RE: Access Issue at the Former S.P.C.A. Site
Dear Mayor and Council Members:
Attached is a memorandum from Public Works outlining their position in regard to access to
General Booth Boulevard for the former SPCA site. They have detailed the reasoning to support
their position to oppose the access. An area map, which highlights the SPCA site and proposed
changes to General Booth Boulevard as well as the new connection with Oceana Boulevard, is also
attached.
Staff will be available to discuss this matter in further detail at your next City Council meeting
on March 3, 1998.

Subject: ACCESS ISSUE AT THE FORMER SPCA SITE
We have reviewed the preliminary site plan for the development at the old SPCA site located between
General Booth Boulevard and Oceana Boulevard, and south of Prosperity Road. Based on a thorough
review, we are recommending that no access be allowed to the site from General Booth Boulevard.
The three primary reasons why we are opposed to an access are: General Booth Boulevard is a
controlled access highway; an access will conflict with the Virginia Dept. of Transportation CIP project
(First Colonial Road Phase III); and traffic safety will be significantly compromised. Below are
expanded details that support the basis for opposition of an access on General Booth Boulevard.
* General Booth Boulevard is a controlled access, four-lane divided highway.
* General Booth Boulevard is 55 MPH in the vicinity of this proposed site. It changes to
45 MPH approximately 175' south of Prosperity Rd.
* General Booth Boulevard currently carries approximately 29,000 vehicles per day (VPD).
* The future volume of traffic on this section of General Booth Boulevard, after the VDOT
project, is expected to exceed 60,000 VPD.
* The VDOT CIP is being designed to eliminate the current merge and weave problem that
exists further south, just prior to Dam Neck Station.
* The VDOT CIP project will construct an additional through lane (acceleration lane) on
General Booth Boulevard, for a total of 3 through southbound lanes. The new lane is being
designed exclusively to handle the high volume of right turning traffic from Prosperity Rd.
(future Oceana Boulevard connection), traveling southbound on General Booth Boulevard.
It is estimated that this lane will handle approximately 2000 vehicles per hour, which is the
capacity of one lane of arterial highway.

0 There will be approximately 2000 vehicles in this lane and there will be approximately 100
vehicles during the peak hour attempting to merge and weave through this lane to access
the site.
0 Providing access to this proposed site will combine accelerating and decelerating traffic in
a very short distance, and will only recreate the merge and weave problem that presently
exists further south.
0 Southbound General Booth Boulevard traffic destined for the site will have to cross a
minimum of two lanes to access the site.
. Some vehicles in this acceleration lane will be merging and weaving left with the other two
lanes of southbound traffic as they pre-position themselves to turn left at General Booth
Boulevard & Dam Neck Road.
0 The distance between Prosperity Road, and the access to the site is approximately 455'.
a The site will require the installation of a right turn lane. Applying minimum design
standards, the turn lane will need to be at least 400'. This will locate the transition for the
turn lane within the corner radius of Prosperity Road.
* Vehicles in the acceleration lane will need approximately 550' to reach 45 MPH, without
any decelerating vehicles in front of them.
0 There are two other points of access for this site: Ruffian Road & Oceana Boulevard.
In addition, we have reviewed the record on the rezoning approval for this parcel in 1986 (copy
attached). At that time even though Oceana Boulevard was not planned for relocation onto Prosperity
Road, Council recognized the hazardous and congested nature of the intersection and expressed
concern about the curb cut. Today, with the new alignment and projected volumes that concern is even
more accurate. We, therefore recommend against the requested curb cuts as noted above.
Staff is evaluating other options such as the potential purchase of this parcel of property. Based on
this evaluation of alternatives, we will bring a recommendation to you and Council next week. If you

CITY CLERK: Your Honor, the first Application in that of
the Virginia Beach S.P.C.A. for a change of
zoning from AG-2 to B-2 on General Booth Boulevard and Ruffian Road in
the Princess Anne Borough. It is recommended for approval subject to
the dedication of an appropriately sized controlled access and scenic
easement along the frontage on General Booth Boulevard. Charles
Salle' is representing the Applicant.
CHARLES SALLE': Thank you, Mrs. Smith. Mayor and Members of
council, my name is Charles Salle' and I'm an
attorney representing the Applicant, S.P.C.A.
As you can see from the map, this property in located right adjacent
to the Pleasant S.P.C.A. facilities, and although it's recommended for
residential development under the Comprehensive Plan, both the
Planning Commission and Planning Staff have recognized that the
physical development and the zoning of the area, along with the fact
that this property lies in both the crash zone and noise Zones around
Oceana, really make it unsuitable for residential development and they
have recommanded that it be rezoned to commercial.
If you look at that map, you see the AG at the bottom that's been
zoned B-2. If you look at the AG to the left, AG-2, all of that is
recommended for commercial under the Comprehensive code. if you look
at the AG to the right of General Booth, that's recommended for
commercial development. The R-8 on the right of General Booth and at
the top has already been zoned B-2. So I think the precedent for the
commercial zoning has been wall established in that area. if you have
any questions, I would be happy to answer them.
MAYOR HEISCHOBER: Are there any questions of Mr. Salle',
Members of Council?
COUNCILMAN FENTRESS: I just would like to ask is S.P.C.A. going
to use that parcel?
CHARLES SALLE': They probably will sell the entire parcel at
some future date and look to relocate in an
area that's much lose congested.
COUNCILMAN FENTRESS: That means move it away all together?
CHARLES SALLE': Pardon?
COUNCILMAN FENTRESS: That means move it away all together if you
sell that whole thing?
CHARLES SALLE': Yes, sir, that's correct
COUNCILMAN FENTRESS: Thank you.
VICE MAYOR McCLANAN: Mr. Salle', you-all don't mind, as one of the
conditions of the rezoning, combining the two
parcels for the purpose of traffic access for controlled access, so
that we don't - this is a fairly bad intersection as it is right now,
and I would -- I notice there was no mention of combining, you know,
dissolving lot lines or anything. But sense you own both parcels, you
wouldn't object, I assume?
CHARLES SALLE': Well, I think, as a practical matter, it
would be developed as one parcel and the site
plan requirements are going to dictate that the traffic curbcuts and
so forth are going to have to apply to both parcels, so I don't think
we would have a problem with that.
VICE MAYOR McCLANAN: You wouldn't have a problem with that, I see.

MAYOR HEISCHOBER: All right. Mrs. McClanan, are you prepared
for a motion?
VICE MAYOR McCLANAM: Yes, sir. I move that we uphold the
recommendation of the Planning Commission
subject to the condition that is stated as to the dedication of the
appropriately sized controlled access and scenic easement. And, in
addition to that, an additional condition saying that the controlled
access policy for traffic planning will be submitted in conjunction
with the adjacent parcel, which the S.P.C.A. presently owns.
CHARLES SALLE': That's acceptable.
VICE MAYOR McCLANAN: Is that agreeable?
CHARLES SALLE': Yes, ma'am.
COUNCIL LADY CREECH: Second.
MAYOR HEISCHOBER: All right, Motion made and seconded
that the rezoning from to AG-2 to B-2 with
the two conditions. One is stated in the Agenda. The second, as
added by Vice Mayor McClanan, be accepted and it is acceptable by the
Applicant and the vote will soon be open. The vote is open.
CITY CLERK: By a vote of 10 to 0, ou have approved the
change of zoning for Virginia Beach S.P.C.A.
subject to the conditions as stated in the Agenda, plus controlled
access for traffic in accordance with the adjacent property.
