The Regular Meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by Mayor J. Henry McCoy, Jr., D.D.S.,
in the Conference Room, City Hall Building, on Monday, 8 March 1982,
at 12:35 p.ni.

Mayor McCoy entertained a iiiotion to pernlit Council to conduct its
INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the
purpose of discussing the following:
1. PERSONNEL MATTERS: Discussion or consideration
@f employment, assignment, appointment, promotion,
perforniance, demotion, salaries, disciplining or
resignation of public officers, appointees or
employees.
2. LEGAL MATTERS: Consultation with legal Counsel

attorneys, pertaining to actual or potential
litigation, or other matters within the juris-
diction of the public body.

BASKETBALL GAME ITEM #17890
Mayor McCoy reminded Council of the James K. Cole Memorial basketball
game and the City staff on Friday, March 12, 1982, at 7:00 P.M., in
the Virginia Beach Recreation Center.
VEPCO EASEMENT ITEM #17891
Mayor McCoy advised Council of a meeting between the City Manager,
Ass i stant City Attorney and hi mseif with Wi 1 1 i am Berry, Pres i dent
of Virginia Electric and Power Company, regarding the use of a
VEPCO right-of-way and easements for a bike trail from Mount Trashmore
to Princess Anne Park.
VEPCO would like the City to purchase the right-of-way and easements.
The City would like to maintain the easenient and not purchase the
property but possibly "trade" other property to VEPCO.
VEPCO has advised Council they will take the matter under advisement.
The City also discussed with VEPCO lower electrical rates for the
Municipal Center and beautification of Atlantic Avenue.
NEW YORK/BONDS ITEM #17892
Mayor McCoy advised Council he went to New York for the signing
of the Bonds and found it to be a fascinating experience and
suggested all future Mayors of Virginia Beach attend the signing/
closing of future Bond issues.
SENATE BILL 69 ITEM #17893
Mayor McCoy advised Council that Senate Bill 69 will be a nloot issue
as far as Council is concerned. The Bill passed the House of Delegates
on Friday, March 5, 1982 and will be presented to the Governor for
his signature. Approximately $90 Million in additional revenues
will be utilized for teachers salaries.
Mr. David M. Grochmal, Assistant to the City Manager for Intergovernniental
Relations, advised the Bill will aid basic education and increase per
pupil al 1 ocati on fro ni $1 , 306 to $1 , 320/ $1 , 436 to $1 , 476. "Shall endeavor"
are words used in reference to increase teacher salaries--nothing else
specified--10% per Bi-ennium. The budget will probably be presented
Saturday, March 13, 1982, and the General Assenibly hopes to complete
its work this week.

PECAN GARDENS ITEM #17894
Mayor McCoy advised Council that on February 22, 1982 Walter Monahan
spoke before Council concerning the Pecan Gardens subdivision whereby
the Department of Public Works had notified him he must escrow one-half
the cost of piping a ditch at the end of Arthur Avenue.
The City Manager advised he and the Director of Public Works met
on this matter and as the request is a City Policy Mr. Monahan
will be required to escrow funds for one-half of the cost of piping
the ditch at the end of Arthur Avenue in Pecan Gardens, (approxmately
$1 4 , 0 0 0 ) .
The City Manager advised developers are responsible for one-half
the cost of pipe and construction unless the pipe is 72" or larger
and then a canal is constructed. The Code allows the City Manager to
waive for site plans; however, the Council must waive for developers.
Council instructed the City Manager and Director of Public Works to
work with the City Attorney regarding policy revisions and report
to City Council.
VOTING BOARD ITEM #17895
Mayor McCoy advised Council that the City Clerk has obtained figures
on speeding the voting process of the Voting Board. The cost will
be approximately $350.00.

BINGO/RAFFLE ITEM #17896
Councilwoman Oberndorf requested the Bingo/Raffle pernlit application of
Tidewater Rape Inforniation Services, Inc. (TRIS) be placed on the
FORMAL AGENDA for vote.
ICE CREAM STORE (AM_LR@IA ITEM #17897
Councilwoman McClanan advised she and Councilwoman Oberndorf have
received telephone calls froni the owner of the Ambrosia Ice Cream
Parlor requesting an appearence before Council to discuss the
matter of being required to place two (2) bathrooms in his store.
The store is located in the Chimney Hill section of Virginia Beach.
The owner is to provi de Council wi th the ad equ ate i nf ormati on
concerning this niatter.
SHENSTONE COURT AREA ITEM #17898
Counciltnan Ervin made reference to a letter concerning water and
sewer in the Shenstone area of Virginia Beach and suggested Council
prepare a "clear cut" Policy concerning water and sewer lines.

VIRGINIA BEACH ARTS-CENTER ITEM #17899
The City Manager advised Council that in 1971 the City Council
indicated a desire to permit the Virginia Beach Arts Center to
utilize land known as Toll Road Park, north of the Virginia
Beach Toll Road between 23rd Street and Parks Avenue.
Mrs . Frank Batten i ntroduced Frederi ck Schniid, Director, Vi rgi ni a
Beach Arts Center, who advised Council of a Resolution adopted by
the Board of Directors of the Virginia Beach Art Center.
Mr. Schrnid spoke to Council regarding construction of a new Virginia
Beach Art Center and advised of the ways in which the Center would
raise the funds for the proposed construction. He also acknowledged
that the City owns the land and would have to extend 23rd Street and
Parks Avenue plus provide utilities, insurance and exterior inaintenance.
The City Attorney was directed to review the legal facets whereby the
Center would build the building, donate it to the City and the City would
provide a lease-back arrangement with the Virginia Beach Arts Center for
the Center.
CANAL NUMBER ONE ITEM #17900
The Engineering Division reviewed the history of Canal No. 1 and
tnade a preliminary investigation of the existing drainage systein
in this watershed to determine the necessity of Canal No. 1 for
drainage purposes. Based on this review, it is the recotilillendation
of the Engineering Staff:
1. That the scope of the Canal No. I project
be reduced by elimination of that portion of
the al i gnnient f roni Redwi ng Lake to approxiinately
fifteen hundred feet (1,500') north of Bells Road.
2. The alignment of Canal No. 4 be iiiaintained to
allow for possible construction in the future.
3 . Canal No. 1 aiignment f roiii 01 d Da iii Neck Road
to Redwing Lake be maintained to allow for the
interception of stori@ runoff which presently
outfalls into the Redwing Lake/Lake Tecumsah
system.
4. A study of the watershed be performed in
conjunction with development of the area.
5. If Canal No. I alignillent is modified the
City make a firm commitment to ensure that the
existing drainage systems are upgraded as
necessary with the development.
A Resolution will be presented to Council on March 15, 1982, noting
the areas of the Canal to be elitiiinated and the areas to be studied.

VIRGINIA EMPLOYMENT COMMISSION ITEM #17901
The City Manager advised the City has been contacted by the Virginia
Employment Commission and Delegate Glenn B. McClanan regarding the
reopening of a Virginia Eniployment Coi-nniission Office in Virginia Beach.
In order for the Employnient Commission to have an office in Virginia
Beach the City must provide the cost of the space and utilities with
the exception of telephones.
The Commi ssi on has i ndi ca ted they wo ul d like to allocate 20 employees
for the Virginia Beach area - 13 to work in unemployment insurance and
7 to work in employment services.
BUDGET ITEM #17901(a)
The City Manager advised Council that prior to Mr. Hanbury's leaving
he had held staff meetings with all Department Heads and reduced the
departiiiental requests by approximately $6.5-Million.
The City Manager advised he discussed the possibility of reducing
the budget with the menibers of the staff and Council received a
copy of the minutes to the meeting.

Mr. Glen Bond, National Fish and Wildlife Services, Back Bay National
Wildlife Refuge, presented a check to the City of Virginia Beach in
the amount of $110,571.00, in behalf of the Fish and Wildlife Services
for property owned by the Services entitled Back Bay National Wildlife
Refuge and that portion of Mackie Island in the City of Virginia Beach.
This check is in lieu of taxes, and represents 88% of what the taxes
would have been, but represents 100% of the Federal allocation.

-lomiaunity Development Act of 1974 made substantial changes to the
Community Development Dlock Grant Progr:am concerning citizen
participation; Those amendments require that the City of
Virginia Beach shall:
1) Furnish citizens infol-mation concerning the amount
of funds available for proposed community development and housing
activities and the range of activities that may be undertaken;
2) Publish a proposed statement in such manner to
afford affected citizens an opportunity to examine its content
and to submit cominents to the City on the proposed statement and
on the commu@iity development performance of the City;
3) Hold one (1) or more public fiearings to obtain the
v4@--v7s o-- citizens on com:,,unity de!,Tclo,@ment and housing needs;
and
4-) Consider any such comments and views in preparing
the statement and may, if deemed appropriate by the City, modify
the proposed stateinent; and make the final statement available to
the public.

Ordinance upon application of Virginia Beach Campgrounds,
Inc., for a Change of Zoning District Classification from
R-8 Residential District to B-2 Community- usiness District
on certain property located on the South side of South
Birdneck Road beginning at a point 90.43 feet East of
General Booth Boulevard, running a distance of 50 feet along
the South side of South Birdneck Road, running a distance of
185 feet along the Eastern property line, running a distance
of 50 feet along the Southern property line and running a
distance of 185 feet along the Western property line. Said
parcel contains .212 acre. PRINCESS ANNE BOROUGH.
Approval is subject to the following provisions in
conjunction with the intended use of the land:
1. Standard improvements as required by the Site Plan
Ordinance.
2. City water and sewer.
3. The developer shall install standard right-of-way
improvements including pavement widening, curb and
gutter, sidewalk and storm drainage facilities
along the frontage on South Birdneck Road.
4. A 15-foot dedication along the frontage on South
Birdneck Road, 45 feet from the centerline of the
old 60-foot right-of-way to provide for an ultifflate
90-foot right-of-way as per the Master Street and
Highway Plan.
5. The vacation of the existing lot lines in order to
avoid the creation of nonconforming lots.
This Ordinance shall be effective from date of adoption.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA:
Ordinance upon application of Virginia Beach Campgrounds,
Inc., for a Conditional Use Permit for a gasoline station
and registration center on certain property located at the
Southeast corner of General Booth Boulevard and South
Birdneck road, running a distance of 90.43 feet along the
South side of South Birdneck Road, running a distance of
185 feet along the Eastern property line, running a distance
of 219 feet along the Southern property line and running a
distance of 224.41 feet along the East side of General Booth
Boulevard. Said parcel contains .70 acre more or less.
PRINCESS ANNE BOROUGH.
Approval is subject to the following provisions in
conjunction with the intended use of the land:
1. Standard improvements as required by the Site Plan
Ordinance.
2. City water and sewer.
3. The developer shall install standard right-of-way
improvements including pavement widening, curb and

4. The developer shall provide an adequate drainage

Council voted to uphold the recomniendation of the Planning Conimission
and APPROVE the request of VAUGHAN MUMFORD for a variance to Section
4.4(a) of the Subdivision Ordinance as per the following:
Appeal from Decisions of Administrative Officers in
regard to certain elements of the Subdivision Ordinance,
Subdivision for Vaughan Muniford. Property located at
the Northeast corner of 20th Street and Mediterranean

The applicant requests a variance to Section 4.4(a)
