Mayor Dyer called to order the SPECIAL MEETING BY ELECTRONIC COMMUNICATION MEANS
of the VIRGINIA BEACH CITY COUNCIL on Tuesday, January 12, 2021, at 3:03 P.M Mayor Dyer
personally opened the meeting in the Virginia Beach Convention Center, Suite 5, while all other members
of City Council appeared electronically via WebEx.

and the City's Continuity of Government Ordinance adopted on September 15, 2020, and
Chapter 1289 of the 2020 Acts of Assembly as amended, and by the authority vested in me
as Mayor of the City of Virginia Beach, I hereby call for a SPECIAL MEETING BY
ELECTRONIC COMMUNICATION MEANS of the VIRGINLA BEACH CITY
COUNCIL

This SPECIAL MEETING BY ELECTRONIC COMMUNICATION MEANS will be held

• Supported six feeding partners in efforts to expand capacity and serve over 1,750
Virginia Beach households by providing:
• Supplemental food
• Pantry renovations
• Refrigeration equipment
• Refrigerated vehicles
• Purchased 105,039 pounds of fresh produce,dairy and meat for distribution
• Hosted a Holiday Drive-Thru Pantry in partnership with the City of Virginia Beach
Department of Human Services and served 750 households
• Launching a 757 Mobile Market Program in February Fbodbank

Mayor Dyer opened the floor for Council discussion.
Council Member Tower advised the proposed Ordinance to Suspend the Tax Imposed by City Code Sections
18-49 and 18-50 for Calendar Year 2021 and to Provide Offsets, was distributed via email prior to the
meeting, attached hereto and made a part of the record. Council Member Tower advised the Ordinance
will be on the next Agenda for consideration.
Council Member Moss referenced the City Manager's letter regarding the acceptance of funds through the
emergency rental assistance program, advising there needs to be a way to have a different rule applied for
the City. Council Member Moss explained the program eligibility requirements include those who have a
gross household income at or below 80% area median income (AMI) and the City's median income and
housing costs are higher than the Region's AMI, therefore disqualifying some residents from receiving
assistance. Council Member Moss advised he understands this issue will take time but requested resources
be used to find a solution.
Council Member Moss advised, on the issue of the remaining CARES ACT Relief Funding, he would like
to have a discussion on having a comprehensive prioritization plan for its use rather than applying it
towards single issues.
Council Member Moss advised the FCC recently made a ruling for rural area broadband users to allow
installation of antennas or towers for internet purposes and would like to know if the ruling will apply to
the southern part of the City.
Council Member Moss requested information concerning the new City Hall building, specifically the
installation of ultraviolet light purification in HVAC systems as well as the plan for a security system.
Council Member Wilson advised due to the pandemic;the In-House Pharmacy Committee has put its work
on hold until more time is available to focus on the work the Committee wants to accomplish. Council
Member Wilson advised she has found a pharmacist who managed thirty(30)area pharmacies who would
like to be involved and will provide valuable expertise.
Council Member Wilson advised Preston Midgett was diagnosed with COVID-19 and is currently at the
University of Virginia Hospital being evaluated for a lung transplant tomorrow. Council Member Wilson
wants the staff there to know he is a valuable person to the City and there are signs all over the City showing
support for his recovery. Council Member Wilson acknowledged Mr. Midgett's dedication to the City
through years of his volunteered service and wants him to know, we as a City, are wishing him the best.
Council Member Tower advised there is a link on the Virginia Department of Health website to register to
be notified when people are eligible to receive the COVID-19 vaccine. This provides citizens a way to know
where they fall on the prioritization list.

Mayor Dyer advised he received a telephone call requesting City Council support for Preston Midgett's
recovery from COVID-19. Mayor Dyer advised under ideal circumstances, he would have a Resolution
signed by all City Council Members in his honor however, due to the urgency of his condition as he is
awaiting a decision from a panel of doctors to determine if he should have a lung transplant, Mayor Dyer
sent a letter to the doctors on the panel. Mayor Dyer advised the value of the City is its'people and Mr.
Midgett is very much a part of the DNA of the City and on behalf of City Council, he wishes him and his
family well.
Mayor Dyer expressed his appreciation to City Council Members for the productive and meaningful
discussion.

ITEM: An Ordinance to Suspend the Tax Imposed by City Code Sections 18-49 and
18-50 for Calendar Year 2021 and to Provide Offsets
MEETING DATE: January 19, 2021
• Background: The City imposes local license taxes upon various businesses
with licenses from the Virginia Alcohol Beverage Control Authority. These local license
taxes are authorized by § 4.1-233 of the Code of Virginia. The local license is in
addition to any state approvals and fees. The vast majority of such local licenses are
paid by restaurants serving beer, wine, and mixed beverages.
• Considerations: The estimated annual revenue from local ABC licenses is
$325,000. The attached ordinance suspends these local license taxes for calendar year
2021 . This tax suspension will provide some relief to those businesses that have been
hit particularly hard by public health restrictions during the COVID-19 Pandemic.
• Public Information: Public information will be provided through the normal
Council agenda process.

17 suspended for the entirety of calendar year 2021. The Commissioner of the
18 Revenue is hereby requested to provide notice of such suspension to

20 that would be subject to such license tax.
