Mayor Dyer called for a short break for Council Members to move to City Council Chamber for the remaining City Manager's Briefings. September 24, 2019 29 CITY MANAGER'S BRIEFINGS INDEPENDENT INVESTIGATION STATUS UPDATE 6:02 P.M. Mayor Dyer re-called to order the remaining City Manager's Briefings in City Council Chamber. Mayor Dyer advised it has been less than four months since the tragic events of May 31'and while the criminal investigation and the independent review are still in progress, it is important to share factual information received to limit speculation and correct false information. Mayor Dyer advised the work being conducted is parallel but distinctly different, and will not be impacted by the following briefings. Mayor Dyer advised tonight's briefing is a testament to the professional and personal commitment and dedication of the Police Department's detectives. Mayor Dyer welcomed Lyndon Remias, City Auditor and Arnette F. Heintze, CEO—Hillard Heintze. Mr. Remias expressed his appreciation to City Council for their continued support. Mr.Remias advised Hillard Heintze is continuing to do an outstanding job in engaging the family members and has contracted a third party who distributed a survey to all City employees today. The information in the survey is anonymous and cannot be requested through FOIA. Mr. Remias turned the brief over to Mr. Heintze. Mr.Heintze expressed his appreciation to City Council for their continued support. Mr.Heintze confirmed the criminal investigation and the independent review have parallels but in no way interfere with each other and expressed his appreciation to Mayor Dyer for making that statement. Mr. Heintze provided an update on their work which is attached hereto and made a part of the record. Mr.Heintze advised they have continued to process information received. Through the investigative process there have been a high number of concerns communicated regarding the possible existence of a "hostile" work environment. There were allegations made concerning African American employees being treated differently, subject to more disciplinary actions than their counter parts, less likely to be promoted than their counter parts, could not share their concerns with management without retaliation and overall felt management created a challenging and difficult work environment. Mr. Heintze advised the allegations are outside the scope of the contract but were taken seriously as they could have an impact on City government and are behaviors that give rise to a hostile work environment. Mr. Heintze advised he contacted the City Auditor requesting to conduct an independent survey for all City employees to determine the extent of the mentioned concerns. The survey has been distributed and will be available until October 13`h Mr. Heintze advised the next steps include scheduling an additional forty-three interviews with Building 2 employees as well as sending out a separate and anonymous survey specifically to Building 2 employees to allow them to provide any concerns and schedule an interview if they choose. That survey is due to be sent out on Monday, September 30`h. Mr. Heintze advised the report is expected to be finalized in the coming weeks but there are four factors that are impacting the October 1.5 h due date. The four factors include: the overall level of public engagement; a requirement to view all police reports within their department which is a best practice; the independent employee surveys; and the volume of electronic data being analyzed. These factors have delayed the report by three weeks to November 12`h. Mr. Heintze advised he is coordinating with the City Auditor and Police Chief to meet with the families prior to releasing the report. Following that meeting, a date will be scheduled to present the report to City Council and the public. Mayor Dyer expressed his appreciation to Mr. Remias and Mr. Heintze for the brief September 24, 2019 HILLARD tr HEINTZE' City err Virginia Beach Hillard Heintze Bi-Monthly Project Report September 13, 2019 PROJECT STATUS INF Summary of Since the submission of the report on August 30, 2019, Hillard Heintze has: 1 Continued to process inquiries made through our direct access lines including approximately 132 emails to our public-facing email address - virginiabeach@hillardheintze.com - and approximately 65 calls to our toll-free phone number,(877)208- 5650. 2 Sustained a weekly presence in Virginia Beach from July 22 through September 13, 2019 during which time the team conducted interviews, collected observations and reviewed evidence. 3 Initiated the timeline development of the police-response data,911 calls, and Virginia Beach Police Department(VBPD)and emergency medical services(EMS)radio dispatch recordings during the incident. 4 Continued assessing and reviewing all data received, including 335,000 emails(115.75 gigabytes)and 6,500 documents(2.62 gigabytes) in response to our initial data request on July 22. 5 Continued to index all emails in a standard format to properly and thoroughly search for key words, dates and so on in all emails relevant to the May 31 incident. We are also extracting metadata from those emails to ensure the validity of the messages' content. The investigative task of indexing and keyword-searching extends to all documents retrieved from the computer hard drives as well. 6 Conducted over 110 interviews with stakeholders, 51 of those with Building 2 employees and the rest with other City employees, including representatives from Human Resources, the VBPD,the City Auditor's office, the Magistrate's Office the Virginia Beach Fire Department, EMS,and the Office of Emergency Management(OEM)and Facilities. We are currently awaiting replies 17 additional employees for interview requests, and additional requests continue to be sent out daily. 7 Conducted eight victims'family interviews(one family denied our request and three remain pending contact)and reached out multiple times through City and the Catholic Charity liaisons in order to schedule interviews with the remaining families to ensure their voices are heard. We have met with a range of family members. 8 Continued to review social media and public records for information relating to the shooter and possible motives. 9 Engaged the contractor to conduct the anonymous survey for City of Virginia Beach employees to be disseminated on September 9, 2019 to gauge overall perceptions of workplace safety. 10 Developed the survey to ensure every City of Virginia Beach employee has an opportunity to engage in the process and share their perspective, if they elect to do so. 11 Completed the report outline and continued to work on various sections of the report as information is developed and assessed. 312-869-8500 30 South Wacker Drive,Suite 1400,Chicago, Illinois 60606 www.hillardheintze.com 111°12P Page2of2 ® Wilk • Ongoing communication and coordination with employees, the victims'families and schedule interviews, either in-person or by phone. This has consumed more time than originally anticipated. • Managing the document evidence to ensure consistent and appropriate review of all factual evidence. • Accessing evidence to support timely remote review and identification of where specific evidence is located, including journals and records maintained by managers.
