Mayor Dyer welcomed Patrick A. Duhaney, City Manager. City Manager Duhaney advised he wanted to provide a brief summary on the vaccination progress and read the following statement: "Mayor and Members of Council, Thank you for allowing me to update you on the vaccination clinic operations and the status of several related initiatives. Some of the questions we are getting from citizens suggests it would be helpful to start with a brief overview of how the overall effort is organized and where various responsibilities lie. The City of Virginia Beach has a support role to the State, especially the Virginia Department of Health and the local office, the Virginia Beach Department of Public Health. The state oversees the vaccine supply, the distribution to localities,staffing clinics, selecting and notifying people who have pre-registered for the vaccination waitlist. It takes more than 100 people to operate an 8-hour clinic, which exceeds the staffing capabilities of the state. We are blessed to have volunteers with EMS, the Medical Reserve Corps and CMRC and Community Emergency Response Team, or CERT, to augment the paid staff.It is an incredible operation and it simply could not be done without the support of these volunteers. However, as you can imagine, we are concerned about the ability to sustain this level of commitment over a prolonged period of time. This is one area in which we have stepped in and committed substantial City resources.As I reported to you last week, we have redeployed some City staff from their usual assignments to support the vaccination clinics at the VBCC. While we are working to minimize the service disruptions these temporary reassignments might cause, it is possible there may be delays or intermittent closures so we can continue to operate the clinics. This is especially true as the weeks progress. To date: • As of this morning, 60,232 people have pre-registered in the portal we stood up a week ago. • About 40%of those are seniors over the age of 65 • 16,500 first doses and 289 second doses have been provided to people eligible in the IA and IB groups through 11 Virginia Beach points of distribution, or PODs • There are 3 PODs this week with 2000 first doses each, so we will have vaccinated about 22,500 people by the end of the day Thursday o VBDPH has started pulling names of people from the portal February 2, 2021 4 CITY MANAGER'S BRIEFINGS VACCINATION UPDATE ITEM#71235 (Continued) o They are focusing predominantly on the top tier of the 1 B group, which is seniors—50%of the vaccines are going to people who are over 65 and half is being administered to the 1 B essential workers like medical staff, teachers,firefighters,police officers and childcare workers. o Candidates receive an email with their assigned date. They still have the ability to pick an appointment time. The Health Department is selecting names based on the order they signed up and the category they meet. • Keep in mind these numbers do not reflect vaccines being administered by Sentara or pharmacies • The Health Department reports Virginia Beach can expect to receive 5,225 doses for the next few weeks. • This amount is based upon our population size and not all of it will come to the Convention Center clinic. The Health Department has to address all participating partners, such as hospitals,pharmacies, and providers. • We know the pace is not where any of us want it to be. The Health Department has made a point of stressing that all of the vaccine received locally has been administered, but as you know, the supply continues to be a problem, not just here but around the country • We have been made aware of the possibility that the state may create some megasites to provide vaccinations. We don't have many details about it yet but one of the possibilities would be to augment the operations at the VBCC to increase the total number of potential vaccinations from around 3000 a day to 4800. I will let you know if those discussions progress and its possible impacts to the City • I know we would all like to see additional sites activated so people have more choices for where they can get the vaccine, but the supply shortage is hindering those efforts • One of the issues we have heard about involves the state's recent transition to a new scheduling system called PrepMod.According to the Health Department, the new software offers a more user-friendly interface and controls for scheduling, but there have been logistical issues they are working through. • People have questioned the URL because it doesn't reflect the state or the Health Department and the link for rescheduling appointments was not working. No new individuals will be added to VAMS—only second dose appts will be managed through the old system. February 2, 2021 5 CITY MANAGER'S BRIEFINGS VACCINATION UPDATE ITEM#71235 (Continued) COVID-19 Vulnerable Populations Outreach Vaccination Pilot Program: We have shared with the Health Department the concerns you and others have raised about addressing health equity concerns, including but not limited to: language barriers, digital access barriers, transportation to /from POD sites, the need for more POD sites and mobility issues on site at POD locations. To meet the vaccination needs of the most vulnerable populations impacted by COVID-19 (people older than 65 and those who are 16-64 years old who have underlining health conditions), City staff is assisting the Public Health Department with the following plans: • Establishing a program to operate vaccination clinics in small venues located in or near areas that can target vulnerable populations like: o Lake Edward o Great Neck/Virginia Beach Blvd o SeaTac o Kempsville/College Park o Green Run o Creeds • This may involve partnerships with the faith-based community and other community organizations to aid outreach and perhaps host a vaccination clinic • It would be scheduled on days other than those when the Convention Center POD is operating • Staff is exploring how to use existing transportation services to help provide rides to people who need them We know the City organization has no control over many of the variables that are hampering best efforts to vaccinate as many people as possible as fast as possible. We do not manufacture the vaccine and we have no role in the distribution. While we have been strong and vocal advocates for increasing access to the supply, ours is just one more voice in that chorus because it is a problem everyone is dealing with. We will remain focused on working collaboratively with the state and the Virginia Beach Department of Public Health to meet the needs of our citizens in the most effective way possible. February 2, 2021 17 CITY COUNCIL DISCUSSION HB2043 (ESTABLISHMENT OF THE VIRGINIA BEACH TOURISM AUTHORITY)— FOLLOW-UP ITEM#71238 5:05 P.M. Mayor Dyer opened the discussion on House Bill 2403 regarding establishment of the Virginia Beach Tourism Authority. Council Member Moss requested the City Manager look into how to leverage the City's current authority and create an internal structure to respond to the leadership and agility issues that have been highlighted with the existing Convention and Visitors Bureau. Council Member Moss called for continued discussions on a tourism authority so that if the City eventually gets permission, there would be further understanding on the desired structure and compensation packages. Council Member Moss noted his bias to utilize an in- house performance system, as there would be greater flexibility. Council Member Moss advised City Council does not need to wait on the creation of an authority to start addressing some of the report findings concerning the Convention and Visitors Bureau. Council Member Rouse referred to separate pieces of legislation, HB 2198 and 1890. Council Member Rouse advised there should have been a scheduled discussion on the Bills, before the Mayor and Vice Mayor sent a letter to the General Assembly Delegation and took a position without a City Council discussion. Council Member Rouse highlighted February as Black History Month and its relation to the Voting Rights Act of 1965, which outlawed discriminatory voting practices. Council Member Rouse noted how troubled he was by the position taken in the letter by the Mayor, Vice Mayor, and silent majority of City Council Members to oppose Bills centered around voting systems and voting rights. Council Member Rouse emphasized City Council did not have an open discussion to determine a majority's position on the legislation, and there is a lack of transparency. Council Member Rouse recalled that in August 2020 City Council denied holding a referendum to gain citizen input on the voting system,yet the lack of citizen input was the Mayor and Vice Mayor's reasoning for opposing the House Bills. Mayor Dyer advised the House Bills were introduced by a member of the General Assembly Delegation seeking to change the City's voting system with no communication and no input from City Council or the citizens. Due to the sudden introduction of the House Bills, immediate action by the City was required Mayor Dyer stressed the need for better communication with the Delegation. Referencing the failed Referendum, Mayor Dyer advised it was not enough time to provide citizens with education and COVID- 19 posed additional challenges. Mayor Dyer stated that there will be continued discussions at the Retreat about holding public meetings to receive input on the voting system. Council Member Rouse advised he takes issue with the Mayor and Vice Mayor declaring City Council's position on any legislation without first having a dialogue with City Council. Council Member Rouse requested a discussion at the Retreat to determine a policy on how City Council will take positions on legislation and voice that position. Council Member Tower referenced the tourism authority and expressed his agreement with Council Member Moss that there needs to be a focus on current City resources and how they can be used to attract tourism. February 2, 2021 18 CITY COUNCIL DISCUSSION HB2043 (ESTABLISHMENT OF THE VIRGINIA BEACH TOURISMAUTHORITI9— FOLLOW-UP ITEM#71238 (Continued) Council Member Tower advised he does not want the failure to proceed with a tourism authority to slow down dealing with issues in the Convention and Visitors Bureau. Council Member Tower requested the guidance of the City Manager on how to deal with the issues and keep the Convention and Visitors Bureau vibrant and successful ahead of the tourism season. Council Member Wooten advised HB 2043 needed to be withdrawn as not enough information was given in order for the Delegation to properly champion the Bill in the legislature.Referencing HB 2198 and 1890, Council Member Wooten advised they were not sprung on the City, as there is a lengthy process and the City's Legislative Liaison should have been made aware. Council Member Wooten observed there was a reactive approach to all three (3) House Bills, and City Council needs to establish better protocol for addressing legislation. Council Member Wooten called for better communication to ensure any correspondence sent on behalf of City Council is representative of all Members. Council Member Wooten stated that due to the failure to bring forth a referendum and give the citizens the opportunity to provide input on the voting structure, there's a pending lawsuit in addition to the legislation. Council Member Wooten called for better leadership, communication and transparency. Council Member Moss advised he does not oppose the content of the Bills, rather that there was no provision that the voting system should still be adopted by the locality's voters. Council Member Moss highlighted that the majority of City Council decided not to give voters the opportunity to decide their election system by referendum, and now the State is going to prescribe a solution. Council Member Moss supported establishing a process for determining City Council policy positions during the Retreat. Council Member Rouse called attention to minorities seeking equal and fair representation and noted voting systems are critical to that. Council Member Rouse advised of his shared frustrations that the sponsor of the Bills did not seek City Council's input but noted that the Bills are not specific to Virginia Beach. Council Member Rouse asked for a transparent policy to encompass all voices on City Council. GPIN: 2433-16-9348 (CITY-OWNED PROPERTY KNOWN AS PIKE INLET) GPIN 2433-16-8461 (321 TEAL CRESCENT) NOW, THEREFORE, for and in consideration of the premises and of the benefits accruing or to accrue to the Grantee and for the further consideration of One Dollar ($1.00), cash in hand paid to the City, receipt and sufficiency of which is hereby acknowledged, the City hereby grants to the Grantee permission to use the Encroachment Area for the purpose of constructing and maintaining the Temporary Encroachment. It is expressly understood and agreed that the Temporary Encroachment will be constructed and maintained in accordance with the laws of the Commonwealth of Virginia and the City of Virginia Beach, and in accordance with the City's specifications and approval and is more particularly described as follows, to wit: A Temporary Encroachment into the Encroachment Area as shown on that certain map entitled: "EXHIBIT A ENCROACHMENT REQUEST FOR PROP. WHARF SEAN M. MILLER LOT 67, SECTION 1-B SANDBRIDGE SHORES NORTH (M.B. 103, PG. 24) DATE: NOVEMBER 9, 2020," a copy of which is attached hereto as Exhibit A and to which reference is made for a more particular description. Providing however, nothing herein shall prohibit the City from immediately removing, or ordering the Grantee to remove, all or any part of the Temporary Encroachment from the Encroachment Area in the event of an emergency or public necessity, and Grantee shall bear all costs and expenses of such removal. It is further expressly understood and agreed that the Temporary Encroachment herein authorized terminates upon notice by the City to the Grantee, and that within thirty (30) days after the notice is given, the Temporary Encroachment must be removed from the Encroachment Area by the Grantee; and that the Grantee will bear all costs and expenses of such removal. It is further expressly understood and agreed that the Grantee shall indemnify, hold harmless, and defend the City, its agents and employees, from and against all claims, damages, losses and expenses, including reasonable attorney's fees, in case it shall be necessary to file or defend an action arising out of the construction, location or existence of the Temporary Encroachment. It is further expressly understood and agreed that nothing herein contained shall be construed to enlarge the permission and authority to permit the maintenance or construction of any encroachment other than that specified herein and to the limited extent specified herein, nor to permit the maintenance and construction of any encroachment by anyone other than the Grantee. It is further expressly understood and agreed that the Grantee agrees to maintain the Temporary Encroachment so as not to become unsightly or a hazard. It is further expressly understood that any existing encroachments referenced in the Exhibit or this Agreement are the ongoing maintenance obligation of the Grantee and the City disclaims any ownership interest of maintenance obligation of such encroachments. It is further expressly understood and agreed that the Grantee must obtain and keep in effect liability insurance with the City as a named insured in an amount not less than $500,000.00 per person injured and property damage per incident, combined, with the City listed as an additional insured. The company providing the insurance must be registered and licensed to provide insurance in the Commonwealth of Virginia. The Grantee will provide endorsements providing at least thirty (30) days written notice to the City prior to the cancellation or termination of, or material change to, any of the insurance policies. The Grantee assumes all responsibilities and liabilities, vested or contingent, 3 with relation to the construction, location, and/or existence of the Temporary Encroachment. It is further expressly understood and agreed that the Temporary Encroachment must conform to the minimum setback requirements, as established by the City. It is further expressly understood and agreed that the City, upon revocation of such authority and permission so granted, may remove the Temporary Encroachment and charge the cost thereof to the Grantee, and collect the cost in any manner provided by law for the collection of local or state taxes; may require the Grantee to remove the Temporary Encroachment; and pending such removal, the City may charge the Grantee for the use of the Encroachment Area, the equivalent of what would be the real property tax upon the land so occupied if it were owned by the Grantee; and if such removal shall not be made within the time ordered hereinabove by this Agreement, the City may impose a penalty in the sum of One Hundred Dollars ($100.00) per day for each and every day that the Temporary Encroachment is allowed to continue thereafter, and may collect such compensation and penalties in any manner provided by law for the collection of local or state taxes. It is further expressly understood and agreed that the Grantee agrees to maintain the Temporary Encroachment so as not to become unsightly or a hazard. It is further expressly understood and agreed that the Grantee must obtain and keep in effect liability insurance with the City as a named insured in an amount not 3 less than $500,000.00 per person injured and property damage per incident, combined, with the City listed as an additional insured. The company providing the insurance must be registered and licensed to provide insurance in the Commonwealth of Virginia. The Grantee will provide endorsements providing at least thirty (30) days written notice to the City prior to the cancellation or termination of, or material change to, any of the insurance policies. The Grantee assumes all responsibilities and liabilities, vested or contingent, with relation to the construction, location, and/or existence of the Temporary Encroachment. It is further expressly understood and agreed that the Temporary Encroachment must conform to the minimum setback requirements, as established by the City. It is further expressly understood and agreed that the City, upon revocation of such authority and permission so granted, may remove the Temporary Encroachment and charge the cost thereof to the Grantee, and collect the cost in any manner provided by law for the collection of local or state taxes; may require the Grantee to remove the Temporary Encroachment; and pending such removal, the City may charge the Grantee for the use of the Encroachment Area, the equivalent of what would be the real property tax upon the land so occupied if it were owned by the Grantee; and if such removal shall not be made within the time ordered hereinabove by this Agreement, the City may impose a penalty in the sum of One Hundred Dollars ($100.00) per day for each and every day that the Temporary Encroachment is allowed to continue thereafter, and may collect such compensation and penalties in any manner provided by law for the collection of local or state taxes. 4 IN WITNESS WHEREOF, Paul V. Council Member Henley advised she takes exception to Council Member Rouse's previous comments believing there is a misunderstanding and is hopeful there will be an opportunity for City Council to have a discussion to understand the different perspectives. Council Member Henley advised City Council has a lengthy public hearing process for any item the City will present within the Legislative Package for the General Assembly to consider, adding the State apparently has a different process. Council Member Henley expressed frustration that she was not aware House Bill's (HB) 2198 and 1890 were being considered, much less introduced, and caused the lack of transparency, blindsiding both citizens and City Council. Council Member Henley advised when she received an email informing her HB 2198 and 1890 were being introduced and going to a Sub-Committee, she responded with opposition to both proposed Bills. Council Member Henley advised there was no time to hold a City Council Meeting or a Public Hearing, and feels the letter sent by Mayor Dyer and Vice Mayor Wood expressed only their opinions and not of the Body. Council Member Henley advised, last summer, City Council was considering the District Voting Referendum but due to the pending federal case against the City, discussions were, and still are, limited. Council Member Henley advised it was not possible to engage citizens for input as the case was going to court just before the election, as well as the complications with holding public hearings during the pandemic. Council Member Henley advised she does not appreciate anyone attributing motives to her and believes any changes to local government needs to be done very carefully as the proposed House Bills will cause the City's Charter to change, adding this is no way to make changes to the City's Charter. Council Member Henley advised that presenting this issue as a racial issue, is very narrow, nor is it the entire issue, and does a disservice to citizens. Vice Mayor Wood advised he agrees with virtually everything Council Member Henley stated, and suggested people go back to the discussions during consideration of the referendum and read the comments as it would be educational. Vice Mayor Wood advised he reviewed three (3) previous City Council discussions and at no time were HB 2198 or HB 1890 mentioned Vice Mayor Wood advised of the two HB's, one is centric to the City and the other is not. The Bill sponsored by Delegate Fowler is centric to the City and she testified against the City in Court which is public information. Vice Mayor Wood advised City Council can always do better in how City Council reacts to issues like this however, these Bills were not on City Council's radar until days before the Sub-Committee hearing. Vice Mayor Wood advised the Virginia Municipal League (VML) has taken a position against these Bills, showing this issue is not just about the City, but includes a majority of Virginia's elected Body. Vice Mayor Wood advised he respects comments from Council Member Rouse and Wooten and suggested improvements could be made by inviting the City's Delegation to City Council Meetings three(3) or four(4) times a year to be aware of what issues they are discussing. Council Member Tower advised he has experience as a registered lobbyist, previously representing a diverse nonprofit membership with varying views. Council Member Tower advised that with his personal experience, he is shocked at the level of representation that City Council has in keeping the Body advised February 2, 2021 39 OLD BUSINESS ITEM#71256 (Continued) of issues with the General Assembly. Council Member Tower advised he believes this is a big issue that needed discussion. Council Member Tower advised it is clear this Body cannot depend on the good will of the General Assembly to look after the City's interests and emphasized the importance of the City having the very best representation, who understands the needs of the City, in Richmond Council Member Tower advised having that representation is the responsibility of the City Manager, with the Body's assistance. Council Member Rouse advised these Bills deserve scrutiny and expressed concern that leaders of this Body spoke on behalf of him without having a proper discussion. Council Member Rouse responded to Council Member Henley's comment concerning race, advising this issue around voting rights is not a racial issue but an American issue with a racial history. Council Member Rouse advised this is the second day in Black History Month, and in relation to the discussion on not having enough time for public input, feels that Dr. Martin Luther King Jr.'s quote, "It is always the right time to do the right thing"is relevant. Council Member Berlucchi advised he appreciates and respects his colleagues and their comments and believes improvements can be made to these important processes going forward Council Member Berlucchi advised a matter of this importance, should have been discussed with City Council, or at a minimum the legislator should have consulted with the Mayor and Vice Mayor, which did not happen. Council Member Berlucchi advised is it is important to recognize the flaws that existed within the General Assembly in this process, the citizens are entitled to collaboration between their elected representatives, especially on a matter as important as this. Council Member Berlucchi advised while it is true the State follows Dillion Rules and can impose its will on a municipality, it does not mean they should Council Member Wooten advised she wanted to address the comments concerning the way Delegate Fowler introduced the Bill she proposed, advising in 2018 when she was appointed to City Council, she remembers Delegate Fowler reaching out to City Council for feedback on other Bills being proposed to the General Assembly. Council Member Wooten advised during that time she learned through discussions with other Council Members there would not be a lot of support for Delegate Fowler, suggesting that may have been the reason she did not reach out to City Council at this time. Council Member Wooten advised, while this Body reflects on what happened with this issue, they should also reflect on being non partisan and should be open to listening to everybody when issues are brought to them. Mayor Dyer expressed his appreciation to Council Members for their comments and advised there will be further discussions on making improvements to the relationship with the City's delegation and processes and in the future.
