ADJOURNMENT M I N U T E S VIRGINIA BEACH CITY COUNCIL Virginia Beach, Virginia December 19, 1985 Mayor Heischober called to order the SPECIAL MEETING f the VIRGINIA BEACH CITY COUNCIL in the Council Chambers, City Hall Building, on Thursday, December 19, 1985, at 1:00 P.M. Council Members Present: John A. Baum, Nancy A. Creech, Robert E. Fentress, Mayor Harold Heischober, Barbara M. Henley, H. Jack Jennings, Jr. , Louis R. Jones, Vice Mayor Reba S. McClanan, J. Henry McCoy, Jr., D.D.S. and Meyera E. Oberndorf Council Members Absent: Robert G. Jones Councilman Robert Jones entered the SPECIAL MEETING at 1:40 P.M. PLEDGE OF ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA - 2 - ITEM # 24727 Mayor Heischober entertained a motion to permit Council to conduct its EXECUTIVE SESSION pursuant to Section 2.1-344, Code of Virginia, as amended, for the following purposes: 1. LEGAL MATTERS: Consultation with legal counsel or briefings by staff members, consultants or attorneys, pertaining to actual or potential litigation, or other legal matters within the jurisdiction of the public body. Upon motion by Councilman Louis Jones, seconded by Councilwoman Creech, City Council voted to proceed into EXECUTIVE SESSION. Voting: 10-0 Council Members Voting Aye: John A. Baum, Nancy A. Creech, Robert E. Fentress, Mayor Harold Heischober, Barbara M. Henley, H. Jack Jennings, Jr., Louis R. Jones, Vice Mayor Reba S. McClanan, J. Henry McCoy, Jr., D.D.S. and Meyera E. Mayor Heischober REOONVENED the SPECIAL MEETING of the VIRGINIA BEACH CITY OOUNCIL in the Council Chambers, City Hall Building, on Thursday, December 19, 1985, at 1:25 P.M. Council Members Present: John A. Baum, Nancy A. Creech, Robert E. Fentress, Mayor Harold Heischober, Barbara M. Henley, H. Jack Jennings, Jr. , Louis R. Jones, Vice Mayor Reba S. McClanan, J. Henry McCoy, Jr., D.D.S. and Meyera E. Oberndorf Council Members Absent: Robert G. Jones 4 Item E. ITEM 24728 CONSIDERATION OF EXEMPTIONS Attorney Grover Wright represented Oxford Development Company and their proposed 480-unit Multifamily Project on South Lynnhaven Road. He requested consideration of exemption to: Ordinance to amend and reordain Sections 37-7, 37-8, 37-9, 37-10, 37-11, and 37-12 and ADD Sections 37-7.1 and 37-7.2 to the Code of the City of Virginia Beach, Virginia, pertaining to Tap and Meter Installation Fees and Water Resource Recovery Fees. City Council DID NOT TAKE ANY ACTION concerning EXEMPTIONS to the above Ordinance which will be considered January 6, 1986. Councilman Louis Jones stated for the record: "Mr. Wright made the comment that the Council had made it clear by its actions that this Ordinance would be retroative to December 16, 1985. I would like to say that the STAFF made it clear that it is their intention to recommend to the Council that this Ordinance would be retroactive to December 16, 1985, but that decision has not yet been made by this Council and will be made on January 6, 1986, when we vote on this Ordinance." December 19, 1985 5 Item II-E.1 ADD-ON ITEM # 24729 UNFINISHED BUSINESS Councilman Baum inquired as to whether the Consultant, Harland Bartholomew and Associates, should be allowed to DELETE the OIJ) DOMTION PARKWAY from the MASTER STREET AND HIGHWAY PLAN. City Council should decide this particular factor. The City Manager advised the Consultant had indicated he would RECO to City Council that OLD DONATION PARKWAY be DEUTED from the MASTER STREET AND HIGHWAY PLAN. 6 Item II-F.1 ADJOURNMENT ITEM 24730 Upon motion by Councilman Louis Jones, seconded by Councilwoman Creech, City Council ADJOURNED the meeting at 2:00 P.M.
