An Ordinance to amend Section 106 of the City Zoning Ordinance pertaining
to notices of publication.

•Section 106 (a) of the Zoning Ordinance establishes the requirements
for public notification for the Board of Zoning Appeals.
•The General Assembly recently adopted Senate Bill 413, which
standardizes the requirements for certain public hearings.
•The proposed text amendment makes our ordinance consistent with
State legislation, though current procedures conform with the new
requirements.
•Current procedure is that we advertise the two Wednesdays prior to the
hearing.
•Current requirements of Section 106 (a):
•Notice shall be published once a week for two successive weeks.
•Notice shall be posted not more than fourteen days before the
intended adoption of the item.
•Proposed amendment:
•Notice shall be posted twice in a newspaper, not more than 28
days prior to a meeting. Second notice shall be no less than seven
days before the meeting.
