The Regular Meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by Mayor J. Henry McCoy, Jr., D.D.S.,
in the Conference Room, City Hall BUilding, on Monday, 5 April 1982,
at Twelve-Thirty in the afternoon.

ITEM #18000
Mayor McCoy entertained a motion to permit Council to conduct its
INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the
purpose of discussing the following:
1. PERSONNEL MATTERS: Discussion or consideration
of employment, assignment, appointment, promotion,
performance, demotion, salaries, disciplining or
resignation of public officers, appointees or
employees.
2. PUBLICLY HELD PROPERTY: Discussion or consideration
of the condition, acquisition or use of real property
for public purpose, or of the disposition of publicly
held property, or of plans for the future of an insti-
tution which could affect the value of property owned
or desirable for ownership by such institution.
3. LEGAL MATTERS: Consultation with legal Counsel or
r@iefi.gs by staff members, consultants or attorneys,
pertaining to actual or potential litigation, or other
legal matters within the jurisdiction of the public
body.

the INFORMAL SESSION.

EVALUATION/APPOINTEES ITEM #18001
Due to the heavy schedule on the Agenda, Mayor McCoy requested the
evaluation of Appointees be postponed until a future meeting of the
Council.
DISABLED AMERICAN VETERANS ITEM #18002
Mayor McCoy made reference to a letter from Robert M. Shesler,
Commander, Disabled American Veterans, requesting Council adopt a
Resolution opposing the inclusion of fixed income social security payments,
price-connected veterans' compensation or vocational rehabilitation
assistance, etc., as taxable income by the City of Virginia Beach
in the determination of Real Estate Disability Tax Exemption.
Mayor McCoy advised he had "problems with the wording' and Vice Mayor
Heischober advised he would like to discuss the wording of the
Resolution with the City Attorney.
KINGS POINT DITCH ITEM #18003
Mayor McCoy advised Council of a telephone call from a resident in
Kings Point reqarding the Kings Point Ditch.
The City Manager advised Council the Kings Point Ditch will need to
be in the Capital Improvements Program for 1983-84. The City Attorney
advised Council of the necessity for an additional Ordinance ratifying
the cost of the Ditch.
The City Manager advised construction should begin between June of
1983 and June 1984.

EXPEDITION OF PLANNING ITEM ITEM #18004
Counclman Ervin requested the application of E. B. Midgett (Funland
Corporation), be expedited to be heard by the Planning Commission on
April 13, 1982 and by the City Council on April 26, 1982.
This matter will be voted on in the FORMAL SESSION of today's meetinq,
(April 5, 1982)

MARINE SCIENCE MUSEUM ITEM #18005
Councilman Holland advised tht he and Councilman Buchanan were appointed
by Mayor McCoy to a Committee to meet with the Marine Science Museum
personnel and advised he and Councilman Buchanan would like to discuss
tbat meeting during he INFORMAL SESSION of April 12, 1982.

VIRGINIA BEACH ARTS CENTER ITEM #18006
The Virginia Beach Arts Center has requested Council defer action on
the Resolution authorizing the City Manager to execute a lease between
the City of Virginia Bech and the Virginia Beach Arts Center
Incorporated.
The City Manager asked that this item be removed from the Agenda by
request of the Arts Center Executive Director.
STREET CLOSURE ITEM #18007
The City Manager advised in the petition of Jerry F. McDonnell for
the closure of portions of 28th and 29th Streets and two 20-foot
unnamed lanes VEPCO had requested this matter be deferred.
The City manager advised VEPCO has obtained their necessary easements
and their request for deferral should be deleted from the Agenda.
CEDAIR@HILL CANAL BID ITEM #18008
The City Manager advised Council in his letter regarding the Cedar
Hill Canal Bid there is an error in the second paragraph.
'This project consists of upgrading, redigging, and
reshaping the Cedar Hill Canal from Centerville
Turnpike to approximately 1,700 feet north south of
Indian River Road (or Westward Drive).'

RESEARCH AND ADVISORY ITEM #18009
R. H. Koch, President of the Virginia Beach Research and Advisory
Council, recognized three members of the Advisory Council who
prepared the report concerning Solid Waste Collection:
William H. Duis, Co-Chairman
Tom Aiken, Co-Chairman
Sheldon Corner, Treasurer's Office
Mr. Duis advised that "at the request of City Council we were asked
to study the impact of current once-per-week solid waste pick-up and
assess its cost effectiveness. Also, we were asked to recommend
improvements to the present system and provide any alternatives with
cost benefits".
The following objectives were establisbed:
1. To determine public acceptance of once-per-week
collection.
2. To determine if projected savings were realized
when collection frequency was reduced to once-per-
week.
3. To determine any adverse effects of the present
system.
4. To determine if any cost effective improvements
could be made to the present system.
This matter will be heard in the FORMAL SESSION for further discussion
and vote.
VIRGINIA EMPLOYMENT COMMISSION ITEM #18010
The City Manager advised that at a previous meeting Council had
discussed office space for the Virginia Employment Commission. The
Staffhas located space in the Lynnhaven Shoppes at a cost of $6.50
per square foot, (2,000 square feet) for $13,000 per year.
The Commission will supply the telephones and employees with the City
providing the remainder of the utilities and offic!e sp,c,.
The City Manager advised he would like to sign a year-to-year lease
with the Virginia Employment Commission.
This matter will be brought to Council for formal action.

VOTING PRECINCTS ITEM #18011
Mrs. Cleta Liverman, General Registrar, spoke before Council with
a request from the Electoral Board for Council to define the
Precincts to be re-evaluated:
Ocean Park
Chesapeake Beach
Fairf ield
Brandon
Seatack
Lake Christopher
Mrs. Liverman advised the Precincts were divided by placing 2,000
voters in each and the changes will become effective when the
General Assembly approves a Redistricting Plan for the State of
Virginia.
WATER AND SEWER POLICY ITEM #18012
The City Manager advised that on the FORMAL AGENDA was a Resolution
setting forth the policy of the City of Virginia Beach in regard to
extension of the public water and/or sewer systems into areas developed
prior to the availability thereof.
This matter will be brought forward to the FORMAL AGENDA for further
discussion and vote.
It was noted that Council voiced considerable concern over the
wording of the Resolutio, and requested it be deferred.

concerning this Ordinance.
Upon motion by Councilman Holland, seconded by Councilwoman Oberndorf,
City Council voted to REFER BACK to the Planning Commission the
Ordinance to amend and reordain Article 2, Section 201(d) of the
Comprehensive Zoning Ordinance pertaining to requirements relating
to fences and walls TO RE-EVALUATE the original recommendations,
to evaluate the original Ordinance, to evaluate any new proposals
and to include whether to permit by right construction of tennis
courts within residential areas.

The following spoke in opposition:
Mrs. Nancy Parker, President of the Old Beach
Civic League
Edward Barco, resident of Shorehaven and former
resident of 27th Street.
Upon motion by Councilman Holland, seconded by Councilman Baum,
City Council voted to uphold the recommendation of the Viewers
and ADOPT the Ordinance closing, vacating and discontinuing a
portion of those certain portions of those streets, known as
28th Street, 29th Street, 20-foot unnamed lane lying between
28th and 29th Streets, and a portion of that certain 20-foot
lane lying between 27th and 28th Streets. Petition of Jerry
F. McDonnell. Approval subject to the following:
1. Drainage easements over the entire area to
be closed are to be retained by the City of
Virginia Beach.
2. No excavation or filling will be allowed
without obtaining the necessary permits from state,
local and federal agencies.
3. Utility easements over the entire width of
all the rights-of-way proposed for closure shall be
retained for maintenance of existing or future
utilities.
4. The vacation of existing lot lines to ensure
that all lots have access to a public street.

Upon motion by Councilman Ervin, seconded by Councilman Baum, City
Council voted to uphold the recommendation of the City Manager and
ADOPT the Ordinance amending Chapter 2, Division 3, by adding
Section 2-60 of the Code of the City of Virginia Beach, Virginia,
by accepting the offer of the State Archivist dated March 25, 1982,
to process and microfilm records, including Minutes of the Virginia
Beach City Council, and authorizing the Clerk of Council to prepare
said records and implement the processinq and microfilming in
accordance with said offer from the Virginia State Archivist and the
provisions of Title 42.1, Chapter 7, Code of Virginia, 1950, as amended.

City Council voted to uphold the recommendation of the City Manager and
ADOPT the Ordinance to amend and reordain Chapter Two of the Code of
the City of Virginia Beach, Virginia, relating to the reorganization
of certain police agencies and chartered and non-chartered volunteer
fire departments and rescue squads as an integral part of the official
Public Safety Program of the City of Virginia Beach.
