Jones in the Conference Room, City Hall Building, on Monday, May 18, 1987, at 10:38 P.M. Council Members Present: Albert W. Balko, Harold Heischober, Barbara M. Henley, Mayor Robert G. Jones, Reba S. Fentress was on vacation. - 2 - MAT T E R S BY MAYOR ITEM # 27383 Mayor Jones advised a BRUNCH had been SCHEDULED on June 8, 1987, at 10:30 at the Marine Science Museum in Honor of the new School Superintendent, Dr. James E. Melvin. This BRUNCH is sponsored by Messrs Fletcher and Clyburn - NOT from public funds. The City Manager advised of a Conflict concering the dedication of the new City Book Mobile in the front of City Hall commencing at 11:00 A.M. Certain Members of City Council shall speak. Mayor Jones referenced whether it was possible to move the dedication of the Book Mobile to 11:30 A.M. ITEM # 27384 Mayor Jones referenced the TWENTY-FIFTH ANNIVERSARY CELEBRATION COMITTEE. As no guidelines had been presented to Chairwoman Creech concerning the activites of said Committee, Chairwoman Creech had suggested various events commencing January First and culminating with the Neptune Festival in September. There is approximately $25,000 in the Budget which is very modest in comparison with Chairwoman Creech's appropriate celebration. By CONSENSUS, Chairwoman Creech will meet with the TWENTY-FIFTH ANNIVERSARY CELEBRATION COMMITTEE and make a presentation to City Council concerning their proposed activities and the itemized cost. - 3 - C I T Y C 0 U N C I L C 0 N C E R N S ITEM # 27385 Councilman Moss referenced the VML EFFECTIVE GOVERNMENT POLIGY GOMMITTEE Meeting in Richmond on Wednesday, May 20, 1987 at 10:00 A.M. Councilman Moss referenced the Policy Statement they are proposing. Another Meeting is scheduled for July 30, 1987, for FINAL ADOPTION of the POLICY. Copies of said Policy Statement will be distributed to City Council. ITEM # 27386 Councilman Balko reiterated his concerns relative numerous cars in Virginia Beach which only have one license plate. Councilman Heischober advised during World War II, the State did have only one license plate. After many discussions, the opinion of the Police and Commissioner of Motor Vehicles was to utilize two license plates. Approximatley thirty of the fifty states within the United States have two license plates. Twenty have only one license plate. Councilman Balkols concerns were relative individuals who remove the front plate and perhaps use same on a second vehicle. ITEM # 27387 Councilwoman Henley advised an invitation had been extended to the Members of City Council, City Staff and their familiies to attend the Fireworks' Display at HARBORFFST. James Echols, Executive Director of the TIDEWATER TRANSPORTATION DISTRICT COMMISSION, will arrange transportation for City Council and Staff from the Municipal Center on Saturday, June 6, 1987. Councilwoman Henley will advise the details relative time when arrangements have been made. ITFM # 27388 Councilwoman Henley referenced the NEEDS ASSESSMENT for the THIRTEENTH PROGRAM YEAR OF THE COMMUNITY DEVELOMENT BLOCK GRANT PROGRAM Public Hearing on February 23, 1987. Several people spoke relative problems of the HOMELESS. Councilwoman Henley advised of a telephone call from Mr. Powell relative a program he wished to institute for the HOMELESS. Before too much involvement occurs in specific projects, there should be a a City Staff summary presented with recommendations concerning the problem. ITEM # 27389 Councilwoman Parker referenced the APPEAL AGENDA of the BOARD OF ZONING APPEALS for Wednesday, May 20, 1987, relative True Value Homes Center of Tidewater, Inc. and Tidewater Imports, Inc. T/A Hall Auto Mall concerning the issuance of certain sign permits. Councilwoman McClanan advised City Attorney Bill Macali had prepared a brief and will be a representative at the Board Meeting. Councilwoman McClanan will also be in attendance. - 4 - ITEM # 27390 The INFORMAL SESSION of the VIRGINIA BEACH CITY COUNCIL was called to order by Mayor Robert G. Jones in the Conference Room, City Hall Building, on Monday, May 18, 1987, at 10:50 A.M. Council Members Present: Albert W. Balko, Harold Heischober, Barbara M. Henley, Mayor Robert G. Jones, Reba S. McClanan, John D. Moss, Vice Mayor Meyera E. Oberndorf, Nancy K. Parker and John L. Perry Council Members Absent: John A. Baum and Robert E. Fentress - 5 - PRESENTATIONS MASTER STREET AND HIGHWAY PLAN/SOIJTHF.ASTERN EXPRFSSWAY ITEM # 27391 Relative the Corridor of the SOUTHEASTERN EXPRESSWAY, the City Staff reflected the major arterials planned and their location in relation to the SOUTHFASTERN EXPRESSWAY. Robert J. Scott, Director of Planning in conjunction with William Cashman, Planner II, depicted how the SOUTHEASTERN EXPRESSWAY alignment compares with other roads on the 14ASTER STREET AND HIGHWAY PLAN. The most improtant road close to same would be Ferrell Parkway. Of lesser importance, the extension of Rosemont Road. This CORRIDOR has been shifted farther to the south over the last several months. The reason for the realignment has to do with the concern for environmental issues certain to arise during more detailed study and evaluation of alternative alignments with regard to the State's efforts. There are two essential items involving the CORRIDOR: (1) The need to determine a more specific alignment. The State has hired a Consultant firm to develop an exact alignment; however, this will entail approximately a year and 'half to two years. (2) A Policy for Safeguarding said alignment, once established. Robert Scott reiterated the potential impact of moving the CORRIDOR. as it was a number of months ago, further to the north. There is one particular point of of interest, there must be found a way to cross West Neck Creek. There have been preliminary discussions with agencies involved and while it may be possible to move the CORRIDOR further north, these agencies are not in a position now to say but there will be a great deal of concern expressed at the appropriate time. The element of cost must be kept in mind. If there is someway to bridge the Wetlands in the area, it will not be done inexpensively. This CORRIDOR is now moved closer to the Pine Ridge Subdivision and further away from the Lake Placid Subdivision. The Staff is aware of the consequences of placing the CORRIDOR close to existing subdivisions. The locations of interchanges were reiterated by Bill Cashman: Starting at the North, Interchange with 44 Heading South, First Colonial Road reclocated at Oceana Boulevard Main Gate of Oceana and Oceana Boulevard Dam Neck Road Extended (Possibly) London Bridge Road. Princess Anne Road, North of the Courthouse Indian River Road, before crossing into Chesapeake. From Ferrell Parkway west, where Indian River Road and Ferrell Parkway come together, the Harland Barthlomew Study concluded that without the Southeastern Expressway, at least 10 lanes would be needed in that area west to the Interchange with 64. The current 14ASTER STREET AND HIGHWAY PLAN has eight lanes with controlled access. Close to 80,000 cars per day by the year 2010 are projected as one approaches the Interstate 64 interchange from Indian River Road. Without the SOUTHFASTERN EXPRESSWAY, this number would rise above 100,000. Oceana Boulevard in the northern section shall parallel the CORRIDOR or become a portion of the CORRIDOR. There shall be six lanes in this section. Birdneck Road adjacent to same shall be four-lane divided. General Booth Boulevard parallel to the other side shall have six-lanes. As cost-effectiveness needs to be addressed, some reconsideration of these aspects might be in order at the appropriate time. - 6 - PRESENTATIONS mASTER STREET AND HIGHWAY PLAN/SOUTHFASTERN EXPRESSWAY ITEM # 27391 (Continued) Prior to the SOUTHF.ASTERN EXPRESSWAY, the City was anticipating the widening of Oceana Bouelvard to a four or six-lane arterial. Robert Scott advised the City's employment patterns need to be critically examined. Private enterprise shall also have a say in this. The State is utilizing C. E. McGuire as their consultant. The Consultant's responsibility basically is to produce an alignment. The State has not yet chosen someone to peform a toll feasibility study. Three questions need to be addressed regarding a desirable policy for employment distribution: (1) What type of policy or employment for job distribution would be desirable? (2) What may be done to accomplish same? (3) What does the above have to do with the transportation system? Mayor Jones referenced inquiring of the Urban Land Institute whether they would have an interest for a reasonable sum of money in determining the appropriate land use along that CORRIDOR. Vice Mayor Oberndorf referenced the possibility of utilizing the UNIVERSITY OF VIRGINIA's Environmental Mediation. Williamsburg, James City and York County utilized their services. The AICUZ extends a little south of Dam Neck. The City has to examine acquisition of certain critical, stragetic parcels. There are no funds from the State for this. Same must be funded by the City and there are no funds budgeted for this in the Capital Improvement Program. The SOUTHEASTERN EXPRESSWAY provides another way to move traffic within the City. Presently there are three ways in and out of the City. The SOUTHFASTERN EXPRESSWAY adds a fourth way. If the SOUTHKASTERN EXPRESSWAY were not developed, the City would have to stregthen the three aforementioned connecting routes and develop a strategy within the City to include more jobs in key locations within the City thus diminishing the relative need to travel in and out across the City's boundaries. The Study the State has authorized by C. E. McGuire is to determine the poposed CORRIDOR or route of the SOUTHEASTERN EXPRESSWAY. Jerald Banagan, Real Estate Assessor, was requested to determine the value of the property in the "hot" spots, those points likely to be required for acquisition. The tax consequences of this situation shall also be identified. - 7 - PRESENTATIONS CONCEPT AND OPERATION OF THE HOV LANES CONTROL CENTER BUILDING AND PARKING LOT AT INDIA14 RIVER ROAD ITEM # 27392 The following were in attendance to explain the concept and operation of the HOV LANES and the Control Center Building and Parking Lot at Indian River Road: Frank Dunn, Transporation Planner; Bruce Clark, Assistant Transportation Planning Engineer; Denis Gribok, Resident Engineer - Virginia Department of Transportation; Jim Cleveland, Assistant District Engineer - Virginia Department of Transportation; Charlie Rasnick, Transportation Planning Engineer - Virginia Department of Transportation; and, Marvin C. Gersten, Executive Vice President, URS Corporation. The solution of HOV LANES (special lanes in major highways for vehicles carrying three or more persons) is utilized to move more people in less time. In Tidewater, the HOV solution is targeted at the two major thoroughfares crisscrossing the region - Virginia Beach/Norfolk Expressway and the heavily traveled segment of Interstate 64. More than 200,000 vehicles utilize this intersection each day. Route 44 is the most heavily traveled road in South Hampton Roads and the most traveled in the State. During rush hour, Route 44 carries over 30% more traffic over the amount for which it was designed. Two HOV diamond lanes have been added to the Expressway, one in each direction or concurrent with the flow of traffic in the adjacent lane. During weekday peak traffic periods, these diamond lanes are exclusively for vehicles carrying three or more persons. In non-rush hour periods, these diamond lanes provide an extra avenue for all traffic. The Expressways' HOV lanes are being introduced in two stages: First Stage: HOV Lanes extend on Route 44 from the vicinity of Newtown Road eastward to the main line Toll Plaza, a distance of approximately 5 miles. Second Stage: HOV Lanes continue east from the Toll Plaza to Laskin Road, a distance of ten miles. Special lanes for HOV Traffic at the Toll Plaza are also coming with the Second Stage. HOV will be extended to Interstate 64 intitally along the seven-mile segment from I-564 to I-264. Here, the HOV Lanes will be set off in a physically separated facility from the main roadway. The direction of traffic will be reversed in accordance with the rush hour flow. Eventually, HOV will continue from the Intersection with I-264 to Indian River Road, a distance of 2.6 miles. This stretch of I-64 will be widened to include an additional conventional lane and a diamond HOV Lane in each direction. The HOV plan for Tidewater has been designed to provide dramatic relief to the City's unique traffic problems. HOV can actually improve travel time by as much as a minute a mile for commuters who elect to utilize these special lanes. For an example, the trip from the main line Toll Plaza west to I-64 should become approximatly 5 minutes faster than current non-HOV traveling times. Similarly, vehicles moving from I-564 down to Indian River Road during rush hour should experience a 20-minute time savings. There is a fine of four points on an individual's license and up to a $100 fine, if one is in an HOV Lane with a vehicle capacity of less than three people. The Courts are also charging the individuals with court costs. The HOV Lanes are conventional other than they are restricted during the peak travel times in the morning in the westbound lane between 6:00 and 9:00 A.M. and in the evening in the eastbound lane between 3:00 and 6:00 P.M. - 8 - PRESENTATIONS CONCEPT AND OPERATION OF THE HOV LANFS CONTROL CENTER BUILDING AND PARKING LOT AT INDIAN RIVER ROAD ITEM # 27392 (Continued) Frank Dunn, Transportation Planner, reiterated the various statistics concerning HOV traffic counts: EASTBOUND DIRECTION October 7 217 December 9 318 March 16 310 April 8 380 MaY 13 434 WESTBOUND DIRECTION October 8 141 December 10 249 March 17 205 April 9 125 May 14 253 The Federal Highway Administration has just recently APPROVED the Construction of a temporary ramp situated in the Interstate Complex of 64, 44 and 264. This ramp will connnect with 44 westbound to the 64 eastbound ramp to the 264 eastbound to the 64 westbound. This should be advertised late this summer and in place early 1988. The HOV Lane will have its own Toll Plaza during the hours of operation and will take quarters, as well as script. The Highway Hotline Phone Number is: 1-800-367-ROAD. Marvin Gersten, Executive Vice President, URS, advised the State engaged URS to perform a concept and final design study of the traffic control system that will operate and supervise the reversible lanes between 564 and between 44 and Indian River Road where they terminate. In addition to the traffic control system for that specific stretch, the system is being designed to have expansion capability to be able to include traffic surveillance and control on virtually the entire Interstate freeway system in the Tidewater area. As part of this system, there shall be a control center to be located at the northwest quadrant of I-64 and Indian River Road adjacent to the new or proposed commuter HOV Parking Lot. Same shall be a one-story colonial style building and shall house the control system, the computer, a room with monitors for the television cameras. It will have the ability through operator control to reverse the direction of the reversible roadway every day in a safe manner. There will be disc type changeable message signs at the entrance and the entrance points to the reversible roadway. There will be one on 1-564 where it comes into 64, the northwestern end of 64, north of 564, at Route 44 and at the eastern terminus just north of Indian River Road. The building and lot shall be adequately landscaped conforming to City standards. The City Manager advised the intersection that needs to be addressed regarding the HOV Lane on 64 is the intersection with North Hampton Boulevard. As there are no plans for an a HOV intersection with this particular facility, the reasons for this were requested in writing. - 9 - ITEM # 27393 Mayor Jones entertained a motion to permit City Council to conduct its EXECUTIVE SESSION pursuant to Section 2.1-344, Code of Virginia, as amended, for the following purposes: 1. PERSONNEL MATTERS: Discussion or consideration of employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining or resignation of public officers, appointees or employees. 2. PUBLICLY HELD PROPERTY: Discussion or consideration of the condition, acquisition or use of real property for public purpose, or of the disposition of publicly held property, or of plans for the future of an institution which could affect the value of property owned or desirable for ownership by such institution. 3. LEGAL MATTERS: Consultation with legal counsel or briefings by staff members, consultants or attorneys, pertaining to actual or potential litigation, or other legal matters within the jurisdiction of the public body. Carlton Bowyer advised Salem High School should be on Schedule with the August 1987 Opening. The completion of the Princess Anne High School Air Conditioning should be by October 31, 1987. Carlton Bowyer advised there was a Projected Project Balance of $1,400,000 in the Princess Anne High School Renovation Project. $100,000 would be used as a contingency until the completion of the project. Salem High School was funded at the time with no site. A site had been anticipated which did not come to fruition (the Spence Farm). The Site was not acquired until April 1985. As a 5 1/2 hour-day is now required and a 22-credit diploma, the flexibility within a a building is lost. A 236,000 square foot building with 2,000 students is now 258,862 square feet. The Bond Counsel has advised approval of the transfer is within the authority of City Council. David Grochmal advised the List of Decisions regarding the Judical Genter Project: I. Location of the Judicial Center A. West end of the Municipal Center B. Lease/Purchase B. Referendum Bonds C. Charter Bonds These major policy questions must be answered to proceed with the Judicial Center Project. The Staff has met with each State Legislator from Virginia Beach to discuss the possibilities of enabling legislation to establish local user fees to pay for the Judicial Center Project. A summary of the Legislators' responses is hereby made a part of the record. The City Staff and Consultant recommended the location of the Judicial Genter be located at the west end of the Municipal Genter. A tour by the City Council Members of the Virginia Beach Court Buildings and the new Fairfax Court Center was recommended. Vice Mayor Oberndorf had suggested a Tour could be arranged when Members of City Council attended the Virginia Municipal League Conference in September which will be in Fairfax County. David Grochmal suggested User Fees be considered by City Council as the primary source for funding of this project. A secondary source would be rental from State Agencies; however, this might not provide very sufficient funds. Once the mood of the General Assembly is determined and enough User Fees can be collected to pay for the entire building, at that point City Council can decide if they must come up with Local Taxes to pay the balance. The fourth decision is relative Funding. Mr. Grochmal recommended Lease/Purchase with Certificates of Participation as the most advantageous method of Funding. BY CONSENSUS, a Resolution was SCHEDULED for the City Council Meeting of June 8, 1987 to determine the Location of the Judicial Center, the Revenue Stream and the Funding. - 41 - Item III-L.1 NEW BUSINFSS ITEM # 24721 ADD-ON Vice Mayor Oberndorf extended an Invitation to the Members of City Council on behalf of the Association for the Preservation of Virginia Antiquities, the Southeastern Chapter. The Majority of the Federal funds is contained in the School Operating Fund. A very small amount is received into the General Fund. Relative Page 3, the Analysis of the Building Permits, the increase in the water resource recovery fee rate on July 1, 1986 caused the sale of building permits to accelerate prior to June 30, 1986.
