
Replacements-HVAC Phase III.
19. Modify the Schools' CIP section to reflect the correct Appropriations to Date (ATDs) and
project totals for the following CIP projects: ATDs and the total project cost for CIP#1-043
Thoroughgood Elementary School Replacement are reduced by($2,750,000), ATDs and the
total project cost for CIP #1-056 Princess Anne Middle School Replacement are increased
by $1,000,000, and ATDs and the total project cost for CIP #1-180 Renovations and
Replacements- Reroofing III are increased by$1,750,000. The Proposed CIP had incorrectly
displayed transfers among these projects.
20. The Real Estate tax increase of 1.50 included within the City Manager's Proposed Budget
creates capacity within the Storm Water Enterprise Fund by moving Mosquito Control,
Street Sweeping, Surface Water Regulatory Compliance, and Project Management to the
General Fund. This funding strategy creates capacity within the Storm Water Enterprise
Fund and maximizes the use of the Equivalent Residential Unit (ERU) to support revenue
bonds in the Storm Water CIP. The storm water programs moved to the General Fund are
identified by unique budget unit names reflecting their programmatic cost and FTEs and the
1.50 increase is dedicated for that purpose.
21. Expansion of Human Services Mental Health program- In accordance with amendments
made to the Commonwealth of Virginia's adopted 2018-2020 Biennium Budget, a sum of
up to $916,066 in revenue from the Commonwealth is awarded to the City of Virginia
Beach for the Jail and Reentry Service Coordination Pathway program. This funding shall
support the creation of up to 12 FTEs. A memorandum of understanding (MOU)is currently
being drafted between the Sheriff's Office and Human Services on the implementation of
this new program. The MOU was not finished in time to include within the budget. The
intent is for the City Manager to follow up with City Council to amend the FY 2020
Operating Budget by appropriating the revenue and establishing the FTEs once the
impending MOU is final.
The details for the funding sources and the adjustments are identified on the attachments.

Full Day Kindergarten and
Retention of the Schools Four Cents Real Estate Tax Dedication
Background
With the adoption of the FY 2012-13 Operating Budget,the City Council increased the real estate tax
rate from 89 cents to 95 cents per$100 of assessed valuation. Of the total six cent increase,four cents
were dedicated to the Schools,and the Real Estate Tax Ordinance stated that this revenue dedication
would remain in place until State funding to the School Operating Fund exceeded $350 million.The
Ordinance also directed that once State funding exceeded this established threshold, "the City Manager
will recommend a reduction, in whole or part,to the four cent tax rate dedication in an amount roughly
equal to the increased State funding with a corresponding decrease in the real estate tax rate."
Current Situation
Based on the estimated State revenue included in the FY 2019-20 Superintendent's Estimate of Needs,
the Schools are projecting$364.5 million of State revenue in the School Operating Fund, which exceeds
the$350 million threshold for the first time since the Ordinance was established in FY 2012-13. As p. 24
of the Executive Summary noted, it has taken eight years to reach this level of funding when both Basic
Aid and State Sales Tax revenue are combined. The City Manager recommends maintaining the
dedication to achieve City Council's goal to have World Class Schools and Educational Programs, but he
also recommended that the dedication be reviewed with the update to the City/School Revenue Sharing
Formula this summer.
Recommendation
While City Council supports the City Manager's recommendation, it also recommends that the School
Board fully implement full day kindergarten in all remaining elementary schools(not under construction)
in the FY 2019-20 Operating Budget using part of this four cent dedication. The City Council requests an
update of full day kindergarten implementation in conjunction with the School Board's anticipated
request for appropriating FY 2018-19 reversion funding in the Fall of 2019.The School Board's request
for reversion funding should reference using it for implementing Full Day Kindergarten.

Council Member Rosemary Wilson DISCLOSED that she is a real estate agent affiliated with Howard
Hanna Real Estate Services("Howard Hanna"), who's Oceanfront Office is located at 303 34th Street Suite
102, Virginia Beach, VA 23451. Because of the nature of realtor and real estate agent affiliation, the size
of Howard Hanna, and the volume of transactions it handles in any given year, Howard Hanna has an
interest in numerous matters in which she is not personally involved and of which she does not have
personal knowledge. In order to ensure her compliance with both the letter and the spirit of the State and
Local Government Conflict of Interests Act(the "Act'), it is her practice to thoroughly review the agenda
for each meeting of City Council for the purpose of identifying any matters in which she might have an
actual or potential conflict. If, during her review of the agenda for any given meeting of the Council, she
identifies a matter in which she has a `personal interest, "as defined in the Act, she will file the appropriate

Council Member Rosemary Wilson also DISCLOSED she has a personal interest in Dixon Hughes
Goodman and receives income from the firm as a result of her late husband's employment. The income is
proceeds from the sale of his partnership interest,paid out over an extended period of time. She is not an
employee of Dixon Hughes Goodman, does not have any role in management of the company and does is
not privy to its client list. However, due to the size of Dixon Hughes Goodman and the volume of
transactions it handles in any given year,Dixon Hughes Goodman may have an interest in matters of which
she has no personal knowledge. In that regard, she is always concerned about the appearance of
impropriety that might arise if she unknowingly participates in a matter before City Council in which Dixon
Hughes Goodman has an interest. In order to ensure her compliance with both the letter and spirit of the
State and Local Government Conflict of Interests Act(the "Act"), it is her practice to thoroughly review

Mayor Dyer read the Proclamation declaring, May 2019, "HISTORIC PRESERVATION MONTH".
Mayor Dyer called upon citizens, government agencies,public and private institutions, businesses and
schools in Virginia Beach, to recognize the importance of Historic Preservation in maintaining the
historical identity of the City and to commemorate this month with appropriate activities.
Mayor Dyer presented the Proclamation to Jimmy Wood, Vice Chair—Historic Preservation
Commission. Mr. Wood expressed his appreciation to City Council for their continued support of the
Historic Preservation Commission since 2008. Mr. Wood spoke on behalf of the Historic Preservation
Commission to express their support for the proposal to transfer City-owned historic homes to the
Department of Cultural Affairs.

Mayor Dyer invited Council Member Rouse to read and present the Proclamation.
Council Member Rouse read the Proclamation recognizing the North End Run Club for their
contributions to the City; assisted in beach cleanups, supported local charities, and small businesses,
raised funds for timely causes, supported local running events, donated clothing and food to those in need
and encouraged the community to volunteer and vote. Council Member Rouse encouraged all citizens to
familiarize themselves with this organization and their efforts.

8 WHEREAS, the City of Virginia Beach (the "City") is the owner of certain
9 properties located in the Interfacility Traffic Area (the "ITA") in the City of Virginia Beach,
10 Virginia, which properties are identified as follows (collectively, the "Properties"):

12 1. North Landing Road (2.195± acres), acquired from Robert J. Yoder and
13 Verda Fern Yoder, GPIN: 1483-98-7034

15 2. North Landing Road (2.101± acres), acquired from Gregory A. Holestin,
16 Jr. and Kristin E. Holestin, GPIN: 1493-08-0095

18 WHEREAS, on September 27, 2007, the City and the United States of
19 America, Department of the Navy (the "Navy") entered into an agreement (the
20 "Encroachment Partnering Agreement") to partner to protect property in the ITA from
21 incompatible development;
22
23 WHEREAS, the terms and provisions of the Encroachment Partnering
24 Agreement, as amended, provide that the City will sell to the Navy restrictive easements
25 (the "Restrictive Easement(s)") over property the City acquires in the ITA and the Rural
26 AICUZ Area, and in exchange the Navy,will pay to the City 100% of the fair market
27 value of the Restrictive Easements, up to 50% of the appraised fair market value of the
28 property the City acquired;
29
30 WHEREAS, the City acquired the Properties pursuant to the ITA
31 Acquisition Program, an element of the City's BRAC response program;
32
33 WHEREAS, the City funded the acquisition of the Properties through a
34 partnership with the Commonwealth of Virginia (the "Commonwealth"); and
35
36 WHEREAS, the City Council of the City of Virginia Beach finds that the
37 Restrictive Easements over the Properties are in excess of the City's needs and finds
38 that the sale of the Restrictive Easements to the Navy, pursuant to the terms of the
39 Encroachment Partnering Agreement, as amended, will allow the City and the
40 Commonwealth to recover a portion of the funds paid for the Properties.

42 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
43 OF VIRGINIA BEACH, VIRGINIA:

45 1. That Restrictive Easements over the Properties identified above are
46 hereby declared to be in excess of the needs of the City of Virginia Beach;
47
48 2. That the City Manager is hereby authorized to execute any documents
49 necessary to convey the Restrictive Easements to the Navy, in substantial conformity
50 with the terms and provisions of the Encroachment Partnering Agreement dated
51 September 27, 2007, as it has been or may be amended, and such other terms,
52 conditions or modifications as are deemed necessary and sufficient by the City Manager
53 and in a form deemed satisfactory by the City Attorney; and
54
55 3. That revenue from the sale of the Restrictive Easements over both
56 properties in the amount of $125,000 will be received; $62,500 of the amount will be
57 deposited for appropriation in future Capital Improvement Program capital budgets in
58 #9-059, Oceana and Interfacility Traffic Area Conformity and Acquisition II; and $62,500
59 will be deposited for future payment by the City Manager to refund the Commonwealth's
60 portion in accordance with the grant agreement.

SUMMARY OF TERMS
OF
ENCROACHMENT PARTNERING AGREEMENT, AS AMENDED:
Parties:
The City of Virginia Beach and The United States of America, acting through the
Department of the Navy
Term of Agreement:
The term of the agreement expires September 30, 2019, unless sooner terminated
by either party, upon 30 days' notice to the other party. The agreement may be
renewed or extended as the parties agree.
Other Terms
1. If the City purchases property from willing sellers in the ITA, then the Navy will
purchase from the City a restrictive easement over that property limiting its
use to those uses marked with a "Y" in the Table set forth in City Zoning
Ordinance Section 1804 as enacted on the date of the Multi-Year Agreement
(copy attached hereto as Exhibit A"):
a. If the property is in 65-70 and 70-75 dB DNL Noise Zones, then the
property would be limited to the allowed uses in 70-75 dB DNL Noise
Zone, as stated in the Table;
b. If the property is in >75 dB DNL, then the property would be limited to
the allowed uses in >75 dB DNL Noise Zone;
2. The Navy will pay 100% of the appraised fair market value of the restrictive
use easement or 50% of the appraised fair market value of the real property
interest acquired by the City, whichever is less. After the appraisals are
completed, the City can decide on a case-by-case basis whether to sell an
easement to the Navy.
3. The Navy may contribute any amount of funds to acquire easements pursuant
to the Encroachment Partnering Agreement, to the extent that funds are
appropriated, without requiring an amendment to the Agreement.
4. The City shall provide surveys necessary to delete all standard exceptions for
title insurance as to surveys.
5. The City and the Navy will obtain one appraisal to be used both for the City's
acquisition of the property and for the Navy's later purchase of the restrictive
easement from the City, and the Navy will share in the cost (50%) of obtaining
such appraisals.
6. The area subject to the Agreement includes both the ITA and the area south

7. The City and the Navy may obtain one survey to be used both for the City's
acquisition of the property and for the Navy's later purchase of the restrictive
easement from the City, and the Navy will share in the cost (50%) of obtaining

7 dwelling (the "Premises") located on its property at 2089 Indian River Road

10 WHEREAS, the Police Department's Mounted Patrol facility is located on
11 the Property;

13 WHEREAS, the Police Department prefers to lease the Premises to a
14 police officer;
15
16 WHEREAS, John Doe, the current tenant (the "Tenant"), is a police officer
17 and desires to continue leasing the Premises;
18
19 WHEREAS, the Police Department has requested that the name of the
20 Tenant not be publicly released for security reasons; and
21
22 WHEREAS, the Tenant desires to enter into a formal lease agreement
23 with the City in accordance with the terms and conditions set forth in the
24 Summary of Terms, attached hereto as Exhibit A, and made a part hereof.

26 THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
27 OF VIRGINIA BEACH, VIRGINIA:

29 That the City Manager, or his authorized designee, is hereby authorized to
30 execute a lease agreement between John Doe and the City of Virginia Beach for
31 the Premises located at 2089 Indian River Road, in accordance with the

33 such other terms, conditions or modifications as may be acceptable to the City

purpose.
• Tenant will perform all necessary maintenance and repairs to keep the

heating, air conditioning and electrical).
• Tenant will maintain renter's general liability insurance coverage with
policy limits of not less than $1,000,000 combined single limits per
occurrence and will name the City as additional insured.
• Tenant will comply with all applicable federal, state and local laws,
ordinances, and regulations.
• Tenant will comply with all terms and conditions set forth in the Lease.
TERMINATION:
Either party may terminate the Lease for any reason by giving thirty (30) days'
written notice to the other party.

1.0 Purpose and Need
The purpose of this policy is to provide clear guidance to the City Manager and the City Clerk in
the placement of advertisements in the newspaper for a tax or fee increase. This policy is intended
to require the affirmative approval of the City Council prior to the City Manager or the City Clerk
making a public statement that will be attributed to the City Council regarding any tax or fee
increase.
2.0 Requirement
Prior to the placement of any advertisement related to a tax or a fee increase, the City Manager or
the City Clerk shall seek and receive approval from the City Council. The approval of the City
Council shall come in the form of a motion, a resolution, or an ordinance.
The City Manager shall make arrangements to obtain the approval required in the preceding
paragraph in sufficient time to meet the statutory or charter requirements for the presentation of
the Manager's Proposed Annual Budget.
3.0 Definitions
For purposes of this policy, the term "fee increase" shall include all fees required to be advertised
in the manner set forth in§ 15.2-107 of the Code of Virginia,and the term"tax increase"shall mean
those taxes or levies required to be advertised by§ 58.1-3007 of the Code of Virginia.
4.0 Applicability
This policy shall apply to any public notice regarding a tax increase or a fee increase.
5.0 Revisions to Policy
The City Council may revise this policy at any time.

EXTENET SYSTEMS (VIRGINIA) LLC NON-EXCLUSIVE
FRANCHISE AGREEMENT
SUMMARY OF TERMS
Parties: City of Virginia Beach ("City") and
ExteNet Systems (Virginia) LLC ("ExteNet")
Term: Five (5) years. Franchise term may be extended beyond 5
years by mutual agreement of the parties and City Council
action.
Fee: No franchise fee (State law restricts telecommunications
franchise fees to Public Rights-of-Way Use Fee); applicable
permitting fees, including $1000 one-time fee for all new
poles installed in the public rights-of-way.
Installation: ExteNet is required to return public streets and rights-of-way
to at least the same or similar condition existing before such
work was performed to reasonable satisfaction of the City.
Relocation: If any of ExteNet's facilities interfere with the construction,
operation, maintenance, repair or removal of the City's public
works or public improvement projects, ExteNet will be
responsible for removal or relocation of its facilities, at its
sole expense.
Permitting: ExteNet will be responsible for obtaining all governmental
permits as necessary to install, maintain and repair its
facilities.
Insurance: Commercial General Liability (min. $2 million); Automobile
Liability (min. $1 million); Pollution Liability Insurance ($1
million). Alternatively, may have $5 million umbrella
coverage.
Surety: $25,000 letter of credit and $50,000 surety bond.
Alternatively, $75,000 surety bond.

11 WHEREAS, as authorized by Ordinance 3000B, adopted by the City Council on
12 September 25, 2007, the United States of America, Department of the Navy (the
13 "Navy") and the City entered into a Multi-Year Agreement on September 27, 2007, in
14 which the Navy and the City agreed that the City would convey to the Navy restrictive
15 easements over property the City acquires in the Interfacility Traffic Area (the "ITA"),
16 and the Navy would pay the lesser of 100% of the fair market value of the easement or
17 50% of the appraised fair market value of the property acquired by the City (the
18 "Encroachment Partnering Agreement");
19
20 WHEREAS, as authorized by Ordinance ORD-3449C, adopted on May 3, 2016,
21 the City and the Navy modified the Encroachment Partnering Agreement to extend the
22 Agreement until September 30, 2019;
23
24 WHEREAS, the City and the Navy wish to further modify the Encroachment
25 Partnering Agreement to extend the Agreement for up to an additional three (3) years
26 (through September 30, 2022);

28 WHEREAS, all of the other terms of the Encroachment Partnering Agreement, as
29 amended previously, will remain the same; and

31 WHEREAS, the City Council finds that amending the Encroachment Partnering
32 Agreement is in accordance with the City's ongoing efforts to partner with the Navy to
33 retain NAS Oceana as the East Coast Master Jet Base and is an effective means of
34 accomplishing the shared goal of preventing future encroachment around the bases.

Permit re tattoo parlor at 4604 Pembroke Lake Circle, Unit 105 (GPIN
1478511874)DISTRICT 4—BAYSIDE
The following conditions shall be required:
1. This Conditional Use Permit for a Tattoo Parlor shall be limited to only microblading, a tattooing
technique used in the application of permanent make-up. No other form of tattooing shall be
permitted.
2. A business license for the Tattoo Parlor shall not be issued to the applicant without the approval
of the Health Department for consistency with the provisions of Chapter 23 of the City Code.
3. The actual application of tattoos shall not be visible from the exterior of the establishment or from
the waiting and sales area within the establishment.
4. The proposed sign for the business shall have a black background with white letters and shall be
limited to the name of the salon and shall not identify the business as a tattoo parlor.
5. Any on-site signage for the establishment shall meet the requirements of the City Zoning Ordinance,
and there shall be no neon,electronic display or similar sign installed on the exterior of the building
or in any window, or on the doors. Building signage designed to be a "box sign"and signage for
windows shall not be permitted. A separate sign permit shall be obtained from the Planning
Department for the installation of any new signs.
This Ordinance shall be effective in accordance with Section 107(f)of the Zoning Ordinance.

Nineteen.
