The Regular Meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by Mayor J. Henry McCoy, Jr., D.D.S.,
in the Conference Room, City Hall Building, on Monday, 3 May 1982,
at Twelve-Thirty in the afternoon.
Council Members Present:

Mayor McCoy entertained a motion to permit Council to conduct its
INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the
purpose of discussing the following:
1. PERSONNEL MATTERS: Discussion or consideration of
employment, assignment, appointment, promotion, per-
formance, demotion, salaries, disciplining or resignation
of public officers, appointees or employees.
2. PUBLICLY HELD PROPERTY: Discussion or consideration
of he cndi i.@n, acquisition or use of real property for
public purpose, or of the disposition of publicly held
property, or of plans for the future of an institution
which could affect the value of property owned or
desirable for ownership by such institution.
3. LEGAL MATTERS: Consultation with legal Counsel or
briefings by staff members, consultants or attorneys,
pertaining to actual or potential litigation, or other
legal matters within the jurisdiction of the public body.

City Council voted to RECESS into EXECUTIVE SESSION following the
INFORMAL SESSION.

ARCHER GREEN ENCROACHMENT ITEM #18130
Councilman Ervin asked the City Attorney if his staff was going to
appeal the Archer Green matter.
The City Attorney advised Council his staff would appeal the matter
and the Director of Public Works was preparing standards concerning
matters of this nature.

VIRGINIA MUSEUM OF MARINE SCIENCES ITEM #18131
The City Manager advised that on the FORMAL AGENDA of today's meeting,
(3 May 1982) is an Ordinance to transfer revenue sharing funds of
$100,000 to the Virginia Museum of Marine Science.
The City Manager advised that in addition to the Resolution for
formal adoption is a letter from Mac Rawls, Director of the Museum,
advising Council of his observations and a "plan of action which
puts Councilmen Holland and Buchanan's recommendation in context
as to events which will or should occur during the next yeal!'-

CRIME SOLVERS, INCORPORATED ITEM #18132
The City Manager advised Council of Crime Solvers, Inc., created
by the Police Department and private corporations, to increase
public involvement in the fight against crime.
Alfred Craft, Chairman of the Board of Directors, advised there
are eight (8) board members which can be increased to twenty-one
per the By-Laws.
No city funds will be expended and all funds received will be
used solely for rewards.
Chief Charles Wall spoke on this matter, with Captain Hathaway
in attendance.

RESOLUTION
WHEREAS, the City of Virginia Beach has long been home base
for four of America's important military installations: Oceana
Naval Air Station, Little Creek Amphibious Base, Fleet Combat
Training Center Dam Neck and Fort Story;
WHEREAS, approximately twenty percent of Virginia Beach's
residents are in the military and another sixteen percent are
military retirees who have established permanent residence in
Virginia Beach;
WHEREAS, these four installations provide employment, both
military and civilian, for over 30,000 persons, with an approxi-
mate annual payroll of $450 Million;
WHEREAS, the City of Virginia Beach recognizes the impor-
tance of the military in our city, not only for an economic
aspect, but also because of the military's contributions to our
social, cultural and civic growth and development; and,
WHEREAS, the City of Virginia Beach would like to set aside
this special time to recognize the members of our military com-
munity and their leaders.
NOW, THEREFORE, BE IT RESOLVED: That the Council of the
City of Virginia Beach, Virginia, joins with the Virginia Beach
Chamber of Commerce in declaring the month of May 1982, as:
MILITARY APPRECIATION MONTH
BE IT FURTHER RESOLVED that this City Council declares
Saturday, May 15, 1982
ARMED FORCES DAY AT FORT STORY
in Virginia Beach and urges all businesses and individuals to pay
special recognition to our military community during that time.

and ADOPT the Resolution supporting Crime Solvers, Inc., a community
initiative to help the fight against crime.

WHEREAS, Crime Solvers, Inc., is a program to increase public
involvement in the fight against crime; and
WHEREAS, Crime Solvers, Inc., is a nonprofit, community
organization composed of a broad spectrum of community-minded people; and
WHEREAS, the Board of Directors of Crime Solvers, Inc., will
raise the funds necessary to support this program through tax deductible
donations from the public; and
WHEREAS, Crime Solvers, Inc., will offer cash rewards of up to
$1,000 to citizens who provide information to the Police Department if
the information results in the arrest and indictment of an offender or
the apprehension of a wanted person;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA, that we support this community initiative to
help the fight against crime; and
BE IT FURTHER RESOLVED that the City Council encourages the
citizens of the City of Virginia Beach to provide information to Crime
Solvers, Inc., and to support this program with their contributions.

and ADOPT the Resolution authorizing Mrs. Katherine Green to enlarge
a nonconforming structure located on Bradford Road, in the Bayside
Borough.

WHEREAS, Katherine Green desires to add a one-story
addition to the single-family dwellinq located at 1557 Bradford
Road, as shown on the attached physical survey; and
WHEREAS, the structure does not conform to the
provisions of the Comprehensive Zoninq ordinance because single-
family dwellinqs are not allowed in the B-2, Communitv Business
District; and
WHEREAS, pursuant to SS105(c) (4) of the Comprehensive
Zoninq Ordinance, City Council may authorize the enlargement of a
nonconforminq structure if Council finds that the structure as
enlarged is equally or more appropriate to the zoninq district
than the existinq nonconforminq structure.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THP
CITY OF VIRGINIA BEACH, VIRGINIA:
That City Council hereby finds that the enlarqement of
the nonconforming single-family dwelling located at 1557 Bradford
Road, as shown on the attached physical survey, is as equally or
more appropriate to the zoning district in which it is located as
the existinq nonconforming structure; and the Citv Council hereby
authorizes the enlargement of said structure in the manner shown
on the attached physical survey.

WHEREAS, Crow, Terwilliqer and Michaux, Inc. a
develop@ent corporation located at 218 North Lee Street,
Alexandria, Virqinia has indicated its willinqness to construct
and provide a 250 unit apartment complex to be located at
Independence Botilevard and Rosemont Road in the Timberlake
subdivision in the city of Virginia Beach of which 20% will be
utilized for rental to persons of low to moderate income; and
WHEREAS, pursuant to the Virqinia Housing Authorities
Law, Chapter 1, Title 36, Code of Virqinia of 1950, as amended
(the "Act"), redevelopment and housing authorities may issue tax
exempt obliqations to 'Drovide the financina for low and moderate
income housing projects such as the Project, and
WHEREAS, althouqh there is no redevelopment and housinq
authority created in the City of Virqinia Beach, pursuant to
Section 36-23 of the Act, a redevelopment and housina authority
created in another jurisdiction is authorized to provide the
financing for the Project provided that the City Council first
adopt, after a public hearing, a resolution finding that (a)
there is a need for such an authority to exercise its powers in
the City, (b) there is a shortaqe of safe or sanitary dwellina
accommodations in the Citv available to persons of low income at
rentals they can afford, and (c) these conditions can best be
remedied throuqh the exercise of such authority's power within
the City; and
WHEREAS, it appears that there should be a public
hearing to determine whether or not such conditions do exist in
the City and that the Project will alleviate a shortaqe of
housing in the city for persons of low to moderate income; and

WHEREAS, the Fairfax County Redevelopment and Housinq
Authority (the "Authority") will soon issue tax exempt
obliqations in order to finance a low to moderate income housinq
project in Fairfax County and there are indications that the
Authority may be willinq to issue additional obliqations in
connection with that financinq in amounts sufficient to finance
the Project referenced above in Virginia Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VIRGINIA REACH, VIRGINIA:
1. The Clerk of the Cit,V Council is hereby authorized
and directed to cause a public notice of a public hearing as
required by Section 36-23 of the Code of Virqinia to be held in
the City Council Chambers, Virginia Beach, Virginia on the 17th
day of May, 1982, at 2:00 p.m. and such public notice of such
hearing to he published in a newspaper of general circulation
published in the City of Virginia Beach, at least ten (10) days
prior to the date of such meeting.

CITY OF VIRGINIA BEACH IS HEREBY AMENDED AND REORDAINED AS
FOLLOWS:
Section 5-31. Established; purpose.
The following described areas in the city are hereby
declared to be bird sanctuaries for the protection of all birds:
(1) North Thalia in Kempsville Borouqh:
Beginning at a point in the center of
Thalia Creek on the north side of U.S.
Route 58 (Virqinia Reach Boulevard);

AN ORDINANCE TO AMEND AND REORDAIN
ARTICLE 2, SECTION 221(9) OF THE
COMPREHENSIVE ZONING ORDINANCE
PERTAINING TO CONDITIONAL USES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
That Article 2, Section 221(q) of the Comprehensive
Zoninq Ordinance is amended and reordained as follows:
(g) Unless otherwise provided when a conditional use
permit is issued, the applicant must show and bear
evidence in good faith of his intention to proceed
with the construction and use of the land.
Construction shall begin or the use of the land
for which a conditional use permit has been
obtained shall commence within twelve (12) months
from the date of issuance of said permit;
otherwise, said permit shall be void. Prior to
the endinq of the twelve (12) month period, upon
written request by the applicant to the Planninq
Director, the conditional use permit shall be
extended for an additional six (6) months. All
conditional use permits not acted upon as set
forth above shall become void eighteen (18) months
from date of issuance. Once the conditional use
permit is activated by commencement of construction
or use, then the qeneral and specific conditions
attached to the conditional use permit shall
constitute additional zoninq regulations and
requirements for the site which to the extent of
any conflict shall supercede the zoninq district
requlation. Notwithstandinq anything in the zoninq
district requlations to the contrary, no use other
than those set forth in the conditional use permit

and those uses accessory thereto shall be allowed
on the site until (1) the conditional use is
removed in its entirety from the site or (2) City
Council adopts an ordinance allowinq modifications
to the conditions or terminating the conditional
use permit in whole or in part. Whenever
construction or use in conjunction with a
conditional use permit is abandoned or is not
carried to completion with due diligence, the City
Council may by ordinance revoke the conditional
use permit, in which case any further use or
construction on the site shall be in conformance
with the provisions of this Ordinance effective at
the time the further use or construction is
initiated. Construction or use shall be deemed to
have been initiated when any part of the
structure, including foundation, has been put in
place.
Adopted by the Council of the City of Virqinia Beach,
Virginia, on the 3rd day of May 1982.

AN ORDINANCE TO TRANSFER REVENUE
SHARING FUNDS OF $100,000 TO THE
VIRGINIA MUSEUM OF MARINE SCIENCE
WHEREAS, City Council desires to continue tbe effort to
construct the Virginia Museum of Marine Science in Virginia Beach;
and,
WHEREAS, the following activities are needed to stabilize
and improve the Museum site;
(1) Establish erosion control measures to stabilize
shoreline
(2) Provide fill material and install drains in low
lying areas
(3) Cut, grade and seed site
(4) Erect signs
WHEREAS, the cost of these activities is estimated to be
$100,000; and,
WHEREAS, funding for this project is available by transferring
from existing revenue sharing allocations; and,
WHEREAS, the use of these funds for this project will not
adversely affect the schedule of existing revenue sharing projects;
and,
WHEREAS, the funds used from existing revenue sharing projects
will be replaced by the FY 83 Revenue Sbaring Entitlement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF VIRGINIA BEACH, VIRGINIA that funds of $100,000 be transferred
from existing revenue sharing projects to the Virginia Museum of
Marine Sciences for the above stated purposes.
This Ordinance shall be in effect from date of adoption.
Adopted by the Council of the City of Virginia Beach,
Virginia, on the Third day of May, 1982.

Councilman Baum advised that he and Councilwoman Oberndorf were
appointed to the AIRPORT ENVIRONMENTAL AD HOC COMMITTEE and
requested he be removed as he has been unable to attend the
meetings.
It was the consensus of Council to appoint a replacement for
Councilman Baum after July 1, 1982.
Councilwoman Oberndorf advised she had attended two (2) meetings of
the CoMmittee at which problems of other area cities were discussed
and she requested the third meeting give attention to the problems
of Virginia Beach. Councilwoman Oberndorf thanked Jack Whitney,
Timothy Barrow and an employee of the Department of Community Development
for their presentation to Kenneth Scott and other members of the
Committee.
As a result of tbe presentation, the Committee has agreed to work with
the City of Virginia Beach on the Burton Station Plan.
