Oberndorf in the Council Chamber, City Hall Building, on Thursday, July 18, 1991, at 3:00 P.M. Council Members Present: John A. Baum, Robert W. Clyburn, Vice Mayor Robert E. Fentress, Harold Heischob6r, Louis R. Jones, Paul J. Lanteigne, Reba S. McClanan, Mayor Meyera E. Oberndorf and Nancy K. Parker Council Members Absent: James W. ITEM # 34689 The MAYOR read her LE = R stating the purpose of the SPECIAL SESSION: In accordance with the City Charter, Section 3.06, the City Code, Section 2-21, and by the authority vested in me as Mayor of the City, I hereby call a SPECIAL SESSION of the VIRGINIA BEACH CITY COUNCIL in the Council Chamber, City Hall Building, on Thursday, July 18, 1991, at 3:00 P.M. to review resumes received from interested City Staff and determine whether to conduct a national search for the position of City Manager. ITEM # 34690 The MAYOR announced one internal resume for the position of City Manager had been received as of 11:59 A.M. today, July 18, 1991. Vice Mayor Fentress distributed a proposed Resolution for the selection of an Executive Search Firm to conduct a search and examine prospective candidates for the position of City Manager. The names of the various Recruiting Consultants were distributed to City Council accompanied by their location, experience and cost. These firms shall be numbered for purposes of discussion. Mayor Oberndorf distributed a revised position announcement. Mayor Oberndorf advised there was a 'phone inquiry from Nebraska, a resume from Newport News, and the general public advised their favorite for the position of City Manager. - 4 - Item I.D. ITEM # 34691 Mayor Meyera E. Oberndorf entertained a motion to permit City Council to conduct its EXECUTIVE SESSION (3:25 P.M.), pursuant to Section 2.1-344, Code of Virginia, as amended, for the following purposes: 1. PERSONNEL MATTERS: Discussion or consideration of or interviews of prospective candidates for employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees pursuant to Section 2.1-344 (A) (1). To Wit: Personnel: City Manager's Position. Upon motion by Councilman Jones, seconded by Councilman Baum, City Council voted to proceed into EXECUTIVE SESSION. Voting: 9-0 Council Members Voting Aye: John A. Baum, Robert W. Clyburn, Vice Mayor Robert E. Fentress, Harold Heischober, Louis R. Jones, Paul J. Lanteigne, Reba S. McClanan, Mayor Meyera E. ITEQ # 34692 RECONVENE FORMAL SESSION Mayor Meyera E. Oberndorf RECONVENED the FORMAL SESSION of the VIRGINIA BEACH CITY COUNCIL in the Council Chamber, City Hall Building, on Thursday, July 18, 1991, at 4:08 P.M. Council Members Present: John A. Baum, Robert W. Clyburn, Vice Mayor Robert E. Fentress, Harold Heischober, Louis R. Jones, Paul J. Lanteigne, Reba S. McClanan, Mayor Meyera E. Oberndorf and Nancy K. Parker Council Members Absent: James W. Brazier, Jr. and William D. Sessoms, Jr. - 6 - Item I-F. ITEM # 34693 CERTIFICATION OF EXECUTIVE SESSION Upon motion by Heischober, seconded by Councilman Baum, City Council CERTIFIED THE EXECUTIVE SESSION TO BE IN ACCORDANCE WITH THE MOTION TO RECESS. Only public business matters lawfully exempted from Open Meeting requirements by Virginia law were discussed in Executive Session to which this certification resolution applies; AND, Only such public business matters as were identified in the motion convening the Executive Session were heard, discussed or considered by Virginia Beach City Council. Voting: 9-0 Council Members Voting Aye: John A. Baum, Robert W. Clyburn, Vice Mayor Robert E. Fentress, Harold Heischober, Louis R. Jones, Paul J. Lanteigne, Reba S. McClanan, Mayor Meyera E. Sessoms, Jr. CERTIFICATION OF EXECUTIVE SESSION VIRGINIA BEACH CITY COUNCIL WHEREAS: The Virginia Beach City Council convened into EXECUTIVE SESSION, pursuant to the affirmative vote recorded in ITEM # 34691, Page No. 4 and in accordance with the provisions of The Virginia Freedom of Information Act; and, WHEREAS: Section 2.1-344.1 of the Code of Virginia requires a certification by the governing body that such Executive Session was conducted in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED: That the Virginia Beach City Council hereby certifies that, to the best of each member's knowledge, (a) only public business matters lawfully exempted from Open Meeting requirements by Virginia law were discussed in Executive Session to which this certification resolution applies; and, (b) only such public business matters as were identified in the motion convening this Executive Session were heard, discussed or considered by Virginia Beach City Council. ITEM # 34694 Regarding the proposed Position Announcement for City Manager, Councilwoman McClanan suggested the verbiage "strong financial expertise" be included in the job description. Councilwoman McClanan referenced requirement relative Total Quality Leadership. Other candidates should not be eliminated from consideration, if they are not committed to this particular leadership technique. Councilman Lanteigne suggested the "capital letters" of Total Quality Leadership be changed to "small letters" thus defining them in a broader sense. This type of theory has been in the public sector only a short time. Mayor Oberndorf said it should be understood the City Council is looking for leadership skills. Councilman Baum referenced line three: "..Mayor and ten member elected Council." The verbiage should be directly-elected Mayor and ten-member Council. Concerning the sentence ".. one of the largest and fastest growing cities in the southeast United States." The words "approximately 40% (whatever the correct proportion) is rural" should be inserted after the word "largest". Councilman Lanteigne advised the announcement should state "a minimum of eight years experience.." rather than "eight to ten years of experience as a high level municipal executive." Councilwoman McClanan expressed concern over issuance of contracts. The City will not be advertising. The Executive Search Firm will be advertising the position. - 8 - Item I-G. ITEM # 34695 Upon motion by Vice Mayor Fentress, seconded by Councilman Jones, City Council ADOPTED, AS REVISED*: Resolution authorizing the Mayor to enter into a contract with the firm of The Mercer Group, Inc. to conduct a search and examine prospective candidates for the position of City Manager, both inside the City and outside the City; and, TRANSFER sufficient funds for this contract from Reserve for Contingencies to the General Fund. "The verbiage "..subject to negotiated cost to be competitive with other firms shall replace the words "in the amount of Voting: 8-1 Council Members Voting Aye: John A. Baum, Robert W. Sessoms, Jr. 1 RESOLUTION 2 3 4 WHEREAS, the City Manager has announced his retirement 5 effective October 1, 1991; and 6 WHEREAS, Council desires to employ a new city manager as 7 expeditiously as possible in order to ensure an orderly transition. 8 NOW THEREFORE, BE IT RESOLVED, that the Mayor is 9 authorized to enter into a contract with the firm of The Mercer 10 Group, Inc. , subject to negotiated cost to be competitive with 11 other firms, to conduct a search and examination of prospective 12 candidates for the position Of City Manager both inside the City 13 and outside the City and forward its report thereof to the City 14 Council; and 15 BE IT FURTHER RESOLVED, that sufficient funds for this 16 contract are hereby transferred from Reserve for Contingencies in 17 the General Fund for this purpose. 18 19 Adopted by the Council of the city of Virginia Beach, 20 Virginia this 18th day of July, 1991. 21 22 CA-4358 23 T\ORDIN\NONCODE\MANAGER.RES 24 9 Item I.H.
