The Regular Meeting of the Council of the City of Virginia Beach,
Virginia was called to order by Mayor J. Henry McCoy, Jr., D.D.S.,
in the Conference Room, City Hall Building, on Monday 17 May 1982
at Twelve-Thirty in the afternoon.

Mayor McCoy entertained a motion to permit Council to conduct its
INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the
purpose of discussing the following:
1. PERSONNEL MATTERS: Discussion or consideration of
employment, assignment, appointment, promotion, performance,
demotion, salaries, disciplining or resignation of public
officers, appointees or employees.
2. PUBLICLY HELD PROPERTY: Discussion or consideration
of the condition, acquisition or use of real property for
public purpose, or of the disposition of publicly held
property, or of plans for the future of an institution
which could affect the value of property owned or desirable
for ownership by such instituion.
3. LEGAL MATTERS: Consultation with legal Counsel or
briefings by staff members, consultants or attorneys,
pertaining to actual or potential litigation, or other
legal matters within the jurisdiction of the public
body.

SISTER CITY ITEM #18205
Mayor McCoy advised Council he received a telephone call from
Dr. Lee L. Garling, a resident of Grasse, France, requesting
the City of Virginia Beach and Grasse, France,, become "Sister
Cities".
Mayor McCoy advised research has been undertaken in France and
a City is permitted to have more than one "Sister City", and
requested Council to "think about this as it may be worthwhile".

OCEAN ISLAND, INC. ITEM #18206
Councilwoman Henley advised that the residents of Sandbridge are
concerned with the application of Ocean Island, Inc., requesting
the State Water Control Board grant them a permit to construct a
200-unit hotel at Little Island and to discharge an average of
30 thousand gallons per day of treated waste water from the sewage
disposal facility in Back Bay.
Councilwoman Henley requested Council "take a position on this"
to determine what the City's policy should be.
The Planning Director is to study this matter for a report to
City Council.
COMMITTEE ON "BEACH SWAP" ITEM #18207
Councilman Ervin advised that last Monday, (10 May 1982) Council
appointed Councilwoman McClanan to serve on the Governor's TASK
FORCE COMMITTEE to study an exchange of property at False Cape
State Park. Councilwoman McClanan is to serve with Dr. Deaner.
Councilman Ervin requested Councilwoman McClanan be supplied copies
of all Resolutions pertaining to False Cape.

TELEPHONE RATE INCREASE ITEM #18208
The City Manager advised Council he received a visit from Dennis H.
O'Hearn, Customer Service Manager for Continental Telephone, concerning
a proposed rate increase by Continental Telephone.
The City Manager presented to Council a packet from Mr. O'Hearn
explaining the proposed rate increase.
APPOMATTOX RIVER WATER AUTHORITY ITEM #18209
The City Manager introduced Robert Green, Vice President of Wiley
and Wilson, who presented a study on the Appomattox River Water
Authority.
Mr. Green advised the work on this Project began in December of 1981,
when the five phases were approached:
1. Water demand.
2. Facilities: Reservoirs, Treatment Plants and
Transmission Lines.
3. Cost Data and Schedules
4. Implementation and Future Water Rates.
5. Recommendations.
In April of 1982 the draft report was presented to and accepted by
the Appomattox River Water Authority.

Aubrey V. Watts, Director of Public Works, spoke on this matter
and advised there is a substantial difference in the initial
cost per thousand gallons for water when the plants first go on
line and are not working at their designed capacity.
This matter will be brought back to Council for FORMAL VOTE during
a future Council meeting.

Boulevard and Rosemont Road" this Public Hearing is CANCELLED and
will be readvertised with the correct address for a future date
approved by Resolution subject to Council's adoption.

legislation designated as the Housing and Comniunity Development
Act of 1974 setting forth as a National goal the developnient of
viable urban communities; and
WHEREAS, the United States Congess has enacted legis-
lation designated as the Housing and Community Development
Amendinents of 1980, providit@g for continuinq efforts in the
development of viable urban communities; and
WHEREAS, there is federal assistance available for the
support of Community Development and flousing activities directed
toward specific objectives such as the eliminatioii of deteriorateci
conditions in low and moderate income neighborhoods; the elimination
of conditions which are detrimental to health, safety and welfare,
the conservation and expansion of the Nation's housing stock; th--
expansion and improvement of the quantity and quality o-@ conriunity
services; and other related activities; and
WHEREAS, the City of Virginia Beach has developed a
multiyear Community Development Prog--am and has structured the
necessary mechanisms for implementation in compliance with federal
and local directives; and
WHEREAS, the City of Virginia Beach is in the process
of implementing this program and desires to initiate an application
for Eighth Year funding (1982-83) in the amount of $2,441,676.60

WHEREAS, Crow, Terwilliger and Michaux, Inc. a
development corporation located at 218 North Lee Street,
Alexandria, Virginia has indicated its willingness to construct
and provide a 250 unit apartment complex to be located at
Independence Boulevard and South Plaza trail, only 12.5 acres of
21.5 acres, in the City of Virginia Beach of which 20% will be
utilized for rental to persons of low to moderate income; and
WHEREAS, pursuant to the Virginia Housing Authorities
Law, Chapter 1, Title 36, Code of Virqinia of 1950, as amended
(the "Act"), redevelopment and housing authorities may issue tax
exempt obligations to provide the financing for low and moderate
income housing projects sucil as the Project; and
WHEREAS, althouqh there is no redevelopment and housinq
authority created in the City of Virginia Beach, pursuant to
Section 36-23 of the Act, a redevelopment and housing authority
created in another jurisdiction is authorized to provide the
financing for the Project provided that the City Council first
adopt, after a public hearin(j, a resolution finding that (a)
there is a need for such an authority to exercise its powers in
the City, (b) there is a shortage of safe or sanitary dwellinq
accommodations in the City available to persons of low income at
rentals they can afford, and (c) these conditions can best be
remedied through the exercise of stich authority's power within
the City; and
WTiEREAS, it appears '@hall there should be a public
hearing to determi.ne whetlier or not such conditions do exist in
the City and that the Project will alleviate a shortage of

Mrs. Vivian Hitchcock spoke in opposition to the proposed Ordinance.
Dr. Buchanan presented a statement to Council concerning the
proposed Ordinance, (a copy of which will be made a part of these
proceedings).
Councilman Baum presented a statment to Council concerning the
proposed Ordinance, (a copy of which will be made a part of
these proceedings).
Discussions were held by Council Members and by consensus requested
the proposed Ordinance be changed to a MEMORANDUM OF UNDERSTANDING.
Vice Mayor Heischober suggested Council appoint a Committee to include
two (2) Council Members, City Attorney, City Manager and two (2)
members of the press (print and electronic) to draft a Memorandum of
Understanding*.
No action was taken on this item.

Les Burke, (4821 Grove Court, Timberlake Subdivision) requested
permission to construct a garage in a PUD setback. His first
appeal to Council was redirected to the Board of Zoning Appeals
where his application was denied. Council advised Mr. Burke they
have no priority over the BZA and his only resolve now would be
an appeal in the Virginia Beach Circuit Court.
