advertisement was removed •No known opposition DEBBIE ANDERSON | 36 ITEM 11 – CITY OF VIRGINIA BEACH (Slide 1 of 3) An Ordinance to Amend Section 104 of the City Zoning Ordinance pertaining to Short Term Rental Violations CITY OF VIRGINIA BEACH | 37 •Section 104 of the Zoning Ordinance regulates fines and penalties for zoning violations. •Unless noted in Section 104(b), any person who violates the ordinance, upon conviction, is guilty of a criminal misdemeanor. •Currently, violations of the Short Term Rental Ordinance are a civil penalty, as specified in Section 104(b). •STR violations were changed from criminal to civil in September 2020, with the hopes of expediting the enforcement process. •This change proved to be relatively unsuccessful due to state requirements. •The Task Force recommends changing STR violations back to criminal misdemeanors, consistent with all other zoning violations except signage. CITY OF VIRGINIA BEACH | 38 ITEM 11 – CITY OF VIRGINIA BEACH (Slide 1 of 3) ITEM 12 – CITY OF VIRGINIA BEACH (Slide 1 of 4) An Ordinance to Amend Section 241.2 of the City Zoning Ordinance pertaining to Short Term Rentals CITY OF VIRGINIA BEACH | 39 •Short Term Rentals are regulated by Section 241.2 of the Zoning Ordinance. •October 2024, the Short Term Rental Task Force finalized their recommendations to improve the enforcement and regulations of STRS •Recommended amendments included: 1.Updated sign requirements 2.Allow class A, B, and C contractors to provide structural inspections 3.Accept attestations for the registration and renewal processes 4.Amend the parking requirement for grandfathered properties 5.Reduce the frequency of required inspections from 3 to 5 years CITY OF VIRGINIA BEACH | 40 ITEM 12 – CITY OF VIRGINIA BEACH (Slide 2 of 4) •Task Force recommendations considered by the Planning Commission at their July 9th hearing •Recommended approval of the Task Force amendments with the following modifications: 1.Require a minimum of 1 parking space per 2 bedrooms;
