Mayor Robert G. Jones referenced the proposed CERTIFICATE OF OCCUPANCY
Ordinance.
Mayor Jones advised in discussions with Mayor-Elect Oberndorf, the City
Manager, City Attorne3, and City Clerk at the Agenda Meeting on Friday, Jule
24, 1988, the suggestion was to revise the conce,,ot to apply this Ordinance to
rental units only.
Rather than fund a redeveloplient aulhority, it is less expeilsive to maintain
the condition of housing.
Councilman Moss wished first to be aware of the feelings of the com-munity.
Mayor Jones advised samples should be provided of other code provisions
available throughout the Uni@@ed States and a listing of the inspector's check
list should also be provided to interested parties to li.,.Iit anxiety.

Mayor Robert G. Jones entertained a motion to permit City Council to conduct
its EXECUTIVE SESSION, pursuant to Section 2.1-344, Code of Virginia,
as amended, for the following purposes:
1. PERSONNEL 14ATTERS: Discussion or consideration of employment, assignment,
appoi,ntment, promotion, performance, demotion, salaries, disciplining or
resignation of public officers, appointees or employees.
2. PUBLICLY HELD PROPERTY: Discussion or consideration of the condition,
acquisition or use of real property for public purpose, or of the
disposition of publicly held property, or of plans for the future of an
institution which could effect the value of property owned or desirable
for ownership by such institution.
3. PUBLIC YIJNDS INVESTMMT: The investing of public funds where competition or
bargaining is involved, where if made public initially the financial
interest of the governmental unit would be adversely affected.
4. LEGAL MATTERS: Consultation with legal counsel or briefings by staff
members, consultants or attorneys, pertaining to actual or potential
litigation, or other legal matters within the jurisdiction of the public
body.
Upon motion by Councilman Moss, seconded by Councilman Balko, City Council
voted to proceed into EXECUTIVE SESSION.

LIFESAVER AWARD
Mayor Robert G. Jones PRESENTED the VIRGINIA BEACH LIFESAVER AWARD to:
NEVIE SESSOMS
Nevie Sessoms risked his own life by entering his apartinent which was engulfed
by flames and heavy smoke and saving his brother, DuKenino Sessoms.
Nevie was the thi,rd student recognized for a life-saving event by the Virginia
Beach Safety Council in the last year who had completed the fire sa.@ety
training course offered by Chief Diezel in the Virginia Beach Public Schools.
Nevie was also the youngest of the three.

VIRGINIA BEACH LIFESAVER
On May 21, 1988, at aliproximateiy 2:30 p.m., Nevie Sessoms, eleven years of age, left the basketball
court to return home. Ul)on entering his apartment building, he observed smoke coming from under
the door. He opened the d()or to find the apartment filled with heavy smoki and the T.V. set in flames.
He called to his 8 year-old brother, DuKenino Sessoms. DuKenino;.ttempted to extinguish the fire
with water. When that failed, DuKenino panicked, and he refused to c()me out of the bedroom. Nevie
had to go past the fire and pull his brother out of the apartment bu-Ilding. Nevie then went to the
neighbor's house and dialed 911.
Nevie risked his own life by entering the apartment which was engulfed by flames and heavy smoke.
Due to Nevie's actions, his brother is alive and well today.

Mayor Robert G. Jones PRESENTED a RESOLUTION IN RECOGNITION to:
DR. RICHARD T. CHENG
This RESOLUTION recognized Dr. Cheng's contribi)tions as an entrepreneur and
businessman to the City of Virginia Beach.
Working nights and weekends, Dr. Cheng established Eastern Computers, Inc. Dr.
Cheng assisted the Virginia Beach Department of Economic Development by
introducing the Director of Computer Science in the Ministry of Foreign Trade
from Beinjing, China, as well as a repre,@entative of Governor Ho of Henan
Province, Peoples Republdc of China. Dr. Cheng has established joint ventures
in exporting his products from Virginia Beach.

Curtis Strange captured the 1988 United States Open Championship in the June
20, 1988, play-off against Nick Faldo, the reigning British Open Champion, at

WHEREAS, Ralph Lane visited the Chesapeake Indians in
1585 and chose a site on Chesapeake Bay for his future
settlement; and
WHEREAS, the members of the expedition of 1587 were left
at Roanoke Island against their will since the navigator,
Simon Ferdinando, would not take them to their destination on
Chesapeake Bay; and
WHEREAS, it is believed that the expedition of 1587
proceeded overland to their intended destination and that
they spent about twenty years at their settlement on Chesa-
peake Bay; and
WHEREAS, it was reported by the Jamestown Colonists of
1607 that there were men who "dressed as we doll living in
"stone houses of two storeys" within fifty miles of
Jamestown; and
WHEREAS, it was said that almost all of the Chesapeake
Indians and first English settlers were killed by Powhatan
just prior to the arrival of the Jamestown Colonists; and
WHEREAS, the Jamestown Colonists were told by the
Indians that they could not speak to the settlers of circa
1588, probably because they had been killed.
NOW, THEREFORE, I, Robert G. Jones, Mayor of the City of
Virginia Beach, do hereby proclaim the year One Thousand Nine
Hundred And Eighty-eight as the

8365, represented the applicant. Attorney Pickrell distributed an artist's
rendering of a colonial-type convenience store and canopy for this location.
The existing freestanding identification sign will be reduced from twenty feet
in height to sixteen feet in height and from eighty square feet to fifty-three
square feet.
Mr. Cary Lloyd, Real Estate Engineer for Exxon, responded to City Council's
inquiries. Mr. Lloyd advised Exxon tried to project their standard design.
Councilman Moss referenced the letter dated June 24, 1988 from C. D. Stevens,
Engineering Manager, Exxon Company, U.S.A., advising of Exxon's intent to
remain a good corporate citizen and continuing to do business in Vdrginia
Beach. Exxon is committed to their standard design; however, since Thalia is a
very established neighborhood to which a colonial design may be suited, Exxon
has agreed to specifically design a colonial-type convenience store and canopy.

RFSOLUTION IN RFCOGNITION
WHEREA,S The history of America is one of a nation of people helping
people -- joining together to build a better society with
iridividual initiative and intense pride;
WHEREAS: Dr. RICH&RD T. CRENG, who was born in China and later lived
in Taiwan, came to the United States where he received his
Masters in Electrical lhgineering in 1969 with his Doctorate
in Computer Science from the University of Illinois in 1971.
He organized and directed the Department of Computer Science
at Old Dominion University and received the distinguished
honor of "Professor - Emeritus" at ODU;
WHEREAS: Energy and stamina, pursuit of happiness and dedication to
purpose vaulted him toward his goal and accomplished his
mission to establish his own business, Eastern Computers,
Incorporated, in 1980. His wife, Nancy, and their son,
Jimmy, cond uc ted the day-to-day business during the
formative years so he could continue his professorship at
ODU until 1985 when he took a leave of absence to become
full time CEO of his company;
WHEREAS: Dr. Cheng assisted the Virginia Beach Departinent of Economic
Developinent by introducing the Director of ODmputer Science
in the Ministry of Foreign Trade from Beinjing, China, as
well as a representative of Governor Ho of Henan Province,
Peoples Republic of China. Since that initial introduction,
Dr. Cheng has established joint ventures in exporting his
products from Virginia Beach. Most recently, the President
of the China Central machinery Imi)ort and Export Corporation
visited his office and plant in Virginia Beach. Currently,
Dr. Cheng is working with a Saudi Arabian delegation from
the Ministry of the Interior on the establishment of an
R & D Center at his present office in Virginia Beach; and,
WHEREAS; Dr. Cheng has made considerable contributions to the
economic development of Virginia Beach and has become an
outstanding Arnbassador.

RESOLUTIO14 IN RECOGNITION
WHEREAS: knerica was built on individual initiative, competitive
spirit and intense pride;
WHEREAS: Curtis Northrup Strange graduated from Princess Anne High
School in 1973, having been the Virginia State Junior
Champion in 1970; back-to-back State High School Team
Champion with his twin brother, Al-lan, in 1972 and 1973;
individual NCAA Champion as a freslnan at Wake Forest
university in 1974; duplicated his late father's Eastern
Ain a te ur Championship in 1975; Virginia State Aniateur
Champion in the North and South, 1975 and 1976; earned his
PGA Thur card in 1977; won the Pensacola Open PGA in 1979;
1980, realized three PGA Tour Championships; 1982, set the
record for "most money earned in a calendar year without a
victory"; 1985, was named "Golf Writers Player of the Year";
1987, four victories included his second Canadian Open and
the prestigious World Series of Golf; and 1988, won four
tournaments, including the Jack Nicklaus' Memorial and the
UNITED STATES OPEN.
W@S: Cartis Strange is the first Virginian to win the United
States Open in forty-one years -- In 1947, Lee Worsham,
another Virginian, captured this most coveted championship
in Golf;
WHEREAS: Curtis Strange captured the 1988 United States Cpen
Championship in the June 20, 1988, play-off against Nick
Faldo, the reigning British Cpen Champion, at THE COUNTRY
CLUB, Brookline, Massachusetts. nis was only the twenty-
eighth play-off in the history of the American National
Championship; and,
WHEREAS: Curtis Strange grew up in golf by borrowing his father's
clubs and dreaming of winning the U S Open. Tom Strange was
the Pro at Bow Creek Golf Club until his untimely death in
1969. In dedicating his championship win to his father, he
remembered the early mornings and long bours his father
worked at Bow Creek and the many times his father taught him
the game basics %hich act@ly made this childhood dream
becorne a reality. Curtis Strange reached the game's summit
by winning a major championship--the only one that was real
to him as a dream throughout his entire life.

participation in interscholastic athletics. @ssons in
sportsmanship, teamwork, competition and how to win and lose
gracefully are an integral part of each team in the athletic

the individual student develop a healthy self-concept as
well as a healthy body. Athletic competition adds to the
school spirit and helps all students--spectators as well as
participants--develop pride in their school;

Peninsula Districts comprise the Fastern Region. Kempsville
High School, as a member of the district and regional
councils within the Virginia High School League, is

AN ORDINANCE TO APPROPRIATE FUNDS IN THE AMOUNT OF
$990,000 TO THE WATER AND SEWER OPERATING BUDGET
FOR THE PURCHASE OF HOLLAND UTILITIES AND TO AUTHORIZE
THE CITY t4ANAGER TO ENTER INTO A CONTRACT FOR THE PURCHASE
WHERFAS, in 1977, the Mayor's Water and Sewer Committee recommended
that the city acquire all of the non-city owned water and sanitary sewer
utilities within the city, and
WHEREAS, on February 24, 1986, the City Council authorized a study to
provide a valuation of Holland ULilities sewer facilities with the report issued
on September 10, 1986, and
WHEREAS, Holland Utilities is currently suing the city for purloining
customers with the suit pending liligation, and
WHEREAS, Holland Utilities has offered to sell the utility for a
purchase price of $990,000, and
WHEREAS, based upon the report of the consulting firm, and with the
potential damages that may occur through litigation of the law suit, it would be
prudent for the city to purchase Holland Utilities, and
WHEREAS, the amount of $990,000 needed Lo purchase Holland Utilities
may be obtained from the Water and Sewer Enterprise Fund.
NOW, THEREFORE, BE IT ORDAINED BY TIJE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA that funds in the amount of $990,000 are hereby appropriated from
Retained Earnings to the Water and Sewer Operating Budget in the Water and Sewer
Enterprise Fund for the purchase of Holland Utilities.
BE IT FURTHER ORDAINED, that the City Manager is hereby authorized Lo
enter into a contract for the acquisition of Holland UtiliLies.

personnel positions, 2.5 new part-time City positions and conversion of two part-

WHEREAS, the details and amounts of this funding were not available for
inclusion in the Proposed FY 88-89 City of Virginia Beach operating Budget and,
WHEREAS, no matching funds from the City are required for these funds,

FOR PAYMENT OF THE BALANCE ON THE LEASE/PURCHASE
CONTRACT OF FOUR REFUSE COLLECTION VEHICLES
REAS, the City of Virginia Beach in order to maintain the health,
safety and welfare of iLs citizens provides refuse collection and disposal
services, and
WHEREAS, the Department of Public Works, Bureau of WasLe Collection
collects approximately 160,000 tons of refuse annually accounting for over
900,000 vehicle miles traveled annually, and
WHEREAS, four refuse collection vehicles purchased through a
lease/purchase contract are no longer used by waste disposal crews and are
available for sale as surplus equipment, and
WHEREAS, prior to the sale of surplus equipment it is necessary to pay
off the balance on the lease/purchase agreement for the four refuse collection
vehicles equaling $76,419, and
WHEREAS, there are excess appropriations in the Bureau of Waste
Disposal's SPSA Disposal Charges account available for the balance of the
lease/purchase agreement to be paid in full.
NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA, that funds to pay in full the current balance on the
lease/purchase agreement for four refuse collection vehicles in the amount of
$76,419 are hereby approprialed to the Ceneral Debt Fund with a corresponding
increase in estimated revenue from the Ceneral Fund, and
BE IT FURTHER ORDAINED that funds in the amount of $76,419 in the
General Fund be transferred from the Bureau oE Waste Disposal's SPSA Disposal
Charges to Transfers to the General Debt Fund.
This ordinance shall be in effecl from Lhe date of its adoption.

VIRGINIA BEACH, VIRGINIA, AS SHOWN ON THAT CERTAIN PLAT
ENTITLED, "PLAT SHOWING PROPOSED STREET CLOSURE OF
WESTERN TERMINUS OF BUSHNELL DRIVE LOCATED BETWEEN
BLOCKS 29 & 30, CROATAN BEACH, M.B. 24, P. 37, LYNNHAVEN
BOROUGH, VIRGINIA BEACH, VIRGINIA", WHICH PLAT IS RECORDED
IN THE CLERK'S OFFICE OF THE CIRCUIT COURT OF THE CITY
OF VIRGINIA BEACH, VIRGINIA, IN MAP BOOK AT
PAGE
WHEREAS, it appearing 8y affidavit that propec
notice has been given by Kenneth L. Seay, Sr., that it
would make application to the Couhcil of the City of
Vicginia Beach, VIrginia, on , to
have the hereinafter described street discontinued,
closed, and vacated; and
WHEREAS, it is the judgment of the Council
that said street be discontinued, closed, and vacated;
NOW, THEREFORE,
SECTION I
BE IT ORDAINED by the Council of the City of
Virginia Beach, Virginia, that the hereinafter described
street be discontinued,, closed, and vacated:
ALL THAT certain parcel of land being the
western terininus of Bushnell Drive located between
Parcel 29 (Block 48) and Parce@@(13lock 49) on the
Plat of Croatan Beach, made by Wi@iam ?-. McMillan,
C.E., dated July 4, 1949, and recorded in the Clerk's
Office, Circuit Court, Virginia Beach, Virginia at
Map Book 24, page 37, and being more particularly
described as follows:
BEGINNING at a pin on the southern side of
the Bushnell Drive 50' right of way, which pin marks
the boundacy between Lot 10 and Lot 11 on the plat
of "SUBDIVISION OF PROPERTY, PARCEL 29 - BLOCK 48,
CROATAN BEACH, M.B. 24, P. 37, LYNNHAVEN BOROUGH,
VIRGINIA BEACH, VA" prepared by Gallup Surveyors and
Engineers, Ltd. dated May 27, 1987, and last revised
October 29, 1987, recorded in the aforesaid Clerk's
Office at Deed Book 2702, page 1049, and proceeding
along Bushnell Drive N 45'00'00" W 20.12 feet to a
pin, the TRUE POINT OF BEGINNING; thence along Bushnell
Drive on a curve to the right, having a radius of 60.00
feet, a distance of 84.25 feet to a pin; thence 10.29
feet to a pin; thence reversing dicection and pro-
ceeding along a curve to the right having a radius
of 10.00 feet, a distance of 16.00 feet to a pin;
thence N 45'00'00" W 70.38 feet to a pin; thence along
a curve to the right having a radius of 20.00 feet,
a distance of 30.63 feet to a pin on the eastern side
of the cight of way of General BQoth Boulevard; thence
reversing direction and proceeding along General Booth
Boulevard on a curve with a radius of 1186.00 feet,
a distance of 69.23 feet to a pin; thence S 45'00'00"E
156.81 feet to the TRUE POINT OF BEGINNING. (Portion
to be vacated is designated as 5855.30 sq. ft. of
Bushnell Drive).
Said parcel of land being a portion of Bushnell
Drive as indicated on that certain plat of propecty to
be vacated along existing Bushnell Drive, which plat is
recorded in the Clerk's Office of the Circuit Court of
the City of Virginia Beach, Virginia, in Map Book
at page and which is made a part hereof by
reference.
SECTION II
A certified coi)y of this Ordinance shall be
filed in the office of the Circuit Court of the City
of Virginia Beach, indexed in the name of the City of
Virginia Beach, as grantor.
SECTION III
This Ordinance shall be effective sixty (60) days from the
date of its adoption.
