WHEREAS, the City of Virginia Beach has enacted an ordinance dated
May 17, 1976, which regulates CATV in the City of Virginia Beach; and
WHEREAS, this ordinance allows for the establishment of regulatory
and service requirements through a competitive franchise process and through
negotiation, which brings the benefits of competition to the citizens of
Virginia Beach; and
WHEREAS, this ordinance has provided adequate regulations to ensure fair
competitive practices on the part of cable operators in the City; and
WHEREAS, Senate Bill 66 (Cable Telecommunications Act of 1983) would
invalidate the City's carefully prepared ordinance and substitute federal control
for that of states and localities; and
WHEREAS, this bill is special interest legislation which seems to be
designed to eliminate meaningful competition from the cable industry; and
WHEREAS, Senate Bill 66 would invalidate two freely-negotiated franchise
agreements in Virginia Beach by unilateral federal action while cable operators
would retain all their benefits, an action which is fundamentally unfair.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA, that it requests its Senators to oppose Senate Bill 66 in order
to preserve the rights of the citizens of the City of Virginia Beach to enjoy
the privilege of cable TV which was gained through effective local government
action.

photographs, drawings, and other Dertinent information were made
available for public inspection in accordance with state
requirements, and

AND PERMANENT EASEMENTS OF RIGHT-OF-WAY,
EITHER BY AGREEMENT OR BY
CONDEMNATION.
WHEREAS, in the opinion of the Council of the City of
Virginia Beach, Virginia, a public necessity exists for the
construction of this important roadway to provide transportation
and for other public purposes for the preservation of the safety,
health, peace, good order, convenience, and for the welfare of
the people in the City of Virqinia Beach.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF VIRGINIA BEACH, VIRGINIA:
Section 1. That the Citv Attorney is hereby authorized
and directed to acquire by purchase or condemnation pursuant to,
Sections 15.1-236, et seq., 15.1-898, 15.1-899 and Section
33.1-89, et seq, Code of Virginia of 1950, as arnended, all that
certain real property in fee simple including temt)orary and
permanent easements of right-of-way as shown on the plans
entitled, "Drainacte System - Ocean Park - Phase I and Drainaqe
System - Ocean Park - Phase II, these plans being on file in the
Office of Real Estate, Department of Public Works, Virginia
Beach, Virqinia.
Section 2. That the City Attorney is hereby authorized
to make or cause to be made in behalf of the City of Virginia
Beach, to the extent that funds are available, a reasonable offer
to the owners or persons having an interest in said lands, if
refused, the City Attornev is hereby authorized to institute
proceedings to condemn said property.
Section 3. That an emerqency is hereby declared to
exist and this ordinance shall be in force and effect from the
date of its adoption.

GENERAL FUND
WHEREAS, the Police vice squad seized $547 in
a gambling raid, and
WHEREAS, the ensuing court case has been
concluded, and the money seized has been forfeited
to the City of Virginia Beach, and
WHEREAS, the Police Department has requested
that the confiscated funds be placed in the Uniform
Division's confidential account for use by the
vice unit, and
WHEREAS, City Council feels this is a proper
request and desires to support the efforts of the
Police Department's vice unit.
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF
THE CITY OF VIRGINIA BEACH that funds of $547 are
hereby appropriated to the Police Department Uniform
Division's confidential account for use by the vice
unit.
BE IT FURTHER ORDAINED that the General Fund
Revenue confiscated monies be increased by $547 to
finance this appropriation.
This ordinance shall be effective from the date
of its adoption.

WHEREAS, Mr. Harry L. Solomon, Jr., Mr. William J.
Jones, and Mr. William E. Conklin each desire to assign his 2 1/2
percent interest in a limited partnership named the Chesapeake
Oil and Gas 1980#7 to the City of Virgi.nia Beach; and
WHEREAS, the property owned by this limited partnership
is expected to produce substantial revenue to which these
interests would become entitled in the coming years; and
WHEREAS, it is their desire, but they do not direct,
that the revenue produced by these property interests be used for
the financial assistance of the Virainia Museum for Marine
Sciences, or some other similar public purpose as may be deemed
appropriate by City Council; and
WHEPEAS, they have tendered these gifts to the City of
Virginia Beach on December 22, 1982; and
WHEREAS, it is deemed to be in the public interest of

R E S 0 L U T I 0 N
WHEREAS, Bold Venture, a Virginia qeneral partnership,
consisting of Mr. Oscar E. Parker, Jr., Dr. John J. Krueger, Mr.
R. Lawrence Smith, Mr. Bill R. Beach and Mr. Norman J. Zwahlen,
wish to aive to the City of Virginia Beach certain contract
rights amountinq to a Twenty (20) percent interest in three oil
wells situated in Pennsylvania; and
WHEREAS, it has been estimated by an independent
enqineering concern that the economic valuation of the
partnership interest in the three oil wells is approximatelv
$77,760; and
WHEREAS, it is the partnership's desire, but they do
not direct, that the revenue produced by this property interest
be used for the financial assistance of the Virqinia Musuem for
Marine Sciences, or some other similar public purpose as may be
deemed appropriate by City Council; and
WHEREAS, this qift was tendered bv the partnership to
the City of VirQinia Beach on December 30, 1982; and
WHEREAS, it is deemed to be in the public interest of
the City of Virainia Beach to accept such qift.
NOW, THEREFORE, be it resolved by the City Council of
the City of Virqinia Reach:
That the Citv ManaQer is hereby authorized to accept
such gift to be used in the future for the financial assistance
of the virainia Museum of Marine Sciences or some other similar
public purpose as may be deemed appropriate by the City Council.

COMMUNITY DEVELOPMENT PROGRAM
WHEREAS, the Office of Housing and Community
Development (HCD) has been notified that the construction ldhase
of their Seatack Street Project is ready to be bid, and
WHEREAS, the determination has heen made that
additional appropriations are required so that funding for this
construction phase can be certified, and
WHEREAS, funds are available for transfer from the
Community Development seventh and eight program year caldital
project budgets, and
WHEREAS, funding to the projects from which these
transfers will be made will be restored in the FY 84 Community
Development budget.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF VIRIGNIA BEACH, VIRGINIA:
That a transfer of appropriations in the amount of
$465,600.00 be made within the Seventh and Eighth Program Year
capital prolect budqets for funding the Seatack Street Project.

SHOWN ON THAT CERTAIN PLAT ENTITLED "PLAT
SHOWING 15 FOOT ALLEY ADJOINING LOTS 76,
77, 95 AND 96, THE HOLLIES, PROPOSED TO BE
CLOSED BETWEEN MYRTLE AVENUE AND ATLANTIC
AVENUE, VIRGINIA BEACH, VIRGINIA, WHICH PLAT
IS RECORDED IN THE CLERK'S OFFICE OF THE
CIRCUIT COURT OF THE CITY OF VIRGINIA BEACH,

WHEREAS, it appearing by affidavit that proper notice
has been given by Claud P. Brownley, III, Tren L. Brownley and
Bernice Leonard, that they would make application to the Council

in and along the western side of Atlantic Avenue
across a 15 foot alley to the southeast corner of
Lot 95; thence in a westerly direction along the
southern boundary line of Lot 95 and Lot 96, 80
feet to a point, in the southwestern corner of
Lot 96, which said point is on the eastern line
of Myrtle Avenue; thence in a southerly direction
along the eastern line of Myrtle Avenue across
said 15 foot alley to a point in the northwest

AN ORDINANCE TO APPROPRIATE FUNDS
OF $10,380 FOR CABLECASTING CITY
COUNCIL MEETINGS
WHEREAS, City Council has approved cablecasting City Council meetings,
and
WHEREAS, the cost to prepare the Council Chambers and to produce
Council sessions for cablecast on our local government access channel is
estimated to be $10,380 for the remainder of this fiscal year, and
WHEREAS, funding is available from the increased fees the City will
receive as a result of the Cox Cable rate increase effective January 1,
1983.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA, that funds of $10,380 are hereby appropriated to the City
Council's budget for cablecasting City Council meetings.
BE IT FURTHER ORDAINED that estimated General Fund Revenue for franchise
taxes from cable television be increased by $10,380 to finance this
appropriation and that the City Manager be authorized to enter into the
necessary agreements and contracts to prepare the Council Chambers and to
produce the City Council meetings within the amount so authorized.
This ordinance shall be effective from the date of its adoption.
Adopted by the Council of the City of Virginia Beach, Virginia, on
the. day of 1983.
