May 7, 2024 9 CITY COUNCIL RECONCILIATION FY 2024-25 RESOURCE MANAGEMENT PLAN(BUDGET) OPERATING AND CAPITAL BUDGETS ITEM#75621 2:55 P.M. Vice Mayor Wilson discussed the importance of the budget as it sets the priorities for the upcoming year and is a collaboration of the Body working together to adopt a budget the majority can agree on. Vice Mayor Wilson advised the budget will not have what everyone wants but all Council Members were called prior to the Reconciliation and again this past week. Vice Mayor Wilson read the FY 2024-25 Resource Management Plan Reconciliation Letter, attached hereto and made a part of the record. Council Member Hutcheson noted a correction for the Woodstock Road Sidewalk project and asked to amend the language in the scope of the project to: "Establish Project 100682 `Woodstock Road Sidewalk' and program $150,000 in year - one of the Capital Improvement Program for preliminary design of a sidewalk on the eastern side of Woodstock Road near Avalon Church of Christ." Mayor Dyer advised this is a long and challenging process and asked the Body if there were any questions or concerns? Council Member Henley advised she sees that requests made by other Council Members have a dollar amount included coming from the General Fund and her requests do not have an amount specified unless the funding is coming from another project in her District. Council Member Henley referenced item #5 from the letter and asked for clarification if there will be a report and funding? City Manager Duhaney advised the intent is to provide a high level report on types of passive recreation in the Interfacility Transition Area (ITA) with estimated costs and funding options. City Manager Duhaney advised staff can provide the concept plan and then funding could be provided for the design and build out in the next budget. Council Member Henley advised she may not be able to support the budget with other Council Member's receiving $100,000 and up for their requests and suggested allocating some funding. Council Member Henley reference item #6 and asked if the funding from Dominion Energy will be used to cover the tree mitigation cost? City Manager Duhaney advised he will provide City Council a report on the Tree Mitigation Plan in the fall with the planned use of funds for City Council's consideration. Council Member Henley referenced item #4 and stated the City Manager will provide options for ambulances, but it looks like she will also have to wait one(1) or two (2)more years for funding. Council Member Henley asked how much funding is left in the General Fund after all of the deductions have been taken out? Council Member Henley advised the design funding for the Indian River Road Improvement project has funding but is not coming from the General Fund, it is instead being transferred from the Southern Rivers Watershed Sight Acquisition Program Capital Improvement Project(CIP)fund. Council Member Henley stated money was taken from a project in her District to fund this project which is also in her District. May 7, 2024 10 CITY COUNCIL RECONCILIATION FY 2024-25 RESOURCE MANAGEMENT PLAN(BUDGET) OPERATING AND CAPITAL BUDGETS ITEM#75621 (Continued) Council Member Taylor advised there is a lot of money in the proposed budget but does not believe it prioritizes citizens requests and feels there is disparity and partiality in the budget process. Council Member Taylor advised in last year's budget each Council Member had access to$150,000 but found that one Council Member has been given a total of$400,000 in requests with no collaboration with the rest of the Body. Council Member Taylor advised$300,000 was requested for the Shore Drive Corridor project and was told it was due to residents in that area who were very vocal about the project. Council Member Taylor advised a large portion of Shore Drive is in his District and he did not hear from residents during his Town Hall and other public engagement meetings or from the Bayfront Advisory Commission (BAC). Council Member Taylor referenced item #3 concerning the reduction of Regional Grant Awards and advised he was told by Vice Mayor Wilson there would be no new spending for charity, however;Men of Faith will receive a 50% increase, the Virginia African American Cultural Center (VAACC), which was founded by one of the Council Members,will receive a 20%increase and believes the$30,000 for replacing a sign in District 3, which was hit by a drunk driver, is charity. Council Member Taylor referenced the $1.6-Million dedication reserve for Arts and Culture and believes that fund should have been used to fund the VAACC and the Virginia Beach VA250 Committee. Council Member Taylor advised there was a lot of discussion concerning affordable housing which led to a study and staff recommendation to set up a housing trust fund, however; there is no funding for affordable housing and is another reason the public has said that sometimes City Council's words do not match actions taken. Council Member Taylor advised when he worked with the City Manager and Budget Director, he found$7-Million that could be used for a myriad of needs and wanted to see the Body take a holistic and strategic approach to all of the dedication revenues. Council Member Taylor referenced his request from last week to give $25,000 to each recreational association, and explained when he spoke with City Manager Duhaney and realized the cost for forty(40) associations would be$1-Million,he requested to limit the funding to the tier one associations which totaled $300,000. Council Member Taylor advised there was no collaborative effort, the Vice Mayor did not call him to discuss and through a decision made,funding was not provided. Council Member Taylor advised the proposed budget does not reflect any priorities and hopes next year's budget process is more collaborative with collegiality. Council Member Schulman advised he has a different perspective and believes most Council Members understand they are one (1)person on an eleven (11) member team and will not get everything requested but will support each other the best they can and when there is a disagreement, it is treated with dignity and respect. Council Member Schulman advised his request is for restrooms at Chic's Beach, it is a heavily visited area on the western side of the Bayfront area and when people need to use the restroom, there is no place for them to go. Council Member Schulman advised there was a pilot program last year to have two (2)portable restrooms installed and since there was support from residents, business owners and civic leagues, he requested it again and was his only request. Council Member Schulman advised everything else he supported were requests from the rest of the Body and had nothing to do with District 9. Council Member Schulman advised last year,District 9 took a hit and had$8.3 Million taken from the Shore Drive Corridor—Phase X project to go towards the Phase Ill project across the bridge,where there were already May 7, 2024 11 CITY COUNCIL RECONCILIATION FY 2024-25 RESOURCE MANAGEMENT PLAN(BUDGET) OPERATING AND CAPITAL BUDGETS ITEM#75621 (Continued) sidewalks on both sides of the road, however, he supported it because it made sense as it was meant to go first and could be completed with the funding. Council Member Schulman advised he did not complain and instead did his best to explain it to residents in District 9. Council Member Schulman advised he became aware that the Shore Drive Corridor needed to be updated during his campaign and it was important to him and the residents,adding the$300,000for the Shore Drive Corridor Plan came from an existingproject and was not new money and benefits both District 8 and 9. Council Member Schulman advised if the District 8 Council Member attended more than four (4) Bayfront Advisory Commission (BAC) meetings over the past year and four months, he would know it is a priority for their constituents. Council Member Taylor advised he was not making it personal with Council Member Schulman and i1,as making a point that there was a lack of communication and leadership. Council Member Hutcheson advised this is the first budget he has been a part of and expressed his appreciation to everyone who has helped him understand the process. Council Member Hutcheson advised that since the budget is not final yet, he would like to address a couple of items related to Public Safety. Council Member Hutcheson advised he is concerned about the shortage of ambulances, and with costs and delays increasing, he would like to see some funding included in the budget if possible. Council Member Hutcheson expressed appreciation for the funding to hire additional firefighters from seventeen (17) to thirty (30) to reduce the costs of forced overtime, estimated at$4.5-Million. Council Member Hutcheson understands there is a priority in the next budget to increase the number hired and asked when there is approval to hire additional firefighters, to increase the number of positions in increments of three (3) to total 33, 36, 39 and so on, to allow each of the three(3)shifts to have a new firefighter. Council Member Hutcheson advised if there is a way to increase the number of new hires in this budget it would be helpful to reduce the amount of mandatory overtime sooner but will understand if it is not possible. Council Member Remick advised this is the Body's biggest vote of the year and believes the Body has communicated and collaborated as each has advocated for their Districts and for Public Safety, Schools, Parks and Recreation, the Resort, Town Center and a myriad of priorities discussed at the City Council Retreat. Council Member Remick believes there will be a program coming soon to address affordable housing. Council Member Remick advised he is a lifelong member of the Seatack Civic League and during his campaign,promised to do everything he can to make improvements, however;the funding he requested for Seatack Park would come from the Parks and Recreation Department which is strained this year. Council Member Remick explained he will continue working with the City Manager and the Park and Recreation Director to look at other options. Council Member Remick advised the signage for Seatack was provided and believes they will be really nice for the community, and he will also look at the $150,000 provided in the last budget for each District and will apply it towards a park for either Seatack or Bay Colony. May 7, 2024 12 CITY COUNCIL RECONCILIATION FY2024-25 RESOURCE MANAGEMENT PLAN(BUDGET) OPERATING AND CAPITAL BUDGETS ITEM#75621 (Continued) Council Member Wooten advised she has been through several budget cycles and has not felt she is fully onboard with understanding the process and asked questions about why things were done a certain way, who makes the decisions and why the Districts priorities are not reflective of the budget. Council Member Wooten advised the landscape has changed with the new District system and Council Members being held more accountable by their District residents and asked for abetter process next year. Council Member Wooten advised she supports increasing positions in the Fire Department but does not believe the proposed language reflects a commitment. Council Member Wooten advised the language for funding the two (2) festivals in items 15 and#16 lacks a commitment for future funding, adding,Juneteenth is a federal holiday and believes both festivals should not have future funding dependent on the 90-Day Festival Task Force Report. Council Member Henley expressed her concern that there are not enough new firefighter positions funded in the budget due to the issues on how long the training takes plus the three(3)years it takes to fully certify a firefighter,adding,during that process there will be more and more retirements. Council Member Henley suggested adding more hires at the end of the year to allow them to start the training process. City Manager Duhaney explained there is authorization to over hire to account for the expected attrition. Council Member Henley referenced the study previously completed which recommended hiring sixty(60) firefighters and was the minimum and would like to see how filling the vacancies can best be done. Council Member Ross-Hammond expressed her appreciation to Mayor Dyer and Vice Mayor Wilson for their work on the budget and understands it will not please everyone. Council Member Ross-Hammond advised there were disappointments last year when projects were not funded but this year many of them are,such as improvements to Cleveland Street,Independence Crossing and the VB Trail. Council Member Ross-Hammond expressed she works with Council Member Schulman in her neighboring District to ensure the community is covered and is pleased to see fundingfor the Parks After Darkprogram, dedicated funding for Arts and Culture and funding for the VB VA250 Committee. Council Member Ross-Hamond expressed her support for hiring additional firefighters and believes hiring in increments of three (3) is a good idea. Council Member Ross-Hammond referenced the $150,000 provided for each District and advised she requested four(4)or five(5)brick signs to be installed in African-American neighborhoods across the City to preserve their history and not all are in her District. Council Member Ross-Hammond explained it took time to talk to the community and submit the necessary permits for Burton Station,Doylestown,Beechwood New Light and Queen City and hopes to see a couple installed by the end of this summer. Council Member Rouse expressed her appreciation to the Body for supporting the Parks After Dark Program in Green Run and believes it is beneficial to not only her District but the neighboring Districts as well. May 7, 2024 13 CITY COUNCIL RECONCILIATION FY 2024-25 RESOURCE MANAGEMENT PLAN(BUDGET) OPERATING AND CAPITAL BUDGETS ITEM#75621 (Continued) Vice Mayor Wilson advised this has been a long budget season and believes it is good for the Body to see each Department and their staff to reconnect with how big the City is and how much work they all do. Vice Mayor Wilson advised she often hears from people that the City has the best employees, and she agrees. Vice Mayor Wilson advised she appreciates there are areas identified for next year that need to be looked at because some of the issues could not be solved immediately, such as the shortage of ambulances and firefighters. Vice Mayor Wilson asked City Manager Duhaney what message he heard from the Body. City Manager Duhaney advised his understanding of the Body's expectation is for him to hire thirty (30) additional firefighters. City Manager Duhaney suggested changing the language to allow ninety(90)to be hired and if more are hired than what is allocated, he can come back to City Council for an appropriation. Mayor Dyer advised this is a tough and complicated process and thanked the Body for their participation. Mayor Dyer advised he works with mayors from not only this region, but all over, and is confident that every city, township and municipality is going through the same process with the same concerns and frustrations. Mayor Dyer advised there are tremendous challenges ahead with maintaining Stormwater, Schools and other infrastructure needs but the Body has been proactive and is doing a remarkable job and believes overall, the public is very thankful. May 7, 2024 14 CITY COUNCIL LL4ISON REPORTS ITEM#75622 4.21 P.M. Council Member Henley advised the Green Ribbon Committee (GRQ sponsored the North Landing Albemarle Symposium and had a great turnout with approximately 150 attendees. Council Member Henley expressed her appreciation to staff for organizing the event and the selection of presenters, one of which was the Secretary of Natural Resources, who advised the Governor looks at ways to assist localities. Council Member Henley advised the most impressive group were the Environmental Studies Program High School students, led by Chris Freeman, who did a phenomenal job presenting for one of the guest speakers who was unable to attend. Council Member Henley advised it left her feeling the City's future is in good hands. May 7, 2024 15 CITY COUNCIL LL41SON REPORTS ITEM#75623 (Continued) Council Member Taylor advised earlier today, he met with concerned constituents and members of the Bayfront Advisory Commission(BAC)regarding the ramp that was supposed to be built next to Westminster Canterbury to meet the American with Disabilities Act (ADA) requirements. Council Member Taylor advised with the way the ramp is built, the storms have pushed sand over approximately 50%of the ramp. Council Member Taylor advised he spoke with a gentleman who uses a wheelchair who could not use the ramp and heard concerns from several Bayfront residents. Council Member Taylor advised he took several pictures that he will share with the City Manager and Council Member Schulman who is the other BAC Council Liaison. May 7, 2024 16 CITY COUNCIL LIAISON REPORTS ITEM#75624 (Continued) Council Member Rouse advised she is the Council Liaison to the Active Transportation Advisory Committee (ATAQ and tonight the Proclamation for Bike Month will be presented to celebrate cyclists and encourage everyone to ride their bikes this month. May 7, 2024 17 CITY COUNCIL DISCUSSION/INITL4TIVES/COMMENTS ITEM#75625 4.21 P.M. Council Member Berlucchi advised this is Teacher Appreciation Week and provides a great opportunity to thank teachers for their dedication to education. Council Member Berlucchi shared the impact his teachers have had on him that inspired him into his profession. Council Member Berlucchi advised he visited Windsor Woods Elementary School earlier today and learned about a nationwide program they have implemented for students with special needs and enjoyed meeting many of the students and their teachers. May 7, 2024 18 CITY COUNCIL DISCUSSIONANITIATIVES/COMMENTS ITEM#75626 (Continued) Council Member Schulman expressed his appreciation to the staff who supported his Town Hall last night as well as approximately sixty (60) residents who attended. Council Member Schulman advised Brooke Costanza - City Arborist, PJ Scully - Planning Department and Frank Fentress - Parks and Recreation Department, all presented information on tree preservation, enhancing the tree canopy and ways to mitigate tree loss during development. May 7, 2024 19 CITY COUNCIL DISCUSSION/INITIATIVES/COMMENTS ITEM#75627 (Continued) Council Member Schulman advised he has been dealing with a problem in his neighborhood with young teen drivers on unregistered ATVs and motorcycles driving up to eighty(80) miles per hour on streets in Thorogood and Chic's Beach. Council Member Schulman advised people have been run off of the road and just last week his daughter had a school dance and there were between 200- 300 children with their families outside when motorcycles sped by at a very high speed. Council Member Schulman advised he has spoken to the police, but they have a strict no chase policy. Council Member Schulman advised he wanted to share this in case anyone else is experiencing the same problem in their neighborhoods. May 7, 2024 20 CITY COUNCIL DISCUSSIONIINITLITIVES/COMMENTS ITEM#75628 (Continued) Mayor Dyer advised he would like to bring a Resolution forward for an advisory referendum on collective bargaining in November. Mayor Dyer advised there are a lot of people who want collective bargaining and believes the Body and public are split and the referendum would give the public an opportunity to be involved in the decision. Mayor Dyer advised he will also have a Resolution for consideration to have a private company conduct a Strength, Weaknesses, Opportunities and Threats (SWOT) Analysis for an academic perspective. Council Member Taylor asked what the process is to bring forward an advisory referendum, stating he believes the general public he has spoken to was aware of plans to design a park at Rudee Loop but did not necessarily know the City spent$60-Million for a park. Mayor Dyer advised a majority of the Body would have to vote in support and explained it has been done in the past for Recreation Centers and Light Rail. Council Member Wooten asked if the Referendum she requested for the Recreation Center and Parks could also be considered. Mayor Dyer advised she would need to bring it forward. May 7, 2024 21 CITY COUNCIL DISCUSSIONANITIATIVES/COMMENTS ITEM#75629 (Continued) Council Member Remick advised he wanted to recognize Nancy Helman—Director and Brande Rumpf— Coordinator, Convention Visitor's Bureau,for organizing a very nice luncheon last Thursday to honor National Travel and Tourism Week. Council Member Remick advised there were over 400 in attendance to celebrate the front line hospitality staff who go above and beyond to maximize services for their guests. Council Member Remick advised there were nearly 13-Million visitors who spent approximately$3-Billion. Council Member Ross-Hammond congratulated Ms. Helman and Ms. Rumpf, adding, it was a very nice event and is an example of how much City employees are appreciated. May 7, 2024 22 CITY COUNCIL DISCUSSION/INITIATIVES/COMMENTS ITEM#75630 (Continued) Vice Mayor Wilson advised the-Vh Annual Crush Cancer event was held last Sunday and was pleased it did not rain. Vice Mayor Wilson advised there was a 100%chance of rain, and it rained in other parts of the City but not at the event. Vice Mayor Wilson advised firefighters came with their fire trucks to support and Council Member Hutcheson participated. Vice Mayor Wilson advised$2.3-Million has been raised and all goes towards rare cancer research and expressed it was great to see it all come together. Council Member Hutcheson expressed his appreciation to everyone who attended, advising it was a great event and is important, the City has lost firefighters in past years and there is one battling cancer now. May 7, 2024 23 CITY COUNCIL DISCUSSION/INITIATIVES/COMMENTS ITEM#75631 (Continued) Council Member Ross-Hammond announced Marth McClees recently held her retirement ceremony at MOCA and expressed her appreciation to Ms. McClees for all of her work with Virginia Beach Vision. Council Member Ross-Hammond further advised,Dr.Johnson who has been her legislative assistant, will be leaving as she has accepted a position as President for her Homeowner's Association. Council Member Ross-Hammond advised Dianna Arocho Gonzalez will be her new legislative assistant. May 7, 2024 24 CITY COUNCIL DISCUSSIONANITL4TIVES/COMMENTS ITEM#75632 (Continued) Council Member Hutcheson advised he held his first Town Hall Meeting last Wednesday and expressed his appreciation to all of the staff who provided support. Council Member Hutcheson advised he has held a couple other meetings with the public and has heard of other neighborhoods with complaints of drivers speeding through their neighborhoods, excessive traffic and using neighborhood roads to cut through to main roads and does not believe this is an issue that will stop and will be working on that going forward. May 7, 2024 25 CITY COUNCIL DISCUSSIONANITIATIVES/COMMENTS ITEM#75633 (Continued) Mayor Dyer advised on May 22"a there will be a Helping Our People Excel(H.O.P.E.)forum focused on mental health and overall wellness. Mayor Dyer advised he has asked Council Member Berlucchi to help coordinate the forum as he has a passion and significant contacts within the mental health community. Council Member Berlucchi advised this will be a great continued resource to support, empower and educate the community on mental health and wellness. NOW, THEREFORE, for and in consideration of the premises and of the benefits accruing or to accrue to the Grantee and for the further consideration of One Dollar ($1.00), cash in hand paid to the City, receipt, and sufficiency of which are hereby acknowledged, the City hereby grants to the Grantee permission to use the Encroachment Area for the purpose of constructing and maintaining the Temporary Encroachment. Providing however, nothing herein shall prohibit the City from immediately removing, or ordering the Grantee to remove, all or any part of the Temporary 2 Encroachment from the Encroachment Area in the event of an emergency or public necessity, and Grantee shall bear all costs and expenses of such removal. It is further expressly understood and agreed that the City may enter upon the Grantee's property for ingress and egress on an as needed basis in order to monitor Grantee's compliance with the terms of this Agreement, for routine maintenance activities upon public property adjacent to 1286 S. City shall not unreasonably interfere with Grantee's use and quiet enjoyment of the Property. Any access authorized by this section shall be limited to the property with a street address of 1286 S. Schooner Lane, Virginia Beach, Virginia 23454. It is further expressly understood and agreed that the Grantee shall indemnify, hold harmless, and defend the City, its agents and employees from any/all potential impacts from the Lake Trant Spillway arising out of the construction, location or existence of the Temporary Encroachment. The Lank Trant Spillway is located south and upstream of the Property. It is further expressly understood and agreed the Temporary Encroachment crosses into a 25' City-owned drainage easement and a 5' City-owned utilities and drainage easement, said Temporary Encroachment will not interfere the City's ability to perform maintenance on any/all City easements. It is further expressly understood and agreed that the Temporary Encroachment herein authorized terminates upon notice by the City to the Grantee, and 3 that within thirty (30) days after the notice is given, the Temporary Encroachment must be removed from the Encroachment Area by the Grantee; and that the Grantee will bear all costs and expenses of such removal. It is further expressly understood and agreed that the Grantee shall indemnify, hold harmless, and defend the City, its agents and employees, from and against all claims, damages, losses and expenses, including reasonable attorney's fees, in case it shall be necessary to file or defend an action arising out of the construction, location or existence of the Temporary Encroachment. It is further expressly understood and agreed that nothing herein contained shall be construed to enlarge the permission and authority to permit the maintenance or construction of any encroachment other than that specified herein and to the limited extent specified herein, nor to permit the maintenance and construction of any encroachment by anyone other than the Grantee. It is further expressly understood and agreed that the Grantee agrees to maintain the Temporary Encroachment so as not to become unsightly or a hazard. It is further expressly understood that any existing encroachments referenced in the attached Exhibit or in this Agreement are the ongoing maintenance obligation of the Grantee and the City disclaims any ownership interest or maintenance obligation of such encroachments. It is further expressly understood and agreed that the Grantee must obtain and keep in effect liability insurance with the City as a named insured in an amount not less than $500,000.00, per person injured and property damage per incident, combined. The company providing the insurance must be registered and licensed to provide insurance in the Commonwealth of Virginia. The Grantee will provide endorsements 4 providing at least thirty (30) days written notice to the City prior to the cancellation or termination of, or material change to, any of the insurance policies. The Grantee assumes all responsibilities and liabilities, vested or contingent, with relation to the construction, location, and/or existence of the Temporary Encroachment. It is further expressly understood and agreed that the Temporary Encroachment must conform to the minimum setback requirements, as established by the City. It is further expressly understood and agreed that the City, upon revocation of such authority and permission so granted, may remove the Temporary Encroachment and charge the cost thereof to the Grantee, and collect the cost in any manner provided by law for the collection of local or state taxes; may require the Grantee to remove the Temporary Encroachment; and pending such removal, the City may charge the Grantee for the use of the Encroachment Area, the equivalent of what would be the real property tax upon the land so occupied if it were owned by the Grantee; and if such removal shall not be made within the time ordered hereinabove by this Agreement, the City may impose a penalty in the sum of One Hundred Dollars ($100.00) per day for each and every day that the Temporary Encroachment is allowed to continue thereafter, and may collect such compensation and penalties in any manner provided by law for the collection of local or state taxes. It is further expressly understood and agreed that the Grantee shall indemnify, hold harmless, and defend the City, its agents and employees, from and against all claims, damages, losses and expenses, including reasonable attorney's fees, in case it shall be necessary to file or defend an action arising out of the construction, location or existence of the Temporary Encroachment. It is further expressly understood and agreed that nothing herein contained shall be construed to enlarge the permission and authority to permit the maintenance or construction of any encroachment other than that specified herein and to the limited extent specified herein, nor to permit the maintenance and construction of any encroachment by anyone other than the Grantee. It is further expressly understood and agreed that the Grantee agrees to maintain the Temporary Encroachment so as not to become unsightly or a hazard. It is further expressly understood that any existing encroachments referenced in the attached Exhibit or in this Agreement are the ongoing maintenance 3 obligation of the Grantee and the City disclaims any ownership interest or maintenance obligation of such encroachments. It is further expressly understood and agreed that the Temporary Encroachment must conform to the minimum setback requirements, as established by the City. It is further expressly understood and agreed that the Grantee must obtain and keep in effect liability insurance with the City as a named insured in an amount not less than $500,000.00, per person injured and property damage per incident, combined. The company providing the insurance must be registered and licensed to provide insurance in the Commonwealth of Virginia. The Grantee will provide endorsements providing at least thirty (30) days written notice to the City prior to the cancellation or termination of, or material change to, any of the insurance policies. The Grantee assumes all responsibilities and liabilities, vested or contingent, with relation to the construction, location, and/or existence of the Temporary Encroachment. It is further expressly understood and agreed that the City, upon revocation of such authority and permission so granted, may remove the Temporary Encroachment and charge the cost thereof to the Grantee, and collect the cost in any manner provided by law for the collection of local or state taxes; may require the Grantee to remove the Temporary Encroachment; and pending such removal, the City may charge the Grantee for the use of the Encroachment Area, the equivalent of what would be the real property tax upon the land so occupied if it were owned by the Grantee; and if such removal shall not be made within the time ordered hereinabove by this Agreement, the City may impose a penalty in the sum of One Hundred Dollars ($100.00) per day for each and every day that the Temporary Encroachment is allowed 4 to continue thereafter, and may collect such compensation and penalties in any manner provided by law for the collection of local or state taxes.
