Oberndorf in the Council Chamber, City Hall Building, on Tuesday, December 2, 1991, at 10:00 A.M. Council Members Present: John A. Baum, James W. Brazier, Jr. , Robert W. ITEM # 35124 DIRECT ELECTION OF SCHOOL BOARD In response to City Council concerning whether present members of the School Board could be appointed until May 1992, at which time a Direct Election of the School Board would be held and those Members elected by the public would serve, the City Attorney advised the Charter provision adopted by the City Council provides the School Board be elected in the year 1996. It is improbable that all the factors could be put in place prior to May 1992. A Charter Amendment must be approved by the General Assembly. This would necessitate emergency legislation. Once this legislation comes out of the General Assembly, it must be submitted to the Justice Department for preclearance. The Justice Department has up to sixty days to preclear. The City can request an expedited review. However, there are two factors which are beyond the City's control: The General Assembly must enact the provision and the Justice Department must have preclearance. At the same time and concurrently, individuals would have to declare candidacy within sixty days of the election. Regarding appointment of School Board Members for a temporary period until May 1992, the City Council does not have the option to lessen the term of candidates. This action would have to be by the General Assembly. The terms ending at a certain period of time could be part of the Charter Amendment, but Council's appointment must be for the full term. While May is not achievable, November 1992 would allow additional time to make this action achievable. The provisions could be redrafted in that fashion and probably offer adequate time for enactment of the provision by the General Assembly and preclearance by the Justice Department, as well as individuals declaring candidacy. City Council does not have the authority to limit terms, it has to be through the charter amendment process of the General Assembly. 5 item I B.
