The DI economic impact model is used to measure the economic impact that extends beyond the event itself. The model inherently includes many estimates which are used to project spending by both the event attendees and organizers. Sales are tracked by industry and include categories such as Finding 1. lodging, transportation, and retail. For purposes of this section 3.2 only, the definition of Operating Revenue shall exclude: (1) rental net reimbursed expenses; and (2) interest and miscellaneous operating income; plus (ii) Seventy-five cents ($0. 75) per paid attendee (based on ticket sales) in excess of 42,500 in paid attendance (based on paid ticket sales) per Operating Year': • Upon reperforming the calculations, we found that the Incentive Fee for Fiscal Year 2022 was over by $3,973.50, which means that the City was overcharged by this amount. Manager stated that accidental deletion of the formula in the Excel spreadsheet was the cause of this error. We found no other errors when we reperformed the calculations for the other fiscal years. Management should: 1.0 Implement an internal control to verify all fees charged to the City are Recommendations: accurate. 1.1 Manager should credit the City for the overpayment. Note: The credit for overpayment was applied to the FY2023 incentive fee calculation. For so long as Manager is an Affiliate of Corncast Corporation, Manager shall secure from Comcast Corporation or one of its Affiliates (including Comcast Spotlight) an additional ten thousand dollars ($10,000) of value each Operating Year in advertising and promotional spots to drive tourism from the Richmond market to Virginia Beach." • In our discussion with management, we learned that Manager misunderstood this requirement and has not been compliant with the first portion of Section 2.5 since the termination of its affiliation with Comcast Corporation in November 2020. Because of this, no funding was spent to create promotional packages that advertised Facility events and Virginia Beach. Vice Mayor Wilson advised she has received questions concerning trash and yard waste pick-up services and understands the delays are due to staff shortages but asked City Manager Duhaney if there are any updates that can be shared with the public. City Manager Duhaney advised the department has increased working four(4)days a week to six(6), are prioritizing the black cans for pick-up and,for now, citizens can put yard waste in their black cans. City Manager Duhaney advised since July 1 S`other cities in the area have recently changed waste management employee compensation and his staff is reviewing the City's compensation to ensure the City remains competitive. City Manager Duhaney further advised there are several employees on limited duty and unable to work. Public Works Director Hansen advised the staffing challenges he briefed the Body on last week have not had any significant changes. Mr. Hansen advised he is currently working with Human Resources to improve the recruitment process that already includes sign on bonuses for waste management as well as a separate sign on bonus for those who have valid commercial driver's licenses. Council Member Henley asked Mr.Hansen to address how the current staff is working to provide services. Mr. Hansen advised that as of today, they are caught up on the black cans but are behind on picking up yard waste. Mr. Hansen advised that in addition to his operations manager and supervisors, staff from Parks and Recreation are also assisting. Council Member Taylor expressed his appreciation to Mr. Hansen and his staff as well as the Communications Department for getting the message out to the public. Council Member Taylor asked if using vacancy savings to bring in outside vendors is an option. Mr. Hansen advised temporary employees are used to assist in picking up trash but not as drivers. Mr. Hansen advised it takes time to ensure the drivers have enough driving experience that they can safely navigate down narrow neighborhood roadways. Mr. Hansen added, the problem is not with compensation but rather recruitment and retention. Council Member Wooten advised Referendums have been issued in the past to build recreation centers such as Lynnhaven, Bayside and Princess Anne as well as for the renovation of Bow Creek. Council Member Wooten advised the Referendum can also include the extension of the VB Trail and modernization of the other recreation centers. Council Member Wooten advised she has researched this and there is time to have the Referendum on the November ballot. Council Member Wooten advised staff was requested to provide a suggested location in District 7 for a recreation center and was informed the Charlestown Park off of Centerville could be a possible location. Council Member Wooten advised in order for it to be considered on the November ballot, it must be in by August 18th. Council Member Wooten advised the other option is for citizens to petition to the Circuit Court to have the question placed on the ballot. Providing however, nothing herein shall prohibit the City from immediately removing, or ordering the Grantee to remove, all or any part of the Temporary Encroachment from the Encroachment Area in the event of an emergency or public necessity, and Grantee shall bear all costs and expenses of such removal. It is further expressly understood and agreed that the Temporary Encroachment herein authorized terminates upon notice by the City to the Grantee, and that within thirty (30) days after the notice is given, the Temporary Encroachment must be removed from the Encroachment Area by the Grantee; and that the Grantee will bear all costs and expenses of such removal. It is further expressly understood and agreed that the Grantee shall indemnify, hold harmless, and defend the City, its agents and employees, from and against all claims, damages, losses and expenses, including reasonable attorney's fees, in case it shall be necessary to file or defend an action arising out of the construction, location or existence of the Temporary Encroachment. It is further expressly understood and agreed that nothing herein contained, shall be construed to enlarge the permission and authority to permit the maintenance or construction of any encroachment other than that specified herein and to the limited extent specified herein, nor to permit the maintenance and construction of any encroachment by anyone other than the Grantee. It is further expressly understood and agreed that the Grantee agrees to maintain the Temporary Encroachment so as not to become unsightly or a hazard. 3 It is further expressly understood that any existing encroachments referenced in the attached Exhibit or in this Agreement are the ongoing maintenance obligation of the Grantee and the City disclaims any ownership interest or maintenance obligation of such encroachments. It is further expressly understood and agreed that the Grantee must obtain and keep in effect liability insurance with the City as a named insured in an amount not less than $500,000.00, per person injured and property damage per incident, combined. The company providing the insurance must be registered and licensed to provide insurance in the Commonwealth of Virginia. The Grantee will provide endorsements providing at least thirty (30) days written notice to the City prior to the cancellation or termination of, or material change to, any of the insurance policies. The Grantee assumes all responsibilities and liabilities, vested or contingent, with relation to the construction, location, and/or existence of the Temporary Encroachment. It is further expressly understood and agreed that the Temporary Encroachment must conform to the minimum setback requirements, as established by the City. It is further expressly understood and agreed that the City, upon revocation of such authority and permission so granted, may remove the Temporary Encroachment and charge the cost thereof to the Grantee, and collect the cost in any manner provided by law for the collection of local or state taxes; may require the Grantee to remove the Temporary Encroachment; and pending such removal, the City may charge the Grantee for the use of the Encroachment Area, the equivalent of what would be the real property tax upon the land so occupied if it were owned by the Grantee; and if such removal shall not be made within the time ordered hereinabove by 4 this Agreement, the City may impose a penalty in the sum of One Hundred .Dollars ($100.00) per day for each and every day that the Temporary Encroachment is allowed to continue thereafter, and may collect such compensation and penalties in any manner provided by law for the collection of local or state taxes. It is further expressly understood and agreed that the Grantee agrees to maintain the Temporary Encroachment so as not to become unsightly or a hazard. It is further expressly understood and agreed that the Grantee shall indemnify, hold harmless, and defend the City, its agents and employees, from and against all claims, damages, losses and expenses, including reasonable attorney's fees, in case it shall be necessary to file or defend an action arising out of the construction, location or existence of the Temporary Encroachments. It is further expressly understood and agreed that nothing herein contained shall be construed to enlarge the permission and authority to permit the 3 1 1 maintenance or construction of any encroachment other than that specified herein and to the limited extent specified herein, nor to permit the maintenance and construction of any encroachment by anyone other than the Grantee. It is further expressly understood and agreed that the Grantee agrees to maintain the Temporary Encroachments so as not to become unsightly or a hazard. It is further expressly understood that any existing encroachments referenced in the Exhibit or this Agreement are the ongoing maintenance obligation of the Grantee and the City disclaims any ownership interest or maintenance obligation of such encroachments. It is further expressly understood and agreed that the Grantee must obtain and keep in effect liability insurance with the City as a named insured in an amount not less than $500,000.00, per person injured and property damage per incident. The company.providing the insurance must be registered and licensed to provide insurance in the Commonwealth of Virginia. The Grantee will provide endorsements providing at least thirty(30) days written notice to the City prior to the cancellation or termination of, or material change to, any of the insurance policies. The Grantee assumes all responsibilities and liabilities, vested or contingent, with relation to the construction, location, and/or existence of the Temporary Encroachments. It is further expressly understood and agreed that the City, upon revocation of such authority and permission so granted, may remove the Temporary Encroachments and charge the cost thereof to the Grantee, and collect the cost in any manner provided by law for the collection of local or state taxes; may require the Grantee to remove the Temporary Encroachments; and pending such removal, the City may charge the Grantee for the use of the Encroachment Area, the equivalent of what 4 would be the real property tax upon the land so occupied if it were owned by the Grantee; and if such removal shall not be made within the time ordered hereinabove by this Agreement, the City may impose a penalty in the sum of One Hundred Dollars ($100.00) per day for each and every day that the Temporary Encroachments are allowed to continue thereafter, and may collect such compensation and penalties in any manner provided by law for the collection of local or state taxes.
