The Regular Meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by Mayor J. Henry McCoy, Jr., D.D.S.,
in the Conference Room, City Hall Building, on Monday, 4 January
1982, at Twelve-Thirty in the afternoon.

Mayor McCoy entertained a motion to permit Council to conduct its
INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the
purpose of discussing the following:
1. PERSONNEL MATTERS: Discussion or consideration of employment,
assignment, appointment, promotion, performance, demotion,
salaries, disciplining or resignation of public officers,
appointees or employees.
2. PUBLICLY HELD PROPERTY: Discussion or consideration of the
condition, acquisition or use of real property for public
purpose, or of the disposition of publicly held property,
or of plans for the future of an institution which could
affect the value of property owned or desirable for owner-
ship by such institution.
3. LEGAL MATTERS: Consultation with legal Counsel or briefings
by staff members, consultants or attorneys, pertaining to
actual or potential litigation, or other legal matters
within the jurisdiction of the public body.

SOUTHEASTERN VIRGINIA REGIONAL ITEM #17581
JAIL FACILITY
Mayor McCoy advised Council of the Southeastern Virginia Regional
Jail Facility Committee, attended by Councilwoman Oberndorf and
Vice Mayor Heischober. This Committee is a Mayor's Committee,
Chaired by Judge Hodges who requested each Mayor appoint a permanent
member to the Committee.
With Council's concurrence, Mayor McCoy appointed Vice Mayor Heischober
to the SOUTHEASTERN VIRGINIA REGIONAL JAIL FACILITY.
HANDICAPPED PARKING ITEM #17582
Mayor McCoy advised he received a telephone call from Dr. Wright,
Board of Directors of Avalon Hills Board of Deacons, advising
Mayor McCoy they have eliminated their problems with handicapped
parking for voting purposes.
PRINCESS ANNE ROAD PROJECT ITEM #17583
Mayor McCoy advised Council of a letter from Harold C. King, Commissioner
of the Department of Highways and Transportation, concerning the Princess
Anne Road Project. Mr. King advised Council the Project will be delayed
until the end of 1982.
The proposed project is from Edwin Drive to Carper Apartments.
The City Manager is to study this matter and report his findings
back to Council on@ 11 January 1982.

Councilman Ervin requested a copy of the December 30, 1981 issue of
the VIRGINIA BEACH SUN NEWS be made a part of these proceedings.

PROVIDING FOR FAMILIES ITEM #17585
Councilman Ervin requested information from the City Manager with
regard to providing for families of slain police officers.
The City Manager advised that all employees are insured. All
employees' families receive four (4) times their salary if death
is accidential, social security, and five hundred (500) weeks of
Workman's Compensation.
Councilwoman Oberndorf requested City Council adopt a Resolution of
Appreciation commending Governor Carey of New York and the New York
Police Department for their outstanding hospitality due to the death
of Police Officer Maloney.
IMPACT FUNDS ITEM #17586
Councilwoman Henley made reference to a letter received from Robert
W. Daniel, Jr., Congressman, concerning impact aid to our school
d i s t r i c t s .
Councilwoman Henley requested Council meet with the School Board
to determine the best possible use of these funds.
The City budgeted $7-Million, and the Federal Government advised we
would be receiving $5.2-Million.
A Joint Meeting between the City Council and the School Board will
be held on Monday, 11 January 1982.
VOTING PRECINCTS ITEM #17587
Councilman Holland asked if a Resolution should be drafted concerning
the changes in Voting Precincts.
The City Manager advised he discussed this matter with Mrs. Cleta
Liverman, General Registrar, who requested Council wait until the
redistricting is completed.

TRAFFIC ENGINEERING PERSONNEL ITEM #17588
The City Manager advised he has received a request for additional
personnel in the Traffic Engineering Division of Public Works due
to the signalization throughout the City of Virginia Beach.
With Council's concurrence, the City Manager will employ three (3)
personnel positions for the Traffic Engineering Division of the
Department of Public Works, with the stipulation he "freeze" three
(3) other positions to offset these and to avoid increasing total
personnel.
The request for personnel positions in the General Services Department
was withdrawn by the City Manager.

AN ORDINANCE TO APPROPRIATE FUNDS
OF $208,909 TO THE DEPARTMENT OF
PUBLIC WORKS FOR ATLANTIC AVENUE
IMPROVEMENTS
WHEREAS, the removal of parking from Atlantic Avenue
has created the need to profile and pave the road surface including
the installation of new signs and additional traffic signals on 19th
Street; and,
WHEREAS, the cost of the new signs will be funded from
the operating budget and the pavement markings will be funded from
a Highway Safety Grant; and,
WHEREAS, funds of $208,909 are needed for the remainder
of the work which is pavement from 5th Street to 31st Street and
traffic signals at 19th Street.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF VIRGINIA BEACH that funds of $208,909 be appropriated from
the General Fund Balance to the Department of Public Works for Atlantic
Avenue Improvements.
This Ordinance shall be effective from date of adoption.
Adopted by the Council of the City of Virginia Beach,
Virginia, on the Fourth day of -January, 1982.

AN ORDINANCE APPROPRIATING FIFTY THOUSAND
DOLLARS ($50,000) FOR THE PURPOSE OF
UNDERTAKING AN ENGINEERING STUDY OF THE
POTENTIAL IMPACT OF VIRGINIA BEACH
MEMBERSHIP IN THE APPOMATTOX RIVER
WATER AUTHORITY
WHEREAS, the City of Virginia Beach has expressed a
desire to seek membership in the Appomattox River Water Authority;
a n d ,
WHEREAS, the Appomattox River Water Authority has
approved the undertaking of an Engineering Study to examine various
aspects of the potential impact upon the Authority's system should
Virginia Beach be granted membership; and,
WHEREAS, the City of Virginia Beach is willing to bear
the cost of such study; and,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF VIRGINIA BEACH:
That the amount of Fifty Thousand Dollars ($50,000) is
hereby appropriated for such purpose. That the City Manager is
hereby authorized to execute a contract upon approval as to form by
the City Attorney for such Engineering Study at a cost not to exceed

AN ORDINANCE TO AUTHORIZE THE ACQUISITION
OF PROPERTY IN FEE SIMPLE FOR AVALON
TERRACE SANITARY SEWER PROJECT AND THE
ACQUISITION OF TEMPORARY AND PERMANENT
EASEMENTS OF RIGHT-OF-WAY, EITHER BY
AGREEMENT OR BY CONDEMNATION
WHEREAS, in the opinion of the Council of the City of
Virginia Beach, Virginia, a public necessity exists for the construction
of this important project for the purpose of preserving the safety,
health, peace, good order, convenience, and general welfare of the
people in the City of Virginia Beach.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF VIRGINIA BEACH, VIRGINIA:
Section 1. That the City Attorney is hereby authorized
and directed to acquire by purchase or condemnation pursuant to
Section 15.1-236, et seq., and Section 33.1-89, et seq., Code of
Virginia of 1950, as amended, all that certain real property in
fee simple including temporary and permanent easements of right-of-way
as shown on the plans entitled, "Construction Plans of Avalon Terrace
Sanitary Sewer Project for City of Virginia Beach, these plans being
on file in the office of Real Estate, Department of Public Works,
Virginia Beach, Virginia.
Section 2. That the City Attorney is hereby authorized
to make or cause to be made in behalf of the City of Virginia Beach,
to the extent that funds are available, a reasonable offer to the
owners or persons having an interest in said lands, if refused, the
City Attorney is hereby authorized to institute proceedings to condemn
said property.
Section 3. That an emergency is declared to exist and
this Ordinance shall be in force and effect from the date of its
adoption.

AN ORDINANCE TO AMEND AND
REORDAIN SECTION 21-396(a)
PERTAINING TO THE DEPOSIT
OF COINS IN PARKING METERS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
That Section 21-396(a) is hereby amended and reordained
as follows:
(a) When any vehicle shall be parked in any parking
meter space designated as provided in this Division, the operator
of such vehicle shall, upon entering such space, immediately deposit,
or cause to be deposited, one or more coins of the United States of
America in the parking meter adjacent thereto, and such space may then

a sign or signal showing illegal parking, in which event, the vehicle

and beyond the period of legal parking time.
This Ordinance shall be effective on and after the date
of its adoption.
