City Manager Duhaney introduced Jason Strout as the new Emergency Medical Services (EMS) Chief
and invited members of City Council to attend his swearing in ceremony on August 31, 2023.

referendum question. "The explanation shall(i)state the estimated maximum
amount of the bonds proposed to be issued,and(ii)state the proposed use of the
bond proceeds,and if there is more than one use,state the proposed uses for which
more than 10 percent of the total bond proceeds is expected to be used." Va.Code
24.2-687
• "The explanation shall be presented in plain English,shall be limited to a neutral
explanation,and shall not present arguments by either proponents or opponents of
the proposal" Id.

• The City Charter requires the bonds to be approved by the City Council by a two-thirds
affirmative vote. City Charter 6.05:1.This action requires 8 votes.
• The circuit court provides an order with the results of the referendum election.

• Once approved,the City has eight years after the date of the election to issue the
bonds.The City can request this period of time be extended to ten years.Id.

in the Water (SITW) Festival and attended a meeting with stakeholders, media and participants to gain
feedback from the recent Festival.
Council Member Rouse advised some of the complaints were:
- Restaurant owners felt left out
- Re-entry issues prevented attendees to get food outside of the venue
- Cost of food inside the venue was overpriced,for example a turkey leg was $40.00
Council Member Rouse advised staff will draft a report with the successes and challenges and will share
the report with the Body once it is finalized.

Council Member Berlucchi advised he has received feedback on illegal Short Term Rentals(STR)operating
in District 3. Council Member Berlucchi advised while there is a legal process for enforcing the policy,
STR's are allowed to continue to operate throughout the process. Council Member Berlucchi advised once
the violation is adjudicated, they may be fined a penalty of$500.00, which he does not believe is an
adequate deterrent. Council Member Berlucchi requested City Manager Duhaney to review the policy to
see if amendments should be made.
City Manager Duhaney advised this concern was previously discussed with the Body and proposed changes
were included in the last Legislative Package but were not passed by the General Assembly. City Manager
Duhaney advised if the Body would like, it can be included in the next Legislative Package.

Vice Mayor Wilson advised she received a letter from the Historic Preservation Commission requesting to
repurpose the old library building on 21 t Street. Vice Mayor Wilson advised it is one of the few historic
buildings owned by the City and requested the City Manager look at how it can be moved rather than
tearing it down.
Council Member Remick advised the land around the library is in poor condition but is aware of potential
development he believes would be beneficial for the City as well as providing right of way lanes which
would provide access to the Resort. Council Member Remick agreed with moving the building in order to
preserve it.

Council Member Ross-Hammond advised she was recently asked by a Council Member to provide
information regarding the Virginia African American Cultural Center's (VAACC) sponsorship agreement
with the City for the 2022 Juneteenth celebration. Council Member Ross-Hammond advised she responded
to the Council Member that she would provide the requested information to the Body, attached hereto and
made a part of the record. Council Member Ross-Hammond advised she requested the funding before she
was elected to City Council and was acting within her role as Chairman of the VAACC in effort to bring
unity in the community during the time when there was so much divisiveness in the City with the pandemic
and the Black Lives Matter movement. Council Member Ross-Hammond advised she was asked by Council
Member Berlucchi to coordinate the event with TEAM L.A.M.B., who she did not know, to shepherd a
smooth delivery. Council Member Ross-Hammond advised the City also provided$5,000.00 in funding to
TEAM L.A.M.B., which was combined with the $69,450 the VAACC received. Council Member Ross-
Hammond advised the funding supported a public art display with fifteen (15)framed murals displayed on
the Boardwalk and the information distributed provides the accounting information.
Council Member Taylor advised he is the Council Member that requested the information and advised the
information was requested in context to the accountability information TEAM L.A.M.B. is being asked to
submit. Council Member Taylor advised he first requested the accounting information for VAACC f�om
staff, however, they did not have it as it was not submitted post event as required. Council Member Taylor
advised there were questions about the pieces of art, and after a meeting today with Kate Pittman, it was
learned there are eight(8)pieces of art displayed in the community and the remaining twenty-two (22)are
in storage. Council Member Taylor advised the artwork was not used in this year's Juneteenth celebration
as there was no collaboration, adding, TEAM L.A.M.B. expended thousands of dollars to bring in art and
believes it was unfair to TEAM L.A.M.B. that they were unaware of the twenty-two (22)pieces in storage.

Attached is a copy of our Appreciation letter as well as a link to the images from the
Unity in the Community Art along the Boardwalk project. We were grateful for the
sponsorship and can proudly say the residents and visitors have shared nothing but
positive remarks about the murals.
It was a team effort, working collaboratively with Kate Pittman, Executive Director,
Laura Habr, Co-Founder of the ViBe Creative District; Gary Ryan, Executive Director
of VMOCA, and the VB Cultural Affairs Department. Behind the scene were several
construction and design companies, along with the Resort Management city staff who

SUMMARY OF MATERIAL TERMS
TYPE OF AGREEMENT: Sponsorship
EVENT: "Unity in Community Art Walk along the Boardwalk"("Event")
PARTIES: Virginia African American Cultural Center("Promoter")
City of Virginia Beach("City")
Sponsorship fee: $69,450
Responsibilities of the Promoter:
Create an inclusive public art installation substantially as presented in the attached Unity in
Community Powerpoint with support at the amount needed for 15 mural frames. The Promoter is
to secure all necessary permits,licenses,and insurance required for the Festival. The Promoter is
to provide the City with copies of its"call for artists"and any details to assist the VB Public Art
Committee to support the Event. Provide the City with recognition in printed materials and press
releases related to the Event.
Responsibilities of the City:
The City to pay.a half of the sponsorship fee upon execution. Upon the Promoter completing the
above responsibilities,the City to provide a payment of the other half of the sponsorship fee.
Coordination with TEAM LAMB,LLC:
The City desires the Promoter coordinate with TEAM LAMB, LLC in executing a successful
Juneteenth Weekend.
Additional Responsibilities of the Promoter after the Event:
Provide Event attendance and sponsor information to City to allow the City to review economic
impact,and the provision of such information is a precondition to the City's potential future
sponsorship of the Event.

8 WHEREAS, Juneteenth was recognized by the City formally in 2019, and by
9 ordinance adopted in June 2021, Juneteenth is a holiday for City employees;

11 WHEREAS, the Virginia African American Cultural Center, Inc. (VAACC), in
12 partnership with the ViBe Creative District has proposed Unity in Community Public Art
13 Walk along the Boardwalk ("Unity in Community")to provide inclusive public art starting
14 Juneteenth Weekend;

16 WHEREAS, the VAACC has requested City support of $69,450, which will allow
17 15 mural frames to be installed and painted along the railing at the Virginia Beach
18 Boardwalk;

20 WHEREAS, the City support of Juneteenth and this Festival is aligned with the
21 celebratory spirit of the occasion for the residents of the City;
22
23 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
24 VIRGINIA BEACH, THAT:

26 1. The City Manager is hereby authorized to execute a sponsorship agreement
27 between the City and the VAACC in a form acceptable to the City Manager and
28 approved by the City Attorney, consistent with the attached VAACC Exhibit A,
29 summary of material terms.

31 2. $69,450 is hereby transferred from the City Council Reserve for Emergent Needs
32 to the Operating Budget of the Convention and Visitors Bureau in furtherance of
33 the City's sponsorship of Unity in Community.

1- Summary of stakeholder survey results.
2- Based on a very conservative estimate of 1,500 people per day, the project can
report having 135,000 boardwalk attendees. Knowing that this was visible from
both the boardwalk and sand, it is more realistically double this figure. The project
was on view for 90 days from June to September 2022.
3- The QR code that was attached to the banner and the Artwalk Google Map for
people to scan for artist information was viewed 2,010 times digitally. Attached

4- Also -- a portion of the banners have since been repurposed in two ways:
A- Two banners were installed in Seatack Park in partnership with VB Parks
& Rec and Cultural Affairs in 2022. These banners are seen a minimum of 1,000
times a day by driveby traffic which account for an additional 256,000 views
between October 2022 and July 2023-- they are still on view.
B- Eight of the banners have recently been installed at the corner of 21 st St
(264E exit) and Parks Avenue where they will be seen a conservative estimate of
approximately 250,000 times between July 5, 2023 and September/ October 2023
before they are removed.
These conservative estimates are based on traffic study data from the City of
Virginia and pedestrian estimates. Attached screenshots show reports of 12,000+
cars daily on Birdneck and 10,000 on 21st St daily. We know not every car will
have someone looking specifically at the art.

Council Member Henley requested more information on the portions of right-of-way the City owns where
the Southeastern Parkway and Greenbelt project was planned. Council Member Henley advised the project
never came to fruition and in July 2021, the Body adopted an Ordinance to terminate the Memorandum of
Understanding with the City of Chesapeake since they no longer wanted to participate in the project.
Council Member Henley advised now that uses are coming up for connector roads, she believes it is
important to know what the City owns and what plans Virginia Power may have.

Council Member Taylor advised he met with Chief Neudigate to discuss fentanyl issues he is seeing in
District 8 with users and dealers. Council Member Taylor advised he is aware that Governor Youngkin is
working on strategies to address this and advised he asked Chief Neudigate if the City has any other
strategies other than the use of Narcan. Council Member Taylor advised the discussion was helpful in
providing him a better understanding on how to discuss this issue with residents in District 8 and looks
forward to receiving the follow up report from Chief Neudigate.

Commending the City of Virginia Beach
Agreed to by the Ilouse of Delegates,February 20,2023
WHEREAS,the City of Virginia Beach,the most populous city in the Commonwealth and a vibrant tourism destination,is a hub for culture,
education,business,and national defense;and
WHEREAS,situated where the southern mouth of the Chesapeake Bay meets the Atlantic Ocean,Virginia Beach traces its deepest roots to the
earliest days of the nation,with Cape Henry serving as the initial landing site in the New World for the Jamestown settlers;and
WHEREAS,from Colonial America through the founding of the United States to the Reconstruction Era,the area around what is now Virginia
Beach remained largely rural,but with the arrival of the railroad in 1883,a resort community began to develop near the coast in Princess Anne County,
and Virginia Beach was incorporated as a town in 1906;and
WHEREAS, Virginia Beach continued to grow and became a well-known seasonal vacation destination for families throughout the
Commonwealth and the eastern United States;and
WHEREAS,Virginia Beach was incorporated as an independent city in 1952,but maintained strong ties with the surrounding Princess Anne
County,and in 1963,residents of both localities passed a referendum to merge;and
WHEREAS,at the time,Virginia Beach was only about two square miles in area,and with the addition of the 253 square miles that represented
Princess Anne County,the new city was divided into seven boroughs,then known as Bayside,Blackwater,Kempsville,Lynnhaven,Princess Anne,Ringo,
and Virginia Beach;and
WHEREAS,tourism accounts for a significant share of Virginia Beach's vibrant economy,with millions of annual visitors accounting for billions
of dollars in spending,which supports thousands of local jobs;Virginia Beach is listed in the Guinness World Records as the longest pleasure beach in the
world,with 38 miles of coastline dedicated to outdoor recreation and family-friendly activities;and
WHEREAS,Virginia Beach also maintains a significant agribusiness sector and is home to a variety of industries,advanced manufacturers,and
national and global corporations,as well as several United States military installations,including Naval Air Station Oceana;and
WHEREAS,Virginia Beach is home to Regent University and Virginia Wesleyan University,and offers numerous opportunities for educational
and cultural enrichment through the Virginia Museum of Contemporary Art,the Virginia Aquarium and Marine Science Center,and the Military
Aviation Museum,among other shows and venues;and
WHEREAS,Virginia Beach has preserved the history and heritage of the Commonwealth and the United States as the location of 18 sites on the
National Register of Historic Places,including one of the oldest surviving colonial homes in Virginia,the Adam Thoroughgood House,and the Cape Henry
Lighthouses;and
WHEREAS,Virginia Beach supports conservation of the Commonwealth's valuable natural resources;within city limits,there are more than 210
city parks,two state parks,and the Back Bay National Wildlife Refuge;and
WHEREAS,to commemorate the 60th anniversary of the creation of the modern incarnation of Virginia Beach,Mayor Bobby Dyer launched the
Helping Our People Excel(H.O.P.E.)Initiative to recognize individuals,civic organizations,and religious groups that have enhanced community life in
the city through their generosity and commitment to service;and
WHEREAS,Virginia Beach has reimagined the city's branding and developed a commemorative 60th anniversary logo and media toolkit for local
businesses and organizations;city agencies also have a wide range of special events and activities to celebrate the landmark year;now,therefore,be it
RESOLVED by the House of Delegates,That the City of Virginia Beach hereby be commended on the occasion of the 60th anniversary of the city's

ZERO WASTE AWARENESS WEEK
Council Member Holcomb, on behalf of Mayor Dyer, welcomed Members of the Clean Community
Commission and read the Resolution declaring the first full week in September as, "ZERO WASTE
AWARENESS WEEK"and encouraged all citizens to reduce waste by reducing, reusing, recycling and
repurposing waste.
On behalf of the Clean Community Commission, Vice Chair Terry Stevens accepted the Resolution and
expressed their appreciation to City Council for their continued support.
Mayor Dyer welcomed Esabella Fernandez, Morgan Ramsey, and Anna Sherman from Troop 477 and
expressed his appreciation to them for presenting him with a strand of paper cranes in remembrance of the
May 31 S`victims.

WHEREAS:The City of Virginia Beach wants to encourage citizens to waste less by reducing,reusing,recycling and
repurposing;and
WHEREAS: The City of Virginia Beach recognizes that it is the innovation of its citizens that lead to thoughtful
solutions regarding zero waste;and
WHEREAS: The City of Virginia Beach realizes that zero waste will benefit the environment and land in our City;
and
WHEREAS: The City of Virginia Beach acknowledges that zero waste will save the citizens of Virginia Beach
financially;and
WHEREAS: The City of Virginia Beach challenges all businesses in its community to engage its employees and
citizens to be more mindful regarding ways to decrease waste;and
WHEREAS:The City of Virginia Beach encourages all city departments to participate during Zero Waste Awareness
Week by educating its citizens on ways to reduce waste;and
NOW, THEREFORE, BE IT RESOLVED: That the City of Virginia Beach will designate the first full week of

9 WHEREAS, Vincent and Daisy Pabon (the "Applicants") have requested
10 permission to maintain a 43.67 LF and 33.81 LF 6' wood fence, a 34.8' x 9.1' concrete
11 driveway, a 10.7' x 20.1' frame shed, 5.95 sq. ft. of concrete pad, 95 sq. ft. of pool area, a
12 14' x 7.7' wood dock, and a 166 sq. ft. covered fireplace area within the City's 100'
13 drainage easement and 10' maintenance easement (collectively, the "Temporary
14 Encroachment"), located on the Applicants' property at 920 Sandoval Drive (GPIN: 2414-
15 68-4261); and

17 WHEREAS, City Council is authorized pursuant to §§ 15.2-2009 and 15.2-
18 2107, Code of Virginia, 1950, as amended, to authorize the temporary encroachment upon
19 the City's easements subject to such terms and conditions as Council may prescribe.

21 NOW,THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
22 VIRGINIA BEACH, VIRGINIA:

Encroachment within the Encroachment Areas.
NOW, THEREFORE, for and in consideration of the premises and of the
benefits accruing or to accrue to the Grantee and for the further consideration of One
Dollar ($1,00), cash in hand paid to the City, receipt and sufficiency of which are hereby
acknowledged, the City hereby grants to the Grantee permission to use the
Encroachment Areas for the purpose of constructing and maintaining the Temporary
Encroachment.
It is expressly understood and agreed that the Temporary Encroachment
will be constructed and maintained in accordance with the laws of the Commonwealth of
Virginia and the City of Virginia Beach, and in accordance with the City's specifications

removing, or ordering the Grantee to remove, all or any part of the Temporary
Encroachment from the Encroachment Areas in the event of an emergency or public
necessity, and Grantee shall bear all costs and expenses of such removal.
It is further expressly understood and agreed that the City may enter upon
the Grantee's property for ingress and egress on an as needed basis in order to monitor
Grantee's compliance with the terms of this Agreement, for routine maintenance
activities upon public property adjacent to 920 Sandoval Drive, or at any time upon an
event of noncompliance with the terms of this Agreement to enforce the terms of this
Agreement; provided that City will provide at least ten (10) days' notice of such entry to
Grantee, except when there is a threat of imminent harm, personal injury or property
damage. City shall not unreasonably interfere with Grantee's use and quiet enjoyment
of the Property. Any access authorized by this section shall be limited to the property
with a street address of 920 Sandoval Drive.
It is further expressly understood and agreed that the Temporary
Encroachment herein authorized terminates upon notice by the City to the Grantee, and
that within thirty (30) days after the notice is given, the Temporary Encroachment must
be removed from the Encroachment Areas by the Grantee; and that the Grantee will
bear all costs and expenses of such removal.
It is further expressly understood and agreed that the Grantee shall
indemnify, hold harmless, and defend the City, its agents and employees, from and
against all claims, damages, losses and expenses, including reasonable attorney's fees,
in case it shall be necessary to file or defend an action arising out of the construction,
location or existence of the Temporary Encroachment.

It is further expressly understood and agreed that nothing herein
contained shall be construed to enlarge the permission and authority to permit the
maintenance or construction of any encroachment other than that specified herein and
to the limited extent specified herein, nor to permit the maintenance and construction of
any encroachment by anyone other than the Grantee.
It is further expressly understood and agreed that the Grantee agrees to
maintain the Temporary Encroachment so as not to become unsightly or a hazard.
It is further expressly understood that any existing encroachments
referenced in the attached Exhibit or in this Agreement are the ongoing maintenance
obligation of the Grantee and the City disclaims any ownership interest or maintenance
obligation of such encroachments.
It is further expressly understood and agreed that the Grantee must obtain
and keep in effect liability insurance with the City as a named insured in an amount not
less than $500,000.00, per person injured and property damage per incident, combined.
The company providing the insurance must be registered and licensed to provide
insurance in the Commonwealth of Virginia. The Grantee will provide endorsements
providing at least thirty (30) days written notice to the City prior to the cancellation or
termination of, or material change to, any of the insurance policies. The Grantee
assumes all responsibilities and liabilities, vested or contingent, with relation to the
construction, location, and/or existence of the Temporary Encroachment.
It is further expressly understood and agreed that the City, upon
revocation of such authority and permission so granted, may remove the Temporary
Encroachment and charge the cost thereof to the Grantee, and collect the cost in any
manner provided by law for the collection of local or state taxes; may require the

Grantee to remove the Temporary Encroachment; and pending such removal, the City
may charge the Grantee for the use of the Encroachment Area, the equivalent of what
would be the real property tax upon the land so occupied if it were owned by the
Grantee; and if such removal shall not be made within the time ordered hereinabove by
this Agreement, the City may impose a penalty in the sum of One Hundred Dollars
($100.00) per day for each and every day that the Temporary Encroachment is allowed
to continue thereafter, and may collect such compensation and penalties in any manner
provided by. law for the collection of local or state taxes.
IN WITNESS WHEREOF, Vincent and Daisy Pabon, the said Grantee,
have caused this Agreement to be executed by their signatures. Further, that the City of
Virginia Beach has caused this Agreement to be executed in its name and on its behalf
by its City Manager and its seal be hereunto affixed and attested by its City Clerk.

4 WHEREAS, ZIM American Integrated Shipping Services Co., LLC, a subsidiary
5 of publicly held Israeli international cargo shipping company ZIM Integrated Shipping
6 Services Ltd., will invest approximately $30 million to relocate to Virginia Beach and
7 expand its U.S. headquarters;

9 WHEREAS, Virginia successfully competed with other states for the project,
10 which represents several hundred jobs over the next five years;
11
12 WHEREAS, ZIM has purchased a first-class office building, which will serve its
13 growing shipping business in the U.S., reflecting ZIM's commitment to the North
14 American market and to the expansion of its capacity in the region with their new LNG-
15 Green Energy vessels fleet;
16
17 WHEREAS, ZIM's expanded operation will strengthen supply chain infrastructure
18 in the region and in the Commonwealth, and as a leading carrier in the global container
19 shipping industry, they will provide a vital service to our maritime community; and
20
21 WHEREAS, in appreciation for ZIM's decision to relocate their U.S. headquarters
22 to Virginia Beach, the City Council desires to designate Corporation Lane as "ZIM
23 Avenue;"

25 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

6 prepared and submitted a Certified Local Governments grant application;

8 WHEREAS, a letter was received from the Department of Historic Resources on July
9 20, 2023 to notify the City of Virginia Beach of a grant award in the amount of $19,523;
10 and

12 WHEREAS, an equal amount of$19,523 of matching funds from the City is required.

14 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
15 VIRGINIA BEACH, VIRGINIA, THAT:

17 1) $19,523 is hereby accepted from the Virginia Department of Historic Resources and
