The Regular Meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by Mayor J. Henry McCoy, Jr., D.D.S.,
in the Conference Room, City Hall Building, on Monday 22 February
1982, at Five o'clock in the evening.
Council Members Present:
John A. Baum, E. T. Buchanan, Vice Mayor Harold Heischober,
Barbara M. Henley, Clarence A. Holland, M.D., W. H. Kitchin,
III, Reba S. McClanan, Mayor J. Henry McCoy, Jr., D.D.S.,

Mayor McCoy entertained a motion to permit Council to conduct its
INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the
purpose of discussing the following:
1. PERSONNEL MATTERS: Discussion or consideration of
employment, assignment, appointment, promotion'
performance, demotion, salaries, disciplining or resignation
of public officers, appointees or employees.
2. PUBLTCLY HELD PROPERTY: Discussion or consideration of the
ondition, acquisition or use of real property for public
purpose, or of the disposition of publicly held property, or
of plans for the future of an institution which could affect
the value of property owned or desirable for ownership by
sucb institution.
3. PUBLIC FUNDS INVESTMENT: The investing of public funds
where competition or bargaining is involved, wbere if
made public initially the financial interest of the
governmental unit would be adversely affected.
4. LEGAL MATTERS: Consultation with legal Counsel or briefings
by staff members, consultants or attorneys, pertaining to
actual or potential litigation, or other legal matters within
the jurisdiction of the public body.

City Council made several comments concerning an article which appeared
in the LEDGER STAR regarding Legal Matters.
Upon motion by Councilman Buchanan, seconded by Councilman Standing,
City Council voted to proceed into the EXECUTIVE SESSION following
the INFORMAL SESSION.

ICE CREAM PARLOR ITEM #17808
Mayor McCoy advised Council of a letter received from two gentlemen who
have opened an Ice Cream Parlor at Chimney Hill Shopping Center. The
gentlemen were advised by an Inspector from the Department of Permits
and Inspections they had to construct two bathrooms in the store.
The gentlemen complied with the request and discovered later that the
BOCA Code does not require placing two bathrooms in a store. The
gentlemen are requesting they be reimbursed $3,000 (the cost of the
bathrooms). Council can take no action in this matter.
BASKETBALL GAME ITEM #17809
Mayor McCoy advised Council that the basketball game between the Council
and Staff will be on March 12, 1982 and practice will be held on
March 8, 1982, at 8:00 a.m., Recreation Center.
PUBLIC SAFETY ITEM #17810
Mayor McCoy advised Council that Robert Engesser has been placed on the
Council Agenda of March 1, 1982.
CONTRIBUTIONS ITEM #17811
Mayor McCoy requested information as to $5,000 being donated to a charity.
Councilman Holland advised that in the "Bid-Rigging" settlement a $5,000
check was forwarded to the City of Virginia Beach to be given to a charity
of the City's choosing.
The consensus of Council was to accept the City Manager's recommendation
and distribute the contribution evenly among the City's fire companies,
(approximately $333.33).
GOLF PACKAGE ITEM #17812
Mayor McCoy advised Council of a letter received from A. James DeBellis,
Director of Economic Development concerning the 1981 Golf Package,
and advised the Mayor's Golf Package Committee placed ads in Golf World
and Golf Digest. Mr. DeBellis recommended the program be continued and
a Committee be named for 1982 so work begun in 1981 can continue this
spring in anticipation of golf packages this fall.

COAST GUARD ITEM #17813
Mayor McCoy advised Council that the Coast Guard was initiating a
Comprehensive Marine Firef ighting Contingency Plan for the Port of
Hampton Roads and requested the Mayor to appoint someone to par-
ticipate in the formulation of this Plan.
Mayor McCoy advised he appointed Chief Harry Diezel to participate in
the planning effort
TIDEWATER COMMUNITY COLLEGE
Mayor McCoy advised Council of the Tidewater Community College Annual
Luncheon on Monday, April 9, 1982, at 10:30 a.m.

RESTAURANT ASSOCIATION ITEM #17814
Councilman Kitchin advised that on the Council Agenda of today (22 February
1982), under UNFINISHED BUSINESS the Virginia Beach Restaurant Association
Councilman Kitchin spoke with Mr. Robert Herman of the Restaurant
Association who advised that the citizens are not sure whether they
are to pay the meal tax or not because of the ruling by Judge
Bernard Barrow.
Councilwoman McClanan advised it was her understanding that all tax
bills relating to food, etc., were consolidated and placed in a Study
Committee of the General Assembly.
The Virginia Beach Restaurant Association was scheduled t pear
but had cancelled.

REAL ESTATE ASSESSMENTS ITEM #17815
The City Manager advised Council that Clyde Merritt, Real Estate Assessor,
forwarded to him a copy of Estimated Revenues for tax year 1982-83 which
shows an increase of approximately 9. 9% in real estate assessments .
It was noted that over 88,000 Real Estate assessment notices for the
tax year 1982-83 will be mailed Friday, February 26, 1982 and have an
average increase of 9.864 percent. Hearings will be held in the Office
of Real Estate Assessor from March 15 through April 30, 1982.

TRIHALOMETHANES (THMS) ITEM #17816
Tom Laehy, Public Utilities Department, presented to Council a report
on Trihalomethanes (THMS) in Virginia Beach's drinking water, and
advised that THMs are the product of a chemical reaction between the
chlorine used for disinfection and naturally occurring material present
in almost all surfact water.
THMs are a unique contaminant in that they form at the water treatment
plant and in the distribution system. Because Virginia Beach has higher
storage capacity, higher flow capacity distribution mains and many more
miles of area to serve than Norfolk, the water spends more time in the
distribution system. The result of this is higher THM levels in Virginia
Beach than in Norfolk.
Dr. Crawford, State Health Department, spoke on this matter.
B-5 RESORT-COMMERCIAL DISTRICT ITEM #17817
The City Manager advised Council of Ordinances on the FORMAL AGENDA to
amend and reordain Article 9 of the Comprehensive Zoning Ordinance to
establish a B-5 Resort-Commercial District, and to rezone to B-5 most
property now zoned B-4 generally between Rudee Inlet and 40th Street
and between Atlantic Avenue and Pacific Avenue.
It has been recognized that older commercial establishments within
this area have had difficulty in providing sufficient parking space
as required by existing regulations. The Original Zoning Ordinance
of the City prior to merger exempted all parking in this area for
certain businesses such as restaurants and small retail establish-
ments. In order to lessen this problem and to provide parking in a
more appropriate maniier, the Ordinances have been proposed.
Included within the Ordinances will be the elimination of setback
requirements through the district and, as presented to the Planning
Commission, elimination of parking requirements for all retail
commercial uses, eating and drinking establishments, commercial
recreational facilities other than those of an outdoor nature, museums
and art galleries and personal service establishments located and proposed
witbin this newly-created district. All other requirements in the B-2
District would be the same as those in the B-4 District.
The Planning Commission recommended Council approve the proposed
Ordinances subject to the following:
1. Eating and drinking establishments shall be
governed by the same parking requirements as
in the B-4 District.
2. Uses in the B-5 District may be allowed off-site
parking facilities
The City Manager requested these Ordinances be deferred one week to permit
a joint committee of representatives of the Chamber of Commerce, Restaurant
Association and Tourist Bureau to meet with the Planriing Director to
discuss the implications of the parking recommendations.
The Planning Director spoke on this matter.

Virginia will be represented in Virginia Beach for the
AAA Wrestling and Gymnastic Tournament; and,
WHEREAS, 300 boys and girls from these schools will
compete for the State championships in Wrestling and
Gymnastics; and,
WHEREAS, Gymnastics will be held at Brandon Junior High
School, February 27 and 28, and Wrestling will be held
at Green Run High School, February 27 and 28; and,
WHEREAS, this is the first time the State wrestling and
Gymnastics have both been held at the same time in our
City;

Council voted to uphold the recommendation of the City Manager and ADOPT
the Ordinance appointing viewers in the application of Jerry F. McDonnell
for the petition for the closure of portions of 28th and 29th Streets
and portions of 20-foot rights-of-way, in the Virginia Beach Borough.

Robert Herman, Virginia Beach Restaurant Association, discussed the
matter of Virginia Beach Meal Tax with Councilman Kitchin and cancelled
his presentation with City Council.

Walter J. Monahan spoke before Council concerning a disagreement between
himself and the Department of Public Works regarding certain property in
the Pe can Gardens subdivision at the end of Arthur Avenue on the West
side of Rosemont Road.
The proper ty was developed in the 1960 's and ear ly 1970 's and during
that time the streets, drainage, utilities, etc., were put in. The
problem arises on the 414.34 foot property line, (which "sits in a
ditch). The Department of Public Works has advised approval with the
condition of escrowing one-half the cost of piping the ditch, approximately
$25,000 to $28,000.
The City Manager requested he be permitted to review this matter
and bring his recommendations back to Council upon completion of his
review.

Councilman Holland requested citizens in the Bayside Borough be permitted
to speak before Council on March 22, 1982 concerning fences, fence
height and location.
It was the consensus of Council to permit the citizens to speak before
Council on March 22, 1982, at 7:00 p.m. concerning fences, fence heights
and location.
