Code of the City of Virginia Beach, Virginia, pertain-

purchase of a new vehicle and reduce FY '84 appropria-
tions.
6. Ordinance, on SECOND RF-ADING, to increase appropria-

into the necessary agreements for the implementation
of this project.

The Regular Meeting of the Council of the City of Virginia Beach, Virginia
was called to order by Mayor Louis R. Jones in the Conference Room, City
Hall Building, on Monday, June 20, 1983 at Twelve-Forty in the afternoon.

Mayor Jones entertained a motion to permit Council to ond,ct it, INFOPMAL
SESSION to be followed by an EXECUTIVE SESSION pursuant to Section 2.1-344,
Code of Virginia, as amended, for the following purposes:
1. PERSONNEL MATTERS: Discussion or consideration
of employment, assignment, appointment, promotion,
performance, demotion, salaries, disciplinitig or
resignation of public officers, appointees or
employees.

ANNUAL CONFERENCE
OF MAYORS ITEM # 20117
Mayor Jones stated he had prepared a written report on his attendance at the
Annual Conference of Mayors in Denver, Colorado which will be submitted to
Council members.
A special recognition award was presented to Virginia Beach for outstanding
leadership in "Citizen Volunterism in response to Unemployment" (said award
was from the Xerox Corporation and the United States Conference of Mayors).
APPRECIATION ITEM # 20118
Mayor Jones expressed his appreciation to Vice Mayor Henley for all the help
rendered in his absence.

INDIGENT CARE ITEM # 20119
Vice Mayor Henley made reference to an article on a proposal from the
Governor's budget -- in particular the addition to the budget of $33 million
to improve health care for indigents at the Medical College of Virginia and
the University of Virginia Hospital. Again, the City is left out. This is
an area for which the City needs to be concerned and investigate.
Councilman Heischober commented the City has 29 percent of the indigents but
only 7 percent of the funds.
Vice Mayor Henley stated "regionalism" is the key, to which Councilman McCoy
replied he, too, would like to see regional cooperation.
LYNNHAVEN RIVER ITEM # 20120
Councilman Jennings remarked he is disappointed with the quality of the water
in the Lynnhaven River which does not seem to be improving. He has talked
with the City Manager about a number of studies which were authorized by
prior Councils relative to this subject. Councilman Jennings requested current
data as to what might be done to accelerate the clean-up of the Lynnhaven River.
He would like to see an objective; namely, improvement of the quality of water
within a short period of time (maybe 3 to 5 years).
City Manager Muehlenbeck advised Councilman Jennings he would inquire of
the Water Quality Task Force what studies have been done, what studies can
be done, etc. and will inform Council.
Councilman Jennings stated he felt our Governor has shown excellent leadership
with his attempt to address the cleaning up of the Chesapeake Bay and feels
the City should follow that example and try to do something with the Lynnhaven
River, especially because of the world-famous shellfish industry we have.
Councilman McCoy asked about the status of dredging of the Lynnhaven River
to which the City Manager replied the City is still attempting to obtain a
permit from the Corps of Engineers. The last thing the Corps of Engineers
did was to ask for an inventory of the usage of the River. The City is
spending all City monies for the work to be done. This situation has been
going on for 8 to 10 years.
ATLANTIC AVENUE
BEAUTIFICATION PROJECT ITEM # 20121
Councilman Jennings asked the status of the Atlantic Avenue Beautification
Project. He stated this matter should include a short-run plan and a long-
run plan with the possibility of developing some real tangible incentives
for the businesses located along the Atlantic Avenue corridor. He commented
he would like to see the City consider the development of a "blue ribbon",
citizen-involved committee which would expedite action on tbis situation.

ITEM # 20121 (continued)
City Manager Muehlenbeck stated a presentation on the Atlantic Avenue
Beautification Project was made to Council following a public meeting
on the subject. There were approximately five additional points Council
requested be addressed which were to be brought back to Council in 30 to
45 days. A staff meeting will be held this week. There are some very
involved economic questions being dealt with at the present time. A report
is expected to be ready within the next two to three weeks.
BACK BAY MANAGEMENT PLAN ITEM # 20122
Vice Mayor Henley pointed out that a second public hearing was held last
week with the Back Bay Management Plan consultants who are doing a great job
reviewing the base data and putting it all together.
Vice Mayor Henley commented the City needs to be greatly concerned about
water quality substance (as relates to the above subject, as well as to the
Lynnhaven River situation).
EROSION ITEM # 20123
Councilman Jones expressed concern about the lack of any beach (only approxi-
mately 10 yards) from 30th Street to 45th Street.
The City Manager will meet with the Erosion Commission regarding this problem.
PAVILION ITEM # 20124
Councilman Heiscbober expressed concern about a liquidation sale recently
held at the Pavilion (a flyer was circulated which advertised items for sale).
In his opinion, the Pavilion should be used for conventions, displays, etc.
He stated it was very unfair to retail merchants for the Pavilion to be used
for a retail facility.
After a brief discussion, the City Manager stated he would make copies of
the policy governing the use of the Pavilion for Council's information.

LEDGER CONSTRUCTION TTEM # 20125
Ledger Construction, in its application for a Use Permit, requested this
item be expedited inasmuch as they are attempting to have a private school
open by January 1, 1984. The Planning Conrnission will hear this August 9.
It was decided to have this item scheduled for the August 22 agenda.
KEMPSVILLE LAKE I
PAP,TNERSHIP ITEM # 20126
Kempsville Lake I Partnership's request for permission to encroach into a
portion of the City right-of-way (Weller Boulevard) for a 4-inch pressure
line was placed under "New Business" on today's agenda. The encroachment was
reviewed by all the staff and agreements have been approved by the City Attorney.
This was scheduled for next week's agenda; however, the applicant requested
expedition in order that they can meet tbeir July 4 schedule for the swimming
pool.
RAFFLE PERMIT ITEM # 20127
A request for expeditious handling of a raffle permit for Virginia Beach
Moose Lodge #1998 was made. This was an "add-on" on the Consent Agenda
(ltem #15).
POINCIANA DRIVE
STREET CLOSURE ITEM # 20128
Relative to Planning Item #8, the Mayor received a letter from H. Thomas
Patrick requesting this item be deferred until July 18. Council will not
be meeting the last two Mondays in July; consequently, it will be heard in
August. City Manager Muehlenbeck stated he attempted calling Mr. Patrick
to advise him consideration could not be given to his request.

PRESENTATION ITEM # 20131
Mayor Louis R. Jones presented a framed Resolution in Recognition to
PETTY OFFICER NANCY BEATRICE POGUE, an Aviation Storekeeper, Second Class,
United States Navy, for her unselfish and immediate response to the call
for aid by a neighbor.
With Mrs. Pogue to receive the Resolution were her husband, as well as
Commander M. E. Seay, Jr., Commanding Officer of Fleet Composite Squadron
SIX, United States Navy. Commander Seay also received a copy of the subject
Resolution in Recognition for presentation to the parents of Courtney Marie Socia.

PUBLIC HEARING ITEM # 20132
Mayor Louis R. Jones opened the Public Hearing on the rate adjustment
request by COX CABLE OF VIRGINIA BEACH.
A renegotiation session on the subject matter was held with the City Manager
June 10, 1983. A verbatim transcript of that session is hereby made a part
of the record.
Roger M. Pierce, General Manager of Cox Cable of Virginia Beach, made a
presentation on the rate adjustment. He stated that Cox Cable would pay to
the City of Virginia Beach 3 percent on any and all services derived from
any revenue source received by Cox Cable, including advertising in the
monthly booklet printed as part of the franchise fee.
Upon motion by Councilman McCoy, seconded by Councilwoman Creech, City Council
voted to ADOPT the Resolution authorizing an increase in rates charged for
basic service by Cox Cable Virginia Beach, Inc.
Voting: 9-2

RESOLUTION AUTHORIZING AN INCREASE IN
RATES CHARGED FOR BASIC SERVICE BY COX
CABLE VIRGINIA BEACH, INC.
WHEREAS, Cox Cable Virginia Beach, Inc., has applied for
authorization to increase the rates for which they charge their
subscribers fQr basic monthly service; and
WliEREAS, as required by the CATV ordinance, adopted by the Council
of the City of Virginia Beach on May 17, 1976, a special renegotiation
session and a public hearing have been held to consider this request
by Cox Cable Virginia Beach, Inc.; and
WHEREAS, Cox Cable Virginia Beach has agreed to pay franchise
fees to the City of Virginia Beach on gross revenues from subscribers
who live on military installations within the City of Virginia Beach;

WHEREAS, Cox Cable Virginia Beach has reinstated the two
Washington, D.C., stations (WTTG and WDCA) to the basic service package.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
VIRGTNIA BEACH, VTRGINIA, that effective for services rendered or
to be rendered on and after July 1, 1983, Cox Cable Virginia Beadh
is authorized to raise the basic monthly rate from $8.95 to $9.24
subject to the following stipulations:
1. if subsequent rulings by the Copyright Royalty Tribunal
negate the increased royalty fees, or any portion thereof, then this
rate increase, or portion thereof, shall be also negated or adjusted,
and amounts not necessary to be paid to the Copyright Royalty Tribunal
shall be rebated to subscribers.
2. Cox Cable Virginia Beach agrees to drop all pending Court
action against the City of Virginia Beach.
Adopted by the Council of the City of Virginia Beach, Virginia on the Twentieth
day of June, Nineteen Hundred Eighty-Three.

RESOLUTION IN RECOGNITION
WHEREAS:
The Virginia Beach City Council regularly assembles weekly
to deliberate upon the affairs of business, legislation and city
policy, also aware of many facets of municipal government which must
be coordinated for the comfort and well beinq of its citizens--among
which is the recognition of those whose contribution and personal
sacrifices are important to the welfare of people.
WHEREAS:
A new citizen was born to Virqinia Beach on April 22, 1983,
as a result of the unselfish and expedient action of
AVIATION STOREKEEPER SECOND CLASS
NANCY BEATRICE POGUE
In the peaceful slumber of the early morning hours, Petty Officer
Pogue was awakened by a loud knocking on her door. In response to
emergency, she found a neighbor in distress whose wife was in birth
labor. while her husband called the rescue squad, she unselfishly
and immediately responded to aid her neighbor whose wife was lying on
the bathroom floor. Time was of the essence. Recalling her own
experience in giving birth and the delivery of her own children, she
instructed the mother in breathing and relaxation techniques. Before
the rescue squad arrived, she successfully delivered a healthy baby
girl, COURTNEY KARIE SOCIA, at approximately three-thirty A.M. Upon
arrival of the emerqency unit, mother and daughter were both doinq
well.
NOW, THEREFORE, BE IT RESOLVED: That the Virginia Beach
City Council pauses to recognize Petty Officer Nancy Pogue for her
unselfish loyalty, dedication to others and reflection of tremendous
pride upon herself, her unit Fleet Composite Squadron Six and the
United States Navy in this outstanding performance beyond the call to
duty.
BE IT FURTHER RESOLVED: That this Resolution be framed for
presentation and the Clerk of Council directed to incorporate this
award of merit to Petty officer Pogue in the proceedings of this
Formal Session of the Virginia Beach City Council.

CITY OF VIRGINIA BEACH AND FRANCES
HERRICK HUTCHISON AND JOHN HUTCHISON,
HUSBAND AND WIFE, SWINDELL POULOCK AND
ANNE POLLOCK, HUSBAND AND WIFE
WHEREAS, Frances Herrick Hutchison and John H,tchilln,
Husband and Wife, and Swindell Pollock and Anne Pollock, Husband
and wife, own certain property north of a parcel of property the
City owns near the southeast intersection Of Princess Anne Road
and Witchduck Road; and
WHEREAS, the above-referenced individuals desire to
lease a certain .13 acre parcel of property from the City of
Virginia Beach for valuable consideration for a period of three
(3) years; and
WHEREAS, at the present tirne the City has no present
use for said property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE ci,ry OF VIRGINIA BEAC8, VIRGINIA:
The City Manager is hereby authorized to enter into an
agreeinent with Prances Herrick Hutchison and J,h, Hutchison,

THIS LEASE is conditioned upon the following
terms, conditions and covenants:
1. This lease shall conunence on May 2, 1983, and
expire on May 2, 1986, at midnight.
2. It is understood and expressly agreed between
the Lessor and Lessee that this lease may be terminated by
the Lessor at any time during the term, upon the giving of
ninety (90) days written notice to the Lessee of the
Lessor's intention to so terminate in the event the City
needs the property.
3. Upon termination of the lease, or any part
thereof, prior to the end of the term, Lessor Shall refund
any rent monies paid in excess Of the actual time of
occupation under the ter-Ms of this lease to be determined by
twelve (12) months equally divided rental base. If not
terminated the Lessee shall renew from time to time for like
3 year periods.
4. Lessor reserves, and Lessee covenants to pay
to Lessor without prior demand therefor being made, as rent
for the demised premises and for the rights herein granted
Lessee, the yearly rental of Eighteen Hundred Dollars
($1800.00) payable in monthly installments of One Hundred
and Fifty Dollars ($150.00) on the first business day of
each and every month during the term of the lease. In the
event that the rental payment is not received on the
date/dates specified above, the Lessee hereby covenants and
agrees to pay a late fee equal to ten percent (10%) of the
total monthly rent specified above, which is in arrears.
Lessor expressly reserving all other rights and remedies
provided herein and/or by law and respect th6reto.
5. The premises are leased by Lessor to Lessee
as is," and the sole responsibility for the maintenance and
upkeep of the premises shall be with the Lessee.
6. The Lessee agrees tO Protect and to hold
Lessor harmless from all damage or injury to person or
property which may result from Lessee's use or occupancy of
the premises, and to protect and indemnify the City of
Virginia Beach, Virginia, and its officers and employees
from any and all claims, demands, suits, actions, judqments
and recoveries for or on account of damage or injury,
including death, to property or person occurring on the
leased premises.
7. The Lessee shall not assign this lease
agreement or sublet the parcel or any Portion thereof
without the prior written consent of the Lessor, except that
it may be assigned or sublet to Arthur Bulman and by him to
Hagan's Seafood.
8. The Lessee agrees that it will keep and
maintain the premises in as good condition as they are at
present, and that it will deliver up possession of the
premises at the end of the said term of the lease or upon
earlier termination of said lease as provided in section two
(2) above in as good order and conditio, as the same are
now, reasonable wear and tear excepted.
9. The Lessee covenants that the property shall
be used only for off street parking in conjunction with the
use of the parcels located to the north of the demised
premi'ses, said parcels owned by the "Lessee; and the Lesse,
covenants and agrees that it will not allow said premises to
be used for any illegal or immoral purposes, that it will
not do, or suffer to be done, in or about Said premises, any
act or thing which may be a nuisance, annoyance,
inconvenience or damage to the Lessor or to any adjoining or
surrounding property in the area.
10. The Lessee shall not make or cause to be made
any improvements or install or cause to be installed any
fixtures without first obtaining the landlord's written

advertising niatter Or Other thing of any kind without first
obtaining landlord's written aoproval or consent.
11. In the event tliat the Lessee breaches or
fails to perform any agreements herein, then the Lessor
shall have the option to terminate this lease upon ten (10)
days written notice, or to resume Possession and relet the
demised premises for the account of the Lessee. In addition
hereto, Lessor may pursue such other remedies as are
Drovided by law and in paragrapli eleven (11) in the event f
any breach, default or abandonment by the Lessee.
12. This lease contains the entire agreement
betwoen tlie parties hereto, and it catnot be altered or
niodified in any way except in writinq signed by the Darties
hereto. Any failure of either party hereto to insist upon
strict observance of any covenant, provision or condition of
this lease in any one or more instance shall not constitute
or be deemed a waiver at that time or thereafter of sucti or
any other COVenant, provision or condition of this lease.

Any person who shall violate anv of the provisions of
this chapter shal.1- he (luilty of a Class I misdf'meanor.
Section 15-3. Numberina of roorns.
Each sleeping room or livinq room unit in a roomina
house, lodging house, tourist court, motel or hotel shall be
numbered or designated in a plain, conspicuous manner. Such
number or desiqnation shall be placed on the outside of the outer
door of each sleeping room or livinq room unit, and no two (2)
sleepinq rooni or livinq room @inits shall t)ear the same
number.
Section 15-4. -Rate advertisements.
Except in those instances where the same rates apply to
all units, apartments and rooms in the establishment at all
tiTnes, without reqard to seasons, no person shall displav or
caL)se to be displayed in the rity anv -,;3,qn or siqns, which mav be
seen from a public hiqhway or street, which siqn or siqns
include, in dollar--, an,! c,,rts, a satement relati q t. th,- rates
charged for lodaina accommodations at a rooming house, lodqinq
house, motel or hotel, unless such sign or siqns include, in
letters and fiqures of similar ze an,,l proninence, th,, follwinq
ad(itional information:
(1) The total number of units, apartments or rooms in
the estahlishment and the actual number thereof
available for rental and occupancy at each rate
qtioted.
(2) Whether the rates auoted are for sinqle or
mul.tiple occtipancv, where such fact affects the
rates charqed.
(3) The dates durinq which such rates are in effect,
where such dates aff-et the rates charqed.
The rates displayed on such siqn or siqns shall in each instance
coincide with the rates posted in the units apartments and rooms
of tlie establishment and such sian or signs shall not have
thereon rates for an,v accommodations not offered to the public or
any false, untrue, misleadinq, I ceptive or fraudulent statement,
representation or i.nformation relatinq to rates.
Section 15-5. Guest reqister nenerally,
(a) Every person conductinq any rooming house, lodqino
house, tourist court, motel or hotel in the city, where rooms are
let, shall at all times keep and maintair) therein a citiest
rpqister, in which shall he inscribed, with ink or indelible
pencil, the name and home address of each quest or Derson rentinq
or occupying a room therein. Such reqister shall be signed by

the PerSOn renting a room, or someone bv his authority, and the
Proprietor of such lodqinq house, roominq hous(--, tourist court,
motel or hotel, or his agent, shall thereupon write, with ink or
indelible pencil opposite such name so reqistered, the number of
each room assigned to and occupied by such ouest, together with
the date when such room is rented. t3ntil all of the aforesaid
entries have been made in such reqister, no quest shall be
suffered or permitted to occupy privately any room in such
lodging house, roominq house, tourist court, motel or hotel.
When the occupant of a room so rented shall vacate and surrender
the same, it shall be the further (luty of the proprietor of the
rooTnina house, lodainq house, tourist court, Tnotel or hotp-1, or
his a.oent, to maintain, for one year, a record of the date when
such room @vas vacated and surrenlered.
(b) The relister required by this section shall be
subject to inspection at any and al.1 reasonable times by the
chief of police or by anv police officer in the performance of
his duties.
Section 15-6. False reqistration hy quests.
It shall be unlawful for any r)erson to write, or cause
to be written, or knowingly permit to be written, in anv quest
reqister in any roominq house, lodqinq house, tourist court,
motel or hotel in the city, any oth(,r or different name or
designation than the trtie name of the pe-rson reqistp-red therein,
or the name by which such person is cenerally known.

AND REDUCE FY84 APPROPRIATIONS
WHEREAS, fundina of $14,000 has been Drovided in
the FY84 budget of the Erosion Commission for the
Qurchase of a new four-wheel drive vehicle to replace
an older unit, and
WHEREAS, officials of the Erosion C()mmission
indicate that the vehicle to be replaced is in
immediate need of major repair, and it is their desire
to purchase a new vehicle at this time, and
WHEREAS, the cost of a new vehicle is $11,800 and
the Erosion Commission has the necessary fundina bv
transfer from available sources within its budget, and
WHEREAS, a purchase at t@is time will eliminate
the FY84 vehicle purchaso and will reduc-- FY84
approDriations by $14,000.
NOW THEREFORE BE IT ORDAI-LQED BY THE COUNCTL OF THE
CITY OF VIRGINIA BEACH that funds of $11,800 be transferred
from available sources within the Erosion Commission

FOR THE DEPARTMENT OF PARKS AND RECREA-
TION AND INCREASE ESTIMATED REVENUES
CONCERNING RECREATION CLASS FEES FOR
FISCAL YEARS 1983 AND 1984 IN THE AMOUNTS

WHEREAS, the Department of Parks and Recreation in
previous years collected fees for adult and youth classes and
remitted those fees directly to the professional instructors,
and
WHEREAS, this pc)licy has been revised in FY 83 whereby

WHEREAS, due to this policy change the Department of
Parks and Recreation is requesting an additional apprc)priation
of $3,000 for its youth activities budget in FY 83 and $22,500
for adult and youth activities in FY 84 to pay the contractual
services for professional instructors, and
WHEREAS, both appropriations will be offset by
increased revenues from the recognition of the participants'
fees as revenue and in addition the department will charge
a $5 administrative cost per participant which will result
in excess revenues over expenditures.

THE CITY OF VIRGINIA BEACH, VIRGINIA:

AN ORDINANCE TO ACCEPT A GRANT FROM
THE DEPARTMEN-1 OF CORRECTIONS TOTALING
$164,800 AND TO APPROPRIATE THESE FUNDS
FOR THE VIRGINIA BEACH COMMUNITY DIVERSION
PROGRAM.
WHEREAS, the Virginia General Assembly has enacted the
Community Corrections Incentive Program which makes funds available
to jurisdictions within the Commonwealth for the purposes of
diverting qualified non-violent offenders from the State peni-
tentiaries for the purpose of rehabilitating these offenders and
allowing them the opportunity to make restitution for their
crimes; and
WHEREAS, the City of Virginia Beach is currently
operating such a program; and
WHEREAS, the Virginia Department of Corrections has
approved the necessary funding to continue the Virginia Beach
Community Diversion Program to accomplish the objectives stated
above:
NGW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY CF VIRGINIA BEACH, VIRGINIA:
THAT the City Manager is hereby authorized to accept
the grant for the City and funds are hereby appropriated for the
following purposes:

HEIRS, ASSIGNS AND SUCCESORS IN TITLE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
That pursuant to the authority and to the extent
thereof contained in Section 15.1-893, Code of Virginia, 1950, as
amended, Mr. John Parrott, 4640 Ocean View Avenue, his heirs,
assigns and successors in title is authorized to construct and
maintain a temporary encroachment into the right-of-way of
Garrison Avenue and Bayside Avenue.
That the temporary encroachment herein authorized is
for the purpose of constructing and maintaining a granite quarry
stone scour apron for protection of an existing bulkhead and that
said encroachment shall be constructed and maintained in
accordance with the City of Virginia Beach Public Works
Department's specifications as to size, alignment and location,
and further that such temporary encroachment is more particularly
described as follows:
An area of encroachment into a portion of
the City's right-of-way known as Garrison
Avenue and Bayside Avenue, on the certain
plat entitled: "Scour Apron Encroachment
Into Garrison Avenue and Bayside Avenue,"
a copy of which is on file in the
Department of Public Works and to which
reference is made for a more particular
description.
PROVIDED, HOWEVER, that the temporary encroachment
herein authorized shall terminate upon notice by the City of
Virginia Beach to Mr. John Parrott, his heirs, assigns and
successors in title and that within thirty 30 days after such
notice is qiven, said encroachment shall be removed from the City
right-of-way of Garrison Avenue and Bayside Avenue and that Mr.
John Parrott, his heirs, assigns and successors in title shall
bear all costs and expenses of such removal.

AND, PROVIDED FURTHER, that it is expressly understood
and agreed that Mr. John Parrott, his heirs, assigns and
successors in title shall indemnify and hold harmless the City of
virginia Beach, its agents and employees from and against all
claims, damages, losses, and expenses including reasonable
attorney's fees in case it shall be necessary to file or defend
an action arising out of the location or existence of such
encroachment.
AND, PROVIDED FURTHER, that this ordinance shall not be
