The COUNCIL CONCERNS SFSSION of the VIRGINIA BEACH CITY COUNCIL was called to
order by Mayor Robert G. Jones in the Conference Room, City Hall Building, on
Monday, May 18, 1987, at 10:38 P.M.

Mayor Jones advised a BRUNCH had been SCHEDULED on June 8, 1987, at 10:30 at
the Marine Science Museum in Honor of the new School Superintendent, Dr. James
E. Melvin. This BRUNCH is sponsored by Messrs Fletcher and Clyburn - NOT from
public funds.
The City Manager advised of a Conflict concering the dedication of the new City
Book Mobile in the front of City Hall commencing at 11:00 A.M. Certain Members
of City Council shall speak.
Mayor Jones referenced whether it was possible to move the dedication of the
Book Mobile to 11:30 A.M.
ITEM # 27384
Mayor Jones referenced the TWENTY-FIFTH ANNIVERSARY CELEBRATION COMITTEE. As
no guidelines had been presented to Chairwoman Creech concerning the activites
of said Committee, Chairwoman Creech had suggested various events commencing
January First and culminating with the Neptune Festival in September.
There is approximately $25,000 in the Budget which is very modest in comparison
with Chairwoman Creech's appropriate celebration.
By CONSENSUS, Chairwoman Creech will meet with the TWENTY-FIFTH ANNIVERSARY
CELEBRATION COMMITTEE and make a presentation to City Council concerning their
proposed activities and the itemized cost.

ITEM # 27385
Councilman Moss referenced the VML EFFECTIVE GOVERNMENT POLIGY GOMMITTEE
Meeting in Richmond on Wednesday, May 20, 1987 at 10:00 A.M. Councilman Moss
referenced the Policy Statement they are proposing. Another Meeting is
scheduled for July 30, 1987, for FINAL ADOPTION of the POLICY. Copies of said
Policy Statement will be distributed to City Council.
ITEM # 27386
Councilman Balko reiterated his concerns relative numerous cars in Virginia
Beach which only have one license plate.
Councilman Heischober advised during World War II, the State did have only one
license plate. After many discussions, the opinion of the Police and
Commissioner of Motor Vehicles was to utilize two license plates. Approximatley
thirty of the fifty states within the United States have two license plates.
Twenty have only one license plate. Councilman Balkols concerns were relative
individuals who remove the front plate and perhaps use same on a second
vehicle.
ITEM # 27387
Councilwoman Henley advised an invitation had been extended to the Members of
City Council, City Staff and their familiies to attend the Fireworks' Display
at HARBORFFST. James Echols, Executive Director of the TIDEWATER TRANSPORTATION
DISTRICT COMMISSION, will arrange transportation for City Council and Staff
from the Municipal Center on Saturday, June 6, 1987. Councilwoman Henley will
advise the details relative time when arrangements have been made.
ITFM # 27388
Councilwoman Henley referenced the NEEDS ASSESSMENT for the THIRTEENTH PROGRAM
YEAR OF THE COMMUNITY DEVELOMENT BLOCK GRANT PROGRAM Public Hearing on February
23, 1987. Several people spoke relative problems of the HOMELESS. Councilwoman
Henley advised of a telephone call from Mr. Powell relative a program he
wished to institute for the HOMELESS. Before too much involvement occurs in
specific projects, there should be a a City Staff summary presented with
recommendations concerning the problem.
ITEM # 27389
Councilwoman Parker referenced the APPEAL AGENDA of the BOARD OF ZONING APPEALS
for Wednesday, May 20, 1987, relative True Value Homes Center of Tidewater,
Inc. and Tidewater Imports, Inc. T/A Hall Auto Mall concerning the issuance of
certain sign permits.
Councilwoman McClanan advised City Attorney Bill Macali had prepared a brief
and will be a representative at the Board Meeting. Councilwoman McClanan will
also be in attendance.

ITEM # 27391
Relative the Corridor of the SOUTHEASTERN EXPRESSWAY, the City Staff reflected
the major arterials planned and their location in relation to the SOUTHFASTERN
EXPRESSWAY.
Robert J. Scott, Director of Planning in conjunction with William Cashman,
Planner II, depicted how the SOUTHEASTERN EXPRESSWAY alignment compares with
other roads on the 14ASTER STREET AND HIGHWAY PLAN. The most improtant road
close to same would be Ferrell Parkway. Of lesser importance, the extension of
Rosemont Road. This CORRIDOR has been shifted farther to the south over the
last several months. The reason for the realignment has to do with the concern
for environmental issues certain to arise during more detailed study and
evaluation of alternative alignments with regard to the State's efforts.
There are two essential items involving the CORRIDOR:
(1) The need to determine a more specific alignment.
The State has hired a Consultant firm to develop
an exact alignment; however, this will entail
approximately a year and 'half to two years.
(2) A Policy for Safeguarding said alignment, once
established.
Robert Scott reiterated the potential impact of moving the CORRIDOR. as it was
a number of months ago, further to the north. There is one particular point of
of interest, there must be found a way to cross West Neck Creek. There have
been preliminary discussions with agencies involved and while it may be
possible to move the CORRIDOR further north, these agencies are not in a
position now to say but there will be a great deal of concern expressed at the
appropriate time. The element of cost must be kept in mind. If there is someway
to bridge the Wetlands in the area, it will not be done inexpensively.
This CORRIDOR is now moved closer to the Pine Ridge Subdivision and further
away from the Lake Placid Subdivision. The Staff is aware of the consequences
of placing the CORRIDOR close to existing subdivisions. The locations of
interchanges were reiterated by Bill Cashman:
Starting at the North, Interchange with 44
Heading South, First Colonial Road reclocated at
Oceana Boulevard
Main Gate of Oceana and Oceana Boulevard
Dam Neck Road Extended
(Possibly) London Bridge Road.
Princess Anne Road, North of the Courthouse
Indian River Road, before crossing into Chesapeake.
From Ferrell Parkway west, where Indian River Road and Ferrell Parkway come
together, the Harland Barthlomew Study concluded that without the Southeastern
Expressway, at least 10 lanes would be needed in that area west to the
Interchange with 64. The current 14ASTER STREET AND HIGHWAY PLAN has eight
lanes with controlled access. Close to 80,000 cars per day by the year 2010
are projected as one approaches the Interstate 64 interchange from Indian River
Road. Without the SOUTHFASTERN EXPRESSWAY, this number would rise above
100,000.
Oceana Boulevard in the northern section shall parallel the CORRIDOR or become
a portion of the CORRIDOR. There shall be six lanes in this section. Birdneck
Road adjacent to same shall be four-lane divided. General Booth Boulevard
parallel to the other side shall have six-lanes. As cost-effectiveness needs to
be addressed, some reconsideration of these aspects might be in order at the
appropriate time.

Prior to the SOUTHF.ASTERN EXPRESSWAY, the City was anticipating the widening of
Oceana Bouelvard to a four or six-lane arterial.
Robert Scott advised the City's employment patterns need to be critically
examined. Private enterprise shall also have a say in this.
The State is utilizing C. E. McGuire as their consultant. The Consultant's
responsibility basically is to produce an alignment. The State has not yet
chosen someone to peform a toll feasibility study.
Three questions need to be addressed regarding a desirable policy for
employment distribution:
(1) What type of policy or employment for job
distribution would be desirable?
(2) What may be done to accomplish same?
(3) What does the above have to do with the
transportation system?
Mayor Jones referenced inquiring of the Urban Land Institute whether they would
have an interest for a reasonable sum of money in determining the appropriate
land use along that CORRIDOR.
Vice Mayor Oberndorf referenced the possibility of utilizing the UNIVERSITY OF
VIRGINIA's Environmental Mediation. Williamsburg, James City and York County
utilized their services.
The AICUZ extends a little south of Dam Neck.
The City has to examine acquisition of certain critical, stragetic parcels.
There are no funds from the State for this. Same must be funded by the City and
there are no funds budgeted for this in the Capital Improvement Program.
The SOUTHEASTERN EXPRESSWAY provides another way to move traffic within the
City. Presently there are three ways in and out of the City. The SOUTHFASTERN
EXPRESSWAY adds a fourth way. If the SOUTHKASTERN EXPRESSWAY were not
developed, the City would have to stregthen the three aforementioned connecting
routes and develop a strategy within the City to include more jobs in key
locations within the City thus diminishing the relative need to travel in and
out across the City's boundaries.
The Study the State has authorized by C. E. McGuire is to determine the poposed
CORRIDOR or route of the SOUTHEASTERN EXPRESSWAY.
Jerald Banagan, Real Estate Assessor, was requested to determine the value of
the property in the "hot" spots, those points likely to be required for
acquisition. The tax consequences of this situation shall also be identified.

CONCEPT AND OPERATION OF THE HOV LANES CONTROL CENTER BUILDING AND PARKING LOT
AT INDIA14 RIVER ROAD

The following were in attendance to explain the concept and operation of the
HOV LANES and the Control Center Building and Parking Lot at Indian River Road:
Frank Dunn, Transporation Planner; Bruce Clark, Assistant Transportation
Planning Engineer; Denis Gribok, Resident Engineer - Virginia Department of
Transportation; Jim Cleveland, Assistant District Engineer - Virginia
Department of Transportation; Charlie Rasnick, Transportation Planning Engineer
- Virginia Department of Transportation; and, Marvin C. Gersten, Executive Vice
President, URS Corporation.
The solution of HOV LANES (special lanes in major highways for vehicles
carrying three or more persons) is utilized to move more people in less time.
In Tidewater, the HOV solution is targeted at the two major thoroughfares
crisscrossing the region - Virginia Beach/Norfolk Expressway and the heavily
traveled segment of Interstate 64. More than 200,000 vehicles utilize this
intersection each day. Route 44 is the most heavily traveled road in South
Hampton Roads and the most traveled in the State. During rush hour, Route 44
carries over 30% more traffic over the amount for which it was designed. Two
HOV diamond lanes have been added to the Expressway, one in each direction or
concurrent with the flow of traffic in the adjacent lane. During weekday peak
traffic periods, these diamond lanes are exclusively for vehicles carrying
three or more persons. In non-rush hour periods, these diamond lanes provide
an extra avenue for all traffic. The Expressways' HOV lanes are being
introduced in two stages:
First Stage: HOV Lanes extend on Route 44 from the
vicinity of Newtown Road eastward to the main line
Toll Plaza, a distance of approximately 5 miles.
Second Stage: HOV Lanes continue east from the
Toll Plaza to Laskin Road, a distance of ten miles.
Special lanes for HOV Traffic at the Toll Plaza are
also coming with the Second Stage.
HOV will be extended to Interstate 64 intitally along the seven-mile segment
from I-564 to I-264. Here, the HOV Lanes will be set off in a physically
separated facility from the main roadway. The direction of traffic will be
reversed in accordance with the rush hour flow. Eventually, HOV will continue
from the Intersection with I-264 to Indian River Road, a distance of 2.6 miles.
This stretch of I-64 will be widened to include an additional conventional lane
and a diamond HOV Lane in each direction. The HOV plan for Tidewater has been
designed to provide dramatic relief to the City's unique traffic problems.
HOV can actually improve travel time by as much as a minute a mile for
commuters who elect to utilize these special lanes. For an example, the trip
from the main line Toll Plaza west to I-64 should become approximatly 5 minutes
faster than current non-HOV traveling times. Similarly, vehicles moving from
I-564 down to Indian River Road during rush hour should experience a 20-minute
time savings.
There is a fine of four points on an individual's license and up to a $100
fine, if one is in an HOV Lane with a vehicle capacity of less than three
people. The Courts are also charging the individuals with court costs. The HOV
Lanes are conventional other than they are restricted during the peak travel
times in the morning in the westbound lane between 6:00 and 9:00 A.M. and in
the evening in the eastbound lane between 3:00 and 6:00 P.M.

The Federal Highway Administration has just recently APPROVED the Construction
of a temporary ramp situated in the Interstate Complex of 64, 44 and 264. This
ramp will connnect with 44 westbound to the 64 eastbound ramp to the 264
eastbound to the 64 westbound. This should be advertised late this summer and
in place early 1988.
The HOV Lane will have its own Toll Plaza during the hours of operation and
will take quarters, as well as script.

Marvin Gersten, Executive Vice President, URS, advised the State engaged URS to
perform a concept and final design study of the traffic control system that
will operate and supervise the reversible lanes between 564 and between 44 and
Indian River Road where they terminate. In addition to the traffic control
system for that specific stretch, the system is being designed to have
expansion capability to be able to include traffic surveillance and control on
virtually the entire Interstate freeway system in the Tidewater area. As part
of this system, there shall be a control center to be located at the northwest
quadrant of I-64 and Indian River Road adjacent to the new or proposed commuter
HOV Parking Lot. Same shall be a one-story colonial style building and shall
house the control system, the computer, a room with monitors for the television
cameras. It will have the ability through operator control to reverse the
direction of the reversible roadway every day in a safe manner. There will be
disc type changeable message signs at the entrance and the entrance points to
the reversible roadway. There will be one on 1-564 where it comes into 64, the
northwestern end of 64, north of 564, at Route 44 and at the eastern terminus
just north of Indian River Road.
The building and lot shall be adequately landscaped conforming to City
standards.
The City Manager advised the intersection that needs to be addressed regarding
the HOV Lane on 64 is the intersection with North Hampton Boulevard. As there
are no plans for an a HOV intersection with this particular facility, the
reasons for this were requested in writing.

Mayor Jones entertained a motion to permit City Council to conduct its
EXECUTIVE SESSION pursuant to Section 2.1-344, Code of Virginia, as
amended, for the following purposes:
1. PERSONNEL MATTERS: Discussion or consideration of employment, assignment,
appointment, promotion, performance, demotion, salaries, disciplining or
resignation of public officers, appointees or employees.
2. PUBLICLY HELD PROPERTY: Discussion or consideration of the condition,
acquisition or use of real property for public purpose, or of the
disposition of publicly held property, or of plans for the future of an
institution which could affect the value of property owned or desirable
for ownership by such institution.
3. LEGAL MATTERS: Consultation with legal counsel or briefings by staff
members, consultants or attorneys, pertaining to actual or potential
litigation, or other legal matters within the jurisdiction of the public
body.
Upon motion by Councilman Moss, seconded by Councilwoman Parker, City Council
voted to proceed into EXECUTIVE SESSION.

Councilwoman McClanan referenced an Ordinance to AMEND and REORDAIN Article 2,
Section 233(c) of the Comprehensive Zoning Ordinance pertaining to Recreational
Campgrounds. (See Item III-G.l.g. of the PLANNING AGENDA).
Councilwoman McClanan requested this item be moved forward on the PLANNING
AGENDA and DEFERRED as Councilman Fentress is absent.

Farm Partnerships would develop 39 homes (22 lots on water, 17 interior lots).
The applicant will dedicate to the Virginia Beach Arts Center the Ferry Farm
House accompanied by a gift of $100,000 to the Virginia Beach Arts Genter
identified for the restoration of the Ferry Farm House. If the Arts Center
finds they are unable to maintain the Ferry Farm House, they have agreed to
transfer same to another organization with the understanding that the farm
house shall be restored.
Roy Parks, Land Planner and Landscape Architect, represented the applicant,
formulated the land use plan, and presented various exhibits depicting this
Project. The 22 lots on the waterfront average about 23,000 square feet. The
interior lots range from 12,500 feet to about 14,000 square feet. Main access
street shall be 22 feet wide. The dock shall accommodate somewhere in the
neighborhood of 8 to 10 boats for day use only. Roy Parks requested Condition
No. 3 be amended to state: 'No fences shall be within three feet of the
centerline of the side grass swales.1 Roy Parks believed Condition No. 9 was
misstated. The City shall not perform the indepth study. Said study shall be
conducted by the developer.

to the closing of Pembroke Boulevard and redirecting the Construction Traffic

ORDINANCE UPON APPLICATION OF OLD DONATION FARM
PARTNERSHIP FOR A CONDITIONAL USE PERMIT
Ordinance upon application of Old Donation Farm
Partnership for a Conditional Use Permit for a
non-commercial marina (dock) on certain property
lcoated 1200 feet more or less northeast of the
southeastern terminus of Pembroke Boulevard. Plats
with more detailed information are available in the
Department of Planning. BAYSIDE BOROUGH.
As per Vice Mayor Oberndorf, this DEFERRAL would enable the identification of
the type of historical treasurers located on the grounds of the Ferry Farm
House and perhaps the location of the burial grounds.
Councilwoman McClanan requested the applicant initiate placing the Ferry Farm
House on the National Register of Historic Places and requested the applicant
place the open space under the auspices of the Historic and Cultural Review
Board, so they might review the design.
This DEFERRAL will enable, as per request of Councilwoman Parker, a written
proposal from the Virginia Beach Arts Center concerning their utilization and
funding of the Ferry Farm House, if they intend to take said property, as well
as their method of renovation or restoration accompanied by some type of a deed
plat. Councilwoman Parker wondered whether the surrounding area would be
included as she envisioned the repercussions to the Francis Land House. There
is no buffer from the surrounding commercial. Councilwoman Parker also inquired
concerning the parking lot and wondered if same would be included as part of
the land that is being given with the Ferry Farm House. If so, how does that
affect the Open Space Ordinance.
Attorney Cromwell will attempt to resolve that aspect and will have a
representative from the Virginia Beach Arts Center.
As per request of Councilwoman McClanan, all issues will be resolved in
writing.

ORDINANCES ITEM # 27407
Carlton Bowyer, Assistant Superintendent of Virginia Beach City Schools,
responded to City Council's inquiries. Carlton Bowyer advised Salem High School
should be on Schedule with the August 1987 Opening. The completion of the
Princess Anne High School Air Conditioning should be by October 31, 1987.
Carlton Bowyer advised there was a Projected Project Balance of $1,400,000 in
the Princess Anne High School Renovation Project. $100,000 would be used as a
contingency until the completion of the project. Salem High School was funded
at the time with no site. A site had been anticipated which did not come to
fruition (the Spence Farm). The Site was not acquired until April 1985. As a 5
1/2 hour-day is now required and a 22-credit diploma, the flexibility within a
a building is lost. A 236,000 square foot building with 2,000 students is now
258,862 square feet.
The Bond Counsel has advised approval of the transfer is within the authority
of City Council.

AN ORDINANCE AUTHORIZING THE TRANSFER
OF $1,300,000 FROM PRINCESS ANNE HIGH
3 SCHOOL RENOVATION PROJECT TO SALEM
4 HIGH SCHOOL PROJECT

7 WHEREAS, the School Board desires to enter into a
8 construction contract to complete Salem High school; and
9 WHEREAS, the total project costs will exceed available
10 authorization by $1,300,000 for Sal6m High School; and
11 WHEREAS, the School Board has underway the Princess
12 Anne High School Renovation Project that will have a savings on
13 construction of $1,300,000; and
14 WHEREAS, the Princess Anne High School Project, the
15 Special Education Facilities Project, and the West Kempsville
16 Elementary School Site Acquisition Project were authorized by
17 voters at a referendum on November 5, 1985; and
18 WHEREAS, the School Board and the staff of the School
19 Board have provided information on the status of the above-
20 mentioned Projects (Exhibit "A"), combined with a statement from
21 the City Attorney's Office (Exhibit "B") regarding condemnation
22 of the West Kempsville Elementary School Site, that the above-
23 mentioned Projects can be completed and that an overage of
24 $1,300,000 is available for transfer to other school needs.
25 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
26 CITY OF VIRGINIA BEACH, VIRGINIA:
27 That City Council determines that $1,300,000 is deemed
28 surplus and is available for transfer from the Princess Anne High
29 School Renovation Project to Salem High School Project and that
30 such a transfer in the amount of $1,300,000 is hereby approved.
31 This Ordinance shall be effective from the date of its
32 adoption.

AN ORDINANCE To APPROPRIATE $25,200
To OPERATED A "PILOT" DAY CAMP FOR
CHILDREN OF MUNICIPAL EMPIDYERS
WHEREAS, the completion of the Child Development Study illustrated the need
for programs which address the "latc@-key" children issue, and
WHEREAS, the Department of Personnel surveyed the employee population to
determine the need for a school-age child care program near the municipal
complex, and
WHEREAS, the response was positive, with 65% needing 7 - 10 weeks of child
care for the summer, and
WHEREAS, the time constraints in developing a program for the sununer of
1987, precluded contracting with a private vendor, and
WHEREAS, the Department of Parks and Recreation in conjunction with the
Department of Social Services, could as an extension of its regular day camp
programs offer a quality recreational based child care program, and
WHERF-AS, this program is a pilot program which will be evaluated upon
completion as to the success and potential for continuance as a year round
program, and
WHEREAS, the projected expenditures of the program will not exceed the
$25,200 in anticipated fee revenues.
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA that a pilot child care program open only to municipal employees be
established by the Department of Parks and Recreation and that funds in the
amount of $25,200 be appropriated to support the operation of the program for the
summer of 1987,
BE IT FURTHER ORDAINED, that this program will be totally self-supporting.
This ordinance shall be effective from the date of its adoption.

recognizes the existence of a litter problem within the city; and
WHEREAS, the Virginia Litter Control Act of 1976
provides, through the Department of Conservation and Historic
Resources, Division of Litter Control, for grants for the purpose
of enhancing local litter control programs; and
WHEREAS, the Virginia Beach Clean Community Program is
in its ninth year of funding under this program; and
WHEREAS, in order for the tenth year funding
application to be forwarded to the Division of Litter Control,
said application must be endorsed by Council.
NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Virginia Beach endorses and supports the continuation of
the virginia Beach Clean Community Program with grant funding of
$20,105.00 to be furnished by the Division of Litter Control of
the State of Virginia.
BE IT FURTHER RESOLVED that the Department of
Conservation and Historic Resources, Division of Litter Control,
is hereby requested to consider and approve said grant
application and program, said program being in accord with the
regulations governing the use and expenditure of these funds.

WHEREAS, Old Oakhill Farm Associates is developing certain
property in the Lynnhaven Borough in accordance with the terms
and conditions of city ordinances, and
WHEREAS, in plan review, the Department of Public Utilities
has asked the developer to engage in construction greater in
scope than is necessary for the project in order to provide water
and sewer services outside the project limits, and
WHEREAS, the city desires to enter into cost participation
agreements with the city's share of costs estimated at $3,690 for
water and $3,300 for sewer with such costs to be charged to
projects 5-306 Water Request and agreement and 6-316 Various
Sewer respectively, and
WHEREAS, such construction at this time will provide for
future needs and will prevent the city from incurring additional
costs at a later date.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH that the City Manager is hereby authorized and
directed to enter into cost participation agreements with Old
Oakhill Farm Associates for contruction of certain water and

14 WHEREAS, such construction is beyond the scope of the
15 developer's project but will provide for future City needs and
16 will prevent the City from incurring additional costs at a later
17 date, and
18 WHEREAS, the City desires to enter into a cost
19 participation agreement with the City's share of the costs at
20 $74,625 with such costs to be charged to capital project 6-316

referred to as "Owner", and the CITY OF VIRGINIA BEACH, VIRGINIA,
hereinafter referred to as the "City".
WHEREAS, Owner is seized in fee simple of 10.547 acres
D.B. 2625 p. 984-985 and also known as Beacon's Reach
WHEREAS, Owner is desirous of improving the Project in accordance
with the terms and condition5 of the City ordinances and agrees to conform
to said ordinances; and
WHEREAS, in order for Owner to provide sewer service to this Project,
it is necessary for Owner to construct certain sewer facilities; a@,@
WHFREAS, the City ha5 requested that such construction be c-eater in
scope than is necessary to provide service to this Project; and
WHEREAS, such construction is of value to the City in providing
service to customers other than those within the Project limits;
NOW, THEREFORE, in consideration of the mutual promises an: benefits
accruing hereto, the parties agree that:

according to plans and specifications approved by the Department of Public
Utilities, a copy of which is an file with the Department.
2. The City 5hall make cash payment to Owner in the amou,- f $74,625.00

AN ORDINANCE TO AUTHORIZE AND
DIRECT THE CITY MANAGER TO
EXTEND SEWER SERVICE ALONG OLD
PROVIDENCE ROAD
WHEREAS, in accordance with City Council resolutions, the
city will provide water and/or sewer to areas which have attained
the required 51% property owners participation, and
WHEREAS, property owners along Old Providence Road at 5525
and 5529 have made request for city sewer services, and
WHEREAS, the cost to extend sewer service to the area is
estimated at $11,850 and funds are available in capital project
6-316 Various Sewer Projects.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH that the City Manager is hereby authorized and
directed to extend sewer service along Old Providence Road in
accordance with the above request.
This ordinance shall be effective frcm the date of its adoption.

FOR THE THIRTEENTH PROGRAM YEAR
WHEREAS, the Un i ted States Congress has estab I lshed I eg I s I ation
designated as the Housing and Community Development Act of 1974 setting
forth as a national goal the development of viable urban communities; and
WHEREAS, the United States Congress has enacted legislation designated
as the Housing and Urban-Rural Recovery Act of 1983, providing for
continuing efforts In the development of viable urban communities; and
WHEREAS, there Is federal assistance available for the support of
Community Development and Housing activities directed toward specific
objectives such as the ellmination of deteriorated conditions In low and
moderate Income neighborhoods; the elimination of conditions which are
detrimental to health, safety and welfare; the conservation and expansion
of the Nation's houslng stock; the expansion and Improvement of the
quantity and quality of community services; and other related activities,
and
WHEREAS, the City of Virgi nia Beach has developed a multi-year
Community Development Program and has structured the necessary mechanisms
for implementation in compliance with federaf and local directives; and
WHEREAS, the City of Virginia Beach Is In the process of Implementing
this program and desires to Initiate an application for the Thtrteenth Year
funding (1987-1988) In the amount of $2,365,931 which Includes accrued and
projected Income of $205,931.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
That the City Manager Is hereby authorized and directed to cause such
Information or materials, as may be necessary, to be provided to the
Department of Houslng and Urban Development to permit the review, approvals
and funding of the City's Thirteenth Year Entitlement Grant application.
AND BE IT ORDAINED, that the Council of the City of Virginia Beach
gives its assurance that the Intent of the Act will be complied with In

WHEREAS, the Department of Housing and Community Development
has prepared a Displacement Pol Icy Statement which states that

such a manner as to minimize the displacement of target area
residents whenever possible; and
WHEREAS, the Department of Housing and Community Development
has also modified Its Pol Icy for Assisting Displacees to provide
for displacement of residents caused by a 'non-state' agency or
by substantial rehabilitation of a structure; and

minimize whenever possible the displacement of low and
moderate I ncome persons from their homes a n d
neighborhoods. Steps will be taken to plan and
Implement Community Development Block Grant projects
and actlvlties In such a--way as to mitigate the adverse
ef fects of, displ acement on low and moderate Income
persons. When appropriate, the Last Resor't Replacement
Housing provisions wi I I be uti I lzed as al lowed In the
Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1 9 7 0 a n d I n the
Implementing regulations (24 CFR 42.605). To mitigate
the adverse effects of displacement on low and moderate
Income persons who are dispi aced but are not el lgible
to receive the relocation payments authorized by the
Un I f orm Act or Section 104 (j), this policy wlil
provide relocation payments and assistance to those
persons displaced. Such Relocation Assistance will be
provided as permltted by 24CFR 570.6068.
Ii. POLICY FOR ASSISTING DISPLACEES
The City of Virginia Beach, through the Department of
Housing and Community Development, provides relocation
ass lstance and services to f ami I les, Individuals,
bus I nesses and non-prof i t corporat Ions that are
dIspi aced as a resul t of any substantial rehab i I 1-
tation, code enforcement/demo[ ition or acquisition of
real property by the city or by a non-state agency for
a community development-funded a c t i v i t y . S u c h
rel ocation assistance wi I I be provided as required by
S e c t I o n I 0 4 ( j ) of the Hous I ng and Commun lty
Development Act of 1 974 and the Uni form Relocation
Ass lstance and Real Property Acquisition Pol Icies Act
of 1970 (Uniform Act). A description of the categories
of displacement and of the relocation assistance to be
prov I ded to d I sp I acees under each category Is as
fol lows:
A. Permanent Disillarament by Substantial
Rehabilitation

Community Development to have been displaced

displaced person to rent, purchase or

AN ORDINANCE TO TRANSFER $43,000 WITHIN THE
OPERATING BUDGET OF THE DEPARTMENT OF
DATA PROCESSING TO PURCHASE ARCHIVAL QUALITY
MICROFILM CAMERA
WHERFAS, the City of Virginia Beach recognizes the need for an
effective and cost efficient records retention program, and
WHEREAS, the Virginia State Library Board, in accordance with the
provisions of Chapter 7, Virginia Public Records Act, Section 42.1-82 of the Code
of Virginia, mandates the use of the silver gelatin microfilm camera for the
production of a permanent archival quality security copy of records having
administrative, legal, fiscal, or historical value as defined in Section 42.1-77
of the Code of Virginia, and the production of permanent archival security copy
is required prior to the destruction and/or disposal of official government
records, and
WHEREAS, the present microfilm camera in the Records and Micrographics
Division of the Data Processing Department does not meet the state standards
causing some city departments to contract with private vendors for this service,
and the purchase of a new microfilm camera for Records and Micrographics which
complies with all mandates is estimated to cost $43,000 and will result in a
projected savings of $81,560 primarily from Public Utilities' private sector
contracting costs, and
WHEREAS, funds for the purchase of the camera may be provided from the
reallocation of appropriations within the FY 86 - 87 Operating Budget for the
Data Processing Department.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA, that funds totaling $43,000 be transferred within the operating
budget of the Department of Data Processing to purchase the 35mm silver gelatin
planetary camera system necessary to meet archival standards as required by the
Code of Virginia.
This ordinance shall be in effect from the date of its adoption.

David Grochmal, Director, Department of General Services presented information
relative the Judical Center Project.
David Grochmal advised the List of Decisions regarding the Judical Genter
Project:
I. Location of the Judicial Center
A. West end of the Municipal Center
B. Between General District and Circuit Court
Buildings.
II. Tour of existing and Fairfax Courts
III. Revenue Stream
A. User fees
B. Taxes
C. Rent from state agencies
D. Split in revenue stream
IV. A. Lease/Purchase
B. Referendum Bonds
C. Charter Bonds
These major policy questions must be answered to proceed with the Judicial
Center Project. The Staff has met with each State Legislator from Virginia
Beach to discuss the possibilities of enabling legislation to establish local
user fees to pay for the Judicial Center Project. A summary of the Legislators'
responses is hereby made a part of the record.
The City Staff and Consultant recommended the location of the Judicial Genter
be located at the west end of the Municipal Genter.
A tour by the City Council Members of the Virginia Beach Court Buildings and
the new Fairfax Court Center was recommended. Vice Mayor Oberndorf had
suggested a Tour could be arranged when Members of City Council attended the
Virginia Municipal League Conference in September which will be in Fairfax
County.
David Grochmal suggested User Fees be considered by City Council as the primary
source for funding of this project. A secondary source would be rental from
State Agencies; however, this might not provide very sufficient funds. Once the
mood of the General Assembly is determined and enough User Fees can be
collected to pay for the entire building, at that point City Council can decide
if they must come up with Local Taxes to pay the balance.
The fourth decision is relative Funding. Mr. Grochmal recommended
Lease/Purchase with Certificates of Participation as the most advantageous
method of Funding.
BY CONSENSUS, a Resolution was SCHEDULED for the City Council Meeting of June
8, 1987 to determine the Location of the Judicial Center, the Revenue Stream
and the Funding.

Vice Mayor Oberndorf extended an Invitation to the Members of City Council on
behalf of the Association for the Preservation of Virginia Antiquities, the
Southeastern Chapter. The Association is having a Guest Speaker, Mr. Alan
Flanders on Sunday, May 24, 1987, at 3:00 P.M. at the Lynnhaven House
concerning the preservation of historical sites.

The INTERIM FINANCIAL STATEMENTS: July 1, 1986 - March 31, 1987 were
distributed to City Council and are hereby made a part of the record.
Giles Dodd, Assistant City for Administration, referenced Exhibit A, relative
Expenditures. On Page 2.2 Interfund transfers have been separated from the
other Expenditures.
The Majority of the Federal funds is contained in the School Operating Fund. A
very small amount is received into the General Fund.
Relative Page 3, the Analysis of the Building Permits, the increase in the
water resource recovery fee rate on July 1, 1986 caused the sale of building
permits to accelerate prior to June 30, 1986. On June 30, 1986, the City
collected $358,994 more than the estimate for the fiscal year 1986.
