Dyer Mayor Cc: City Manager City Attorney City Clerk Deputy City Managers FOIA Officer Communications Office CITY OF VIRGINIA BEACH AGENDA ITEM ITEM: AN ORDINANCE TO AMEND SECTION 111 OF THE CITY ZONING ORDINANCE PERTAINING TO DEFINITIONS AND ADD SECTION 209.7 PERTAINING TO STUDENT WORKER HOUSING MEETING DATE: February 11, 2020 • Background: At the City Council meeting on February 04, 2020 this item was deferred to February 11, 2020. It was unanimously decided by the City Council to hold a special session to obtain additional information on the J1 Visa Summer Work Program prior to considering the proposed amendment. It is expected that the City Council will vote on this proposed amendment at the special session on February 11, 2020. The J1 Visa Summer Work Travel program is a cultural exchange program run through the United States Department of State. In 2019, approximately 1,100 students came to Virginia Beach, a majority of which choose the oceanfront, to work, live and play in our City. These student workers provide a valuable service and have a substantial impact on the City's economy. A major factor in these students having a successful and valuable experience in Virginia Beach is finding appropriate and safe housing options. This proposed amendment expands the Zoning Ordinance definition of family to include student workers, and thus assists property owners who wish to rent their homes for the summer season and provides safe housing for the student worker. • Considerations: This proposed amendment expands the Zoning Ordinance definition of a family to include a group of not more than eight international student workers who reside in Virginia Beach on a temporary basis as part of the J1 Visa Summer Work Travel Program. This amendment regulates the dwelling units used to house students in the Summer Work Travel program to ensure that they are compliant with the State Property Maintenance Code. Additionally, the name and contact information of the property owner must be provided, as well as a floor plan of the dwelling. This amendment allows for more flexibility in housing options for student worker housing, while ensuring that the safety and conditions of the housing are acceptable and meet applicable codes. Further details pertaining to the application, as well as Staff's evaluation, are provided in the attached Staff Report. There is no known opposition to this request. A "family" is: 29 30 (a) An individual living alone in a dwelling unit; or 31 32 (b) Any of the following groups of persons, living together and sharing living areas 33 in a dwelling unit: 34 35 (1) Two (2) or more persons related by blood, marriage, adoption, or approved 36 foster care; 37 (2) A group of not more than four (4) persons (including on premise 38 employees) who need not be related by blood, marriage, adoption or 39 approved foster care; 40 (3) A group of not more than eight (8) persons with mental illness, intellectual 41 disability or developmental disabilities residing with one (1) or more resident 42 or nonresident staff persons in a facility whose licensing authority is the 43 Department of Behavioral Health and Developmental Services; provided, 44 that mental illness and developmental disability shall not include current 45 illegal use of or addiction to a controlled substance as defined in section 46 54.1-3401 of the Code of Virginia; 1 47 (4) A group of not more than eight (8) aged, infirm or disabled persons residing 48 with one (1) or more resident counselors or other staff persons in a 49 residential facility or assisted living facility for which the Virginia Department 50 of Social Services is the licensing authority; or 51 (5) A group of not more than two (2) adults, who need not be related by blood 52 or marriage, and the dependent children of each of the two (2) adults, 53 provided that the children are under nineteen (19) years of age or are 54 physically or developmentally disabled. 55 (6) A group of not more than eight (8) student workers as defined by this 56 ordinance living in accordance with the provisions of Article 2, Section 57 209.7 — Dwelling unit — Student Worker Housing. 58 59 . . . . 60 61 Student Worker. A person visiting the United States as part of the J1 Visa Student 62 Work Travel program and meeting all employment requirements as set forth for 63 participation in the program by the United States Department of State. 64 65 . . . . 66 67 ARTICLE 2. - GENERAL REQUIREMENTS AND PROCEDURES APPLICABLE TO 68 ALL DISTRICTS 69 70 A. - REGULATIONS RELATING TO LOTS, YARDS, HEIGHTS, OFF-STREET 71 PARKING, OFF-STREET LOADING, AND CERTAIN USES 72 73 Sec. 209.7 — Dwelling unit— Student Worker Housing 74 75 (a) No dwelling unit shall have more than eight (8) student workers living in a 76 residence; 77 (b) Each dwelling unit shall only house student workers in accordance with the 78 room size, number and housing requirements of the VAUSBC Property 79 Maintenance Code; and 80 Each dwelling housing student workers shall provide to the zoning division of 81 Planning the following information: 82 83 (1) Name and contact information, including emergency phone number, of the 84 property owner; and 85 (2) Floor plan labeling rooms with dimensions and the total number of student 86 worker occupancy in compliance with the VAUSBC Property Maintenance 87 Code. 2 Adopted by the Council of the City of Virginia Beach, Virginia, on the day of , 2020.
