Cover issued a declaration of local emergency in response to the potential damage caused by Hurricane Dorian. The declaration authorized City agencies to take all reasonable actions necessary to protect the health and safety of Virginia Beach citizens from the damaging effects of Hurricane Dorian. • Considerations: Virginia Code § 44-146.21 requires that the City Council confirm the declaration of local emergency. The attached ordinance confirms the declaration and also ends it, effective September 8, 2019 at 12:00 p.m. • Public Information: This ordinance will be advertised in the same manner as other Council agenda items. • Attachments: Ordinance and Declaration of Local Emergency Recommended Action: Approval City Manager: v 1 AN ORDINANCE CONFIRMING THE DECLARATION OF A 2 LOCAL EMERGENCY DUE TO HURRICANE DORIAN 3 4 WHEREAS, Virginia Code § 44-146.21 authorizes the local director of 5 emergency management to declare the existence of a local emergency, subject to 6 confirmation by the governing body; and 7 8 WHEREAS, in response to the imminent threat of damage caused by Hurricane 9 Dorian, Deputy City Manager Steven R. Cover, Deputy City Manager& Director of Emergency Management f-� - 201 (Date) r.•i • �,.�+Ktn BFgc 4 : ,J o- 1 CITY OF VIRGINIA BEACH AGENDA ITEM J ITEM: Ordinance to Amend Sections 23-50 and 23-50.1 of the City Code Pertaining to Accumulations of Trash and Garbage, Excessive Growth of Weeds and Grass, and Removal of Certain Trees MEETING DATE: September 17, 2019 • Background: Sections 23-50 and 23-50.1 of the City Code authorize the City to issue notices requiring removal of trash and garbage, grass and weeds in excess of ten (10) inches in height and trees considered to be hazardous. There is an exemption for land zoned for or in active farming operations for these ordinances. The Virginia Code only requires an exemption for grass and weeds. This amendment will bring the City Code into compliance with the Virginia Code, only exempting the enforcement of grass and weeds. In addition, recent cases identified the need to add language to the code to clarify residents' responsibilities to maintain certain sections of the city right-of-way. This amendment was indefinitely deferred by City Council on November 20, 2018. • Considerations: The current ordinances exempt those parcels of land zoned for or in active farming operations from both the requirement to remove trash, garbage, etc. and the grass and weeds requirement. Parcels greater than one acre in size, located in an agriculture zone and used principally for agriculture of horticulture are exempt from the requirement to remove trees deemed hazardous. The Virginia Code exempts such property only for the grass and weeds requirement. The current code language requires residents to maintain sections of the city right-of-way to the curb line or sound wall. No language is included in the code to address this requirement on properties where no curb or sound wall are present, so that clarification has been made. • Public Information: Public information will be provided through the normal City Council agenda process. The ordinance was indefinitely deferred from the November 11, 2018 City Council meeting. The Agricultural Advisory Committee has worked to amend the Ordinance into its present form and is in agreement with the Ordinance. • Alternatives: Unless the ordinance is amended, the city will not be able to require the removal of trash, garbage or hazardous trees on those parcels of land zoned for or in active farming operations; and the city may be responsible for maintaining sections of the right-of-way where a curb or sound wall does not exist. • Recommendations: Approval of the attached ordinance. • Attachments: Ordinance Recommended Action: Approval Submitting Department/Agency: Housing and Neighborhood Preservation V City Manager:-- 1 AN ORDINANCE TO AMEND SECTIONS 23-50 2 AND 23-50.1 OF THE CITY CODE PERTAINING 3 TO OPEN STORAGE OF RUSTED, JUNKED 4 MACHINERY, EQUIPMENT, GRASS AND 5 WEEDS AND HAZARDOUS TREES ON 6 PARCELS OF LAND ZONED FOR OR IN ACTIVE 7 FARMING OPERATION 8 9 SECTION AMENDED: §§ 23-50 and 23-50.1 10 11 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VIRGINIA BEACH, 12 VIRGINIA: 13 14 That Sections 23-50 and 23-50.1 of the Code of the City of Virginia Beach, Virginia, 15 are hereby amended and reordained to read as follows: 16 17 Sec. 23-50. — Accumulations of trash, garbage, etc., or excessive growth of weeds 18 or grass. 19 20 (a) Except as provided in subsection (e) hereof, upon Upon determination by the 21 director of housing and neighborhood preservation, the code enforcement administrator, 22 or any inspector of the department of housing and neighborhood preservation, whether 23 temporarily or permanently employed as such, that there exists upon any land or 24 premises within the city, including the area between such land or premises and the nearer 25 of (i) the curb line, including a sidewalk if one is present, e-r—(ii) a sound wall, or (iii) the 26 edge of the pavement of any public street abutting such property in the absence of a curb 27 or sound wall any trash, garbage, refuse, litter or similar substances, except as may be 28 placed thereon for purposes of collection in accordance with chapter 31 of this Code, 29 notice shall be served on the owner of such land or premises or his or her agent, or on 30 the occupant thereof, or both, to cause such trash, garbage, refuse, litter or similar 31 substances to be removed from such land or premises within seven (7) days from the 32 date of such notice. For purposes of this section, "sound wall" means a wall or other noise 33 attenuation structure installed as part of a city, state, or federally funded road project. 34 35 (b) Except as provided in subsections (e) and (f) hereof, upon determination by the 36 director of housing and neighborhood preservation, the code enforcement administrator, 37 or any inspector of the department of housing and neighborhood preservation, whether 38 temporarily or permanently employed as such, that there exists on any land or premises 39 within the city, including the area between such land or premises and the nearer of(i) the 40 curb line, including a sidewalk if one is present, e-r (ii) a sound wall, or (iii) the edge of the 41 pavement of any public street abutting such property in the absence of a curb or sound 42 wall, any grass, weeds, brush or similar vegetation in excess of ten (10) inches in height, 43 notice shall be served on the owner of such land or premises or his or her agent, or on 44 the occupant thereof, or both, to cause such grass, weeds, brush or similar vegetation to 45 be cut and removed from such land or premises within seven (7) days from the date of 46 such notice. 47 I 48 . . . . 49 50 (e) The provisions of this section subsection (b) shall not apply to any parcel of land 51 zoned for or in active farming operation. 52 53 . . . . 54 55 Sec. 23-50.1. — Removal of certain trees. 56 57 (a) Upon determination by the code enforcement administrator or the city arborist, or 58 the officers or employees of their respective departments, that there exists upon any land 59 or premises within the city any tree which, by reason of disease, death, injury, infirmity or 60 other condition, presents a danger to property or to the health and safety of persons or 61 other trees or vegetation, notice shall be served upon the owner of such land or premises 62 or his or her agent or upon the occupant thereof to cause such tree to be removed within 63 a reasonable period of time, not less than seven (7) days nor more than thirty (30) days, 64 specified in such notice. If the danger presented by such tree may be eliminated by the 65 removal of a portion of such tree, the notice shall specify the portion or portions of the 66 tree to be so removed. The first ordinance relates to the City Council's real estate tax relief for elderly and disabled taxpayers program. The City Code provides qualification criteria such as income limits, asset limits and reporting time periods. One such criterion is the basis year for income qualification. Currently, income from the prior calendar year is the basis of income qualification. This prior year income rule creates hardships for a very select group of taxpayers who have significant income loss in the current year. The proposal would be to permit a taxpayer applying for elderly and disabled tax relief to seek a waiver from the prior year income rule when that applicant can show there is a material change in income that is not volitional, such as a termination from employment. The waiver would be for the current year only, and it would be prorated based on the number of months remaining in the fiscal year after the change in income. Any qualifying taxpayer would need to reapply the following year and supply all income records needed to verify the previous year's income. The second ordinance is a clarification regarding the applicability of tax exemptions authorized by the Virginia Constitution to special service districts. There are three such tax exemptions that each have particular requirements imposed by the General Assembly. The disabled veteran tax exemption program provides a total real estate tax exemption to a qualifying applicant, and that exemption applies regardless of the value of the real property. The surviving spouse of a servicemember killed in action program exempts the portion of real estate taxes that are not in excess of the average assessed value of a dwelling situated on property that is zoned as single family residential. The average assessed value for single family residential in the most recently ended tax year was $338,200, so the first dollar of tax liability is the value above $338,200. The last program provides tax relief for surviving spouses of certain first responders killed in the line of duty. Unlike the other two, the surviving spouse of certain first responders killed in the line of duty is a local option exemption, and the City Council adopted this exemption by ordinance on June 6, 2017. The tax relief amount provided to surviving spouses of line of duty is the same as that provided for surviving spouses of servicemembers killed in action. The proposed ordinance will allow for consistent treatment of special service district levies for these three programs. If the 40 application pursuant to this subsection is approved, the exemption or freeze shall be 41 prorated by multiplying the amount of the exemption or freeze by a fraction, wherein 42 the number of complete months of the year such property would be eligible for such 43 exemption or freeze is the numerator and the number twelve (12) is the 44 denominator. An extension was approved by Ordinance 3565D on August 21, 2018, which extended the date to meet the conditions to September 18, 2019. • Considerations: There were four(4) conditions to the approval of the street closure: 1. The City Attorney's Office will make the final determination regarding ownership of the underlying fee. The purchase price to be paid to the City will be set according to the "Policy Regarding Purchase of City's Interest in Streets," except that the fee will be waived contingent upon the Applicant providing the City with a comprehensive release of claims, in a form agreeable to the City Attorney, as resolution of concerns raised by the Applicant related to impacts from the Princess Anne Road/Kempsville Road Intersection Improvements Project. 2. The Applicant shall resubdivide the property and vacate internal lot lines to incorporate the portion of closed right-of-way into the adjoining parcels. The resubdivision plat must be submitted and approved for recordation prior to final street closure approval. The resubdivision plat shall show an easement area for a public boat launch and two parking spaces, as well as an easement for ingress/egress thereto. 3. The Applicant shall verify that no private utilities exist within the right-of-way proposed for closure. Preliminary comments from the utility companies indicate that there are private utilities within the right-of-way proposed for closure. If private utilities do exist, easements satisfactory to the utility company must be provided. 4. Closure of the right-of-way shall be contingent upon compliance with the above stated conditions within 365 days of approval by City Council. If the conditions noted above are not accomplished and the final plat is not approved within one year of the City Council approval, said approval shall be considered null and void. The Applicant has submitted a subdivision plat to the Planning Department for review, however, the plat will not be in final form and ready to record prior to the deadline to meet the conditions. The volunteer rescue squads own all the ambulances providing emergency medical transportation services in the City of Virginia Beach. They receive no direct tax funding for their operating costs to provide these services and do not charge patients for the medical treatment and/or transportation rendered. The primary source of revenue for the volunteer rescue squads is through their individual squad fund drives, conducted annually. Depending on the availability of funds, the City provides some support costs for the rescue squads, such as providing standard equipment for the ambulances, physical facilities and spaces to house and support equipment and personnel, paying utility bills for facilities housing a rescue squad, providing or paying for property and liability insurance for facilities used to operate the volunteer emergency medical transport, providing or paying for fuel for ambulances, zone cars and other emergency service vehicles, providing or paying for insurance covering ambulances and other emergency service and support vehicles owned by the rescue squads, providing adequate staff and budget for volunteer EMS recruitment and retention programs, providing initial and continued training and education of volunteers, and providing shift supervision. Also, the City of Virginia Beach has historically provided short term, no interest loans to the volunteer rescue squads servicing our citizens. The majority of these loans have been to provide initial capital for the acquisition of replacement ambulances. This agenda item is for a request for a loan from the Plaza Volunteer Fire Company and Rescue Squad, Inc. (PVRS). The squad requests an interest-free loan from the City for a new ambulance to replace an old one that has exhausted its useful service life. The total estimated cost of the replacement ambulance is $293,000. On July 1 , 2019, the agency was awarded the Rescue Squad Assistance Fund grant from the Virginia Office of Emergency Medical Services in the amount of $132,400 to assist with the purchase of a new ambulance. The loan will be used in conjunction with state grant funds to purchase a new ambulance. • Considerations: This agenda request includes a letter from PVRS requesting the City to provide this loan. C. If, notwithstanding the provisions of subsection E in the prior section, the RESCUE SQUAD elects not to use the services of the CITY's Division of Automotive Services for any and all maintenance and inspection services,it shall be the responsibility of the RESCUE SQUAD to maintain the vehicle(s)in accordance with the manufacturer's recommended maintenance schedule and procedures. The RESCUE SQUAD shall pay for all necessary maintenance and repairs and shall only use repair shops that are acceptable to the EMS Chief. DEFAULT AND MODIFICATION A. In the event that the RESCUE SQUAD defaults on the loan, the CITY may in its sole discretion agree to a modification of this agreement, in accordance with the modification procedure set forth in the next subsection. If the parties do not agree in writing to a modification of this agreement,then, upon default of the loan, ownership of the vehicle(s) shall revert to the CITY. Our current fleet of five ambulances is vital to the staffing of our multiple stations and providing excellent service to our citizens. The total estimated cost of the replacement ambulance is $293,000.00 including a required new stretcher. On July 1st, 2019 our agency was awarded a Rescue Squad Assistance Fund grant from the Virginia Office of Emergency Medical Services in the amount of $132,500.00 to help with this project. Our squad would like to request a loan of $160,000.00 to assist with the remainder of the ambulance and stretcher purchase. If the vehicle(s) be sold, after satisfying all conditions of the loan, including repayment, the CITY-owned equipment shall be removed and returned to the CITY prior to the sale of the vehicle(s), 1 unless prior arrangements have been made to reimburse the CITY for the fair market value of the CITY- owned equipment. C. If, notwithstanding the provisions of subsection E in the prior section, the RESCUE SQUAD elects not to use the services of the CITY's Division of Automotive Services for any and all maintenance and inspection services,it shall be the responsibility of the RESCUE SQUAD to maintain the vehicle(s)in accordance with the manufacturer's recommended maintenance schedule and procedures. The RESCUE SQUAD shall pay for all necessary maintenance and repairs and shall only use repair shops that are acceptable to the EMS Chief. DEFAULT AND MODIFICATION A. In the event that the RESCUE SQUAD defaults on the loan, the CITY may in its sole discretion agree to a modification of this agreement, in accordance with the modification procedure set forth in the next subsection. If the parties do not agree in writing to a modification of this agreement,then, upon default of the loan, ownership of the vehicle(s) shall revert to the CITY. The CITY shall provide a rebate to the RESCUE SQUAD based on the net difference between the fair market value of the vehicles and the unpaid portion of the loan. If the CITY and the RESCUE SQUAD are unable to agree upon the fair market value of the vehicle(s),the parties shall select a third party who is acceptable to both the CITY and the RESCUE SQUAD to determine the fair market value of the vehicle(s). B. This agreement may be reviewed at any time upon the direction of the City Manager. Each party must agree in writing to any subsequent modifications. The Supreme Court of Virginia, Office of the Executive Secretary (OES) is responsible for distribution of state funds to local governments for operations of Drug Treatment Courts. This grant is the result of a sustainability strategy designed to provide long-term funding for Virginia Drug Treatment Court Dockets. On August 14, 2019, the Virginia Beach Adult Drug Treatment Court (VBADTC) program received notification from OES that a grant award in the amount of $25,000 in state funds was approved for Fiscal Year 2020. Administration of this grant will be through the Virginia Beach Commonwealth Attorney's Office. This charitable fund-raising event donates a portion of the private sector proceeds to three local charities.
