Mayor Dyer welcomed Toni Alger, Stormwater Engineering Center Administrator—Public Works. Ms.
Alger expressed her appreciation to City Council for their continued support and distributed a copy of

RESOLUTION FOR INDEPENDENT INVESTIGATION
5:08 P.M.
Vice Mayor Wood opened the discussion and distributed a copy of his proposed Resolution, "Directing
the City Auditor to Engage an Independent Consultant to Conduct an Independent Review of the May 31,
2019 Tragedy", which is attached hereto and made a part of the record. Vice Mayor Wood advised he
contacted each Council Member to discuss the Resolution and emphasized the importance of City Council
adopting the Resolution as a body versus individual Council Members. Vice Mayor Wood advised the key
elements are to have the City Auditor manage the contract and research different entities that have
experience conducting this type of review. The review will include employment history, City policies,
procedures,practices,facility security,prevention of workplace violence and employee alerting. Vice
Mayor Wood advised the proposed Review would include items that would not be included in the police
report and would commence after receiving written assurance from the Police Department the proposed
Review will not impact the law enforcement investigation. Vice Mayor Wood advised it is important to
allow the Police Department to complete their investigation. Vice Mayor Wood requested to have the
proposed Resolution added to the July 2, 2019,Agenda.
Mayor Dyer advised he supports the Resolution and requested discussion from Council Members.
Council Member Abbott clarified the proposed Review is only to be managed by the City Auditor and
would be a true investigation conducted by an outside firm. Council Member Abbott requested to know
when the proposed Review would begin and once it commences, to have the City Auditor provide the
scope.
Vice Mayor Wood advised if the proposed Resolution is adopted, the City Auditor will begin researching
independent agencies and the procurement process.
Mayor Dyer advised he supports choosing the City Auditor to manage the contract noting the City
Manager's Brief last week when Mr. Remias provided embarrassing but necessary details concerning his
recent audit. Mr. Remias has been nothing but a stellar champion of transparency.
Council Member Henley asked how is it then a truly Independent Review if the City is involved as well as
what information does the public expect to learn. Council Member Henley advised politicians should not
be telling the City what should and should not be done. Council Member Henley feels it is premature to
conduct an Independent Investigation prior to the police investigation being complete.
Vice Mayor Wood agrees with Council Member Henley in that the proposed Review cannot interfere with
the police investigation. Vice Mayor Wood suggested reading reports from the Virginia Tech and
Charlottesville incidents that show the type of information to be included in the proposed Review. Vice
Mayor Wood advised the Independent Review must be managed by a City entity since the City will pay for
the review.

Mayor Dyer advised the proposed Review is meant to fill in the gaps. For instance, information on work
environment may not fall under the purview of the police investigation.
Council Member Rouse advised he supports a third party investigation as it is about the twelve(12)
families and victims who need answers, adding, if this proposed Review will help provide healing, then it
should be done. Council Member Rouse advised it is important to allow the police investigation to be
completed first and then begin the proposed Review.
Council Member Berlucchi advised this is a topic Council should collaborate on with a consensus as it is
a matter so serious to public interest- Council must work together with one voice. Council Member
Berlucchi requested to know when the police might find it appropriate to allow the proposed Review to
begin? Council Member Berlucchi feels it is most important to the victims'families and their loved ones
as well as public interest, they need to have confidence in the information and facts.
Vice Mayor Wood advised he would ask the City Manager to speak with the Police Chief to determine if a
completion date has been set.
Council Member Tower expressed his agreement to the points of keeping politicians out of the proposed
Review, the importance of providing information to the victims and their families and the importance to
the community. Beyond knowing, it is part of City Council's obligation to provide safety for City
employees from security in new buildings to safety at City events. Council Member Tower further
advised in a discussion he had with Council Member Wooten, it was believed the intent was for the City
Auditor to "manage"the proposed Review and wanted to clarify the City Auditor would not manage the
proposed Review but would, "engage an independent consultant", and only manage the requirements of
the contract.
Council Member Wooten advised she spoke with Vice Mayor Wood and Mark Stiles, City Attorney,
regarding the proposed Review. Council Member Wooten advised she does not agree with having the
City Auditor involved with the proposed Review as it is an independent investigation and no City person
should be intertwined in the process. Council Member Wooten advised she understands payment for the
independent investigation will be made by the City Auditor and the scope should be written with those
limitations. Council Member Wooten advised her focus is on the expedience of conducting the
independent investigation, stating her concerns with waiting for an unknown amount of time for written
assurance from the Police Chief Council Member Wooten advised she is proposing a separate
Resolution for an independent investigation noting the differences of expediency and with a limited scope
outlining the City Manager's involvement in the contract, which is attached hereto and made a part of the
record. Council Member Wooten advised there is only one chance of conducting the proposed
investigation and by having the City Auditor involved creates a conflict with transparency.

Council Member Rouse asked Mr. Stiles if the money for the contract must be paid by the City Auditor.
Mr. Stiles advised it can be anyone the Council designates from the organization. Some of the issues
relate to policies,practices and procedures that are undertaken by subordinates of the City Manager and
the City Auditor has no role in those and serves independently for that purpose.Mr. Stiles advised the
City Auditor works directly for City Council and is not beholden to anyone else within the City.
Vice Mayor Wood advised the differences between the two proposed Resolutions are who will direct the
independent consultant. Vice Mayor Wood advised in his proposal; the City Auditor will be directed to
engage the consultant whereas Council Member Wooten directs the City Manager to engage the
consultant. Vice Mayor Wood further advised the scope of Council Member Wooten's proposal is limited
to one person and includes the report from the FBI which is not expected to be complete for several
months.
Council Member Berlucchi advised in Vice Mayor Wood's proposal, the proposed Review will not
interfere with the current law enforcement investigation and asked Council Member Wooten how she
would address that concern.
Council Member Wooten advised she is unsure when written assurance will be provided by the Police
Department and feels it is important to expedite the independent investigation.
Council Member Abbott advised the City Auditor is the best option as he works directly for City Council
and believes the scopes in both proposals could be merged into one.
Council Member Rouse advised he believes the two proposals could be merged into one.
Council Member Tower asked Mr. Stiles if the requirements written in the proposals are the minimum
legal requirements.
Mark Stiles, City Attorney, advised he drafted both Resolutions based on the conversations with Vice
Mayor Wood and Council Member Wooten. Mr. Stiles advised his understanding in identifying a City
entity was only for that person to procure, issue and administer a contract but not actively participate.
Mr. Stiles advised Vice Mayor Wood's proposal references City Code as it relates directly with duties the
City Auditor is authorized to conduct whereas Council Member Wooten did not want to have the City
Auditor manage the contract.
Council Member Berlucchi advised he and Council Member Abbott distributed a proposed Resolution
pertaining to Funding for Mental Health on the June 18`h Agenda and encouraged feedback and support.
Council Member Abbott requested more time during each Workshop Session to discuss important issues
to allow for a possible consensus.

6 WHEREAS, the City Council desires to authorize an independent review of the
7 tragic events of May 31, 2019 (the "Tragedy") to ensure transparency and public trust in
8 the results of such review; and

10 WHEREAS, to safeguard independence and public confidence in this undertaking,
11 the Council believes the City Auditor is the appropriate City official to engage an
12 independent consultant and to oversee such an investigation;
13
14 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
15 VIRGINIA BEACH, VIRGINIA:

17 1. That the Council hereby directs the City Auditor to engage an independent
18 consultant to conduct a review of the Tragedy. The review should include creation
19 of a timeline; a review of the perpetrator's employment history and workplace
20 interactions; and a review of relevant City policies, procedures and practices,
21 including, without limitation, those related to facility security, prevention of
22 workplace violence, and employee alerting and response to active shooter
23 notifications.

25 2. That the independent review authorized herein is to commence only after the City
26 Auditor has received written assurance from the Virginia Beach Police Department
27 that such review will not interfere with the current law enforcement investigation of
28 the Tragedy.

30 3. That, pursuant to City Code § 2-468, the City Auditor and independent consultant
31 shall have unrestricted access to all employees, reports, documents, and other
32 records necessary to complete the independent review.

34 4. That, upon completion of the independent review, the independent consultant
35 engaged by the City Auditor is to submit a written report to the City Council and
36 present the findings of the review to the City Council. The written report should
37 include recommendations as to best practices that should be employed by the City.
38 The written report should segregate confidential employee information and safety
39 sensitive facility security information from the main body of the report.

41 5. The City Council authorizes any costs associated with the independent review to
42 be paid from amounts currently appropriated in the Risk Management Fund.

8 desires to authorize an independent investigation of the Tragedy in the interest of
9 transparency;

11 WHEREAS, the investigation should be conducted expeditiously and without
12 delay; and

14 WHEREAS, the investigation must be performed by an independent entity other
15 than the City Auditor to ensure that there is no conflict of interests and to provide optimal
16 transparency.

18 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
19 VIRGINIA BEACH, VIRGINIA:

23 investigation should examine everything that led to the shooting, events during the
24 shooting, and events that occurred after the Tragedy, including any report by the
25 FBI, and it should focus on DeWayne Craddock's personnel file, promotion history,
26 disciplinary records from all of his supervisors, and the culture of the work
27 environment.

29 2. That the City Council hereby authorizes the independent investigative organization
30 to access information pertinent to the investigation from all City departments.

32 3. That, upon completion of the independent investigation, the independent entity
33 shall submit a written report to the City Council and present the findings of the
